Court Rules Against OWS Zuccotti Park Protesters

The latest news in the ongoing saga of Zuccotti Park: a judge has ruled against the demonstrators, and will not allow them to set up camp in the park again. So here’s another thread to argue about it some more…

Correction—they can return to the park (it would be an awfully strange decision that said they couldn’t), but the ban on tents, sleeping bags and generators has been deemed enforceable.

They can stay overnight too — the park remains open 24 hours — but they can’t have tents or sleeping bags, and the injunction on winter failed as well, so it doesn’t look so good for the permanent occupation.

OWS needs to focus its efforts in establishing networks and lobbying the halls of congress. Build a voter base. Protesting only goes so far.

It’s not really possible to stay out in the middle of winter without a fire or other source of heat, unless you have amazingly good— and costly— gear. Or an igloo. And as much as I’m a big ol’ first amendment supporter, running generators to create warmth is massively wasteful and open fires are obviously wrong. So I don’t see how they could have possibly lasted out the winter anyway.

This does give them a chance to sort of gracefully back out. They could either suspend physical activity over the winter, or they could pool that donation money they’re getting and rent out some flophouse type place for the hardcore protesters to stay in. That has its own raft of problems, though.

My small hometown now has a rather large group of occupiers camping out on the courthouse lawn. They are doing a very good job of keeping the occupation clean. I even saw one of them raking the leaves. I wonder whether the Zuccotti Park Protesters would have been asked to leave if they had kept their camp as clean.

Parts of the Occupy Ottawa protests offered to shift their camp AND volunteer at the annual winter festival.

It was too jam-packed with people to really be kept ‘clean’, but it really wasn’t that bad. Not compared to most New York streets, anyway. They managed to clean it up once; they could have probably done so again if Bloomberg had directly negotiated with them about it.

I do not think Bloomberg’s move was actually about health and safety at all. I think he felt pressured to ‘do something’, regardless of how ineffective or counterproductive it actually was. And with him recently going on record with the baffling lie that the banks were not responsible for the mortgage crisis, I’m unwilling to lend him any credibility he doesn’t earn on the topic.

This is exactly right. The movement needs to move away from the occupation of public spaces, eventually this would only lead to marginalizing middle class and blue collar support.

Where it moves to without leadership is the question. While the movement can pat themselves on the back for utilizing a consensus decision process, eventually, as history has shown time and again, the process becomes cumbersome and subject to diversion and subversion.

Time for leadership.

I have an Aunt who has a strict process about dinner, movies, patriotic music, etc that involves everyone at the table “What was your favorite part of the day/movie/etc?” It drove me nuts sitting through this process.

Time for leadership.

There has been “leadership”, organization-wise. Just no leadership regarding formulating political goals, demands, etc. The latter obviously is connected with the former, but… especially the direct-democracy fans will hate political leaders. Representative democracy will almost inevitably lead to some people’s goals and demands not being included.

Leadership could actually fracture the movement. Infighting over positions… wouldn’t be the first time to witness that.

Really? I see comments like this:

This is based on a long line of United States Supreme Court cases, beginning with Cox v. New Hampshire in 1941. “Reasonable time, place, and manner restrictions” is a long-standing concept in First Amendment law, repeatedly upheld in the Courts.

Since OWS filed the petition asking for a TRO, it was their burden to demonstrate that the owner’s rules were NOT reasonable time, place, and manner restrictions. They didn’t do that.

Which is currently rated at +8.

I see other people protesting that the original judge was taken off the the case, and other people getting upset, but not anything like a meltdown.

And other people saying much what I did, that this might be the best thing that could have happened.

Where are you seeing all the meltdown and police state talk?

Personally, I would trust stories coming from DKos far, far before I would sites like HotAir, FoxNews or RedState. Even though they are left-of-center, and sometimes take what I consider ill-advised positions in their opinions, almost always there is sourcing and hard data to back up those positions - and more times than not welcome legitimate criticism. The same cannot be said for the so-called “mainstream” sites on the right.

I went through a period where I started to take them at least semi-seriously but OWS has pretty much wiped out credibility for lefty sites for me. I’ve recently stopped taking stories from Think Progress and TPM too seriously. There’s some decent stuff but the lefty defense of some really indefensible OWS stuff has taken the wind out of my sails. I had kind of hoped the left was becoming more rational as the Tea Party went nuts. I was wrong.

Upper Haight has radically transitioned. It used to be a pretty dangerous place when I was growing up, then it had a brief period where it was actually counterculture cool, now it’s all packaged and merchandised with just a few crusty holdouts.

Ameboa records is still there, so it’s still worth going to. And All You Knead, a good place for breakfast.

Lower Haight remains pretty cool, with some excellent bars, a great sausage place, etc.

LGF certainly went far further left than I’d noticed. Like I said, it did dampen my enthusiasm for condemning right wing radicalism when left wing radicalism is off limits. Highlighting a stupid right wing blog post is a lot of fun for all, highlighting a stupid left wing post is derided as obsessive cherry picking. Investigating Tea Party organizers is important stuff, OWS organizers must not be discussed. Videos of Tea Party speeches advocating violence is a big deal, videos of OWS violence are forbidden.
The double standard is too much and too obvious. I don’t think it’s intellectually honest.

Disagree strongly. On the whole, the OWS movement, outside of a few bad apples (which was more due to the long-term encampment attracting unsavories than the movement itself), has been extremely well-behaved. Unlike the TeaPartiers, there wasn’t recruitment efforts by groups like the Third Position, people proudly waving racist signs, nor calls for “second-amendment solutions” while brandishing weapons. There were a few instances of anti-Semitic individuals trying to get attention, but they either (a) were completely ignored or (b) found themselves surrounded by counter-demonstrators. The MBF argument simply doesn’t fly here.

There is a bit of that. However, certain types of OWS critique have made me revise some of my views on methodology of criticizing TP. I will readily acknowledge that some of the things said about TP were not fair. (Though one can’t equate these two movements in the end.)

There is some truth to that. Certainly a double standard of sorts exists, although it could be said that the double standard is due to the great differences in influence and scope between the radical left and the radical right.

Following those arguments, your lack of objective criticism and generally weak tactics, such as accusing others of ridiculous positions like pro-rape and not fact checking before posting meant that any point you might have had was lost in the background of your obvious hate.

Correction—they can return to the park (it would be an awfully strange decision that said they couldn’t), but the ban on tents, sleeping bags and generators has been deemed enforceable.

CBS news was just there. The drums are going again. I expect to see some sort of 24 hour rotating presence and they will be noisier then ever just to make sure everybody knows they are not leaving. Also expect a swarm of lawsuits involving private property that was destroyed since it was done under another judge’s restraining order.

Judge really has no choice. To rule in favor of allowing the protesters to continue living in Zuccotti, he’d have to rule that property rights end where the First Amendment begins. A ruling that a higher court would be quick to overturn anyway.

Zuccotti was a very unusual case because Brookfield didn’t have a clear policy on use before - and changed policies midstream (but they have the right to do so as owner).

So, there’s a need to balance the protesters’ rights to free speech (and they can still protest there, just not camping with tents overnight).

And I think it was the right decision to make. Throwing the protesters out completely would simply cause too many problems, but allowing them to continue to camp out there would set a precedent that would likely be quickly overturned, as well as have dire results (as you stated) for the city going forward.

OWS needs to start thinking more constructively, to put the money and support it’s generated since the beginning to expanding the movement and evolving it. Even if all they do is rent out a flop house for the winter, at least it’s something.

LGF certainly went far further left than I’d noticed. Like I said, it did dampen my enthusiasm for condemning right wing radicalism when left wing radicalism is off limits. Investigating Tea Party organizers is important stuff, OWS organizers must not be discussed. Videos of Tea Party speeches advocating violence is a big deal, videos of OWS violence are forbidden.

I’ve been posting here for about a year and a half, and mostly lurking & observing for just over a month now, and I don’t see a huge difference from the day I registered. Some of the farther right leaning members have left quietly, flounced, or been banned, as have some of the farther left members.

There are plenty of subjects on which LGF is still right of center. Was the TP unfairly criticized in some cases? Yeah, looking back, it was. Have all of the criticism of OWS been fair. No, but you’re loath to admit it and now you’re framing it in such a way that everyone to the left of center is a cherry-picking hypocrite with nary a leg to stand on WRT criticism of the right. Sorry to say this, but that’s a Buck tactic—you’re better than that, smarter than that. So are we.

Several lefties—or radical leftists, moonbats, however you have us all classified now—tried to tell you from the beginning that your tone was inflammatory. We (myself included) asked you to post Pages, to try discussing it more calmly. You declined, for whatever reason.

So now OWS has become like Anonymous, the last subject I remember that became hugely contentious here. Lines were drawn then too, with the majority coming down to the right of center, and anyone who dissented got the living shit kicked out of them. I’m fairly certain they felt the same then that you do now. Some of the people who were right of center WRT Anonymous, came down left of center on OWS. There’s an ebb & flow here, and many Lizards (though certainly not all) cross from one side of center to the other regularly. It seems to me that nothing much has really changed here.

The double standard is too much and too obvious. I don’t think it’s intellectually honest.

Sorry, but IMO this is pure bullshit, KT—you’re back in Buck territory. Despite all it’s blemishes past & present, LGF is currently still the most intellectually honest place I know of for political discussion.

Frankly, I’m glad the police have run everyone off if for no other reason than that things can now calm down here and we can have rational discussions once again.

There’s a lot of that going around there are certain posters who obsessively characterize my views and spend a lot of time trying to twist my mundane statements into something sinister. So it goes.

You know, I’m curious why people claim OWS is a ‘lefty’ oriented activity? I think OWS would be happy to return to the tax code to the bastion of socialism in America that was the late 90’s and mid 80’s.

From what i can tell of OWS, the major issue is corporate capture and the evolution of the corporation-government merger. As I’ve said before, I’m pretty libertarian, and I recognize one of the biggest dangers to our country isn’t the over reach of government laws and regulation, nor the idea of a powerful corporations. Instead it’s when corporations can use government to create laws that benefit themselves to the detriment of the rest of the country.

I always remember hearing Neal Boortz on WSB claiming that once 51% of the population wasn’t taxed, then we’d have this horrible tyranny of the majority over the rich minority. Instead, what we got were corporations and the extremely rich, dictating loopholes and exceptions, without any accountability for their actions.

We desperately need to remove the concept of corporation as person. that or totally remove the concept of the LLC as a corporate entity.

And some form of leadership would go a long way to uniting the entire movement beyond “in-name-only” status. Seriously, I understand that the whole general assembly, direct democracy method sounds nice, but it makes it extremely hard to organize anything larger than the small camps we’ve seen so far. And I hear the argument that it will mean some will not have their opinions heard, but that’s part of the necessity, else you run the risk of more radical elements turning opinion in their favor and dragging the movement into far darker waters.

Police shoot gunman at California university

POLICE have shot a suspected gunman at the University of California, Berkeley, as hundreds of anti-Wall Street protesters marched on the elite college.

It was unclear if the shooting, which happened at the California institution’s Haas School of Business today, was related to the protest.

The suspect was taken to hospital, a Berkeley statement said, adding that the business school was evacuated and that no other shooters were thought to be involved.

The suspect, who has not yet been named, was followed by police into a computer room where they asked him to put up his hands, the university said.

I’m pretty sure it’s solidly left. There’s some libertarian crossover (there always is with protest moments) but the involvement on various lefty groups (code pink, answer, World Workers Party, et al) makes it a pretty lefty event. I’d go as far to label it far left.

We desperately need to remove the concept of corporation as person. that or totally remove the concept of the LLC as a corporate entity.

Lawhawk may be able to speak with authority about this I think the corporate “personhood” thing is a legal distinction having to do with the ability to make contracts and legally binding agreements. It’s not really a personification other than in a strictly legal sense.

Professional advocacy is a double-edged sword - truly effective strategy and action requires a lot of full-time effort (to counteract all the professionals one is up against), but it also inevitably leads to corruption when one becomes dependent on the “cause” for one’s salary.

But it is more of a consumer/citizen based movement than ideology, apart from the fringe. It’s more middle class citizen based than ideology based. That is it’s failing and it’s sincerity, right there. Because it does not fit into expectations, it is dismissed.

Lawhawk may be able to speak with authority about this I think the corporate “personhood” thing is a legal distinction having to do with the ability to make contracts and legally binding agreements. It’s not really a personification other than in a strictly legal sense.

You are correct, I misstated myself, I’m wondering why it’s a left oriented protest, when it seems the support is broader than that.

The problem is, once the concept that a corporation is a person was determined by the courts and that corporations would get the same constitutional protections as a person, then a ruling like Citizens United was just a matter of time.

At some point, I won’t be surprised to see corporations granted all the protections under the constitution, including the right to vote.

Professional advocacy is a double-edged sword - truly effective strategy and action requires a lot of full-time effort (to counteract all the professionals one is up against), but it also inevitably leads to corruption when one becomes dependent on the “cause” for one’s salary.

I see the Occupy events as an extension of the anti-war marches. These events are all put together, more or less, by the same professional activists. They don’t really want a legislative agenda. Their advocacy is to stage marches and protests. The goal is to get people to show up. Beyond that, there’s not much of an agenda. The cause isn’t really important. They’ll be back next year with something else.

I don’t really play many games anymore, except Deus Ex and (eventually) Skyrim (I been an Elder Scrolls geek since Arena and Daggerfall, which was dos days) I sorta prefer the feeling I got from playing games in the old Atari ST/Amiga days, when they were these weird secret things, full of mystery, done by one or three devs in a basement

Now, it’s like CALL OF DUTY NINE: ADVANCED WARHELMET and LETS SHOOT EVEN MORE ZOMBIES BECAUSE YOU GUYS ALL AGREE ON ZOMBIES, RIGHT?!?!?! I’ve discovered I get the feelings of mystery I want, from other things besides games (like music, like art) Games are like hollywood films, made by committee. Indie games are fun, but also sorta their own thing

The more advanced games get, the less interested in them I am :D And the more interested I am in playing guitar and ignoring my Xbox in favor of looking for the feelings of those old games. Because new games are mostly not getting anywhere close to that

Also, Planescape Torment :D 12 years old and counting, still better than anything I have played since, for what I want out of a game. i play it every year or three, still holds up

Nah. In a recent AT&T case, the SCOTUS smacked down an attempt to expand the scope of corporate ‘personhood’. Unanimous, if I recall. The Chief Justice wrote the opinion, and at the conclusion, wrote “We trust that AT&T will not take it personally.” Best line i’ve ever read in a SCOTUS opinion.

A whole ‘nother approach, for better or wore.

i started watching dr who with my teenage sons this past summer. every summer i have them do things (read books, write papers, etc.) because there are certain things you should just know, even if it’s not introduced in school. well dr. who was one of the things they thought i should know about. i really liked the first doctor and was disappointed with the change. my kids said i was the only one because no one’s favorite dr is christopher eccleston. i also listened to an entire album with dr who inspired songs. it sucked, btw.

Eccleston got me hooked on Dr Who as an adult (somehow I failed to develop the taste while a kid in Oxford, though I certain remember Daleks), so I can totally sympathize…I was really put of when I got “hooked” on Nine just in time for him to transition to Ten.

McSpiff—give Tennant (and eventually Smith) a chance, though. Admittedly not every episode is a gem but he’s a good actor and when given good material really sells the part.

Addendum: if it turns out you hate Tennant’s run (or Davies’s show-running) I still recommend Matt Smith as #11.

Yes. I think a leader would be very helpful. A clear message, code of conduct for the protesters, somebody who could be negotiated with. If this movement had a leader (anyone) they would have had a meeting in the oval office by now. Well, maybe not now since the movement is already imploding. But something could have been accomplished with some decent leadership.

I think the antiwar protests were more successful in terms of a protest movement. They didn’t appeal to me but they were huge. They didn’t discredit themselves by fighting with police, raping fellow protesters, shitting in the street, etc. The antiwar protests went on for years. As did the Tea Party. OWS made such a mess it had to be shut down by force in two months.

Dunno—some industry sectors have been hit very hard. Construction has hurt a lot of architect/engineering firms. My DILs boss in Florida sometimes asks her to delay cashing her paycheck.

Maybe apples to oranges about the shutting down part - most of the anti-war stuff I saw was marches and rallies, most of which lasted only hours and probably had permits. OWS is a 2 month sit-in of private property. I’m surprised they got away with it as long as it did.

Even if a movement, (any movement) could credibly offer me more of everything I like and less of everything I don’t like, my enthusiasm for that movement is inversely proportional to the frequency, duration, and accentuation of bongos and chants. It mostly makes me feel embarrassed for them, and vaguely ashamed even to be sympathetic. And that’s from someone who generally sympathizes with OWS.

I have to admit, I’ve some catching up to do. I sort of tuned out after Last of the Time Lords and Time Crash. Tennant is very good, a very interesting Doctor. But I’ve heard that he gets a bit whiny towards the end of his run and I’m not sure I want to remember him as such.

It’s far more interesting a topic that I’d have originally thought. Very little is so complex it gives me a headache. Dunno—some industry sectors have been hit very hard. Construction has hurt a lot of architect/engineering firms. My DILs boss in Florida sometimes asks her to delay cashing her paycheck.

Recently got into Dr Who. Just went through my first ‘doctor change’. I don’t… like it…

It’s not nearly as painful as companion changes — it always takes me halfway through the new one’s tenure before I get over missing the previous one.

(or maybe that’s just me, I also have trouble dealing with actors in new roles — it took an entire season of H50 before I could look at Chin Ho and Kono and not see Jin and Boomer).

When I said earlier that the park remained open 24 hours, I was wrong. The park owners have changed the rules and the park is now only open 6am-10pm.
