The impression given today is that it's going to be all or nothing, because the Court has no desire to knock down the mandate and then entangle itself in deciding what stays and what goes, nor do they trust a filibuster-prone Congress to do so in a timely fashion.

I gotta find the article over at TPM I read earlier, but it's conclusion that all the cheering and dancing by conservatives who seem convinced that today's hearing "proves" that the law will be struck down very well could be misdirection. That the conservative justices who upheld this law likewise grilled the administration mercilessly about the law before coming back and ruling in its favor.

I guess they are hoping that women who have been the victims of domestic violence will vote their hatred of illegals?

Kennedy's uncomfortable with the ramifications of ruling the mandate Constitutional, but that seems to hinge largely on whether he believes that health insurance is a unique market or not. Silberman did much of the same, treating the argument critically in the courtroom before coming back in his decision to say that he'd found that it was unique and thus the mandate was constitutional.

It really will depend on the course SCOTUS takes, but both parties would do well to start quietly drafting legislation in case of need.

So how do you get no discrimination of preexisting conditions without driving up health care premium costs? The mandate was about expanding the risk pool to support that increase by spreading it across a large population of people (young healthy people who pay, but rarely use). What other mechanism is there? That's not an ideological question. That's a question of math and the reality of how insurance functions. The GOP had no answer for that because the mandate was their answer for that. They liked it until Obama was for it and now they have made their own solution impossible to support. The GOP's got nothing of substance on health care. It's not an issue they have ever really been interested in anyway.

I wonder how DF rationalizes the crazy misogynist shit the GOP has been pulling on both state and fed levels over the last year.

The same way many GOPers do: it's not a voting issue for him. Most people vote what they think most needs defending. At this point in my life, women's reproductive rights and health are non-negotiable for me. I guess something else is non-negotiable or DF.

No obsession, I'm just trying to find what will pass. Unfortunately, some Republicans in Congress really want to boast they "took a hard line against the illegals". I'd say this isn't really the time to take it, but its what they want to do. So now I'm coming with ideas to salvage the renewal.

No I don't want the weapon, but there is no weapon without the GOP's insanity. I'm tired of my party having to be the adults and giving cover and legitimacy to your party's unreasonableness. Your party have been destructive, obstinate assholes for the 3 years in their quest to destroy the president and deny him any victory. Your party would have blocked the bin Laden raid if it couldn't. I think American's that are under the impression that their is a magical balance fairy and that both sides are equally unwilling to govern in a sensible manner should be told the truth. Both sides don't do it. It's the GOP that has moved far, far to the right and is totally unreasonable and unable to make sensible compromises. If the GOP can't pass the VAWA because they have to stay lock step in their opposition to illegal immigrants then the American people should know about it and make a decision.
