When Wisconsin GOP Senate Candidate Jeff Fitzgerald decided to use a song by the Dropkick Murphys as walk-on music, the band was not amused.

“The stupidity and irony of this is laughable,” the band wrote. “A Wisconsin Republican U.S. Senate candidate - and crony of anti-Union Governor Scott Walker - using a Dropkick Murphys song as an intro is like a white supremacist coming out to gangsta rap!”

This complaint led Fitzgerald to utter today’s quote of the day:

“I like their music, and that’s the song from ‘The Departed.’ I always liked the beginning of that song. My last name is Fitzgerald,” he said. “We Republicans don’t have a lot of songs we can choose from.”

There’s always Toby Keith.

Unless being used for commercial purposes, in which case they are due royalties. Its considered intellectual property, so they can object legally if its being used in a campaign, whether for a product or a candidate.

Thanks for the response. I really don't think it's their property beyond whatever copyright claims they have under the law. Poets and authors don't really charge around from classroom to classroom making sure their work is not misinterpreted, do they? Again, I think that the band can and should state publicly that the playing of their music should not be taken as an endorsement; they certainly have the platform to get the message out.

I beg to differ. If I were a songwriter and some candidate with political views to the extreme of mine used one of my songs, I would not like it one bit. It certainly can be construed as endorsement.

Copyright to the song, and mechanical rights to the recording, are two different things.

If you want to use somebody's song, you can hire a band to play it and send a check via ASCAP and there's nothing they can do about it.

If you want to use their recording of their performance, you need permission.

In this case, he is, but I do think most of the time politicians actually legitimately license songs to play from the copyright holders. That's been the case in some of these-- the power the artist has it to make a stink about it, not actual legal power to stop them from duly licensing it.

I'm not an expert, but I seem to recall it shaking out that way on some other uses.

In this case, he is, but I do think most of the time politicians actually legitimately license songs to play from the copyright holders. That's been the case in some of these-- the power the artist has it to make a stink about it, not actual legal power to stop them from duly licensing it.

Yes, I believe that's correct. While there are cases of campaigns actually using songs they haven't secured a license for, most of the time they stop using it because, as you say, the artist(s) hammers them for it publicly and it's just doesn't make sense to continue to use it. Although there may be some cases were the artist has the ability to void the license after the fact/for the future, but that would really depend on how it's all set up.

Rush Limbaugh honored at Missouri's Capitol

Conservative talk show host Rush Limbaugh has been inducted into the Hall of Famous Missourians.

Limbaugh, a native of Cape Girardeau, was honored Monday during a ceremony at the Missouri Capitol that was open to the media but not the general public.

As a member of the Hall of Famous Missourians, Limbaugh will have a bronze bust displayed in the Capitol alongside the likes of President Harry Truman, Mark Twain, Walt Disney, George Washington Carver and Stan Musial.

Republican Missouri House Speaker Steven Tilley selected Limbaugh for the honor but kept the timing of the ceremony secret until shortly before it was to start. Tilley has been trying to avoid a public spectacle for the event after Limbaugh's selection was criticized by Democrats, some women's groups and other political opponents.

Federal authorities have paid tribute to a man they say was the first black U.S. law enforcement official killed in the line of duty after Reconstruction.

William Henderson Foote was honored at a ceremony Monday at the headquarters of the Bureau of Alcohol, Tobacco, Firearms and Explosives. Officials unveiled the addition of Foote's name to the ATF memorial wall as part of National Police Week.

The ATF says Foote was working as a deputy collector for the Department of Treasury's Bureau of Internal Revenue when he was shot by a white mob in Mississippi in 1883. The bureau was later folded into the ATF.

Members of Foote's family attended, as did the wife of Attorney General Eric Holder.

According to a new poll by Reuters/Ipsos, “If the election were held today, Obama would win the veteran vote by as much as seven points over Romney, higher than his margin in the general population:”

Romney, along with his primary rivals Rick Santorum and Newt Gingrich, had also accused Obama of “appeasement” toward U.S. enemies – a charge that drew a sharp Obama rebuttal. “Ask Osama bin Laden and the 22 out of 30 top al-Qaeda leaders who’ve been taken off the field whether I engage in appeasement,” the president shot back. He has reproached GOP candidates: “Now is not the time for bluster.”

There's a fair bit of nuance to the situation:

Copyright experts say you don't have to ask an artist's permission to play a popular song at your rallies — as long as the venue where you play it has what's known as a blanket license from the performing rights organizations ASCAP and BMI. Peter DiCola, who teaches law at Northwestern, says most public venues do have those licenses. But small or unconventional venues may not, including a few that are mentioned by name in the Survivor lawsuit.

In other words, the ASCAP page you posted answered the question of why one should pay, and then equated that payment with the asking of permission. In fact, if the musical piece is licensed under ASCAP/BMI and the venue has a blanket license then the legal recourses are fairly limited. There are also stricter rules associated with advertising:

Sometimes you have to ask for permission. This is especially true if you want to use a song in a television commercial. In that case, you have to pay royalties to the songwriter and to whoever owns the sound recording, usually a record label.

In the end the situation often comes down more to public opinion than strict legal liability:

Some of these artists' claims may not have much legal merit, says Sherwin Siy, an expert on copyright law at the nonprofit Public Knowledge in Washington, D.C. "They're just throwing that out there to say, to make a statement," he says. "To say, by the way, this music they're trying to use as the soundtrack to their campaign, the musician doesn't support it."

But no matter how flimsy the legal case, Siy says it often makes more sense for a political campaign to back down anyway. "The optics of it are so bad that there's really not much point in continuing to use a piece of music when the musicians really don't want you to."

The point of all this is that when we discuss the issue in terms of the band/artist not being paid, that's not actually the case in most of these situations. If the band / artist has licensed their music and the venue or campaign has purchased blanket rights to the library for use at public events then they are being paid. The issues of brand dilution, and the artist not wanting to be associated with the candidate are separate and legally weaker.

New Romney Video Touts Steel Mill That Benefited From Government Largesse

the Fort Wayne Journal Gazette reported at the time (via Nexis), that Bain was just one of eight financiers for the project — hardly the lone white knight:

Financing to build the plant is coming from the Mellon Bank in Pittsburgh, NBD Bank, Fort Wayne National Bank, Lincoln National Life Insurance Co., the Bank of Japan, the Bank of Germany and the Paris Bank. Capital and Bain Capital are also investors.

And while the video touts Romney’s “private-sector” team, the company was successful thanks, in part, to big government subsidies and grants — $37 million from the state of Indiana and DeKalb County. And as the Los Angeles Times reported in January of this year, the county even raised taxes on residents to help fund the mill:

The county promised $23.4 million in property tax abatements and tax increment finance bonds, as well as a new income tax to generate economic development funds. The latter was required by the state, which shelled out another $13.6 million in tax credits, energy grants, workforce training and funds for roads.

A new quarter-percent tax on DeKalb County residents financed infrastructure improvements such as roads and railroad exchanges that benefited Steel Dynamics.

The latest article keeps up the theme in the comments, e.g.:

I think the outrage of artists over the use of their songs is understandable, but pointless. Democrats could quote Limbaugh, Republicans can play Neil Young walk-on music. Does anybody mistake the playing of music for a political endorsement by the band? I can't get too excited about this.
