Wingnut Artist McNaughton Comes Out as Hardcore Birther, Cites #Breitbart.com as Source

Recently Sean Hannity’s favorite “artist” Jon McNaughton, whose Mormon/JW leaflet-style painting “One Nation Under God” was too extreme for Brigham Young University (McNaughton is a BYU alum) and who thinks that lectures about evolution at BYU show it has a problem with “Liberalism”, has come out as a hardcore birther in his blog post “McNaughton and Troy talk about Obama and Socialism”:

I believe that Obama has committed many unconstitutional acts since becoming President.

Also, the evidence is mounting that Obama was in fact born in Kenya. In my original list I did not include this because the evidence was circumstantial at best. But things have changed. (7) If this is resolutely confirmed, it will be one of the greatest lies ever perpetrated upon the American people. Whether it is considered important or not, it is a direct prerequisite of our Constitution, that he be a naturally born citizen. People have tried to ridicule this notion since day one, but Obama has done nothing to resolve this until last year when he released the long form of his BC. McNaughton’s sources for his “mounting evidence” claim are Joe Arpaio’s waste of taxpayers’ dollars and breitbart.com’s article by Ben Shapiro regarding Obama’s “Kenya bio” nontroversy. Good job, Breitbrats!

A lot of these people are jumping on the fact that Obama's literary agent put out some promotional pamphlets saying he was born in Kenya. They claim Obama gave her the info, so he's been lying ever since.

This literary agent is of course the one who helped him publish his book Dreams of My Father. You know - that book in which Obama wrote about being born in Hawai'i.

A mother being a citizen is not an automatic qualification. There are various clauses in the US Code re: the age of the mother and periods of residency in the US prior to birth.

Though, based on the case of US v. Wong Kim Ark, the US Code is only relevant to citizenship, rather than natural born citizenship. The Constitution provides two paths to citizenship. One is natural born, which means born in the U.S., regardless of your parents' status, with limited exceptions. The other is to be naturalized in accordance with laws passed by Congress. Thus a child born to US citizens overseas could be a citizen by birth in accordance with the United States Code, but would not be a natural born citizen. Don't take my word for it, Google the opinion and read it for yourself.

See the section about children born abroad, specifically.

Therefore the US Code comes into play. Under it, Obama's mother was 18 and did not meet the legal residency requirement of the time; so her child would not qualify as a citizen if born outside the US to her non-citizen husband.

HOWEVER Obama Sr. was a bigamist, so it can be argued legally that Obama was born outside of wedlock. And for children born outside of wedlock the mother's period of residency standard doesn't apply for some reason.

It's all about mood and framing the subject: note how the Aryan Jesus prints, for the most part, have light backgrounds and are relatively positive. Then, notice the "Obama burning the Constitution" print is dark and foreboding; McNaughton should have went all out and made his Bizarro Obama a fucking vampire, complete with fangs dripping blood.

Well, what he said is partially true, in that WKA seems to have excluded that, but that by itself doesn't mean this still holds true. Lots of other decisions were taken and laws passed since then, so WKA doesn't control the "born abroad" issue, only "born inside" issue.

Therefore the US Code comes into play. Under it, Obama's mother was 18 and did not meet the legal residency requirement of the time; so her child would not qualify as a citizen if born outside the US to her non-citizen husband.

HOWEVER Obama Sr. was a bigamist, so it can be argued legally that Obama was born outside of wedlock. And for children born outside of wedlock the mother's period of residency standard doesn't apply for some reason.

I'm sure Jack Maskell is a fine attorney, however his opinion about the Constitution doesn't outweigh that of the SCOTUS. Natural born and naturalized are mutually exclusive paths to citizenship; if your citizenship depends on an Act of Congress, then you are naturalized and not natural born.

However, as I said above concerning George Romney, I think the Constitution delegates to the Electoral College, and not the Courts, the authority to determine who is eligible for the Presidency, so if the electors chose George Romney or John McCain for President, I would not second-guess their decision on that basis.

Well I'm seriously bummed.

My wife and I had a fight Tuesday and haven't spoken to one another since. There was a lot of shit said that I'm not sure can be forgotten, and some serious incompatibilities brought up that likely can't be corrected. Things that we've tried several times to change but obviously failed.

So it looks like I'll be leaving at the end of June.

I'm just sitting here in the basement looking at all my 'stuff' and realizing most of it will have to be packed up and stored somewhere until I can find a place big enough to house it and frankly I'm heading into that dark place where all I want to do is sleep. It's going to be tough to get up and go to work every day, and even tougher to pack shit up.

There's no way she can afford to rent this place on her own, so I'm worried about our two cats.

Life sure the hell isn't simple, is it?

Yes, the jus soli part is being cited, because it hasn't been modified in any form by any court in any subsequent decisions. This has exactly zero to do with the matter we're discussing, namely, the children born abroad.
