George Zimmerman’s Bond Revoked for Lying to the Court

The Orlando Sentinel reports that George Zimmerman has been ordered to turn himself in within 48 hours, after a judge revoked his bond for lying to the court about donations he received.

SANFORD – In a shocking turn, Circuit Judge Kenneth Lester has revoked George Zimmerman’s bond in the shooting death of Trayvon Martin.

Zimmerman now has 48 hours to turn himself in to authorities.

The decision came after the revelation that Zimmerman and his wife may have conspired to lie about thousands of dollars in donations they’d collected before his bond hearing.

In a new motion, prosecutors accused Zimmerman and his wife of lying to the judge during a bond hearing about money they collected for his defense.

Prosecutors allege Zimmerman’s wife knew about the donations her husband had collected through a PayPal account, but didn’t mention the money at his bond hearing.

The account ultimately collected about $200,000, his attorney later revealed.

“Defendant has intentionally deceived the court with the assistance of his wife,” the motion says. “During the jail phone calls both of them spoke in code to hide what they were doing.”

There's no one to blame but Zimmerman for lying to the court about both his financial status and that he was contemplating skipping out of the country. Bail is designed to insure presence, not as a punitive measure; bail isn't granted where the defendant is a flight risk.

I'm pretty sure the money was already known about so it was probably the concealed passport that did him in. Pretty stupid considering he can't travel out of the country under his own name anyways. He'd need a fake passport to get out. I was an article yesterday saying the trial isn't even going to start for another year or so. He's going to be sitting in jail for a very long time.

Yeah. Funny enough, it turns out judges tend not to take kindly to being jerked around. Who would have thought?

Additionally, it sounds like it was only the money that was the reason for his bond being revoked. I haven't yet been able to find anything with the actual text of the order, but apparently the judge stated that the passport issue wasn't a factor.

It depends on the evidence involved here, and what was actually said by Zimmerman and how it would be used by the prosecutors. Character evidence is pretty regulated by state (and federal) rules of evidence. For instance, if the defense team says that their client didn't do it and has no history of violence or lying about important matters, the prosecutors could rebut by introducing that Zimmerman lied/obfuscated about his financial situation to secure a lower bail (or bail at all).

It's also possible that it might not affect trial at all though that doesn't mean prosecutors wont use it in trying to work a stronger plea deal or convincing Zimmerman to take a deal...

Any ruling on admissibility would almost certainly occur before the prosecution presented it. If they they went and brought it up anyway then they would risk a mistrial.

In an absolute and objective sense, not at all. But 90% of what we talk about involving this case is conjecture, heavily shaded by how we stand on the issue of SYG and race in general.

I have come to assume that the state prosecutors must have a pretty solid case, or they would not have pressed for second-degree murder charges.
Zimmerman's jittery behavior tends to support that assumption.

Well, it's always hard to be certain on that. While in an ideal world it wouldn't be true, political considerations can often play in to the decision on whether or not to bring charges in a case, working in both directions. I mean, look at John Edwards just the other day. The general consensus among legal experts is (And was even before the trial began) that there was really no case there and the government should have never gone forward with it. And if the background of the case and the defendant weren't what they were, it's likely prosecutors wouldn't have. At least, that's my view.

So, standing outside the jury, I could say that this looks real bad and undermines his credibility to a damaging degree, but if I were a juror, I'd have to consider only the evidence put before me, even if it means not considering this bit about the bail.

I would not want to assume the state only charges when the evidence is strong. Over charging is a tried and true tactic. I can only hope this sets his credibility where it belongs-In the basement.

Zimmerman received a second passport on March 26, 2004, and that one is valid until 2014, she said.

meh. this notion doesn't line up with my own personal experiences. In my younger days I was charged twice with possession of THC cause they found it in my blood. I was also sighted for underage drinking when I blew zero zero once as well.

this is not just a case of cops charging people with shit. the whole blowup started over the fact that the cops did not charge him with anything.

the prosecutors know that this is a high-profile, highly sensitive case and they are going to proceed very carefully. which is why I was slightly astounded to see them pressing for murder charges and not manslaughter.

Personally, I've come to the exact opposite conclusion, that the charges were motivated by an desire to either (A) Give Zimmerman the impression that the case against him was solid and so scare him into pleading to a lesser charge or (B) Appease the natives who had spent weeks growing restless at the fear that he'd be released upon the investigation's conclusion.

Nothing in the evidence so far provides grounds for charges higher than manslaughter or negligent homicide, which means that Murder 2 is a serious overcharge. A lot of Zimmerman's supporters declared on the day Corey announced the charges that she'd got for Murder 2 because it was the highest charge she could go for without impaneling a grand jury. I'm inclined to believe they were right on at least that count.

Then you get to the exclusions (inadmissible evidence):

Then there are rules dealing with character evidence (which this could fall into). Rule 90.404 (again mirroring the federal rules):

Of particular note:

(1) CHARACTER EVIDENCE GENERALLY.—Evidence of a person’s character or a trait of character is inadmissible to prove action in conformity with it on a particular occasion, except:
(a) Character of accused.—Evidence of a pertinent trait of character offered by an accused, or by the prosecution to rebut the trait.

There's also the inconsistency between Zimmerman's statements at the bail hearing and on the recorded police phone call regarding how old he thought Martin was. On the phone call he correctly identifies Martin as a teenager, at the bail hearing he said he didn't know how young he was, thinking he was just a few years younger than himself.

OK, the passport issue seems to be moot. Z and the lawyer claim that they found the passport when they were cleaning up the house and gave it to the lawyer who apparently forgot about it for a month. This would explain both the stolen pass claim and the fact that he didn't surrender the pass. (At this time, at least.)

Of course, you didn't know about this when posting the first reply, so this doesn't excuse it, nor does this second passport bear any relevance to the Zimmerman issue.

The AudioQuest still didn't quite fit, so I added a few links of some old lamp cord I found in the basement, but I figured that the exceptional quality of the new cable would compensate for any possible problems caused by my hand-wired temporary connections).

After I'd connected it to the Coby, I plugged the other end of the cable into the wall and stood up to walk away. But before I'd taken my first step, I realized that my faithful Coby had started to play my favorite Mozart string quintet -- and I had lost that cassette more than a year earlier! The sound was . . . . unbelievable. When I closed my eyes, it seemed that I was actually sitting between the cellist and the violinist. I was almost glad that it wash't a full symphony, let alone a Pink Floyd album. I'd want to be better prepared.

So, although I haven’t been at this as long as Steve Novella, I’ve been at it plenty long, which led me to think I had seen just about everything when it comes to pseudoscience and quackery.

As usual whenever I think I’ve seen it all, I was wrong.

I’m referring to something that has been mentioned once before on this blog, namely something called “Miracle Mineral Solution” (MMS). I must admit that after a brief reaction of “WTF?” I basically forgot about it. I shouldn’t have; I should have looked into it in more detail at the time. Fortunately, being a blogger means never having to say you’re sorry (at least about not having caught a form of quackery the first time it made big news), and fortunately MMS was brought to my attention in the context of an area of quackery that I frequently blog about. You’ll see what I mean in a minute...

If the congressional gop leadership's stated goal is to make Obama a one-term president, how does anyone think the congressional dems will respond next time we've got a gop president? Just like their colleagues, they'll try everything to destroy him, smear him, delegitimize him and make him a one-term president as well. Some would argue this is just politics, but it's actually not. It's a rejection of governing and the compromise necessary in a functioning democracy.

I'm pretty sure the money was already known about so it was probably the concealed passport that did him in. Pretty stupid considering he can't travel out of the country under his own name anyways. He'd need a fake passport to get out. I was an article yesterday saying the trial isn't even going to start for another year or so. He's going to be sitting in jail for a very long time.
