Video: Former Bain Partner Ed Conard With Chris Hayes

Deeper into the weeds
Politics • Views: 32,075

Here’s the spin straight from a former Bain insider; take it for what it’s worth. Ed Conard does confirm in this clip that Mitt Romney was “legally” the CEO and Managing Director of Bain Capital until 2002, but he doesn’t deviate from the campaign’s line that Romney had no control over the company (or responsibility for its investments) after February 1999.

Ok, I give up.

How the hell can you both be the freaking CEO AND have absolutely no control over the company?

Time for one more "Campaign ad"...

*catchy musical intro with Romney clips*

He is the envy of Chameleons everywhere...
He makes a root canal seem enjoyable...
He's so boring, even the color grey says "DAMN..."

He is the most UNinteresting man in the world.

Ever let someone drive your car? Kinda like that. Your name is still on the title but someone else is driving.

Delegation.

That only handles the day-to-day management. Willard was still the CEO, the chairman of the board, and the sole stockholder. If the people he put in charge were doing things he didn't agree with, he could have overrode them or even removed them from management. Instead, he quietly kept drawing a salary until '02, when apparently he decided he wanted to go into politics and "retroactively" retired.

re: #2 Dark_Falcon

Delegation.

Which is a lie. He had defacto and dejure control over the signing of deals. If he didn't want to sign off on Stericycle he could have blocked it, he chose not to. That choice was an affirmative action.

You can delegate authority but not responsibility, and in this case by retaining the titles of CEO, Chairman, President and Managing Partner he never even relinquished actual authority. The fact that he signed off on the deals indicates his tacit approval of them.

They've been calling Obama, Carter 2.0 from the minute the man was nominated. It didn't stick then and it's not sticking now. Romney's caused a lot of his own problems by showing that he has a big problem with honesty.

I don't know. It probably had something to do with the way his settlement with Bain was negotiated. Remember this was finalized in 2002, long before he ran for president, I don't see any evidence that this was some clever plot to hide something for a future presidential run. Probably much more about the way his agreement with Bain was negotiated. There's also no evidence about how much he knew or cared what was going on at Bain after he left in '99. Magement was turned over to a team and there's no evidence he interfered with anything at Bain past '99.

Viscous Responsibility

WOLFEBORO, N.H. (AP) — Mitt Romney's campaign said Sunday that President Barack Obama is willing to say anything to win a second term and should say he's sorry for attacks on the Republican's successful career at a private equity firm. "No, we will not apologize," the president responded, adding that if Romney wants credit for his business leadership, he also needs to take responsibility.

This says very little about his corporate business acumen then, let alone anything political.

Most corporate types turning over the company are very concerned over business decisions made during the transition because of a) the legal responsibility mentioned before and b) the very real possibility that decisions made during that time will have an impact on the future profitability of the company--i.e., how much he gets paid for turning the company over.

It's a lameass excuse that doesnt make sense 't matter how you look at it.

I can understand a person not placing much weight on SEC documents signed under oath simply because they don't want to. I can understand someone thinking that the CEO/Chairman/President/Managing Partner and sole shareholder of a company isn't responsible for what that company does. I get that it's possible not to see anything wrong with a man earning six figures of salary for years, while ostensibly doing nothing for it.

I comprehend all these things because I'm aware that many people are either monumentally stupid or have a near limitless capacity for dishonesty.

I'm not comparing Mitt Romney to Nazis, that's absurd. The comparison is that authority is shed, although in the Nazi trials is was feigned middle management being forcibly directed from the top under fear. In Romney's case, he's saying he wasn't in charge though his title and company hierarchy says so.

By the way...if this does happen, this is usually mentioned in SEC documents, either as being on retainer or under a special agreement (termination agreement, ownership change, etc.). It's pretty clear.

It's also pretty clear that any sort of agreement wasn't mentioned in the contemporarily filed papers.

Conservatives are bending over backwards to dismiss SEC documents signed under oath while placing huge weight on inferences about marketing materials that don't list Romney as a manager of a company he owned outright. The only people with a strong motive to fake Bain memos at this point would be Romney supporters trying to muddy the waters.

Schieffer opened a later segment saying he was "shocked" by the ad and distancing himself from it.

"That was a question that I posed to David Axelrod -- not a statement," he said. "I have no affiliation with the Romney campaign. This was done without our permission."

Schieffer noted the precarious position of an independent journalist appearing in a campaign ad: "I'm sure I'll get some blowback."

.... Romney had no control over the company (or responsibility for its investments) after February 1999.

I know I'm repeating myself, but the above claim is one of the very problems we face in this country.

Mitt Romney was the owner until he was truly divested of Bain. What this means is that Romney benefited from Bain after his time-traveling "retirement" in 1999, because for three years after this Bain did its thing, and then Romney was finally divested of Bain, as his investments were put in blind trusts so he could be Governor.

This idea - of being CEO and benefitting financially, but being held not liable for what the company does - is at the heart of modern American "capitalism" abuse of the laws that were put in place to actually protect private ownership.

Huffpo, TPM and Mother Jones hold up each "new" document as the holy grail only to find out it just tells us what we already know. Without mentioning the heroics Romney has accomplished in his IRA, the New York Times editorialized on July 10 that the rest of Romney’s opaque “tax avoidance” schemes -- including overseas shelters in the Cayman Islands, Switzerland and elsewhere -- amount to nothing short of a “financial black hole” that he would be well advised to explain to the public. That's the kind of thing that could deep-six the Romney campaign. It is certainly something the GOP primaries ought to have sorted out, if enough brains could have gotten behind one of the other candidates and pushed hard enough at Romney.

I wonder if this ultimately wasn't Newt's plan all along - knowing that there would be skeletons in a closet as densely packed as Romney's - and that if someone dug into Bain's history long and hard enough "stuff" would surface.

I think what it ultimately boiled down to in the primaries is that Willard had the money to carpet bomb his opponents into submission, playing on their own flaws while they were too disorganized to really go at his. Newt was the most successful, but it appears he only ever scratched the surface. Not to mention that, to the far Right, being a vulture capitalist is not something to be ashamed of if you can claim it means you know how to create jobs.

The democratic candidate for MA governor banged him on top of the head with offshoring during the campaign. Mitt Romney said then, during debates that he had nothing to do with Bain from 1999 onward. He is just repeating that spin now.

He doesn't have to have had presidential aspirations back then. He was trying to win that election and it was more convenient to say "I had nothing to do with Bain, at all" than to try and tell the complex story of "I was technically CEO but I wasn't managing day to day so really I'm off the hook. You buy that, right?"

It's a blatant lie to say he had nothing to do with Bain. Even KT has already acknowledged this.

That is the real story at this point. He is blatantly lying because he doesn't want to explain why he an absentee owner shouldn't be held responsible for his companies actions.

re: #185 Interesting Times

Anyone here thoroughly familiar with NYC? I'm trying to do a google image search for the Brooklyn Bridge with Manhattan skyline in the background, but can't find the particular angle I want. Are there keywords I can use for certain areas of the bridge, or viewpoints, e.g. "Brooklyn Bridge as seen from...?"

williamsburg?

Thank you! :D That's exactly the kind of view I was looking for (where the bridge disappears off to the right, instead of the left, like the lionshare of most Brooklyn Bridge shots. Probably because it's easier to get better views of Manhattan that way)

It's to use as a basis for a stylized landscape panorama going from NYC to middle America to San Francisco

YW. Yeah, that's a pretty useful tool and even used it for work a few times. Not to use the photos but to use them as reference. The direct link to Panoramio is also here.

Uh oh. Now Bob Schieffer is worried:

"Whatever happened to Hope and Change?"

What the fuck are you talking about, you ridiculous hack. Even Rasmussen has Obama up a point in its latest polls. And those polls have held steady for the last 3 months.

As have the Intrade markets which have the race close, with a slight edge to Obama. This is only news if you haven't paid attention to anything over the last 3 months.

I think people are focussed on the wrong thing here. Bain was managing large amounts of money belonging to Pension Funds etc.. which essentially represented money belonging to normal middle class Americans. As CEO, and as Director, he most certainly would have owed a Fiduciary duty to those investors be informed and involved in major decisions taking place within the company. If he claims he did not, he would be in breach of that Fiduciary Duty.
