Following the Obama campaign ad with Mitt Romney singing “America the Beautiful,” the Romney campaign releases an ad featuring guess what?

Yes, that’s right: the now-famous clip of Obama singing that Al Green song, while the advertisement slams him for “rewarding his biggest donors.”

Three points:

1) Most people who aren’t wingnuts actually found it charming when Obama sang that song.

2) It’s pretty amazing to see Romney trying to criticize Obama for his donors, when Romney himself has collected tens of millions of dollars from an assortment of far right billionaires like Sheldon Adelson and the Koch Brothers.

3) This is childish “I’m rubber, you’re glue” politics, and it may appeal to the far right wingnut base, but to everyone else it’s pretty obvious that Romney is in reactionary mode, letting Obama dictate the course of his campaign.

I've been thinking more about those tax returns and why he won't release them. I'm wondering if he's afraid of crowdsourcing.

There's this assumption I'm seeing everywhere that his returns are going to be legal. After all they were accepted and he wasn't audited, was he. Except, of course, that IRS audits have become less and less common for the wealthy. (two part punch on that. One, a requirement to audit across all brackets, and two the continuing cuts in number of experienced auditors.)

So what if some of his pre-2010 tax games were gray options, open to varying interpretations and challenges as to legality? Things like the guessed at method of getting his IRA so large: artificially pricing the stock low to purchase it for the account, then letting it revert to market. (If that's what was done, by the way, it is borderline illegal - and might be completely depending on /how/ the artificial pricing was applied.)

What happens when a few thousand skilled and willing eyes start climbing through that backload of data?

Tax avoidance is legal, tax evasion is not. And I wonder if that's part of what's behind the unwillingness to release.

You may be right that some of the reluctance to release the returns may have to do with questionable tax decisions that skirt the line from tax avoidance (legal) to tax evasion (illegal). What we'd also need to keep in mind is the status of the relevant law at the time those decisions were made. Some changes made since may greatly affect how those outcomes play out.

Also it's worth noting that there may be all kinds of benefits stemming from the 2001 and 2003 tax changes (EGTRRA and JGTRRA) affecting depreciation, net operating losses, etc. that could have come into play during the time period - along with amended returns for the period to reflect changes made after the initial returns were submitted to take advantage of those tax law changes.

Crowd sourcing would take the place of a forensic accountant piecing together what Romney did and when.

His accountants, representatives, etc., could make certain decisions, but Romney signs the returns and is ultimately responsible for those decisions. There's quite a bit of tax law detailing responsible parties and their liabilities when the taxpayer relies upon advice in making decisions. It goes to how much he knew, had reason to know, etc., and since some of this will go to his investments in companies he was sole stockholder/owner/managing director/etc., he's going to have decision making responsibilities/liabilities on that end as well.

It's very revealing to me the type of person Romney is when he can't manage the first little crisis his campaign has encountered. Excising a wound is sometimes the best way to handle a problem. He doesn't seem to see the advantage of releasing more of his tax returns and financial statements, taking his lumps, and moving on. This would seem to be the best way to quell the growing clamor for him to reveal more about his finances, but he's dug in and decided he owes us nothing. I guess he thinks we should vote for him because of who he says he is. This is what made his little "If you know what's in my heart, you'd vote for me" comment in his NAACP speech so offensive to me. He knows deep in his heart that he doesn't care for anyone in the country except those in his own socioeconomic group. The fact that he had to say in his Fox interview that Senator Kerry's wife didn't release her tax documents when the senator ran for POTUS in 2004 made him look like an idiot. Senator Kerry's wife wasn't running for president. I love seeing people who think they're all that and 10 bags of chips on national TV looking like the tools they are.

That said (IANAL), I think the person who bought the tax prep would be liable for back taxes and fees, but wouldn't be responsible for penalties.

Exactly who pays what would probably be settled by lawsuit.

There's this assumption I'm seeing everywhere that his returns are going to be legal. After all they were accepted and he wasn't audited, was he. Except, of course, that IRS audits have become less and less common for the wealthy. (two part punch on that. One, a requirement to audit across all brackets, and two the continuing cuts in number of experienced auditors.)

So what if some of his pre-2010 tax games were gray options, open to varying interpretations and challenges as to legality? Things like the guessed at method of getting his IRA so large: artificially pricing the stock low to purchase it for the account, then letting it revert to market. (If that's what was done, by the way, it is borderline illegal - and might be completely depending on /how/ the artificial pricing was applied.)

What happens when a few thousand skilled and willing eyes start climbing through that backload of data?

Tax avoidance is legal, tax evasion is not. And I wonder if that's part of what's behind the unwillingness to release.

I don't think anything illegal went on. I suspect there are some years he paid no taxes....or very little taxes using the loopholes and deductions that are available. But a very effective ad would be "why does the man who wants to be President get away with an effective tax rate of whatever ridiculously low number it is when a middle class family pays XX". It's the unfairness of the tax code he's afraid of people finding out about.

I can't guess who it will be because Mitt's so anonymous. It's hard to decide who reinforces, complements, or balances him. He's imitation tofu (just as bland and able to be what the dish requires, but none of the nutrients).

Basically, this means whoever he picks will end up being the definition of the team, and I can't decide what flavor Mitt wants to be.

And I understand that if it can be proven the tax preparer not only sought to defraud the government but also lied to his customer about how he went about filling out the forms, then the person who hired them could hardly be held legally responsible.

But this matter is not reaööy about any sort of smoking gun, about any felonious acts or felonious intent: it is about Mitt's qualities as a leader, his ability to act and react in a hostile environment in which he cannot have things his way at all costs.

Romney will gain a bit of initiative when he names his running mate, but basically whoever he chooses is going to piss off someone in the GOP, so that will dampen things.

What has he got left to run on? His Olympic record? Even that is going to be known to most folks as "the thing he was doing while still earning $100K a year as 'inactive' CEO of Bain Capital".

And as I mentioned the other day, because Romney is refusing to release tax returns, the v.p. pick is actually going to create problems, because he/she is either going to release his/her returns, putting Romney in a very strange place, or they're going to be consistent with Romney's position, meaning that the Republicans will have TWO major candidates who refuse to release any tax information. that probably won't play well in Peoria.

I'd look at Martin O'Malley as someone for the Dems. He's a staunch social liberal. Someone who actually not only survived the Republican-TP landslide but did even better. Plus he's got the "it" quality- he plays in a band. Andrew Cuomo is another name I hear named.

Agreed. I used to get tremendously excited about the Olympics for two reasons. One, there is of course national pride. Second, it was a chance to see some obscure but interesting sports. Now you can barely find any coverage that is not basketball, track and field, or soccer (tape delayed on ESPN Deportes....). Boring. And the omnipresent advertising is a drag.

I think the tax return issue is a red herring. Eventually, Romney will release additional returns and the only thing we learn is that he was very rich in 1990, too. Then he will be able to make hay from there having been nothing there, just as he claimed.

Your probably right that I doubt the returns are going to show what the accusers want but i don;t think he's going to release the extra returns. Politicians usually don't cave on this stuff because it allows opponents the opportunity to fish through additional material looking for dirt. Obama's birth certificate was a rare case.

People want to get transparency from their candidates and Romney's doing everything imaginable to thwart that. Considering that other politicos have released years and decades worth of tax returns, his refusal to release more than the past 2 years is troubling, particularly when he claims business expertise is a reason to elect him over Obama. But if his expertise is really no more than being a good gambler and working the tax code, then it undermines his very expertise argument.

Any equivocation between Romney's tax returns and Obama's birth certificate is the worst sort of MBF.

I think you're wrong. At the very least they'll show he pays an effective tax rate around 1/2 (maybe even less) than your average middle class family. And I wouldn't be surprised if some of those years he paid nothing at all. Perfectly legal but horrendous optics on any chart.

Agreed. I used to get tremendously excited about the Olympics for two reasons. One, there is of course national pride. Second, it was a chance to see some obscure but interesting sports. Now you can barely find any coverage that is not basketball, track and field, or soccer (tape delayed on ESPN Deportes...). Boring. And the omnipresent advertising is a drag.

And don't forget that 50% of the coverage is now "human interest" because some focus group years ago determined that women don't actually want to watch the sports--they want to hear about the sad life the Bosnian archer has led, that she/he has overcome. I'm like, "Com on, for crying out loud! You've got 50 sports competing today. Just show us the horses jumping over the posts, for heaven's sake!"
