Ohio Republicans Make Last-Ditch Effort to Steal the Election

A thuggish last minute tactic

Andrew Cohen has the details on an absolutely blatant attempt by Ohio Republican Secretary of State Jon Husted to suppress the vote for Barack Obama: Ohio’s Provisional Ballot Order: The Biggest Legal Story of the Weekend.

Here’s what happened. On Thursday, voting-rights advocates filed an “emergency motion” with a federal trial judge seeking his reassurance that provisional ballots in Ohio will be judged by the standard he endorsed (and Ohio reportedly agreed to) in a recent consent decree. That standard, the plaintiffs say, is “that a provisional-ballot form that has incomplete or improperly completed information regarding the type of identification proffered by a voter should be counted pursuant” to Ohio law, which, they say, makes the poll worker responsible for taking down the information. Here’s a link to that motion.

Ohio has not yet responded to it with a filing in court — the state’s deadline is Monday. But it was a full day after this motion was filed that the secretary of state, at 6 p.m. on the Friday before the election, issued his contrary directive, the text of which you can read in this timely piece by Judd Legum. The issuance of the directive in turn prompted lawyers for the plaintiffs in the case to go back to U.S. District Judge Algenon Marbley with an even more urgent request, filed late Friday evening:

This new Directive makes an affirmative change to the previous provisional ballot counting standard, beyond what was required to comply with this Court’s and the Sixth Circuit’s recent orders. Instead, contrary to this Court’s October 26, 2012 decision, the Secretary’s representations to this Court on October 24, 2012, and the Constitution, the Secretary is now ordering that county boards of election must reject provisional ballots when the identification information contained in Step 2 of the ballot affirmation form 12-B is incomplete.

The contours of the legal dispute aren’t narrowing, as some legal disputes do at this stage of an election contest, but instead are growing. They are growing because the secretary of state has just doubled down on his position about incomplete provisional ballots. If he was wrong on Thursday, you could say, he was even more wrong on Friday. And that will likely mean a Monday ruling* from Judge Marbley which will then be appealed into Tuesday (and beyond) to the 6th U.S. Circuit Court of Appeals. Folks, the legal fight for Ohio’s votes is already here and here to stay.

A lawyer friend of mine keeps posting the particulars on the political blog, I can't grasp any of it. All I know is the that lawyers are battling tooth and nail every step of the way with this.

Not early votes, provisional ballots. There is a big difference.

That's my hope, that the margin of victory for Obama is such that counting provisional votes is a simple formality. Second-best scenario? That Willard loses enough swing states that Ohio itself becomes a formality.

Look for more vote counts to magically "drop", more ballots declared invalid for suspect reasons, more "technical difficulties" with some of the voting machines. How about a sudden "emergency" that forces some polling places to close early?

Heck, I wouldn't be surprised if some poll workers deliberately mislead voters to try and strengthen support on "their" side.

The nuts and bolts of it boil down to state law demanding that the experienced poll worker fill out the confusing identification form for provisional ballots vs his rule change that makes the voter try to fill out the confusing form from what I read earlier. (someone correct me please if I misinterpreted that.) It's one of those deals where his last minute change will throw just enough confusion into the process that they can game it a bit and get into court easier in Ohio if they think they need to.

Under the law, a poll worker is supposed to take down the voter's ID info, and if there is a mistake it can be corrected then and there. What they republicans are trying to do is make it the voter's responsibility to fill out a form with their ID info, and if there's a mistake, tough shit, your vote doesn't count.

Yes, we need a stinking national voter ID that is free of charge, biometrically sound and allows every single eligble voter to cast a vote if they wish to participate.

Until we have one, we will have no end of these sort of political shenanigans, especially with campaigns tuning into multi-billion dollar circuses, the stakes are jsut too high.

The DoJ is sending lawyers to four places in OH; Cleveland was one. I just read it this morning.

And a woman out west (Oregon I think) was altering ballots, completing them where people had left section incomplete. She is a registered republican.

They've been a joy to read, if only the descriptions, for awhile now. Besides being contrary to the previous court settlement of this issue It also violates Ohio State law.

Ohio Rev. Code § 3505.181(B)(6) provides that, once a voter casting a provisional ballot proffers identification, ‘the appropriate local election official shall record the type of identification provided, the social security number information, the fact that the affirmation was executed, or the fact that the individual declined to execute such an affirmation and include that information with the transmission of the ballot.'

Yep of course. Really as said, their concept of liberty is about other people having the right to deny others liberty whether that's a woman having the right to choose, a gay couple getting married, a Muslim community that wants to set up a mosque, etc. It's repulsive to put it kindly.

The redesign of the dynamic features is eliminating a major bottleneck for the database. Previously, every logged in user's browser was sending an Ajax request every 5 seconds, and every one of those requests was connecting to the database. That's a lot of database connections, over and over, forever.

The redesigned code now has only one script running in a loop on the server, that generates a JSON data file every 5 seconds, and all those logged in users now simply read that data file -- no need to connect to the database at all.

This results in a huge reduction in DB connections; instead of hundreds of connections every 5 seconds, it's now down to one.

This should help a lot in traffic surges, e.g., when Reddit likes one of our posts.

If you dig into the archives and go to an older post, there's no dynamic updating - it all happens once when the page loads.

My hope is that there are so many electoral votes that Ohio by itself won't matter.

See, at this point it is inevitable that this is going into the court system. And because it's of such national import I have little doubt about it at least being presented to the Supreme Court.

Unlike the situation in Florida, this would be a legitimate intervention by that court. However, if "who wins Ohio" does not matter it relieves a lot of pressure both to rush and to follow political positions instead of actual law.

For what it's worth, my personal projection of 303 EVs for Obama would cover this situation. Ohio's 18 votes in contention would take the count down to 285 which is still 15 more than Obama needs. I'd also like to note that this projection assumes Romney will win both North Carolina and Florida. I raise the point because the most recent flurry of polls make both races too close to call. That's a potential 44 more electoral votes to make it immaterial.

But to repeat myself, the court fight over these votes is locked in. The only question is whether or not it matters overall.

"Here is the early vote update from the Board staff in Butler County. Yesterday the wait was one hour at the longest. Today voters lined up at noon for our 1 p.m. opening. The Board staff has been working hard and efficiently to get voters through the process as quickly as possible. The numbers this weekend, 1,525 Saturday, 1,763 on Friday. In 2008 with more hours we voted 4100 voters the last weekend. To date, 17,986 people have voted in person. In the entire 2008 early voting 15.037 total early in person voters. To date we have issued 48,074 early ballots and in 2008 there was a total of 43,452 early voters. We still have Monday in person voting. I'd suggest if you can vote Monday, give it your best shot. Given this turnout and total, I'd say Tuesday will probably be a higher turnout than 2008. If that is the case, those who are waiting until Tuesday need to plan the timing of your vote to try to go on what are normally off peak times."

The problem I see is what is going to happen at the state and local levels. Perhaps that was a wise investment, as we focus on the nationals and ignore the locals. That could fuck us for years.

And provided you look at all the polls, not just the ones RCP lists. Easiest way to see the difference is to see what 538 lists and notice how RCP managed to not list several polls that favor Obama. Even if you excluded the IPSOS online polls RCP should have Obama ahead.

I'm leaving Florida as undecided because there's already way too much going on in the area of voting irregularities, and unlike Ohio, it is still up in the air who is the likely winner there.
Also, North Carolina, even though trending toward Obama, I'm leaving it and Colorado in the Romney column because those two states have an extremely vocal (and influential) religious-right presence, and will probably tip the scales in the end.

Here's mine.

I'm leaving Florida as undecided because there's already way too much going on in the area of voting irregularities, and unlike Ohio, it is still up in the air who is the likely winner there.
Also, North Carolina, even though trending toward Obama, I'm leaving it and Colorado in the Romney column because those two states have an extremely vocal (and influential) religious-right presence, and will probably tip the scales in the end.

In both of these cases Obama would also survive a loss in Iowa.

I'm afraid you're being optimistic. On Wed. morning, even if Obama manages an apparent win, the GOP will be out in force to prevent the key states from certifying the election. Their grounds will be all of the election irregularities, 99% of which were intentionally caused by them for just this reason.

You don't take hundreds of millions of dollars in dark money and just roll over because you've lost a fair election if you're a Republican. These people have been bought, and their owners won't be pleased to get no return on their investment.

I particularly liked that these votes are in a .CSV file because those are oh-so-secure (OH, too).

I figure it has to come from the 'SEAL THE BORDER NOW' crowd. They're more familiar with MS13 than they are with the New Black Panthers. Also: fewer actual black people around to be suspicious of, compared to Latino locals.

I think so. I just got an email that we could vote absentee ballot today as well, til 5pm. So at 440 I tore out of here to get down there. I'd really wanted to vote on Tuesday but the way things are here in FL-la-la land... Anyway, the line was about 50 people or so and some guy told me earlier they'd had upwards of 200+. As we stood in line, from the talk it seemed a very pro-Democratic group.
