Human-Toad Hybrid Dick Morris: “Wake Up White People!”

Toe-sucking human-toad hybrid Dick Morris is still trying to figure out why Romney lost, and he’s finally starting to get a handle on it. Bottom line: “Wake up, white people!”

Now that all the data is in, the fundamental reason for Romney’s defeat is apparent, if largely unreported. It is not just that blacks, Latinos, and single women showed up in record numbers at the polls. It’s that whites didn’t.

The final numbers suggest that 91.6 million votes were cast by whites — seven million less than the 98.6 million that were cast in 2008! Meanwhile, 16.6 million blacks voted — 300,000 more than in 2008; 11 million Latinos voted — 1.7 million more votes than were cast by Hispanics in 2008.

We lost because whites stayed home!

Yeah - it wasn’t that the voters rejected the right wing agenda, it was a simple case of not enough white people! Because everyone knows that all Caucasians are wingnuts, right?

But wait. Maybe it wasn’t the sleeping white people. Maybe it was — Hurricane Sandy! Yeah, that’s it! The hurricane put all the white people to sleep!

Why didn’t whites vote and why didn’t we all spot it sooner?

Impact of Sandy.

There was no good national polling after Sandy struck. Gallup, for example, suspended its polling. At the last minute, it put together a national sample ’ with lots of disclaimers about the dangers of inaccuracies due to the difficulty of sampling storm-hit areas ’ and it showed a slight Romney lead.

Romney was, in fact, leading before Sandy and that his chances blew away in the storm with its famous bipartisan photo of Governor Chris Christie with Obama. And there was no way to measure the impact of Sandy since there could not logistically be any polling. Why was I wrong? I’m a pollster, not a meteorologist!

“Damn it Jim! I’m a Fox News shill, not a real pundit!”

But wait. Maybe it wasn’t the hurricane. Maybe it was — BAIN!

But the real question is why the support for Romney among whites was so shallow that the winds of Sandy blew it away. The answer lies in the fundamental strategic mistake the Romney campaign and the super PACs made in June and July ’ of not answering Obama’s Bain Capital attacks.

These withering attacks undermined Romney’s standing among white voters and led directly to their diminished turnout. The Romney campaign and the Super PACs were so wedded to their attack ads that they failed to realize that Bain posed a mortal threat to the credibility of their candidate.

And so we come full circle, back to “Wake up white people!” Wheels within wheels within endlessly spinning wheels. Dick Morris is clearly plugged in to the Fox News audience — racist and unapologetic, with the IQ of a blue soap dish.

Well this white guy happily voted for Obama and has had enough of pricks like Morris telling us that we should be angry at women, Latinos, Blacks, Asians, etc for voting for Obama in large numbers. This is a representative democracy. If Morris doesn't like how people are voting then he has a problem with our system. Also, the woe to White people crap is the same crap pulled on Catholics and Jews in the first part of last century for daring to think and vote differently than the then White protestant majority. And speaking of floods, earthquakes and locusts, I've been wondering why all the godly types speak of divine retribution (or "messages") in floods and earthquakes (there aren't any locusts left in this part of the globe), but haven't asked themselves what it says about their world-view that God sent Sandy to blow Obama into the White House. If I'm ever standing in front of a camera with one of those types, I'll be sure to ask.

Prop. 8 is granted on the petition question — whether 14th Am. bars Calif. from defining marriage in traditional way. Plus an added question: Whether the backers of Prop.. 8 have standing in the case under Art. III.

then in DOMA (Windsor)

In Windsor, the government petition (12-307) is the one granted. In addition to the petition question — whether Sec. 3 of DOMA violates equal protection under 5th Amendment, there are two other questions: does the fact that government agreed with the 2d CA decision deprive the Court of jurisdiction to hear and decide the case, and whether BLAG (House GOP leaders) has Art. III standing in this case.

IN reading Robert Caro's series of books on LBJ, one thing that stood out was LBJ and other politican's struggle to bring rural Texas into the 20th century. LBJ not only did this for politican gain, but because he saw and lived it first hand. Poverty, ignorance were rampant and exploitation was the result many times.

Now, it looks as if they are working to take it back to pre-LBJ days.

On top of that, Joyner is sure that the implementation of Voter ID laws in Indiana and North Carolina was instrumental in swinging those states away from Obama, who won them in 2008, to Romney this year. Add to that stories about buses full of non-English speaking voters being driving from precinct to precinct to cast votes for Obama coupled with stories of entire precincts not registering a single vote for Romney and it is pretty obvious that the election was fraudulent, which means that President Obama's second term is entirely illegitimate:

This was written before the court decided to hear these two cases (there were ten possible on SSM, but eight of them were all brought under the same legal argument) so it does not just specifically address them.

That's probably the path they'll take if a plurality can't come to an agreement. They'll see whether the parties had standing to bring the suit - wait until a determination is made at the lower court levels, and then watch the cases simmer back up to the SCt at a later date.

If the liberal wing on the Court goes with this approach, it could be because they see that reactions to SSM has moderated and become accepted more and more - the trend is in their favor.

If the conservative wing goes with this approach, it could be to avoid having to make a decision that would restrict rights.

They might both agree to punt this down the road, to a point in time when the political makeup on the Court differs, or when views nationally shift even more towards acceptance of SSM.

The first case - the Prop 8 measure was one where voters may have overriden Constitutional Equal Protection rights of SS couples.

The second of the cases - the one dealing with federal benefits being denied to SS couples would also have Equal Protection as part of the argument.

So, in other words - there would be sufficient constitutional authority to uphold SSM in both measures. The only way to say that they aren't entitled to those rights is to narrowly find that the law or actions by the parties wasn't valid by some other reason (standing to sue for instance). The other possibility is that someone like Scalia or Thomas would claim that there's no right because it's not in the plain language of the Constitution nor is there anything like this that was intended by the Founders (originalism/literalism-based arguments).

I've never heard a legal reason for denying SSM, and personally, I can't even imagine a constitutional reason for denying SSM, especially given the notion of "equal protection under the law" unless the Supreme Court wants to define LGBT's as second-class citizens, enjoying some rights but not others.

I guess we'll all have to wait and see.

Looks like the House Republican leadership is already trying to game which DOMA case should be brought up before the SCOTUS and which justices will be empaneled to hear it:

As same-sex marriage became more common, gay and lesbian couples began to go to court to challenge DOMA, arguing that it was unconstitutional because it deprived married same-sex couples of the federal benefits available to their opposite-sex counterparts. Like the George W. Bush administration before it, the Obama administration initially defended the law against the challenges. However, in February of last year, the Department of Justice notified the courts that it would no longer defend the law. Instead, that role fell to the Bipartisan Legal Advisory Group (BLAG) of the House of Representatives, which for purposes of the DOMA challenges is made up exclusively of Republican House leaders and is represented by former Solicitor General Paul Clement – who also argued against the federal government in the challenges to the Affordable Care Act and S.B. 1070.

Given the high stakes and strong feelings in the DOMA cases, it probably isn’t surprising that the different players in the cases do not agree on which case the Court should take; like Goldilocks’s chair, each side thinks that the Court should grant review in the case that is (at least from its perspective) “just right.” To the extent that facts matter to the Court, the Windsor case is arguably very compelling, and so the federal government has urged the Court to grant its petition in that case, with the Golinski case as an alternative. Instead, BLAG has told the Court, it should grant its petition in one of the First Circuit cases.

Layered on top of the choice of cases is one more complication: the role of Justice Kagan. Based on papers that she submitted during her confirmation process, if the Court were to grant the government or BLAG’s petitions for review of the First Circuit’s decision, she would recuse herself from the case (and the closely related Massachusetts case) because she was involved in an earlier stage when she was the Solicitor General. Significantly, Justice Kagan did not mention any involvement in the Second Circuit case, so she would not recuse herself from those cases if the Court were to grant one of those petitions instead.

Even so, given how closely divided the Court could be on DOMA, as in the health care cases we may still hear a steady drumbeat of calls for her to recuse from all of the DOMA cases because she worked on that “issue” for the Obama administration. But the Justices have never applied such a loose standard for recusal, recognizing that it is important to have a full bench of nine members whenever possible.

In the Windsor case that they agreed to hear a woman who went to Canada to marry her long time partner later inherited her estate. Because of DOMA the woman had to pay $400,000 in estate taxes that she would not have had to pay if the Feds recognized her marriage.

Discrimination under the law? Sure sounds like it.

Looked up what happened to Bani Walid since the siege:

Witnesses said that many civilians are being killed by shelling, while houses were engulfed in flames. Many reports after the fall of the city claimed that pro-government militias used internationally prohibited weapons, white phosphorus bombs and nerve gas. Local people found the missiles militias used contaminated with white phosphorus. Used gas masks which were found on pro-government positions and the hospital reports say that civilians in Bani Walid have been bombed with gas.

This is what uncontrolled vengeance looks like. This is essentially a less total version of what happened to Diriyah about 200 years ago.

The 5 being Thomas, Roberts, Alito, Scalia, and Kennedy.

Kennedy is basically a libertarian. He wrote the opinion that Colorado couldn't amend its Constitution to deny LGBT protection from discrimination. He also wrote the opinion that anti-sodomy laws are unconstitutional. This doesn't necessarily mean that he will find that the government has to allow them to marry, however.

Interesting about Canada. I've gone through the whole inheriting process this year. It didn't to seem to matter in a will what relationships of the parties involved married or not. You all pay the same tax rate..( I think )
It's mostly lawyers doing all the work. For me everything under 100,000 was tax free. And then it goes up 1% progressively from there. so you could end up paying big cash after 100k. I guess that all changes 1-1-13.

They got off fairly lightly at first for backing the wrong side during the revolution, usually people backing the wrong side in these things get dealt with pretty harshly.

But then they had to tempt fate by making more trouble and kidnapping and killing people? I imagine that the forces that retook the town were thinking of teaching them a harsh enough lesson to keep them from making more trouble in the future.

Reality can be pretty harsh at times, especially during civil wars and periods of relative lawlessness.

They got married back when the only option for Gays was to go to Canada for the ceremony. The point here is that under section III of DOMA it wouldn't matter if they were married by a state here or married in Canada, the FED is legally restricted from recognizing SSM for the purposes of taxes or benefits.

Maybe the demographics realized the GOP ideology actually abused and exploited them and that "trickle down" economics where the rich were job creators if they paid less taxes and were deregulated did not not seem to actually work out for them.

Maybe while this white demographics had jobs, even without salary raises to match the growth of the rich or cost of living and they now needed the wives to make a second income to maintain the middle class lifestyle their dad's old one job salary could handle, they never noticed they were getting poorer or thought any day now 'trickle down" will work and the rich will have so much more money they will give us whites awesome jobs or raises as a thank you now that we are taxing them so little - when that did not happen when the economy collapsed under Bush (despite low taxes and regulations), maybe just maybe they realized they were suckered by Reaganomics and they had been worshiping at an altar of a false god by the GOP....

Maybe that is why some of the whites stayed home........

There were probably no 12 tribes. When the mythology was written down they took as inspiration the Babylonian zodiac and created "12 tribes". Same with the 12 disciples and the 12 gods of pantheons, etc.

But the real question is why the support for Romney among whites was so shallow that the winds of Sandy blew it away. The answer lies in the fundamental strategic mistake the Romney campaign and the super PACs made in June and July ’ of not answering Obama’s Bain Capital attacks.

These withering attacks undermined Romney’s standing among white voters and led directly to their diminished turnout. The Romney campaign and the Super PACs were so wedded to their attack ads that they failed to realize that Bain posed a mortal threat to the credibility of their candidate.

I have a hard time figuring how the Court can find any Constitutional basis for denying SSM. There just isn't any reference to anything in the document.

I can only think of mixed-race and polygamy being addressed. I'm not even sure about mixed-race.

Scalia already signaled he would vote against gay marriage under the "originalist" argument. He assumes the founding fathers thought it was icky, so it's icky.

This may be the most succinct and cogent dismantling of "original intent" interpretation that I've seen thus far. Bravo.

Somehow, the founders, being conveniently dead and all, never rise up from their graves to contradict the opinion of the "originalist" interpreter. It's like post-modern lit-crit masquerading as legal thinking.
