Insane New Republican Bill Would Send Women to Jail for Having Abortions After Rape

What the hell is wrong with these people?

Last week we saw a flurry of news articles about Republicans being taught how to talk about rape, because the victim-blaming thing just wasn’t working out as they’d hoped.

Well, they’ve still got a lot of work to do if they plan to hide their sickness; case in point, New Mexico Republican Rep. Cathrynn Brown (yes, a woman), who is introducing a bill that would send women to jail if they get an abortion after being raped.

And the rationale for this insane bill is even worse. The same Republicans who preach about the “sanctity of life” are calling terminating a rape-caused pregnancy “tampering with evidence.”

These people are really not right in the head.

House Bill 206, introduced by state Rep. Cathrynn Brown (R), would charge a rape victim who ended her pregnancy with a third-degree felony for “tampering with evidence.”

“Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime,” the bill says.

Third-degree felonies in New Mexico carry a sentence of up to three years in prison.

Rep. Brown explained further that her only intention — really, honest — is to “protect” women.

Brown said in a statement Thursday that she introduced the bill with the goal of punishing the person who commits incest or rape and then procures or facilitates an abortion to destroy the evidence of the crime.

“New Mexico needs to strengthen its laws to deter sex offenders,” said Brown. “By adding this law in New Mexico, we can help to protect women across our state.”

This nitpick feels important: can the title be changed from ‘will’ to ‘would’? Both New Mexico houses are controlled by the Democratic Party and this bill stands functionally no chance of passage.

According to the Colorado Independent, in the death of a 31-year-old woman carrying twin fetuses, Catholic Health Initiatives’ attorneys argued that in cases of wrongful death, the term “person” only applies to individuals born alive, and not to those who die in utero.

In an interview with music website Noisecreep, “Twisted Sister” frontman Dee Snider said he doesn’t know why most Republicans who seem to love fellow rocker Ted Nugent cannot seem to recall him dodging the draft during the Vietnam war in the most revolting way possible: by pooping and vomiting on himself for a week, and doing hard drugs.

“Ted’s always been a gun-toting conservative,” he said after being asked to opine on Nugent’s claim that he’s prepared to launch an armed revolt against the U.S. government over the reelection of Presidnet Barack Obama. “But what gets me is that he was actually a draft dodger! I mean, to the point where he didn’t bathe for a week, and vomited on himself to deliberately avoid the draft.”

It wasn’t all criticism, though: “I totally understand why he did that,” Snider added, “but all of these Republicans who love Ted don’t seem to know or remember that too well. It’s crazy that he’s become one of the voices of conservative America even though he was a draft dodger. If you don’t believe me, Google it.”

Nugent lashed back at Snider on Twitter, saying he had fallen “for the big lie” and adding: “I challenge u to man up to the truth We xpected btr.”

After Secretary of Defense Leon Panetta’s surprise announcement on Wednesday that women would be free to serve in most or all combat roles by 2016, the Wall Street Journal published an op-ed by former Marine infantryman Ryan Smith. Smith argued that since soldiers had to “defecate inches from his seated comrade’s face” during his tour in Iraq, women could not be permitted in combat because it would “humiliate” men:

Societal norms are a reality, and their maintenance is important to most members of a society. It is humiliating enough to relieve yourself in front of your male comrades; one can only imagine the humiliation of being forced to relieve yourself in front of the opposite sex.

Despite the professionalism of Marines, it would be distracting and potentially traumatizing to be forced to be naked in front of the opposite sex, particularly when your body has been ravaged by lack of hygiene. In the reverse, it would be painful to witness a member of the opposite sex in such an uncomfortable and awkward position. Combat effectiveness is based in large part on unit cohesion. The relationships among members of a unit can be irreparably harmed by forcing them to violate societal norms.

TS, as a band and individually, really walk it like they talk it when it comes to charity. Everything from supporting cops (A.J.) to March of Dimes (Mark & Dee) to Uveitis (Jay Jay) to Sandy Relief (the entire band).

Right after 9/11, they raised $90,000 for the FDNY/NYPD Widows & Orphans Fund.

I really think there could be some backlash against the Republicans here though. I’ve read about some of the songs that have been censored in the past. Read that Clear Channel censored “Walk Like an Egyptian” in the Iraq War and that I think the song is “Killing An Arab” was censored in Gulf War I. Obviously the censors had never read Camus but that just proves Denver’s point about censorship being counterproductive.

Never mind the fact that it would be completely against the Due Process Clause, especially when the victims are not guilty of any crime, but you know there are some RWNJs that would love the idea if it meant that said RWNJs get their way.

UPDATE: 1 pm Rep. Brown just told me that the intent of her bill is not to go after rape and incest victims but to prosecute rapists and incest perpetrators who coerce women into having abortions. She said the current version of the bill is incorrect — apparently a drafting error — and it is in the process of being fixed.

I can’t wait to see how she ‘fixes’ it.

This tampering with evidence bit, falls into what I always felt was fertile ground for this debate. If a fetus is not a person (and I do not ascribe to the belief that it is) than an unwanted pregnancy (in particular in the case of rape but potentially in any instance where the pregnancy is unwanted) is essentially a trespass on the person or property of a woman. Particularly in the case of rape it is essentially something left by the perpetrator of a trespass on one’s property. Moreover, if that is the case, a woman should be able to use almost any means required to remove the perpetrator of the trespass and / or the object of the trespass on the person. Republicans are ok with shooting a human being that unlawfully enters his or her home (even if unarmed - but if there is an apprehension of harm) but does not want to extend that same right to a woman over her own body even when no person would be harmed by her action.

An abortion would in no way destroy the evidence. You could put whatever evidence there is following the abortion into evidence. The Doctor could sign medical report that they in fact did perform the abortion, and if required, DNA tests could be perfomed.
Its like telling a stabbing victim that under no circumstances can the knife be removed from their leg prior to trial as we wouldn’t want to destroy the evidence of the stabbing.
