Arizona Group Seeks to Ban Destruction of Guns Turned in by Owners

Last month’s destruction of hundreds of guns turned in at a [Tucson] city buyback event may be the last.

A gun-rights group is pressing the Legislature to block municipalities from destroying guns voluntarily turned in to police departments.

The Arizona Citizens Defense League requested a change in the law adding guns “surrendered” willfully by the owner to the list of firearms police departments must recirculate back into the market.

Heller said if another “buy-up” occurs, the new language would make it clear the weapons must be sold to a licensed dealer.

“What that does is, it takes them out of the hands of a person who doesn’t want it, and puts it in the legitimate hands of someone who does,” Heller said.

Councilman Steve Kozachik said the bill underscores an inconsistency among folks who would normally champion property rights.

“This bill clearly illustrates that some people don’t view guns like toasters. When it comes to guns, it’s as though they hold some magical or sacred designation in their lives,” Kozachik said. “They go around proclaiming to be for private property, but civil liberties are out the window when it comes to guns. I guess the message is, we can’t do what we want with our property in this state if that property is a firearm.”

The practical impact of the law is unclear. No more gun buybacks are planned, and TPD spokeswoman Sgt. Maria Hawke said the department doesn’t currently tally or track other guns that are voluntarily turned in.

She said they are logged into evidence under the classification of “safekeeping,” which is similar to guns found by officers or citizens and turned in to the evidence section.

Hawke said once those guns are cleared, they are turned over to a local company TPD contracts with where the guns are destroyed. She said she couldn’t reveal the company’s information for security reasons.

Some relevant passages:

A. A state, county, city or town agency shall dispose of all property that was used as evidence and that remains unclaimed in the hands of the agency, after final disposition of the cause in which so used, or that was seized by a peace officer as being used unlawfully or for an unlawful purpose and that was held unclaimed from the date of seizure, or that came into the hands of the agency as unclaimed or contraband. A law enforcement agency may retain and use those items that have a useful value to that law enforcement agency.

Notwithstanding subsection A of this section, if the property is a firearm, the court shall order the firearm to be sold AGENCY SHALL SELL THE FIREARM to any business that is authorized to receive and dispose of the firearm under federal and state law and that shall sell the firearm to the public according to federal and state law, unless the firearm is otherwise prohibited from being sold under federal and state law. A law enforcement agency may trade a firearm that it has retained to a federal firearms licensed business for ammunition, weapons, equipment or other materials to be exclusively used for law enforcement purposes.

This isn’t about individual rights, Heller said, but the role of government.

So….um…. does not compute. People shouldn’t have the option to voluntarily turn in their firearms knowing they’ll be destroyed? It’s not about their individual rights, it’s about government not having the right to destroy firearms because…

I can’t seem to twist my brain around the logic of this. Let me try again: If people are tuning in their firearms knowing they’ll be destroyed, it’s probably safe to assume it’s because they don’t want them and feel good knowing they can’t end up back on the street. But according to this group that is a bad thing and the government should forbid itself the power to destroy those firearms because…? Why? Do the firearms have the right not to be destroyed? Or is it, “Because SHUT UP, that’s why.” I’m at a total loss here…

My guess is that the NRA is going to hate that idea. The whole reason the NRA exists is to enable gun manufacturers to sell more guns. Recycling existing guns undercuts the market.

Caveat-Not defending anything the GOP said here, okay?

Chiming in because we went through this in L.A. 20 years ago. Just policy, not legislation then though.

As was pointed out elsewhere, there will be historic/museum collectible guns from time to time.

As long as the guns are sold only through a dealer, there is no registration loophole to deal with. B/g checks and all. Can be a good little revenue stream for the Police department. There will be good L.E. approved model guns, and young cops will gladly take a good deal to buy their own firearms.

By and large anyone who buys one of these would just buy another gun, maybe a new one. Not much of a net gain really.

Maybe given a revenue stream, more gun buys can happen taking more guns from people that do not want them around, and keeping those people from selling off book. Without the b/g check.

Guns are not hard to destroy. So anyone that wants the surety of it’s destruction can see to it with a simple hacksaw or big mallet. An ordinary welding torch will make short work of any gun. Or the PD can have a checkbox on the tag on the gun-Destroy/Not For Resale.

Okay, let’s look at this a slightly different way.

Someone chooses to sell the rifle to another person. Completely without any kind of coercion - it’s a straight sale for consideration. Inarguably, the purchaser has the right to do whatever they want with the firearm.

If the buyer wanted to take the gun and strip it down for parts, they could do it. If they wanted to bend the barrel all the way around to make a hoop, they could do that too.

But when the buyer is a government? How exactly is that different? No one is forcing the seller to sell to the government in these buybacks. Seller is getting consideration. Buyer just happens to be the seller.

I’m a Tweeting fool this afternoon.

I’m trying to convince someone from TGDN that they’re being taken advantage of by grifters, and they agreed that there are a lot of grifters, but then told me Obama is a Marxist, with no awareness that that’s part of the grift. I still might get through, but won’t be disappointed if I don’t.

If we could cut the less-deranged TGDNers out of the pack, and offer them some grounding in reality, that would be great. I think VB will probably have more success with that than I will.

The reality is that we’d all be shoulder to shoulder with them if the government actually became tyrannical, so we’re not enemies, they don’t need to be afraid, and they’re just very confused.

It is not easy to communicate anything of depth on Twitter.

Swanson: I’m beginning to get some evidence from certain doctors and certain scientists that have done research on women’s wombs after they’ve gone through the surgery, and they’ve compared the wombs of women who were on the birth control pill to those who were not on the birth control pill.
