AP sources: Pentagon extending benefits for gays
The military is poised to extend some benefits to the same-sex partners of service members, U.S. officials said Tuesday, about 16 months after the Pentagon repealed its ban on openly gay service.
Defense Secretary Leon Panetta has not made a final decision on which benefits will be included, the officials said, but the Pentagon is likely to allow same-sex partners to have access to the on-base commissary and other military subsidized stores, as well as some health and welfare programs.
Panetta must walk a fine, legal line. While there has been increased pressure on the Pentagon to extend some benefits to same-sex partners, defense officials must be careful not to violate the 1996 Defense of Marriage Act, or DOMA. The federal law forbids the federal government from recognizing any marriage other than those between a man and a woman.
All the more reason DOMA needs to be tossed.

We are home from St. Louis, it was snowing when we got closer to Chicagloland. The dogs are home from overnight camp. While walking into the doctor’s office this am, I got a call from the nurse where my Mom lives. I couldn’t talk and cut her off. I called back and found they took her to the hospital on a non-emergency basis for an evaluation (she was dizzy and may have lost consciousness).
Everyone I’ve talked to is saying she is very forgetful, which is a new thing. Now I have to figure-out if I have to move her to an assisted living facility or keep going as we are with additional nursing check-ins.

Physicist Lawrence Krauss on teaching creationism: It’s a form of child abuse
Krauss noted that Sen. Marco Rubio (R-FL) recently declined to say how old the Earth was, insisting it was “one of the great mysteries.” Krauss blasted the idea of teaching the Earth was 6,000 years old — as some Christians believe — rather than 4.55 billion years old.
“If you think about that, somehow saying that, well, anything goes, we shouldn’t offend religious beliefs by requiring kids to know – to understand reality; that’s child abuse,” he said. “And if you think about it, teaching kids – or allowing the notion that the earth is 6,000 years old to be promulgated in schools is like teaching kids that the distance across the United States is 17 feet. That’s how big an error it is.”
Krauss added the “purpose of education is not to validate ignorance, but to overcome it.”

It’s probably because I am who I am and spent so much time in the Montessori world that I’ve never met a homeschooler who did it because of religious reasons. Usually because they had a child whom the local school district couldn’t properly education and they couldn’t afford or find a private school that could.
My one friend refused to join a homeschool group because they all seemed to have “rules” of some sort or another she couldn’t agree with. One did have a “I will not say the word Evolution around my children” pledge that had to be signed by both parents. HA!

“A lot of folks are trying to fall back on these, quote-unquote, ‘traditional moral American values,’ by which they’re actually referring to this biblical literalist fundamentalism that has become popular in America over the last 40 years or so,” Wahls said on Democracy Now.
“If I think about what are truly American traditional values, I think there’s probably nothing more American than the idea of ‘live and let live,’” he continued. “It’s really why we founded this country, had the revolution in the first place. And so, when I think about what these folks are trying to talk about, I simply have a hard time believing that this is really what is most important here.”

Pennsylvania Republicans To Introduce New Election-Rigging Plan
…Unlike the plan Priebus backs, the New Republican Plan would not tie electoral votes to congressional districts. Instead, it would award the overwhelming majority of Pennsylvania’s electoral votes proportionally according to the popular vote, with two additional electoral votes going to the winner of the state as a whole.
…
…The problem with the New Republican Plan is that it would only be enacted in blue states such as Pennsylvania — the Democratic candidate for presidential won Pennsylvania in every single election for the past two decades — while red states would continue to award all of their electoral votes to the Republican.

Good points. However, I think an argument could be made that in some cases, it might be better to have an imperfect trial in absentia where at least someone outside the executive branch looks at the evidence, than to proceed with no oversight at all.
That argument can be made, but the judges needed to oversee such a trial are bound by Supreme Court jurisprudence.

Wyden Statement on DOJ Memo on the Killing of Americans During Counterterrorism OperationsSorry, moonbat. Terrorist leaders do not need to be notified before killed overseas while plotting terrorist attacks.
I’ll be taking a closer look at his opponents next election.
There is a difference between sending a terrorist suspect a helpful note saying “We’ve put you on the list, if you use your cell phone you’ll die.” and setting forth the general policies under which people can be put on the kill list.
As indicated upthread, “the bastard had it coming” is an unsatisfactory legal standard.

The Taliban should have let her know they were trying to kill her.

Osama bin Laden should have let us know they were going to attack the WTC.

We’re probably going to have to let perps know this during the next hostage situation.
“You there holding those people hostages. You a right to remain silent. You have a right to an attorney… but we’re also going to shoot you in the head when we get a clear shot.” //
“We are required to inform you that your hat is insufficient to deflect the bullet that’s about to enter your skull. Please update your headgear and inform us when you are sufficiently protected.”

I hope you’re right. But we agreed that anyone posting something that bad would still be downdinged by pretty much everyone who was active on LGF during the time the comment could be downdinged. Heck we’d probably have lurkers logging in just to downding it.

What is required is a serious conversation. “The Bastard Had it Coming” is a strawman. Go ahead and challenge the administration’s memo with the supreme court. The justification is not as simple as you claim.

I don’t make International Lawyer money. Lots of people do. As a general rule, Americans have been sort of shy about Star Chambers.

Of course they are but there’s a little litmus test I learned from Michael Moore propaganda. Ever wonder why Bush wasn’t prosecuted to stealing Florida in 200? It never happened. Ever wonder why the Orwelian Patriot Act was never overturned? Or why the “un Constitutional” healthcare reform bill hasn’t been thrown out? The courts still work, there’s no cabal, no conspiracy. Mostly just overblown claims.

Drone warfare and the extrajudicial killing of Anwar al-Awlaki are two different things. The white paper isn’t about the use of drones in normal combat operations against AQ and Taliban.

Just because I tend to trust the judgment of the administration I just re-elected, doesn’t mean this is an acceptable precedent. Some day the Ashcrofts and Cheneys will be back.

From the DOJ memo, it appears that the three elements needed are 1) a high level US official determines that the target poses an imminent threat, 2) capture is infeasible, and 3) operation conforms to applicable laws of war.
To put it crudely, if a high level US official decides “the bastard had it coming”, the operation can proceed, so I don’t really see a straw man here.
Since there is no apparent non-executive oversight, this is unsatisfactory on its face (see e.g., Star Chamber in England). This cannot reasonably be viewed as being due process of law.

We don’t need to let active citizen-combatants slide, but must develop a process that inspires a high degree of national consensus and confidence.

A high degree of national consensus is currently impossible due to severe political polarization.

We could probably get more than 47%.

Agreed. I think it would be best to get the judiciary involved somehow, despite the difficulties of trial in absentia. It is not helpful for the issue of due process to become a political football, especially with the level of polarization we presently have.
The last thing we need is for paranoids on both extremes of the spectrum to have their ravings about US assassinations and lawless behavior supported in part by real due process/civil liberties concerns.

We should look at a modernized version of the now-unfashionable “Outlawry”. Fugitives were given the opportunity to surrender for defense, before being formally deprived of the protection of the law. It survived in parts of the US into the 19th cent.

That’s an interesting point. The legal history of piracy is also a possible source of inspiration —- many of the issues there were similar, such as pirates being surreptitiously backed by nation-states, being able to disguise themselves as honest shipping, etc.
