GOP Rebranding Watch: NC Republicans Sponsor Bill to Declare Christianity the State Religion

It’s an explicit violation of the First Amendment of the US Constitution, and will certainly be struck down in court if they actually pass this mind-numbingly stupid bill, but nonetheless Republicans in North Carolina are trying to declare Christianity the official state religion.

The word for this is “theocracy.” As usual, Republican priorities are totally screwed up — wasting money on pointless anti-Constitutional legislation that will never stand, and exposing themselves as fanatical religious nutjobs in the process. Pitiful.

RALEIGH, N.C. — A bill filed by Republican lawmakers would allow North Carolina to declare an official religion, in violation of the Establishment Clause of the U.S. Bill of Rights, and seeks to nullify any federal ruling against Christian prayer by public bodies statewide.

The legislation grew out of a dispute between the American Civil Liberties Union and the Rowan County Board of Commissioners. In a federal lawsuit filed last month, the ACLU says the board has opened 97 percent of its meetings since 2007 with explicitly Christian prayers.

Overtly Christian prayers at government meetings are not rare in North Carolina. Since the Republican takeover in 2011, the state Senate chaplain has offered an explicitly Christian invocation virtually every day of session, despite the fact that some senators are not Christian.

Reposting the link to my prior statement/links on the bill, including the direct language of the resolution.

These idiots failed US govt/civics 101. They ignore that the Supremacy Clause governs and that the 14th Amendment Due Process clause apply to the states and localities.

BTW, here’s the most current version of this idiocy from the NC Legislative website.

SECTION 1. The North Carolina General Assembly asserts that the Constitution of the United States of America does not prohibit states or their subsidiaries from making laws respecting an establishment of religion.

SECTION 2. The North Carolina General Assembly does not recognize federal court rulings which prohibit and otherwise regulate the State of North Carolina, its public schools, or any political subdivisions of the State from making laws respecting an establishment of religion.

SECTION 3. This resolution is effective upon ratification.

These folks would like to take the country back more than 100 years to a point in time when the Bill of Rights didn’t apply to states and localities (in other words, a time before the Due Process Clause was used to apply the Bill of Rights to state action and not just against the federal government).

Now, it also seems that the NC legislators also seem to ignore that their own state constitution would prohibit establishment too.

Sec. 13. Religious liberty.
All persons have a natural and inalienable right to worship Almighty God according to the dictates of their own consciences, and no human authority shall, in any case whatever, control or interfere with the rights of conscience.

Attempting to establish a state religion would violate this provision too, since it would interfere with the right of worship or give preferential treatment of one religious group over others.

2011 - North Carolina GOPers Get In On The ‘Sharia Ban’ Game

Republican lawmakers in North Carolina have introduced a bill to ban the use of “foreign law” in courts, joining a growing number of states that are apparently fearful of Sharia law taking hold in the U.S.

The bill doesn’t specifically mention Sharia law:

The General Assembly hereby declares it to be the public policy of this State to protect its citizens from the application of foreign law that would result in the violation of a right of a natural person guaranteed by the North Carolina Constitution or the United States Constitution.

Last I checked, Christianity wasn’t founded in the US, so it would also be a foreign law if applied to a legal system.

Rep. Fleming: UN Treaties May Repeal Second Amendment, Ban Spanking

Family Research Council president Tony Perkins yesterday hosted Rep. John Fleming (R-LA) who immediately started spreading conspiracy theories about the United Nations.

Fleming insisted that the recently approved global UN Arms Trade Treaty, which will restrict the sale of arms to countries and groups that commit war crimes and other atrocities and has been the subject of several discredited right-wing attacks, is an attempt by the left to weaken and ultimately “repeal” the Second Amendment.

States and municipalities have tried this sort of thing to varying degrees before, and have been struck down in court each and every time.

The current precedent that applies to this particular case is Lemon v. Kurtzman, from which comes the “Lemon Test”

The Court’s decision in this case established the “Lemon test”, which details the requirements for legislation concerning religion. It consists of three prongs:

1. The government’s action must have a secular legislative purpose;
2. The government’s action must not have the primary effect of either advancing or inhibiting religion;
3. The government’s action must not result in an “excessive government entanglement” with religion.

If any of these 3 prongs are violated, the government’s action is deemed unconstitutional under the Establishment Clause of the First Amendment to the United States Constitution.

The North Carolina proposal fails on all three criteria.

Whereas, the Constitution of the United States does not grant the federal government and does not grant the federal courts the power to determine what is or is not constitutional; therefore, by virtue of the Tenth Amendment to the Constitution of the United States, the power to determine constitutionality and the proper interpretation and proper application of the Constitution is reserved to the states and to the people; and Whereas, each state in the union is sovereign and may in dependently determine how that state may make laws respecting an establishment of religion; and Whereas, Rowan County, North Carolina, asserts that the protections afforded to citizens of the United States under the First Amendment are not in anyway to be abridged when such citizens become government actors by virtue of their appointment, election, contract, employment, or otherwise engagement; and Whereas, Rowan County, North Carolina, requests and encourages the North Carolina General Assembly to pass a resolution declaring that the State of North Carolina does not recognize the authority of federal judicial opinions arising from the exertion of powers not granted to the federal government by the Constitution of the United States;

This is about as close to outright secession as you can get. This bill claims that federal courts no longer have jurisdiction in North Carolina, and by extension, neither do federal laws. OT: Arg. The wireless rear speakers in my Logitech 5.1 surround system for the Playstation suddenly stopped working while I was playing Bioshock Infinite, and a Google search shows that it’s a known problem with no solution except to tear them apart and replace some capacitors, although some people have done that without success.

Totally out of warranty, of course, and Logitech doesn’t have replacements. I may just get some 7.1 wireless headphones instead of another 5.1 system.

No, they’re hoping that at some point the Courts will side with them and reverse the cases that extended the Bill of Rights and related rights and obligations to the states. They want a return to the case of Barron v. Baltimore, which held that the Bill of Rights applied only to the federal government, not the states.

An 1897 case overruled that earlier decision, and during the 20th century the Court utilized the incorporation doctrine to apply the Bill of Rights to state action.

They’re hoping to reverse this, even though most states have constitutional provisions that mirror the federal constitution and otherwise prohibit the kinds of actions that the GOP is hoping to get away with. But it’s easier to amend a state constitution than the federal one, so they know that if they can get the Supreme Court to rule in their favor, it’s a matter of time before they amend the state law to match their overall goals.

Took apart the PS3 to retrieve the stuck disc and attempted to repair the eject mechanism (again). This time it no longer feeds discs in/makes noise when the eject button is pushed. Looks like we will be moving onto our 4th PS3 (two stolen, one of which came back and is the current one which has already been repaired once by me, and one given away to my sister when the stolen one came back and was working again).

I tried the one hour timed trial of BioInf the other night. I spent most of that time just walking around and looking at stuff. Games like these make me wish I had gotten into game development, even with the rotten rep it has.

The trial ended just as Booker was shown what he had "won" in the raffle. I knew the story was going to be very brutal in dealing with its themes, but Christ, I wasn’t expecting that.

I’m getting the feeling that as the original Bioshock showed what a truly Randian/Objectivist society would be, Infinite might be pretty damning of the Tea Party.

Also, those were airships blowing up the Empire State Building and the Chrysler Building in Booker’s hallucination, right?

Based on the article you linked to, it sounds like Republicans in North Carolina have basically just told the federal government and the supreme court to pound sand.

The resolution goes on to say:

Reddit’s sending us some pretty huge traffic, but the new servers are sailing along with no problem.

We had a few growing pains when we first upgraded these servers, but they’re nicely tuned now.

I would totally send the police to the local GOP rep’s house, every single night, until they got tired of listening to me. Doubly so if I lived near whoever signed the bill into law.

And besides, the cops can’t complain. I have a reasonable suspicion. After all, they’re REPUBLICANS, and we all know that anti-gay, Christian Fundamentalist Republicans have a history of being caught in the act of… er… sodomy.

This country needs job growth and better economic policy and all these morons at the state and federal level can yowl about is state sponsored christianity, trans-vaginal ultrasounds and same-sex marriage. “Rebranding my ass.” GOP get some new ideas for once and dump social conservatism.
