Lest you all forget about Scott Walker, here is an obligatory post:

Scott Walker plan allows rent-to-own contracts that lack key details

Total payment owed could be left blank

Rent-to-own stores could encourage customers to sign contracts lacking key details such as the total payment needed to take ownership of a television and then later fill in these blank spaces in the agreements, under a proposal by Gov. Scott Walker that a key committee will consider Thursday.

The provision is one of several in the Republican governor’s 2013-‘15 budget bill that would weaken consumer protections for those who shop at rent-to-own stores, such as potentially keeping spouses from learning of contracts they were liable for and preventing state regulators from shutting down stores that intentionally violated disclosure laws.

Where were these fine patriots when anti-war groups were being monitored and at times infiltrated? How about those “Free Speech Zones” that were used when liberals showed up to protest damned near anything? I don’t recall a whole lot of talk about that crushing freedom.

Bryan needs to crack an actual history book and read about COINTELPRO before he runs his yap. Like that would happen.

I do have a question though. I’m looking at starting a 501(c)(4) to raise money for a program that helps young adults with developmental disabilities go to college, trade school and learn life skills so they can find jobs. Nowhere in my research so far am I finding anything that says I have to file paperwork in advance with the IRS to start such an organization. I just have to file the right forms and provide accurate financial and other pertinent information when it’s tax time. So why are all these groups filing that paperwork in advance of doing the work they claim to be doing when it’s not even necessary? Were they trying to overwhelm the IRS with requests so they could whine about it when things weren’t moving fast enough? Something seems off with that unless I’m missing something.

I have a 501(c)(3) for my history archive, I had to consult with a tax lawyer to initiate the process.

That’s because those doing the protesting back then were Liberals, the Country was at war and the President at the time was a Republican. Therefore they were all traiters and subversives that had to be silenced for the good of the Nation. Now that the shoe is on the other foot, these True Patriots (tm) feel that they are being supressed and thier Constitutional Rights violated.

SEATTLE — Convenience and speed are reasons businesses often used to encourage early adoption of a technology intended to improve our lives, especially when it comes to paying for goods and services at a cash registers.

But digital pickpockets have found a way to use the same technology to line their pockets with goods and services bought with stolen credit cards. The newest smartphones are making it easy for thieves to steal and use stolen credit cards.

Hazy and muggy in Philadelphia today. Basically waiting for the thunderstorms and a front to roll in. 30% chance this morning with percentage rising through the day. Should cool things off and it will just be rain tomorrow with a cloudy and cool weekend.

Came home from work yesterday and found the one cat using the plastic bag (see yesterday’s Bubble Cat picture) as a sort of greenhouse. She was napping in it while it sat in the late afternoon sun. This ended soon after I got home as L.C. (stands for Loose Cannon) made an ambush attack on the napping cat and started a running play-fight that ran for over ten minutes.

Pub 557 gives a background on what is involved in setting up a IRC 501(c) entity.

For a 501(c)(3), you’d apply using Form 1023
For a 501(c)(4), you’d use Form 1024

For instance, the 501(c)(3) application requires supplying a narrative document detailing past, current, and planned activities by the proposed entity. Compensation for officers, board members, etc., Financial data (such as it may exist or is expected to exist in the given tax year - for a new entity, you’d supply expected data for the tax year).

You might want to consult a tax expert to see if registering as a 501(c)(3) or (4) makes more sense.

Yeah, we’re in that same weather pattern. Storms expected this afternoon, with potential for severe t-storms too. There’s an slight chance at severe storms (including tornadoes) for MD, NJ and Eastern PA and Central NY.

The NWS has issued special weather statements indicating a slight chance for severe storms, including flooding rains.

That will firm up as the morning wears on.

Someone should tell him the same advice that was given regarding Beck’s “convoy”. More efficient to give that stuff to the local shelters and services and send the equivalent funds to the Oklahoma groups — unless the Oklahoma groups have indicated they can use truck shipments of said supplies.

A further comment on supply collecting far from a disaster site.

There is some value to doing this - but it’s less the physical relief value for the disaster victims than a community (local and arguably national since the media will spread the image) value since you have the individuals “doing their part” in contributing even a little bit for the common weal.

A partial historical parallel is the tin and scrap drives down in the UK in 1940. Collecting tin pots and other low-grade metal bits were not really going to be turned into Spitfires. But it allowed the citizenry at large to “do their part” towards helping out the war industries and improve national morale post-Dunkirk towards resisting the expected German invasion.

re: #33 A Mom Anon

All advise given above is valid, but I’ll add a couple of things (since I did some serious research into setting up a tax exempt in Georgia not so long ago.)

tl;dr is get an attorney and an accountant, both with experience in tax exempt organizations, involved in your process. And keep complete, total records of EVERYTHING for the first few years. Even if your two advisors say you don’t need it, keep it anyway just in case. (Laws change, and even experts make mistakes.)

Broad outline: you have to register your corporation with Georgia and inform the Secretary of State you intend it to be a tax exempt organization. You then have to send the right form plus the documentation of your state registration to the IRS. When the IRS sends certification back to you, you will have to send a copy to the Secretary of State (even though they will have received it) AND you’ll have a small set of paperwork that goes to the department of Revenue. (You’ll get that from the Secretary of State in a surprise package.)

Notice that this creates a window during which you (probably) /will be/ tax exempt but aren’t, yet. If your organization counts as “charitable” (not all tax exempts do, but yours looks like it will), then many donations received in that time can be retroactively given tax exempt (charitable donation) status. You really, really need a tax accountant on hand to go through this with you. You’re going to need to send confirmations of receipt of donations, and you’re going to need to list qualifying donors and donations on the 990 (If you don’t qualify for the short form 990).

If you’re requesting donations and you’re going to do it from places other than Georgia you’re going to need to file paperwork with the other states. If you’ve got a ‘donate online’ button on a website the whole thing is mixed and more than I want to go into right here. Basically some states say you have to register, others don’t, and it can wind up costing you a couple thousand dollars to cover nation-wide. Again, talk to the experts.

You can expect to have to send copies of almost everything to some government organization for the first few of years. It won’t officially be an audit, but it might as well be such. The sad thing is that most of this won’t be examined, or if it is it’ll be cursory. Simply a matter of too much to do, too few people to do it. But if you do NOT send it in, it raises flags in the automated software and suddenly you become a priority for those few people. Whether luck of the draw or by flag, if you’re audited they’ll want not just financial but behavioral records to confirm you’re fulfilling the public benefit you claim. Which means those letters you got from people that both the attorney and the accountant said weren’t necessary suddenly become critical and you shouldn’t have thrown them away.

In other words do not throw anything away. File it. Save it. Consider a computerized record management system. (Talk to a pro because there are requirements for such to meet legal standards - “it’s a true copy of the original”.)

And the funny thing is that as long as you’re small all of this turns out to be relatively minimal. It sounds huge, but it isn’t. Just use the experts, keep all the records, and you will have plenty of time to go and do Good Things.

Derp pushback-So I had this conversation yesterday with a guy that runs a company that distributes ammunition to stores, ranges and police departments. We talked about components availability and mfg issues. So I asked him if he knew where government purchases of ammunition stood as compared to civilian purchases. Sorry this is anecdotal, but the truth is that civilian buys of ammo are what is making the temporary shortage happen.

Tell that to the next DHS bought it all derpist. Those guys that are buying up guns are draining the ammo market. Not the gov.

The hysteria over an ammo shortage leads to crowds hoarding ammo which then causes…an ammo shortage.

Absolutely true. The biggest red flags that will drive the tax departments nuts is a lack of records. Keep everything - and keep everything for at the longer of the required periods under state and federal law (eg: the feds require 7 years records to be retained, but the state requires 5, keep for 7).

It’s always interesting what’s actually the most valuable or helpful thing after a disaster. In New York, after Sandy, we got the food settled pretty quickly, without outside supplies. But power was out all over the place, and it was friggin’ cold in some of the buildings, especially the projects. Even more than that, the power out meant no light, so weirdly the thing we suddenly needed tons of was these LCD strips that were supposed to be mounted on your monitor or something, but they could but stuck to the wall or carried around, they were rechargeable battery-powered. So first we distributed those, then we did a lot of bucket rounds to collect spent batteries and recharge them at the generators that were scattered around.

And yet shitloads of food kept being dropped off, even though there were a lot of flyers and PSAs and stuff about food donations not being necessary.

Yeah, I would imagine that batteries can be more useful than food.

If we saw someone using a primus or other open-flame thing, we weren’t allowed or recommended to tell them it was dangerous, but we added a note to have the FD come by and provide them with a fire extinguisher. I think technically it was illegal for them to use them but in the middle of that shit, nobody really cared.

Keep for at least 14 years. In the event peculiarities are discovered an additional period of documentation can be requested both for clarification and to determine if additional peculiarities that are within time limits (think statute of limitations, but not criminal) for action exist. In some (rare) cases this cycle can be repeated to the origin of the organization regardless how long ago that was.

Not necessarily going to run up debt. As a corp in Georgia you need a board that’s more than one person. Some attorneys and accountants are willing to waive fees to be members of boards. Some provide assistance as in-kind charitable donations (grin).

Since you’re in Atlanta, go to the Foundation Center’s field office.

There is some emergency lighting already in the room. However, for looking into nooks and corners and behind equipment the flashlight is a necessity. I was sort of surprised we did not already have one there in a standard location.

More sexual harassment stuff cropping up in the military:

nytimes.com

A sergeant first class on the staff of the United States Military Academy at West Point has been accused of videotaping female cadets without their consent, sometimes when they were undressed in the bathroom or the shower, according to Army officials.

That one is really going to get a lot of heat on the military, because that’s female cadets, college-age girls, the female officer pool.

armytimes.com

The Army announced it has suspended the commander of Fort Jackson, S.C., amid misconduct allegations that include adultery and a physical altercation, according to a spokesman for Training and Doctrine Command.

Does the military prosecute adultery just to avoid having guys who’ve fucked each other’s wives working together, or what? It seems really draconian to me. Of course, this guy also had a physical altercation and unnamed other stuff, so I guess he’s not exactly making the case for it.

Far-right anti-Muslim English Defence League mobs turned out in Woolwich last night clashing with riot police after last night’s sickening Islamist terror attack.

Mosques in Woolwich, Braintree in Essex and Gillingham in Kent were also attacked with bricks while anti-Muslim extremists threw bottles at cops in ugly scenes.

One 43-year-old man is in custody on suspicion of attempted arson after reportedly walking into a mosque with a knife in Braintree, Essex.

Marijuana waste helps turn pot-eating pigs into tasty pork roast

(Reuters) - With Washington state about to embark on a first-of-its-kind legal market for recreational marijuana, the budding ranks of new cannabis growers face a quandary over what to do with the excess stems, roots and leaves from their plants.

Susannah Gross, who owns a five-acre farm north of Seattle, is part of a group experimenting with a solution that seems to make the most of marijuana’s appetite-enhancing properties - turning weed waste into pig food.

Four pigs whose feed was supplemented with potent plant leavings during the last four months of their lives ended up 20 to 30 pounds heavier than the half-dozen other pigs from the same litter when they were all sent to slaughter in March.

“They were eating more, as you can imagine,” Gross said.

Good to see both sides coming together on something important.

At IRS scandal hearing, Democratic Congressman Stephen Lynch says ‘there will be hell to pay’ if special prosecutor is needed to find truth

At the House Oversight and Government Reform Committee meeting on the scandal involving the Internal Revenue Service’s targeting of conservative groups, Democratic U.S. Rep. Stephen Lynch, D-Mass., on Wednesday warned IRS officials to come clean or else.

Lynch, who recently lost the special U.S. Senate race primary in Massachusetts to Democratic Congressman Edward Markey, reacted strongly after Lois Lerner, the IRS official responsible for about 900 employees tasked with reviewing applications for tax-exempt status, invoked her Fifth Amendment right against incriminating herself.

“If this committee is prevented by obstruction or refusal to answer the questions that we need to get to the bottom of this, you will leave us no alternative but to ask for the appointment of a special prosecutor or appointment of special council to get to the bottom of this,” Lynch said as Lerner and former IRS chief Doug Shulman sat silent. “This is a very serious matter. We would like to handle it in this committee. But I watched the last hearing where the IRS had no names and no direction… and basically stonewalled the committee. That can’t continue. I hope that’s not the approach of the IRS going forward because there will be hell to pay if that’s the route we choose to go down.”

On the flip side though, there are some really crazy Army of God style tea party freakazoids around here, those are the people who scare the shit out of me. They don’t care who they hurt to get what they want.

Lemme guess. It has something to do with the fact that the 18 yr old girl is being charged for sexual misconduct re: the 14 year old gf.

I read something about the case, and the charges were likely instigated by the 14 yr old’s parents who didn’t approve of the fact that their daughter was dating another girl (who happened to be of legal age).

The law’s application is correct in this instance, but would there be outrage (by the parent or others) if the 18 yr old was a guy instead of a gal. It’s typically considered statutory rape or sexual misconduct or endangering the welfare of a minor in either instance (as most state law is gender neutral in that regard).

re: #124 Sol Berdinowitz

Congressional hearings are ready made perjury traps for the unwary. The IRS official was already being investigated by the TIGTA, and if there are criminal investigations underway or planned, then her statement of taking the 5th is to avoid that potential situation.

Partisanship has overtaken reality when it comes to the IRS scandal. The TIGTA uncovered problems, and they need to be fixed - but they require more than simply partisan hearings where Issa or others hear themselves yammer away. They need Congress to actually fix the law that they wrote because it’s untenable - and the IRS can’t easily figure out how to divine what constitutes threshold political activities with the staff and guidance it has. Eliminate that from the IRC - make any political activity a disqualifying activity as a 501(c) entity, and push it to another part of the Tax Code (527?). Entities that want to engage in lobbying? 527 - not 501(c).

Want to shield your anonymous donors? You can do that as a 501(c), but if you’re lobbying/political activities? Sorry - out of luck.

That’s what this is really about. All entities should be examined for this kind of conduct. And it extends to religious groups as well. Any that engage in political activities should be disqualified.

Charles Ramsey, who helped free Cleveland kidnap victims, gets burgers for life

Apparently, creating a special hamburger to honor Charles Ramsey was just the beginning.

Now, the hero in the rescue of four kidnap victims held captive on Cleveland’s West Side for roughly 10 years will enjoy free burgers for life.

More than a dozen Northeast Ohio restaurants have pledged an offer of a burger anytime Ramsey wants to stop by and dig in. AMP 150 at the Marriott Cleveland Airport; Washington Place Bistro and Inn in Little Italy; Fahrenheit restaurant in Tremont; Market Garden Brewery, Bier Markt, Bar Cento and Nano Brew in Ohio City; Welshfield Inn in Troy Township; Hodges and Pura Vida in downtown Cleveland; 87 West at Crocker Park in Westlake; Orchard House restaurant in Brunswick; Flour restaurant in Moreland Hills, and the Allegheny Grille in Foxburg, Pennsylvania, have joined in the offer.

The burger tribute was inspired by Ramsey, who stopped eating his meal of a Big Mac to intervene and aid the escape of Amanda Berry and her daughter, along with Gina DeJesus and Michelle Knight.

What seems to be true is that two IRS agents in Cincinnati used ‘Tea party’ and ‘patriots’ as keywords in targeting groups for investigation. To me, given the huge amount of scammery associated with the Tea Parties and Patriot groups, this seems a reasonable approach. I think that charities with ‘green’ or ‘sustainable’ in their names should likewise get a good look over.

It doesn’t appear that there were a flood of adverse decisions, so it looks like they need to either get better at building cases or figuring out where to look, but I don’t get why it’s outrageous to assert that there’s lots of people out there scamming Tea Partiers.

Do you want people who believe in something sincerely giving their money to scammers?

If it get proven that they targeted certain groups, that is against the law. Isn’t that what these hearings have been about, trying to determine how that happened and who is responsible?

No it is not.
It is not against the law. It’s against regulation but not the law.
It is not the purpose of these hearings. The IG was responsible for determining what happened and who is responsible, and did so. If you read the report you discover that various names and other identifiers are redacted. No, the purpose of these hearings appears to be an attempt to find reason to impeach the president. I say this given there have been repetitive questions from the chair of the committee (Issa) as to the involvement of the president - what he knew, when he knew it, and what instructions he may have passed down.

Could that targeting be of groups that do not want to pay the IRS, feel that taxes are bad, and have made public their desire to not pay taxes?

I don’t think that is targeting as much as making smart decisions.

Also, from what I read, they did audits of liberal groups, too. All the conservative groups got their 503 statuses where the liberal ones did not.

re: #134 NJDhockeyfan

Read the TIGTA report instead of people who are trying to spin the reporting on it. It highlights what happened with the TP (who were 1/3 of the groups targeted for further scrutiny - and how they were identified was incorrect - but not the fact that they were targeted for scrutiny). The IRS is within its rights under the law to examine applications for completeness and whether they are engaging in political activities. The question becomes one of whether the types of questions asked were inproper.

But that the IRS needs to be asking these questions at all needs to be fixed by Congress - not some witch hunt against the IRS.

It does not help that nobody likes the IRS, even people who understand that there is no “taxation without representation” in a democratic society.

But to the frothing Tea Partiers, the IRS is the hydra head of a monstrous beast called Big Government, and they see themselves as heroes and patriots trying to slay it to free America from its ravenous claws.

There are those who want to hold hearings simply to get to the bottom of the scandal and prevent it from happening again, but their voices are being drowned out by the people who want the IRS disbanded and Obama impeached.

Lynch’s attacks on the IRS should be taken with a grain of salt. It’s worth remembering that during the 1980s he was a tax delinquent, and that was a black mark when he ran for office the first couple of times.

So it’s personal with Lynch? Really?

There is strong evidence to support it, despite your sarcasm.

I’ll note that Issa knew of this issue back in August of 2012. (see link). But he’s strongly attacked the president over the issue (link) with frequent statements of belief Obama knew of the problem much, much earlier (see previous link). This is the same Issa who is pushing Benghazi, and apparently is gearing up to investigate the NSL/AP phone record issue as well. All frequently naming Obama as, well, to paraphrase him and several of his peers “he’s either Nixon or Harding. Either way he doesn’t belong in the White House and we intend to prove it.”

A bunch of states refused to provide details, including CT and NJ so those in the NYC metro area aren’t completely in the clear.

The problem is that ammonium nitrate is hardly the only kind of chemical hazard out there. It might produce serious explosions under certain conditions, but there are others that could have similarly devastating consequences. Take chemical or petroleum refineries. Some states do a better job of policing these facilities than others.

I was working there at around the time that a bunch of people died in India from a Union Carbide chemical dump. I asked if any of that same shit was being stored at the facility where we worked. They said it was. I asked what was the disaster plan, they laughed and said put your head between your knees and kiss your ass goodbye.

Someone should tell him the same advice that was given regarding Beck’s “convoy”. More efficient to give that stuff to the local shelters and services and send the equivalent funds to the Oklahoma groups — unless the Oklahoma groups have indicated they can use truck shipments of said supplies.

It’s a nice visual, but it’s not as effective for the actual victims.

Like Mr. Beck cares about effectiveness, He only cares about the visuals, ones that make him look good and everybody else look bad.

The IRS is getting what they deserve. I have no sympathy for them.

The matter of certain groups seeking tax exemption status which they ultimately received is a matter of national security and therefore enhanced interrogative techniques or whatever are justified as are any other means for finding out why these groups ultimately received the tax exempt status they sought.

Nowhere near enough. He could have 30 more years in him. That said, I think TX is eventually going to go from light purple to dark blue because too many people find them extreme. As Rick Perry, like George Bush before him, reduces tax burdens to a virtual zero, companies will go to TX bringing all their bright blue employees with them.

It’s all in the froth. Your froth has to have a nice, solid body to it, not just be hot and bubbly. It’s like whipping cream. Once you whip it to the correct consistency, It will maintain that consistency. If you don’t whip it enough, it disintegrates. If you continue whipping it after it is at prime consistency, it turns to butter.
