The Maricopa County Sheriff’s Office has engaged in racial profiling and must not use Hispanic ancestry as a factor when making law-enforcement decisions, a federal judge has ruled.

U.S. District Judge Murray Snow issued the ruling Friday, more than eight months after a seven-day trial on the subject concluded. The trial examined longstanding allegations that Sheriff Joe Arpaio’s emphasis on immigration enforcement led deputies to target Latino drivers based on their race, and that by doing so, they violated the constitutional rights of Maricopa County residents and the sheriff’s own policies requiring constitutional policing.

“The evidence introduced at trial establishes that, in the past, the MCSO has aggressively protected its right to engage in immigration and immigration–related enforcement operations even when it had no accurate legal basis for doing so,” Show [sic] said.

Snow was the sole arbiter of facts in the bench trial conducted without a jury. He was tasked with weighing the plaintiffs’ arguments that the Sheriff’s Office developed an immigration enforcement policy that encouraged deputies to discriminate against Latino drivers, depriving them of their Fourteenth Amendment rights to equal protection. A ruling from Snow late last year expanded the plaintiffs in the 41/2-year-old case to cover a class that includes every Latino driver the Sheriff’s Office has stopped since 2007. The plaintiffs were represented by the American Civil Liberties Union and pro-bono attorneys from a Bay Area law firm, and were faced with the burden of proof in the case.

I love the final two paragraphs of the linked article:

Attorneys for the plaintiffs took a three-pronged approach, using Arpaio’s own statements about undocumented immigrants along with racially insensitive requests from constituents for immigration enforcement to show the sheriff’s callous attitude toward the rights of Latinos and his the agency’s intention to discriminate. Data showing that Latino drivers were more likely to be stopped during the sheriff’s immigration sweeps, and that those stops were likely to last longer, was designed to show the outcome of that intent. And statements from residents who claimed they were victims of profiling was intended to illustrate the impact of the sheriff’s policies.

Arpaio’s attorneys used their allotted time taking apart the statistical data and relying heavily on the testimony of sheriff’s deputies, commanders and administrators who testified repeatedly that the agency does not tolerate racial profiling, despite the lack of a policy expressly prohibiting the practice.

The plaintiffs provided evidence, and the defense provided nothing but art criticism and denials.

Arpaio is the very model of a modern major wingnut. If he were a little younger, he could be a contender for the GOP nomination in 2016.

Heh. You know, I’ve never seen the movie “Liquid Sky”, though I’ve heard of it - one of the great cult classic films and one of the last of the midnight movies.

Much to my surprise, I found it today at a DVD kiosk near the supermarket I normally shop at for the equivalent of $1.00; guess I’ll have to watch it and see what all the fuss is about.

From what I’ve heard, it is indeed a deeply weird film, but on the other hand, quite influential in regard to the indie cinema that followed it. Growing up in the 80s as I did, by the time I began my evolution into a movie buff - 1985 - it was certainly be talked about by the kids who were into non-mainstream film/music/literature. For some reason, I just never got around to actually seeing it myself.

I did recently see “Once Upon A Time In Anatolia”, and holy crap, that was brilliant. An outstanding character-driven film with epic cinematography.

To photograph mankind and explain man to man — that was how legendary photographer Wayne Miller described his decades-long drive to document the myriad subjects gracing his work. Miller passed away Wednesday at the age of 94 at his home in California.

Miller began pursuing photography while attending college at the University of Illinois, Urbana, shooting for the school’s yearbook. Following a two-year stint at the Art Center School of Los Angeles, Miller started working as a photographer for the U.S. Navy, serving in the Pacific Theater under Edward Steichen’s Naval Aviation Unit.

“We had Navy orders that allowed us to go any place we wanted to go and, when we got done, to go home,” Miller said in an interview with the American Society of Media Photographers. “It was fantastic.”

Miller’s reportage-style images of life and death aboard U.S. aircraft carriers provide a visual narrative for a field of battle largely unknown to the American public. Miller’s war-time photographs illustrate the tension and tragedy of bloodshed and destruction underneath the beautiful skies and billowing white clouds of the South Pacific.

And after Japan capitulated in September 1945, Miller was one of the first photographers to enter Hiroshima, documenting the unimaginable effects of the 20-kilton atomic bomb detonated over the city the previous month. Miller photographed victims suffering from acute radiation poisoning and severe shock in the ruins of a city reduced to rubble in one great flash.

It boggles the mind: Arizona is Tea Party central. Tea Partiers are presumably against government waste. You have a single elected official that has cost the county millions upon millions while not impacting the crime rate in any meaningful way. His strong arm tactics are legion (far worse than their fevered minds could ever project on Obama). Yet, he barely has to campaign. Maddening.

Don’t know about the kumquats - only a few in the area have them (but they appear to be doing well.)

The loquats, on the other hand, have had a hard spring. Cold winter, too few bees at flowering, followed by a dry spring with a couple of record hot days, has led to many trees having smaller than usual fruit.

The first harvest was over a month behind last year’s calendar. And the season has been short (due to the record hot days.) So this week I’ve been engorging myself on loquats as many are now past peak and will be gone soon.

I have fattened myself with loquats.

Tasty as always, still one of the highlights of spring around here.

Sheriff Joe ran on Law and Order, and his party ran on Low Taxes. This approach looks good at first, but it is the same short-term, bottom-line approach that leads to higher costs down the line…like saving money on bridge repairs.

The other day I linked to the latest school board creationism controversy, this one back in Ohio (again). The Fox News website jumped on the story tonight, after the school board met:

They craft their story from sources including crediting the AP.

Fox News makes sure to mention the ACLU no less than 5 times in the short article.

It’s just a way for them to find an enemy, rather than just admitting this is a cut and dry case on an issue that has long been settled.

For example, the Payson, Arizona local news paper (now all electronic, I think) has a never ending run of editorials and letters on evolution.

So does the Baton Rouge, LA local outlet - The Advocate, but with more local creationists. Here’s the latest entry:

People hold their religious views because of deep seated emotional needs. To give these up is usually too much to ask, and when people do change it can lead to an identity crisis.

It’s a long, hard slog to fight the old worldviews, no matter how outdated they are.

Well, it took an astounding 5,335,200 bricks to create, but the guys and gals over at Lego managed to build a 1:1 scale model of the Star Wars X-Wing Fighter.

They used a common $60 Lego 9493 X-Wing Fighter as a model, but instead of being 560-pieces and a few inches long, this sucker has more than 5-million pieces and it’s 11-feet tall and 43-feet long … not to mention its 44-foot wingspan! I found migrating to Linux fixed all of those problems. And while I like Ubuntu, I’d really like to reformat this old Dell and put Suse on it as Ubuntu is prone to updates as well. But I don’t worry about AV crap anymore…and I store enough of my shit on the cloud that I can wipe a machine at any time and I don’t lose much at all except for the time it takes.

About to head out to get a 25lb bag of sand to use with the plant pots. Need to put a 1/4” layer of sand on top to suppress the fungus gnats. The bagged potting soil I buy is just too rich in organics, unless I cut it heavily with sand and/or totally cover it I get these outbreaks of gnats.

Though the cats do enjoy hunting them.

I don’t really wax nostalgic for those days too much. When all the search engines were equally bad, it was tough to actually find relevant results. Although, at least then it took real research skills to find what you needed.

In an anecdotal sense, it could apply: think of all the skills one needed to simply survive back then that have atrophied in our modern society.

And the creteria for an “educated” person were much higher: you were expected to master a classacal language, a modern foreign language, rhetoric, reciting poetry and prose, drawing and sletching skills, etc…

All you need today is two years of high school Spanish and the ability to type with ten fingers.

I have some music I bought the right to publish and use commercially. I also have of course the music I own only the right to listen to. Then I have some original work from a friend or two.

When we installed Itunes (not 11 whatever it was about two years ago) it basically locked me out of it all apart from listening. I had to go back through and screw around far too much to get full access to the music I own fully.

I tunes is no longer on my main tower. Just the wife’s Ipad.

One year I got a shuffle for a birthday present but I wasn’t able to use it because it locked out everything before OS 10.5 or something (their own computers, basically). This was before the app store and a good connection, so it was just easier to sell the iPod.

This “study” involves believing that they can replicate a response time test done in the 19th century perfectly, that the results are equivalent to an IQ test, that the sampling for the 19th century test was good and that the measurements were accurate. :/

Even that much sounds like bullshit.

But but but, we have a direct measure of the direction of what IQ test measure, ie IQ tests.

IQ tests are periodically normalized against a median score, so you can just measure the drift of raw scores, which I’ve been told shows that the average intelligence has been rising wildly for a long time.

I’ll google that some other time.

IQ tests do not remain fixed forever. Most of the major ones have been updated from time to time. The 1949 WISC, for example, was superseded by the WISC-R in 1974 and by the WISC-III in 1991. The revised versions are standardized on new samples and scored with respect to those samples alone, so the only way to compare the difficulty of two versions of a test is to conduct a separate study in which the same subjects take both versions. Many such studies have been carried out, and James Flynn, a political scientist at the University of Otago in New Zealand, summarized their results in 1984. In virtually every instance, the subjects achieved higher scores on the older version of a test. For example, in David Wechsler’s own study of his revised adult test—the Wechsler Adult Intelligence Scale-Revised (WAIS-R)—a group of subjects who averaged 103.8 on the new WAIS-R had a mean of 111.3 on the older WAIS. This implies that the actual IQ-test performance of adults rose by 7.5 points between 1953 (when the old WAIS was standardized) and 1978 (when the WAIS-R was standardized), which is a rate of about 0.3 IQ points per year.

These gains are not limited to the WAIS, to adults or to the United States. In an influential series of papers, Flynn showed that the increasing raw scores appear on every major test, in every age range and in every modern industrialized country. (The rise itself is now often called “the Flynn effect.”) The increase has been continuous and roughly linear from the earliest days of testing to the present. On broad-spectrum tests such as the WISC and the WAIS, Americans have gained about 3 IQ points per decade, or 15 points over a 50-year period. It is interesting to compare this total with the much-discussed gap between the mean test scores of Caucasian and African Americans, which is also about 15 points (one standard deviation of the IQ distribution). Given that the IQ of the population as a whole has increased by a similar amount just since the 1940s, that gap does not seem so large.

The pattern of score increases for different types of tests is somewhat surprising. Because children attend school longer now and have become much more familiar with the testing of school-related material, one might expect the greatest gains to occur on such content-related tests as vocabulary, arithmetic or general information. Just the opposite is the case: “Crystallized” abilities such as these have experienced relatively small gains and even occasional declines over the years. The largest Flynn effects appear instead on highly g-loaded tests such as Raven’s Progressive Matrices. This test is very popular in Europe; the Dutch data mentioned earlier came from a 40-item version of Raven’s test. Using the 1952 mean to define a base of 100, Flynn has calculated average Dutch Raven IQs for subsequent years. The mean in 1982 was 121.10—a gain of 21 points in only 30 years, or about seven points per decade. Data from a dozen other countries show similar trends, which seem to be continuing into the 1990s. Whatever g may be, scores on tests that measure it best are going up at twice the rate of broad-spectrum tests like the WISC and WAIS, while the tests most closely linked to school content show the smallest gains of all.

“We should all have guns, lots of them,” opined stylist Traciena Johannsen as she painted highlights on the hair of a client who spoke up from beneath the tent of foil on her head to say she has two guns. In fact, she shot a wild turkey with one of them last week.

Guns have put Nucla in the national Second Amendment spotlight since the Nucla Town Board on May 8 passed the first — and only — municipal ordinance in Colorado requiring heads of households to have guns, and ammunition, “in order to provide for and protect the safety, security and general welfare of the town and its inhabitants.”

So why did the Nucla town board feel the need to pass an ordinance mandating guns for every household except those headed by felons, the mentally disabled, “paupers,” or those whose religion or other beliefs don’t line up with gun owning?

A generally obsolete term used to describe poor people. It’s basically saying that the law isn’t going to mandate a gun purchase by someone who can’t afford it financially. This is inserted to keep the law from being overturned.

Yeah, I know I’m being a pendant, but the Night of the Long Knives isn’t the comparison you’re looking for. I just got through the section of Evans’ Third Reich Trilogy that dealt with the Röhm-Putsch. That event wasn’t about separating the ideological wheat from the crazy-ass chaff, but about reigning in the unruly elements that might have made NSDAP look bad or challenge the centrality of Hitler’s cult of personality in Nazi ideology. The intellectual distance between the SA and the rest of NSDAP was hair’s-breadth fine: authoritarian evil just trimmed the let aesthetic aspects of their authoritarian evil.

Note: If I’m being a pedant it’s not out of anger at you or internet rage, it’s because I find that the story of the Nazis, rise to fall, has become so mythologized and bowdlerized that invoking them is pretty much meaningless. It’s a sensitive subject, a powerful subject, and thus a great deal of precision is required when invoking it.
