The freaking rule change happened under George W. Bush’s watch:

Based on a 2000 ruling by the US Department of Health and Human Services, which mandated that organ allocation policies must be based on medical necessity rather than waiting time, OPTN implemented a new allocation system based on the severity of a patient’s illness (the Lung Allocation Score, or LAS), rather than the amount of time served on the wait list in 2005. This reduced the number of deaths among patients awaiting lung transplant, ensured lungs were allocated to those with less stable diagnoses, and dramatically reduced the average wait time from over two years, and reduced the wait list by half. This new approach only applied to patients over the age of 12.

It’s a change that helped reduce both the waiting time and the number of people on the wait list. Significantly. It was a huge improvement, but it didn’t come easy. I recall lots of people were opposed to the change, thinking it would make things worse.

It didn’t.

Now, could this system have room for more improvement? Possibly. The medical community would have to look at whether expanding the policy of 12+ to all others, and whether that makes sense medically.

Also, as Kragar’s article points out, the family has petitioned for an exception that is allowed under the rules. They may still get that opportunity, and it’s all within the rules.

The family seems cognizant of the fact that if they get a lung transplant that someone else might not - something that all the RWNJs ignore.

And as I keep repeating - the reason we have the lists in the first place is because there is far more demand for transplant organs than there are those who are willing to donate. The rules are meant not to be arbitrary, but to fairly allocate this limited resource in a manner that maximizes the donations.

The Lung Allocation Score falls under the guidance of United Network for Organ Sharing (UNOS). The CEO is Brian M. Shepard who worked for the Virginia governor. Umm…

Shepard is currently UNOS’ Acting Chief Executive Officer

Prior to serving as Acting Chief Executive Officer, Shepard served as Chief Operating Officer. In this role, Shepard managed UNOS operations conducted in support of the OPTN contract, including policy development, member evaluation and peer review, communications and information technology tasks.

Shepard joined UNOS in 2010 as Director of Policy after serving 15 years in various high-level positions in Virginia state government, including the Director of Policy for the governor of the Commonwealth of Virginia. In that position, Shepard worked directly with the governor to help identify and implement the policy priorities of the Commonwealth.

Shepard holds a bachelor’s degree in history from Virginia Polytechnic Institute and State University in Blacksburg.

Larry Niven wrote a number of stories around this. It starts out with harvesting organs from executed murderers, but as the demand for organs grows, the crimes for which one can be condemned become less and less severe. AND of course a black market springs up, snatching healthy people and parting them out.

Scarcity that would drive up the costs even higher, cause even more people to die, and limit transplants only to the wealthy. What could possibly go wrong. ////

Oh yeah, it would create de facto death panels - anyone waiting for an organ who isn’t wealthy is SOL, quite possibly including this poor family.

It would also mean that organs that were harvested might go to waste because the person who bought isn’t geographically able to use them. The UNOS system rationalizes transplants by region, maximizing the chances that an organ donated is transplanted - because organs must be transplanted within a period of time before they are rendered unusable.
