For this reason, lung allocation policy differs for these groups of candidates and is designed to suit their unique needs. Children younger than age 12 have priority for all donors of similar age and size within a 1,000-mile radius before any older candidates would be considered. In some circumstances, a transplant center may determine that a child’s condition warrants a reduced size transplant from an adult donor. If the center wishes to consider this additional treatment option, these children will have access to adult organs once they are offered to adolescents and adults in the same allocation zone.

In 2012, there were 460 pediatric organ donors in the United States, including 114 between the ages of 6 and 10 years. Although there were only 11 lung donors in that age group, that number likely reflects low demand (two lung transplants in recipients aged 6-10) as much as organ availability.

OPTN policies allow status adjustments for specifically defined groups of candidates with unique medical circumstances not addressed by the overall policy. A request to adjust the status of a patient under age 12 so that they may be included in the allocation sequence for adolescents and adults is not within the scope of the existing lung allocation policy.

OPTN cannot create a policy exemption on behalf of an individual patient, since giving an advantage to one patient may unduly disadvantage others. However, the network routinely reviews organ allocation policy to be sure that it reflects the needs of all groups of candidates. In this review process, the OPTN considers public input as well as medical data and experience.

While the availability of organs remains limited, the OPTN is committed to developing and improving policies that give all groups of candidates the best possible opportunity for life-saving transplantation.

Lungs, like most human organs, are not simply plug-and-play. You can’t rip the heart from a small-framed office workers and expect it will be adequate for a large-framed construction worker. Even before you get into the size issue, you have to deal with blood type, tissue matching, if the recipient is healthy enough to receive the new organs, and so forth. And even if all that works for them, they still are facing a life of being on a constant supply of pharmaceuticals to keep their body from destroying their new organs because they view them as foreign invaders. The price of which is that their immune system is less able to fight off everyday infections and more dangerous bastards are pretty much a death sentence.

Before NOTA was put in place, there was no clear jurisdiction on what property rights were for a human corpse. Instead, America applied a “quasi-right” to a corpse. This meant that the relatives of a deceased person had a possessory right long enough to decide how to bury or dispose of the corpse. This does not mean a property right which means they do not have a right to transfer, devise, possess, and lease the human organs and tissues.[2]

Due to a shortage in organs but a growing demand for transplantations, people began to use other means to purchase organs outside of a hospital setting. The organ market began to become a commercial market. H. Barry Jacobs, the head of a Virginia company, announced in 1983 a new plan to buy and sell human organs on the market. This plan put healthy, human kidneys in the price range of up to $10,000 plus a $20,000 to $50,000 commission fee for Jacobs.[3] This brought the issue out into the open. NOTA was a response to this proposal making it criminal to transfer human organs for valuable consideration for the purposes of a human transplantation.[4]

At the time NOTA was passed, there was an 80% survival rate for kidney transplants. A new drug, cyclo-sporin that had been introduced had also increased the survival rate of liver transplant patients from 35% to 70% in a patients first year of undergoing a liver transplant. This made it clear that the legislation was aware of a growing need and also growing shortage of organs when NOTA was passed.[5]

Cuccinnelli Suggests IRS Targeting Virginia, Too

Virginia Attorney General Ken Cuccinelli (R) on Wednesday accused the Internal Revenue Service of deliberately holding up $125 million owed to his state.

“For a long time we thought it was glaring incompetence,” Cuccinelli, who is running for governor, told The Richmond Times-Dispatch. “But in light of the last month or two, we’re now beginning to wonder whether maybe there are more deliberate motives.”

The “last month or two” refers to the ongoing IRS scandal, in which the agency was found to have inappropriately screened and handled applications for tax-exempt status from conservative groups.

The money is Virginia’s claimed portion of a $1.5 billion Medicaid fraud settlement the government reached with Abbott Laboratories in May 2012. According to Cuccinelli’s office, Virginia’s Medicaid Fraud Control Unit performed at least 80 percent of the investigative work, earning the $125 million share of the nearly $200 million asset forfeiture in the case. But federal officials have said, according to Cuccinelli’s office, that the IRS has refused to properly fill out post-case paperwork, holding up the payment. (In August 2012, federal officials told Cuccinelli his state would receive $95 million, not $125 million.)

“I have to openly wonder whether this is an intentional act to deny Virginia its asset forfeiture money,” Cuccinelli said.

My sister works for AMC and was told a couple weeks back by her manager that the head office has sent down directives that no employees can work over 30 hours a week. To which I first assumed she had to be joking, since she regularly does over 30 hours in any given week because this place has a higher-than-average turnover rate. Then when told how they intend to cover the big blanks in their schedules, namely by hiring a bunch of new people, I alternated between laughing and just shaking my head.

When she told me about this new rule, she also said she was going to be limited to 27 hours a week. But she’s also been there for close to 5 years and cross-trained in every position with plenty of experience in them. Last week, she was clocked in at over 30 hours because of needing to cover other people’s shifts.

Suicides fill me with an irrational sense of rage for some reason. I understand they are a cry for help and serious emotional issues are involved, but they still enrage me and I have to force myself to stay objective about them.

Word came out yesterday that Scott Rigell, whose district I fall into, came out publicly saying he would not endorse Jackson for Lt. Gov. due to his homophobic BS. And while Rigell draws the line at civil unions and remains opposed to gay marriage, I feel I can respect him for that after this announcement.

I would run that as a billboard in major cities all over the USA; I’d also run it as advertising on TV and radio.

Also this company has 4 locations in metro Atlanta with around 300 employees. If they’re doing this across the board to get out of providing healthcare then they’re going to tank in a big way. You know it’s funny they hate her because I actually first remember hearing about her when my Republican Congressman Frank Wolf whom I mentioned above spoke at my high school back in 2005. He recommended her book A Problem From Hell, Wolf’s always been big on genocide prevention which is why I sort of respect him though he’s your usual Republican on most other issues so he doesn’t get my vote. Of course, Chuck Hagel was then a Republican senator too and not a “Friend of Hamas.”

My sister works for AMC and was told a couple weeks back by her manager that the head office has sent down directives that no employees can work over 30 hours a week. To which I first assumed she had to be joking, since she regularly does over 30 hours in any given week because this place has a higher-than-average turnover rate. Then when told how they intend to cover the big blanks in their schedules, namely by hiring a bunch of new people, I alternated between laughing and just shaking my head.

When she told me about this new rule, she also said she was going to be limited to 27 hours a week. But she’s also been there for close to 5 years and cross-trained in every position with plenty of experience in them. Last week, she was clocked in at over 30 hours because of needing to cover other people’s shifts.

When you’re working in that sort of low-end retail/service industry, this sort of thing is the norm, and has been since WELL before the ACA. It was that way when I worked grocery in the early 2000s; nobody works over the legal/company policy definition of full time, hire more kids to fill in the gaps by working sub-four-hour shifts. It is done, and has always been done, to keep more money in the higher-ups’ pockets by paying more hours of minimum wage instead of paying actual benefits like healthcare and retirement co-pays and decent PTO.

The ACA didn’t bring about any of these practices. It just provided an excuse for scumbags to ‘justify’ them with.

Yeah he was. Davis was a boomer Republican and pretty sane. The nutjobs hated him because he didn’t always toe the line on so-con purity issues. It’s why he opted not to run for Senate because he knew he’d be toast in a GOP primary despite having been very successful in a Democratic district.

I worked in retail for 25 yrs, with a small stint as a daycare teacher in there. When I first started we had great benefits and insurance. Around 1988 or so that changed dramatically and it became the norm to work someone right up to the almost literal minute til they had 40 hours to avoid having to do anything worth a damn for the employees.
