Once again, we see a naïve, deluded young person paying the price for the insane nihilistic libertarianism promoted by Julian Assange and Glenn Greenwald: Judge Sentences Bradley Manning to 35 Years.

A military judge on Wednesday morning sentenced Army Pfc. Bradley Manning to 35 years in prison for leaking hundreds of thousands of classified documents to the anti-secrecy group WikiLeaks.

Manning, 25, was convicted last month of multiple charges, including violations of the Espionage Act for copying and disseminating the documents while serving as an intelligence analyst at a forward operating base in Iraq. He faced up to 90 years in prison.

Manning is required to serve one-third of the sentence, minus three and half years of time served, before he is eligible for parole. That will be in eight years when he is 33.

Since he could have been sentenced to 60 years, he actually got off remarkably easy considering the gravity of his crimes. But Glenn Greenwald, of course, is raging. His most ridiculous tweet so far:

This just in, the NRA has a far more extensive and expansive database of gun owners than anything the government ever contemplated. It spends countless amounts of time and money maintaining and upgrading the database of owners to not only solicit more donations.

How did the NRA, a private entity that has no real oversight and can do pretty much anything it wants with the data, get its hands on this information?

A whole lot was publicly available. Some of it was achieved by registering owners in gun safety programs, or in publications proffered by the group.

But several observers said the NRA’s methods reflect a sophistication and ingenuity that is largely unrivaled outside of major national presidential campaigns. While the organization took great umbrage in December when a newspaper published the names and addresses of gun owners in two New York counties, the group for years as been gathering similar information via the same public records as a matter of course.
In Virginia, for instance, a North Carolina-based firm called Preferred Communications filed an inquiry with the Virginia State Police in July 2009 asking “on behalf of the National Rifle Association” as to whether the names of concealed carry permit holders could be purchased. The email was obtained by BuzzFeed by Freedom of Information Act request.
“Can you please let me know if you offer 2008 and/or 2009 names?” wrote the representative, Michele Wood, who hung up on BuzzFeed when asked for comment. “Can you please let me know the address to send the check to and also whom to make it payable to?”
Iowa too provides another example. In December 2011, NRA lobbyist Christopher Rager, wrote to Iowa Department of Public Safety legislative liaison Ross Loder from an official NRA email address.
“If the NRA wanted to collect data from DPS’ permit holder files, is there a specific process or any rules for us to acquire the records?” Rager wrote in an email also obtained via FOIA. “Can we pay to have the files copied or sent to us?”
Similarly, officials in Arkansas and Oregon also told BuzzFeed they had requests for such lists, and Gawker reported in February of NRA-related registry requests in Louisiana and Tennessee.
“We’ve been doing this since the old days,” Feldman said. “You could obtain from most states the listings of hunter licenses from the Department of Wildlife and Conservations. It was sort of amazing what we knew about people from that. There were early doe permit holders, black powder holders, so many different seasons. It was a lot of data.”

Complementing this practice is the mining of data on the thousands who take gun safety classes from NRA-certified instructors. Arulanandam said there are 97,000 of them, a figure that impressed Quinn as a larger “army of organizers” than Obama had.

In some states, those ranks are propelled by laws that specify that taking classes from NRA-certified instructors in order to obtain permits or licenses. In 2011, for instance, the Iowa Legislature added such a provision.

Outrage over newspapers publishing owner addresses/locations got a lot of attention. The response was to limit what information could be provided from gun records on hand. So, efforts to limit what information on gun sales can be made available to media outlets would also limit the NRA’s ability to get and maintain its own databases.

But the thing is that people don’t care what the NRA does with this data because it’s not the government, which they think is the real enemy here.

Same thing with all the corporations that create massive databases of information about buying habits, browsing habits, and anything else imaginable - much more invasive and pervasive than anything the NSA considers worthwhile for their efforts.

But the hysteria is dialed up to 11TY because it’s the NSA. And the government’s efforts to protect its national security efforts from prying eyes.

I’d like to issue a small correction as there are two factors folk are forgetting.

Good conduct earns 54 days a year after the first year. It’s not quite that clean, but in general a ‘clean’ inmate ends up serving a bit over 87% of his sentence. In that case the 35 years becomes just under 30.5 years. This depends on the behavior of the inmate so is impossible to predict, but its potential needs to be remembered.

On the other hand Manning has a fixed benefit. He’s got credit for pre-trial incarceration, and by law that applies as time served. The hundred or so days he got for misbehavior of people in charge at Qauntico is a relatively minor addition in this case but the total time served is pretty close to 3.5 years.

What this means is that at worst Manning is eligible for consideration of parole in about seven years, and with good behavior could be out in six and a half.

I doubt he’ll be out that soon, but the possibility exists.

Government classified information ≠ work product. It just isn’t.

Greenwald is once again trying to confuse people by making work product equal to the classified information released by Snowden or Manning, and later published by him or Wikileaks.

Attorneys have a work product doctrine, which keeps the work product from the prying eyes of the opposition. It’s for only those who are privy to the work file.

Journalists too have a work product doctrine, protecting sources, etc.

It’s fear based. No one makes good decisions when locked into fear like that. It’s not love, it’s a toxic mimic of love. I cringe when I hear love as a reason for staying, it’s not love. It’s fear, raw, primal, fear.

I know from experience. It took an attack on a child in my presence to move me forward. And even that was one of the hardest things I have ever done. It’s bizarre and insane and it makes no sense. Which in some ways is good, it shouldn’t make sense. Not to sane people. The bad part of that though is the judgement that falls on the victim/hopefully survivor.

I wasn’t raised in a home where Dad hit Mom. Mom hit us though and was just freaking mean, I’m not sure if that was a part of the issue or not.( I found out as an adult she had been horribly abused as a child, sexually and physically- I have since forgiven her) It’s been more than a quarter century since I left that asshole and I still can’t figure the whole thing out. I do know I was lucky to get out of there in one physical piece. Every now and then I look up his arrest record, it’s full of sexual assault and domestic violence charges. He still lives in the same place, far enough away that I shouldn’t ever run into him, but I still find myself getting scared a little when I see anyone who looks like him.

Nope, it makes no sense. I think the point is that it truly shouldn’t ever.

“If I were starting a society from scratch, I would outlaw alcohol and allow marijuana,” conservative columnist and pundit Charles Krauthammer said on the O’Reilly Factor Tuesday.

O’Reilly and Krauthammer began the segment about Washington’s and Colorado’s recent marijuana legalization laws in agreement, bemoaning together the lenient enforcement of the Washington law’s 21-or-older age limit.

But when O’Reilly began to hyperbolize, the harmony disappeared. “Once a child gets involved with intoxication of any kind…childhood is over, their whole life changes, and not for the better, and this is what’s happening in America,” O’Reilly said. Krauthammer responded by contrasting the risks of marijuana use with alcohol.

“Let me stipulate a couple of things,” he began. “Number one, alcohol is a lot worse. I’ve seen what it does as a doctor. It destroys the body — aggression, car accidents, a lot of damage. If I were starting a society from scratch and had to choose the intoxicant, I would outlaw alcohol and I’d allow marijuana. It’s benign compared to alcohol.”
