The Convergence of Glenn Greenwald and Rand Paul’s “Southern Avenger”

Messengers are actually pretty important
Politics • Views: 54,677
Former Rand Paul adviser Jack Hunter, in his “Southern Avenger” mask.

In the middle of a pretty fascinating rant about Bruce Fein (who is acting as Lon Snowden’s lawyer, Lon being Edward’s father) on NSFW, I saw something that actually made me lose some more respect for Greenwald, which I didn’t think was possible. His associations with the racist Pauls is pretty bad, but they at least are part of an actual power structure and you can make a case for working with them on legislation.

But the article, rather casually, revealed that Glenn Greenwald had been a speaker on something fatuously named The Young American Liberty Tour “with three civil liberties experts,” titled “The War on Terrorism, Civil Liberties, and the Constitution’.”

That’s a lot of liberty.

The other two experts were that selfsame Bruce Fein, a weird perpetual GOP sleazeball, and Jacob Hornberger, who thinks the US was better off before the Civil War.

The real 5-alarm bell-ringer, though, was the moderator, Jack Hunter, the goddamn luchador of the losers, the Southern Avenger.

The topics covered were:

Habeas corpus, the PATRIOT Act, extraordinary rendition, torture, regime change, and a general discussion about how the war on terrorism has infringed upon the rights of U.S. citizens in the name of making us safe.

I do not think the agenda was big on voting rights, anti-discrimination (since I know that Hornberger supports the right of businesses to discriminate) or other civil liberties for black people.

I do not understand how any man with any shred of integrity as a ‘civil rights’ speaker can share the stage with someone named the Southern Avenger. Even the Southern Defender, I could slightly imagine. But vengeance implies someone who thinks a wrong has been done to the South, that there is some reckoning against the enemies of the South that has to come. And that is the really fucking scary kind of racism.

en.wikipedia.org

If people do think the NSA story is super-important, they should be hoping beyond hope that Glenn Greenwald gets distracted by something else. He is a horrible journalist and a worse advocate.

In case anyone thinks I’m smearing Jack Hunter:

John Wilkes Booth Was Right

This Wednesday, April 14th, is the 139th anniversary of the assassination of Abraham Lincoln. Although Lincoln’s assassin, John Wilkes Booth’s heart was in the right place, the Southern Avenger does regret that Lincoln’s murder automatically turned him into a martyr. American heroes like Thomas Jefferson and Robert E. Lee have been unfairly attacked in recent years, but Abraham Lincoln is still regarded as a saint. Well, he wasn’t it - far from it. In fact, not only was Abraham Lincoln the worst President, but one of the worst figures in American history.

Imagine you entered into an agreement with a friend. Your friend then decides to gain the upper hand at your expense. For your own good, you decide to back out and go your own way. But instead of letting bygones be bygones, your friend burns your house down, rapes your sister and forces you to re-enter the agreement at gun point. This is pretty much what Lincoln did to the Southern people.

Full disclosure. Why doesn’t Glenn Greenwald reveal that he was once at a conference moderated by the Southern Avenger?

Jack Hunter sure is worried about black Presidential over-reach.

re: #3 Gus

Not just once. Twice. And shared the stage with people who literally want to take civil rights away from black people, and yet they’re civil liberties experts.

Here’s Jack Hornberger saying that liberals are hypocrites for being okay with people not allowing black people into their houses but getting all mad when businesses ban black people.

He wasn’t just at a conference with him. Jack Hunter “moderated” the speakers. Glenn Greenwald spoke about ‘civil liberties’ alongside people who want to take civil liberties away from black people, while MCed by a guy who thinks that Lincoln raped the South.

If the conference had one questionable speaker among dozens, I’d agree with you.

This is not the case.

If the conference had made it secret their true alliance to anyone but the absolute loyal, I’d agree with you.

This is not the case either.

This was a conference where their real thoughts were on display, and questionable speakers were a dime the dozen.

just because he went to this conference doesn’t mean Greenwald shares their views. (he might, but I don’t know. Greenwald might also disagree with the Southern Avenger.)

He didn’t ‘go’ to the conference. He was a speaker on a ‘civil liberties’ tour MCed by someone who thinks that black people should apologize to white people for high black crime rates.

Why do you keep putting it as though he just attended, rather than being on of the speakers?

What do you have to say about that?

39 Gus  Fri, Aug 23, 2013 9:05:09pm

The squabbling Edward Snowden suitors share more than their mutual adoration for the Paul dynasty. Last year, Glenn Greenwald and Bruce Fein did two major college campus tours together, one in winter 2012, and another in autumn 2012. The Greenwald-Fein tours were by sponsored by two pro-Ron Paul libertarian outfits: Young Americans for Liberty (YAL), a Ron PaulJugend outfit; and the Future of Freedom Foundation (FFF), a libertarian outfit specializing in publishing far-right “historical revisionism” about who’s really to blame for the Civil War and World War II, along with the usual libertarian drivel attacking public schools, civil rights laws, social welfare programs, and regulations on the tobacco industry.

He has been playing this civil liberties “game” now for a while and he cant even admit that there have been some improvements under Obama.

Oh shit. Bamm!

Ron and Rand Paul. Libertarianism. The Confederacy. Revisionist history. Paranoia and alarmist terror over Big Government drones watching your every move, reading your every word….The names and themes repeat themselves over and over, and at some point, if a journalist retains the proper skepticism, you have to wonder where the real story about government surveillance ends, and where the paranoid libertarian fantasies about drones hovering outside their bedroom windows begin, reality and fantasy each bleeding into the other… As our faith in the old 20th century liberal constructs have collapsed without anything to replace it, it’s looking more and more like we’ve been sucked into a far weirder construct, someone else’s paranoid reality, like in those early PKD novels — with Ron Paul as our Palmer Eldritch, Rand Paul our Eye In The Sky.

Yeah. Greenwald wasn’t there to have some challenging debate, to call the others out on their support for businesses banning black people. He was there to say people who are concerned about the war on terror should work with these guys. That people who are concerned about the war on drugs should work with these guys.

There seems to be a really concerted, earnest attempt going on by the libertarians to try to suck in left-wingers. I think they don’t realize that the vast majority of those that they pull in are going to be the anti-state kind who didn’t vote for Obama anyway.

Prosecutor: No race motive in shooting of Australian in Oklahoma

Stephens County District Attorney Jason Hicks said while authorities were aware of the comments made by Edwards, there was not enough evidence to pursue extra charges.

“At this point, the evidence does not support the theory that Christopher Lane was targeted based upon his race or nationality,” Hicks said in a statement.

“The evidence is insufficient to establish that race was the primary motive in the murder of Christopher Lane.”

In separate posts on Twitter earlier this year, Edwards spoke of his “hatred” of white people.

“90% of white ppl are nasty. #HATE THEM,” read one tweet.

In another post Edwards claimed to have assaulted several “woods” — a derogatory slang term for white people — following the acquittal of George Zimmerman for the killing of black teenager Trayvon Martin in Florida.

Hicks later reiterated to CNN that he did not believe the crime was racially motivated. He noted that Luna came from a mixed race family, and that the third teenager arrested with the duo, 17-year-old Michael Dewayne Jones, was white.

“I have nothing in my files, paperwork or audio recordings that suggest that Christopher Lane was killed because of his race or nationality,” Hicks said on CNN.

Police have said Edwards and Luna shot Lane because they were “bored.”

“They were bored and just wanted to see someone die,” Duncan police chief Danny Ford told US media.

Hicks agreed that Ford’s explanation appeared to be the most likely.

“I tend to think that the police chief’s comments, that is they did it out of boredom are probably accurate,” Hicks said.

Googling Young Americans For Liberty brings up this site with a cute, inviting youtube video embedded which, in its first 8 secs, tells you it’s the nation’s largest and fastest growing libertarian and conservative organization. About half way through its 2 min 16 seconds, you discover that Young Americans for Liberty is allied with Americans for Prosperity, the American Majority, The Campaign for Liberty, Freedom Works and the Leadership Institute, and that its goals are to win at least 25 elections on behalf of these fine institutes. You also get hit up for a donation. They’re pretty up front about who they are. No beating around any bushes whatsoever.

So, I have to wonder what on earth a fine, dudebro, progressive, far-left liberal journalist such as Glenn Greenwald was doing, trying to help win at least 25 elections on behalf of the AFP, Freedom Works, the Leadership Institute and the American Majority. Did he, exemplary journalist (cough) that he is, not realize what the goals of the organization he was speaking for were? Did he just not do even a 3 minute google on Young Americans for Liberty? I find that very hard to believe. Or will he just speak for anyone who will pay him enough? Would the KKK be a group he wouldn’t directly associate himself with? How about Fred Phelps?

Aggravated an old injury. I hurt my knee many years ago. Had it checked by a specialist, MRI and all. He said I had a torn ligament, but it was such a tiny tear they couldn’t do anything for me since surgery would be excessive. It flares up from time to time. I’ve gotten used to it over the years.

Slipped and fell a week ago while out with friends. Knee’s been sore ever since. I’m resting a lot and trying to take care of it best I can. If I don’t see improvement soon, I’ll be heading to the doctor.

Republican Rep. Joyce: Unemployment caused by drunk, high workforce not lack of jobs

Joyce (R-OH), spoke with the Stow-Munroe Falls Chamber of Commerce this week about the economy and Congress. He told them that there are millions of jobs going unfilled in America “because they either can’t find people to come to work sober, daily, drug-free and want to learn the necessary skills going forward to be able to do those jobs.”

It is a given that millions of jobs will be unfilled at least temporarily in the natural churn of the economy during good times and bad, according to Department of Labor data, but Joyce chalked up his assertion that the unemployed were simply people who were drunk or drug users to anecdotal feedback from business owners, the Huffington Post reported.

“3.9 million jobs go unfilled in this country each month,” Joyce’s spokeswoman Christyn Keyes said to the Huffington Post. “Rep. Joyce sees that as an enormous problem and to fix a problem, you must accurately diagnose it. Rep. Joyce has made it a top priority to meet with small business owners and job creators and a concern that comes up time and time again is substance abuse among the workforce and adequate workforce training. …Rep. Joyce came to Washington to be a fact-based problem solver and during this 20-second clip of a 15-minute speech,” she added, “he was simply sharing the concerns of small-business owners with other local business leaders.”

73 Amory Blaine  Fri, Aug 23, 2013 11:02:28pm

Sooo by his estimations it’s not Obamas fault UE is so high (default GOP position), it’s that Americans are too drunk, high, lazy and corrupt to get jobs. His “accurate diagnosis” doesn’t include the fact that in a country of 310 million people, that there will be millions of unfilled jobs at any one time, always.

GOP Legislature Altered Wisconsin Constitution Webpage; Changes Mislead on Voting Rights

The Wisconsin Legislature’s webpage on Suffrage, voting, has been changed while under GOP control since 2011.

The following misleading sentence has been added: “An Indiana statute requiring citizens voting in person on election day, or casting a ballot in person at the office of the circuit court clerk prior to election day, to present photo identification issued by the government did not violate constitutional standards. Crawford v. Marion County Election Board, 553 U.S. 181, 128 S. Ct. 1610, 170 L. Ed. 2d 574 (2008).”

This is the first time such a naked display of partisanship has been on display on what used to be a non-political webpage on the Wisconsin Constitution maintained under the auspices of the Wisconsin Legislature. The URL is: docs.legis.wisconsin.gov .

Apparently back in 2006, a number of RW blogs, based on IP logs, speculation and general writing style were accusing Greenwald of frequently operating sock puppet accounts to essentially argue his greatness on their forums:

Yeah, sock-puppetry isn’t a particularly big deal, but still interesting.

It’s sort of… Prairie Home Companion for a Lovecraftian sort of town. But funny. There’s 29 episodes so far (new eps every two weeks), about 20 minutes each.

Reminder: dogs are not allowed in the dog park. People are not allowed in the dog park. Do not look at the dog park. All hail the glow cloud.

Prosecutor: No race motive in shooting of Australian in Oklahoma

This is a problem I have related to hate crimes legislation. How can we assign motives without the ability to see into people’s souls? Sometimes we can only guess, and guess poorly based on limited evidence.

Example: a gang member (one white, one black) kills another over a drug/weapons deal gone bad.

Is it drug violence, gang violence or racial violence?

As long as the sentencing reflects the severity of the crime, I am fine with that.

Have you ever heard of the old saying that you’re known by the company you keep?

I don’t know about anyone else, but I tend to stay as far away from some people as I can get. To name a few—-close-minded individuals, hypocrites, liars, bigots, and racists, among other unsavory individuals. I have a low tolerance for these kinds of people, and I guess it goes back to seeing the world through a child’s eyes when I was a kid growing up in the South under segregation. I don’t care if I have one thing in common with someone. If they fit into any of the aforementioned groups, I avoid them like the bubonic plague because I know it won’t be long before they rub me the wrong way and get on my last nerve. Plus, I have a standard I live by—there is no excuse for certain behaviors, attitudes, or beliefs, especially the types that harm others in some way that is totally unnecessary.

The chair of Oregon’s GOP wants to sprinkle nuclear waste from airplanes. Or put it in the drinking water.

motherjones.com

Robinson, who has a Ph.D. in chemistry, has marketed himself for the last three decades as an expert on everything from nuclear fallout to AIDS to climate science in the pages of a monthly newsletter, Access to Energy, which he published from his compound in the small town of Cave Junction. A quick glance at his writings, which were publicized during his ill-fated challenges to DeFazio, suggest that whatever the failings of the previous party leadership—Democrats now hold all statewide elected offices and control both houses of the state Legislature—Robinson brings with him a new set of challenges entirely.

On nuclear waste: “All we need do with nuclear waste is dilute it to a low radiation level and sprinkle it over the ocean—or even over America after hormesis is better understood and verified with respect to more diseases.” And: “If we could use it to enhance our own drinking water here in Oregon, where background radiation is low, it would hormetically enhance our resistance to degenerative diseases. Alas, this would be against the law.”

Happy BD! The 40s can be wonderful and interesting, as can any decade—you can be in your best physical shape with exercise and eating right, and your brain should be functioning at high capacity with the wisdom of education and experience. Or you can throw in the towel and see it as the beginning of the end and engender all kinds of problems for yourself.

I took the first route and it has served me well in many ways, if not financially, which has never been my game anyway.

You have to put up with a lot of people who take the second route, though, and see age as their enemy. If you embrace it, it will serve you well.

The left should face it: GG is a political whore and will associate with anyone he thinks pushes his own agenda: making GG rich and famous. This is all about narcissistic over-reaching, a phenomenon that appears to be in full bloom these days amongst a varied segment of society—first expressed by Andy Warhol through his collection of these types.

GG is just a huckster who’s just interested in filling his pockets by throwing political bombs—along the lines of Sarah Palin who never saw a dollar she didn’t like. He’s not interested in other people or their opinions, even if he’s wrong, a general feature of narcissism, unless they become his useful idiots.

One way is to ask if they are members of certain groups. A member of the Aryan Nations, et al. who kills a minority can be presumed to have some racial animus. Or go by statements.

The intent of hate crimes legislation is to forestall the kind of violence that happened before the laws: ad hoc groups that while not formally organized, would meet to intimidate those groups that were minorities. And where the intent was to make those groups afraid due to that violence. For that violence was often directed at the most outspoken, successful members of the minority.

Arayan Nation or KK are pretty clear-cut instances, but what about an all-white or all-black street gang? Are they a racially motivated organization, or simply one from an all-white/black neighborhood that has come together out of a sense of mutual protection/self interest?

Bryan haz a sad:

According to the City Charter rules, City Council President Todd Gloria will become acting mayor when Filner, the city’s first Democratic mayor in 20 years, leaves office Friday. An election will be held within 90 days.

Including Gloria, at least four of the potential candidates lining up to replace Filner are gay, including one Republican. It’s another significant milestone in the ascending political power of the lesbian, gay, bisexual and transgender community when the nation’s eighth-largest city - and one with a well-earned conservative reputation - has a gay chief executive.

The reaction to these milestones in San Diego, where former Republican Gov. Pete Wilson was once mayor: meh. It’s not even the first time it’s happened in San Diego. The city briefly had an interim mayor who was gay in 2005 after then-Mayor Dick Murphy resigned in the middle of a financial crisis.

Otherwise, maybe set up a small buffer zone in the border region of Syria, and use it to vet and train various rebel groups?

From Wired-Fair assertion? Wired has been better than most on this.

The PRISM program involves the bulk collection of data from companies under the FISA Amendments Acts, passed in 2008. Section 702 of the law allows the government to target the communications of foreign nationals believed to not be on U.S. soil, but also allows for the collection of data of U.S. citizens if that person is communicating with a foreign national who is targeted. It does not allow for the collection of wholly domestic communications, which the government is supposed to filter out.

The NSA, however, failed to filter out these domestic communications until the court intervened.

Interesting, Facebook is not making any reimbursement claims for costs. Some other big providers are getting millions of dollars for costs associated with NSA programs.

I don’t know about your assertion that Wired has been “better than most” on this. The other day, one of our resident Greenwaldians posted a link to a Wired article that was nothing but endless speculation and heavy implication that the NSA was storing the entirety of the Internet on its hard drives.

re: #181 thedopefishlives

Right better than most. Not perfect not always objective. Still better then all the tabloids and some of the other tech blogs like Cnet. Not looking at the link you mention-
IIRC that article goes way back, when the locked rooms were first outed, and the sheer scale of the government data storage facilities were starting to come out. The only evidence was physical, we had none of the more recent disclosures to see what was really up. And they were pretty careful to discuss this as the potential, not proven reality. Sure they talked about the worst case scenarios. Given the near complete lack of real information about what was really going on and the since ruled unconstitutional “keep this data collection demand secret or else” letters the NSA would send to ISP’s.

Fair to say the NSA only filtered out domestic stuff after the court ordered it to? Or not?

So then yes that’s a fair way to say it?

“Fixed all is well” so we can relax vs. “only after a court order” so we should keep watching & keep the pressure on to sunset the PA are kinda different in implication.

I also find it interesting that the costs are high enough for the gov to have to reimburse so much money. A little rainmaking or hush money is sometimes found in agency expenditures. The NSA ain’t no angel. It’s a hard working hard charging agency with a huge hard job to do, and they like most in the intel profession take it to the limit.

They remind me of the FBI, who having one kind of surveillance ruled illegal by a district court judge only stopped in that district, claiming the decision had no merit outside the district. Legally that’s probably correct. But is that what you want to see from an agency that powerful?

Not at all. NPR has been really good, Wired good but has room for improvement, the rest you cite, yeah a mess.

My remaining concerns echo some of what has been said about how the term “relevance” has been used. I’m not convinced the interpretation we have should stand. By some established legal standards even the meta data not connected to terror investigation should not be gathered or if gathered, kept. The legal support for this interpretation rest in court. FISA of course. IMO open court would rule the other way. I think either way is a valid point of view, in that “good men differ” category.

This argument gets little or no notice. Less than it deserves, although I don’t want to see it fought in the tabloids.

The Wired article is better than most in that they give the absolute figures— 56,000 emails. It’s not terrible. But disinformation is so rife on this that I think Wired should be correcting misperceptions a lot more than they are— NPR should be too, for that matter.

No, because I’m kind of annoyed at how much conversational space the whole topic is taking. It’s nowhere near my top ten list of priorities.

re: #237 Political Atheist

I agree that there are questions about how the court should be structured and what should be secret.
But I have to say, I am just as concerned about the state of journalism.
It is very important that we have an open and honest press. Instead it seems we have headline grabbing, stir up the masses, misrepresentations and celebrity cult activism.

Well that was interesting….

Just got back from a local bbq cookoff/fair/something or other and who did I almost literally run into? Bob Barr. I was looking for the ceramics pavillion and damned near walked into him. In a cowboy hat and pointy boots. Seriously? He had minions running all over the place handing out bumper stickers and the like. The Husband would not let me go to the booth and start asking pointed questions, he plied me with deep fried brownies. Argue with a libertarian, or have some delicious chocolate? Not a tough choice.

Also seen: a booth full of pretty much entirely anti Obama merchandise. Mostly wooden signs and switch covers (?) with the usual bumper sticker type things laminated on them. Some Tea Party Patriots, you could tell by the t-shirts, and bikers with confederate flags on their vests.

As an aside, my husband has had Harleys forever. As a result he buys all sorts of motorcycle magazines. He picked up the latest Easy Rider(which apparently has become a PG rated publication these days), and there is a huge rant against liberals in there that sounds like someone who never leaves the house. All liberals are vegetarians who don’t eat meat, hate hunters, it goes on and on. One thing that surprises me is how many bikers are raving conservative loons. It’s weird.

No, because I’m kind of annoyed at how much conversational space the whole topic is taking. It’s nowhere near my top ten list of priorities.

I’m annoyed we have accepted that ruling on relevance too easily, it’s a more foundational question on this whole thing. And since a major author of the Patriot Act is against the broader view it is no less deserving of a hard look, in public. You can dismiss him over his party or you can think him relevant as an author. Or you can ignore him and just look a little harder. I understand we have to have priorities, I’m appealing to the readers here overall not just you.

re: #247 Political Atheist

It doesn’t matter if I accept the ruling or not. The courts aren’t going to change their mind because I get irate. The court will change its mind when another conservative or ‘classical liberal’ on it gets replaced by a progressive in the mold of Sotomayor. Then we may really have a working affirmative right to privacy.

This “relevance” issue is not even out of FISA court yet, long way to go to get to the Supremes. I would be more surprised if they upheld the current view, but who can really say? Show me some ruling in open court first. Then I’ll start thinking about SCOTUS on this particular point.

Funnily enough, an easy way to determine the potential slant of a site is to look at how they refer to migrants. The most common terms are “undocumented aliens/immigrants”, “illegal aliens/immigrants” or sometimes just plain “illegals”.

My tea-partying representative is moderating on immigration. He now says he’s ‘way out in the middle.’

When asked on his stand with Immigration Reform, Pearce said,”We must do Immigration Reform. My suggestion has always been; secure the border, reform legal immigration because it takes to long and make a guest-worker plan. The right side says they have to be deported — put in jail. The left side wants amnesty and I am way out here in the middle trying to have a compromise.”

This was his position in March:

If the U.S.-Mexico border can be secured, a formidable challenge, Mr. Pearce said he supported granting work permits to the 11 million or so immigrants now in the U.S. illegally. But if they want to become citizens, he said, they will have to leave the U.S. and “get in line like everyone else.”

That’s right. If you want citizenship, first you must self-deport.

Here’s his position as of yesterday:

Pearce, however, told the audience he supports a worker program, not a pathway to citizenship for those in the country illegally.

“I’m uncomfortable making 11 million people citizens,” Pearce said. “But if they want to work, let’s take away the fear, let’s keep families together. That’s the guest worker program.”

“Look(ing) away” and legalizing those in the country illegally would tell the world, “You can come here in any fashion you want,” Pearce said.

Way out in the middle.

Oh, here’s his position on gun control:

One attendee asked Pearce if stricter background checks for gun purchases would have prevented a teen from bringing hundreds of rounds of ammunition to a Georgia elementary school, holding staff members captive and firing at police. The teen was arrested without incident.

Pearce said “America’s heart” needs to change, not gun laws.

“They don’t have guns in Rwanda, yet (more than 500,000) people died by machetes,” he said, referencing the 1994 genocide in the central African nation.

338 piratedan  Sat, Aug 24, 2013 12:47:32pm

what is so strange about all of this is the revisionist history that is attached to it all. Israel of the mid sixties had only been in existence since 1948 and had already been attacked and was still fighting for it’s right to exist. The Brits were ambivalent at best, the Soviets hated them, the Chinese were indifferent and it was kind of apparent that a large swath of the Arab world felt that they shouldn’t exist, especially so the Palestinians (although I do believe that there were good faith gestures made to them by the Israelis at the beginning, it’s not as if Israel was a political monolithic entity itself).

Looking at the statements of MLK of fifty years ago through the lens of history today seems foolhardy at best, like saying that Republicans are the anti-slavery party, things change.

The US will back Egypt and try to remain neutral. Much because of Camp David. Morsi (MB) backed the rebels in Syria. Now Sisi should back Assad in Syria. Qatar was backing Morsi (MB) but cut all aid to Egypt after the coup. Saudi Arabia, UAE, and Kuwait took over with 12 billion in aid.

AP US forces move closer to Syria as options weighed
Defense Secretary Chuck Hagel declined to discuss any specific force movements while saying that Obama had asked the Pentagon to prepare military options for Syria. U.S. defense officials told The Associated Press that the Navy had sent a fourth warship armed with ballistic missiles into the eastern Mediterranean Sea but without immediate orders for any missile launch into Syria.

EDIT-This seems odd about the article. “ballistic” may not be the right term for cruise missiles.

Wikipedia:

A ballistic missile is a missile that follows a ballistic flightpath with the objective of delivering one or more warheads to a predetermined target. Shorter range ballistic missiles stay within the Earth’s atmosphere, while longer range ones are designed to spend some of their flight time above the atmosphere and are thus considered sub-orbital.

Yeah, I think the flight path matters. Which matters because ballistic missiles could easily be mistaken for nukes. IIRC, navy subs have ballistic missiles and cruise missiles, ships just have cruise missiles and the amazing Standard AA missile that once killed a satellite.

Yep. We’d never launch a ballistic missile with a conventional warhead during war. All would assume (As we would) that it was nuclear.
