A legally blind man who was acquitted in the shooting death of another man fought in court Thursday to get his guns back.

John Rogers said he has the right to have both of his guns returned to him. While Judge John Galluzzo said he did not want to return the guns to Rogers, he said it was the law.

Rogers’ guns were confiscated by law-enforcement officers after he fatally shot a man. He was later acquitted.

“I have to return property that was taken under the circumstance,” Galluzzo said. “I have researched and haven’t found case law to say otherwise.”

Galluzzo said he had no choice but to return Rogers’ 10mm Glock and a rifle that was used to kill James DeWitt, 34.

The shooting happened at Rogers’ home in Geneva during a fight in March 2012. Rogers spent time in jail and went to trial in January. He was granted immunity using the “stand your ground” law.

Rogers has a history of violence. Four years ago, he fired 15 rounds from a handgun at Michael Rogers, his roommate and cousin, following a night of drinking and fighting in Geneva, according to court records.

Michael Rogers suffered scrapes but no gunshot wounds. The defendant was charged with aggravated assault but, in a deal with prosecutors, pleaded no contest to a lesser charge — unlawfully displaying a firearm — and was placed on probation.

That was revoked, however, when he pushed and punched a woman a year later, something that resulted in him spending 71 days in the Seminole County jail for domestic violence, according to court records.

Rogers shot DeWitt once in the chest with a .308 Remington assault rifle from a distance of 18 inches or less, defense attorneys said.

Ok, waded through Greenwald’s latest scoop. Here’s my understanding: the Brits developed some techniques for manipulating online communities. Not surprising since ad agencies and political “think tanks” figured that out a while ago. From an intel point of view I get the parts about infiltrating and even creating doubt using misinformation to discredit or marginalize someone. I’d love to see some real world cases where these techniques were used. I guess as long as they’re not using the techniques for political purposes (generating public support for a new government program, etc) then I don’t think it’s a big deal. “slippery slope” and potential for misuse abound but that’s life

During the Occupy protests the group I was working with had a discussion on facebook about defending ourselves against police suppression, in light of the police response in Oakland. I argued that any kind of violent defense would not work to our advantage, and everyone agreed and the conversation drifted towards when it would be appropriate to respond to police violence with violence of our own, as applied to defending ourselves. Later I found that the Fusion Center run by DHS circulated a memo to the local police stations stating that they found evidence that the local Occupy group planed on shooting officers. I believe they were using the discussion we had about defending ourselves from the police to make the case that we were going to shoot cops. I believe that they were using the Fusion Centers to manipulate the police into thinking the peaceful protesters were a threat. I was stunned and scared sh**less after I found this out, since I was not an anonymous protester, but an out front organizer, I gave news interviews and was a public face. My name is directly attached to the local Occupy group, and I would have to think that the local police had my name, along with this memo, which in turn would make me a target for the police. I admit I feel victim to my own fear and have since disappeared from the group out of fear of police harassment. Manipulate the police into thinking the protesters were a threat, deceive them into thinking there is an eminent threat, and then destroy the reputations of the protesters. Sound familiar?

Because each one gets 0.5 yuan per comment, they are called “wumaos” (wu = 5 and mao = 0.1 yuan). If you read comments at some English-language sites relating to Chinese affairs, you can sometimes pick out comments that are so over-the-top pro-Beijing that you may suspect they’re planted by wumaos.

This activity is well documented, so I am sure GG mentions the Chinese practice in his latest exposé. Right?

Sorry, but I’d have to say ‘no’ on that score. Occupy Oakland was a pretty violent bunch and I find it entirely believable that they would talk about shooting police officers, though it must be noted that they did not actually do that.

If this guy is receiving disability benefits, he needs to be reviewed since witnesses say he can see. Back in the ’80s, I worked at a bank and we had a blind guy working in IT using special equipment. What’s Rogers’ excuse for not working for 13 yrs? If he can see well enough to kill someone, he ought to be able to do some kind of work, and therefore trainable. After all, employers make accommodations all the time for disabled workers—it’s the law, too.

He also has a history of violence, so with him, it’s just a matter of time, esp with his drinking, before he harms someone else, either by beating them up or shooting them. He’s a menace to society as it is, not a SYG hero of any sort.

If this guy has any “friends” left, that would be the real news, because he can see well enough to kill someone and obviously won’t hesitate to do it.

I don’t think FL has the guts to deny this guy a license to own guns. But if you have to get a license to own a gun, then isn’t that more of a privilege than a right? You see where the gun nuts are going with this, don’t you? They know this, and that’s why they keep beating the 2nd Amendment to death for owning weapons as a “right”.

I’ll bet FL won’t give Rogers a license to drive. Driving is considered a privilege for which you have to be licensed, too. So—why one license and not the other?

Rogers is a bully, a big ex-Marine who obviously has issues. He beat up an ex-girlfriend and has a violent past of threatening at least one person with a gun. He appears to be a danger to others more than they are to him.

I doubt that very highly; in any event, the new Ukrainian government does need to honor the terms of the treaty (until 2042) unless Russia does something that violates the terms of that treaty, which would nullify it. By that, I mean Russia attempting to annex Crimea back into Russia.

Such a move on the part of the Russians would - and must be - wholly unacceptable.

There’s a good article I was reading, which I’ll link to; it notes that despite appearances of great strength, when one looks behind the curtain with a sharp eye, Russia is actually a power in decline, and one of the things that has the Kremlin so very nervous is that events in Ukraine have served to highlight that fact, something Moscow very much wants to keep concealed.

Well, there are those in some Southern States who have proposed legislation to have every miscarriage report to the police for investigation as a possble abortion.

Spaniels can be quirky —bad inbreeding in this country. Our breed has a problem with seizures tho —there is a concern in England as well. We had one girl that had brain cancer —and my little girl has a 1/2 sister with seizures as well. Her owner also hasn’t done an MRI for the same reasons as us. She is on Pheno and it has helped.

What is so awful is that they basically feel as tho they have been hit in the head by a boxer (athlete, not dog) and don’t know why. The other dogs are freaked as well.

I don’t have an unlimited budget for diagnosis … .

Not here in Alabama. The local hospitals actually hired non-volunteer navigators to help people get ACA. That’s the only way to stop the cash hemorrhage from the emergency rooms. Two of my fellow volunteer navigators are semi-retired MDs.

Bitcoin exchange Mt. Gox disappears in blow to virtual currency

TOKYO (Reuters) - Mt. Gox, once the world’s biggest bitcoin exchange, looked to have essentially disappeared on Tuesday, with its website down, its founder unaccounted for and a Tokyo office empty bar a handful of protesters saying they had lost money investing in the virtual currency.

The digital marketplace operator, which began as a venue for trading cards, had surged to the top of the bitcoin world, but critics - from rival exchanges to burned investors - said Mt. Gox had long been lax over its security.

It was not clear what has become of the exchange, which this month halted withdrawals indefinitely after detecting “unusual activity.” A global bitcoin organization referred to the exchange’s “exit,” while angry investors questioned whether it was still solvent.

A document circulating on the internet, and purporting to be a crisis plan for the exchange, said more than 744,000 bitcoins were “missing due to malleability-related theft”, and noted Mt. Gox had $174 million in liabilities against $32.75 million in assets. It was not possible to verify the document or the exchange’s financial situation.

Just did a quick check of the census (pdf file). The west has the largest proportion of hispanic and minority population. The south has the largest absolute number. State by state breakdown at the link, page 18.

You know what even if he did that say that, let’s look at reality here. 1964, the Republicans nominated one of the few people in their party who voted against the bill for president, 1968 Richard Nixon embraces Strom Thurmond and the Southern Strategy, 1980 Reagan gives a speech on “states rights” where three Civil Rights workers were kidnapped and later murdered, 1988 the Willie Horton Ad, and 2000 Bush takes some heat from having spoken at Bob Jones University which had only recently repealed a ban on interracial dating. There’s a reason why African Americans dislike and distrust the Republican Party and it wasn’t because of “free stuff” it was in large part because the Republicans went out of their way to transform from once being the party of Lincoln to the party of the people he opposed.

Waubant is not sure if the samples from this latest group of patients were tested for enterovirus 71.

According to a CDC report, several outbreaks of paralysis caused by enterovirus 71 were seen in Europe in the 1960s and 1970s. In the late 1990s and early 2000s, fatal encephalitis was a big problem in Malaysia and Taiwan.

Am I supposed to be shocked that currency speculators and others are losing their shirts over Bitcoin as one of the exchanges has gone dark with no explanation? Mt. Gox is disappeared - as is its founder.

The website of Tokyo-based Mt. Gox was returning a blank page Tuesday. The disappearance of the site follows the resignation Sunday of Mt. Gox CEO Mark Karpeles from the board of the Bitcoin Foundation, a group seeking legitimacy for the currency, and a withdrawal ban imposed at the exchange earlier this month.

Prominent members of the Bitcoin community — including San Francisco-based wallet service Coinbase and Chinese exchange BTC China — sought to shore up confidence in the currency by saying Mt. Gox’s collapse was an isolated case of mismanagement. They said it had abused users’ trust, but did not offer details on how.

“As with any new industry, there are certain bad actors that need to be weeded out, and that is what we are seeing today,” the statement said.

Documents purportedly leaked from the company lay out the scale of the problem. An 11-page “Crisis Strategy Draft” published on the blog of entrepreneur and Bitcoin enthusiast Ryan Selkis says that 740,000 bitcoins are missing from Mt. Gox, which roughly translates to hundreds of millions of dollars’ worth of losses, although figures are fuzzy given Bitcoin’s extreme volatility.

It’s a virtual currency with no safety net. And there’s no current regulations in place. States and countries are looking at ways to regulate the currency exchanges, as well as setting up rules to deal with whether the sale/exchange is a taxable event (for sales tax purposes) or whether it is subject to capital gains taxes or other taxing basis.

That one of the biggest sites disappeared without a trace shows just how risky these sites are, but expect the usual suspects (DudeBros among them) to complain that regulatory oversight undermines the purpose of the Bitcoin (to have anonymity - itself laughable considering that you’re required to provide more ID than if you were using plain old American cash).

Even big companies like Wal-Mart are coming out in favor of the increase. What does that tell you? Opposition to this isn’t about companies being able to afford it. It’s about refusal to believe that employees should get decent wages.

By GOP standards perhaps. The fact that it’s a total lie, rather mitigates against it. If the minimum wage is not enough to keep a family from needing food stamps and other welfare while working a 40 hour week, then the minimum wage is too low. Either the wage paid needs to be increased or the corporations need to pay sufficient taxes to pay for their government subsidized labor force. The current situation is unsustainable.

Most retirees can no longer afford to move. Many fewer people have pensions anymore and the 401ks or other retirement schemes aren’t working for people.

A friend’s 80-something old dad died a few yrs ago; he retired from a steel mill, just a working class guy, to FL 30 yrs ago when people like him could still do it because he had a guaranteed pension.

Not to mention hard on kids who often suffer from no supervision, and don’t know from week to week if they’ll see their parents, much less spend any time with them, and a strain on marriages, also, when people pass like ships in the night on their way to different work shifts. Adults may be able to adjust to the hours, but the damage done is sometimes irreversible. It’s one reason, as a single mom, I chose a 9-5 job and had to curb any ambition I might have had which hurt financially since I had no family support anyway.

NO ONE should work a 40 hour week and not be able to afford food, clothing, shelter, transportation and medical care. We used to have that, it’s gone now and it’s wrong.

No, I get that. I was reading about the history of MLK Day on Wikipedia, and the one state in the Union that was all “Damned if we’re celebrating a black guy” was AZ. I mean, even the Confederate states enacted it on the initial run.

Maybe not. What does it cost to recycle or dispose of properly a bunch of toner cartridges? I know here in Columbus the government has a working relationship with the recycle companies and I would imagine there are some public costs involved in all that. And if not properly disposed of, what are the long term costs to a local government to maintain a dump site with a toxic brew of all kinds of stuff cooking in the earth?

Everything has costs, from humans to all humans create. And everything has a bit of public aid behind it too.

Remember the Obama quote and dustup over “you did not build that?”

The Wikipedia page on the state is an interesting read. Rapidly growing state in terms of population - but most of it is basically settling around Phoenix. And that means that 60% of the state population is living in a single county. Also interesting to know that 70% of the land in Arizona belongs to the Federal Government.

By the way, Today’s APR illustrates well just how far Arizona overstepped with their “It’s okay to discriminate against the gays” bill. Part of the reason so many of the same Republicans who voted for it are in a panic asking Brewer to veto it is because they know she’s just bat-shit crazy enough to sign it…and then they lose their second Superbowl hosting opportunity in just over 20 years.

That state needs a sign that reads, “Welcome to Arizona. It’s been ___ days since our legislature passed a law that caused a boycott.”

I’d love to see the Chicago Cubs pull out of there too, after building their multi-million dollar pre-season “training facility”. It’s useless anyway, even without the possibility that AZ passes this stupid law.

Maybe not. What does it cost to recycle or dispose of properly a bunch of toner cartridges? I know here in Columbus the government has a working relationship with the recycle companies and I would imagine there are some public costs involved in all that. And if not properly disposed of, what are the long term costs to a local government to maintain a dump site with a toxic brew of all kinds of stuff cooking in the earth?

Everything has costs, from humans to all humans create. And everything has a bit of public aid behind it too.

Here’s a question for ya Ben. Should a kosher caterer have to cater a gay wedding at a public venue (like a hotel) where they cater other functions?

ANSWER: Yes, if kosher food is requested, the same as for a Jewish wedding or a bar mitzvah or a shul dinner or a birthday party.

A kosher caterer does not have to serve bacon or cheeseburgers because that is not a product that they provide to anyone else.

Insurers have always played games about what they will pay out. And these problems will also go away after the first year since the system will be in place and the annual benefits enrollment will be fixed (as opposed to the first year rolling period with extensions).

I live by the sentiment of treating people how I want to be treated, and treating everyone equally. Largely that graphic contains ideas I can agree with, but it expresses what seems to be a core tenet of the whole ‘privilege’ concept of the social justice movement that I simply cannot abide:

A. Because I am ‘privileged’ I will ‘shut up’.
B. When I try to speak, and people just scream ‘privilege’ at me, I’ll just take it and reflect that maybe they might have a point somewhere.

That’s not social justice. That’s thinly-disguised retaliation.

Western Ukraine got rid of all the SOviet symbolism long ago, around the time of Independence. They replaced all the Lenins with statues of Shevchenko (a poet).

The communists in other parts of the country had their fee-fees hurt if anyone tried to remove the Lenins, and would claim these are “historical” statues and have them left in place. The “Leninopad” began with the toppling of the statue in Kyiv this time around.

I’ve seen photos suggesting that they’ve finally removed his bust from the walls of the Teatralna metro station; good thing, as it used to scare my godson, who called it the Babay (boogieman).

Also too: Jews in the Maidan. And I keep waiting for the ethnic cleansing of Russians and Jews that the Putin apologists claim is coming. No sign yet.

If you ever find the true answer to that, get back with us. Instead of looking at themselves, it seems many religious types have to stand in judgement of others. They also always seem to have to have an enemy or a group to hate. Again, they should look at the enemy to others that lies within themselves. But they get so pumped up on their own righteousness they fail to see their own failings as Christians.

Constantly available internet access doesn’t erase racism, sexism, ableism, etc. Also, you may have missed this in the graphic GGT posted:

Most people occupy multiple social positions with multiple levels of privilege or disadvantage.

The idea of ‘privilege’ is a meaningful sociological construct. People on Twitter will continue to use it with varying degrees of coherence. People with no internet access will not, of course.

When it is thrown out as a label in a debate with the intent of deriding the opponent’s arguments it needs to be heavily backed up. Otherwise it is simply be used to deflect answering the questions being raised.
