NSA Watchdog: Snowden Should Have Come to Me

There is honesty and value in working within the system
LGF • Views: 21,389

But the system has nothing to satisfy one’s self indulgence and ego, does it? Who are really whistle blowers that deserve respect? Let me name a few.

My #1 favorite is Frank Serpico.

Then two other notables-
W. Mark Felt aka Deepthroat.

Cathy Massiter

These are true whistle blowers. Ed Snowden just blows.

Readers could surely add their own to the list, there have been so many. All of them stand head and shoulders above Edward Snowden. A wiki link.

The National Security Agency’s top watchdog slammed Edward Snowden on Tuesday for failing to follow official protocol in relaying his concerns about wayward intelligence gathering and also faulted Congress for not vetting the details of post-9/11 surveillance programs.

“Snowden could have come to me,” George Ellard, the NSA’s inspector general, said during a panel discussion hosted by the Georgetown University Law Center.

Ellard, making his first public comments in seven years working for NSA, insisted that Snowden would have been given the same protections available to other employees who file approximately 1,000 complaints per year on the agency’s hotline system.

“We have surprising success in resolving the complaints that are brought to us,” he said.

Work inside the system to make sure it works properly and not expose national security secrets to hostile foreign powers?

NO WAY, DUDER!

This is a frustrating story because they should have been out there in public saying this from the freaking start of this debacle.

Greenwald has completely poisoned the well with his claims that Snowden had no way to “blow the whistle” without stealing everything he could.

5 Pie-onist Overlord  Wed, Feb 26, 2014 11:04:02am

Snowden was never interested in “whistleblowing” and “expressing legitimate concerns.” He just grabbed a bunch of random classified files like Glenn Greenwald told him to do because….

1. Steal classified data
2. ?????
3. PROFIT!!!!

What took the IG so long to make what is blindingly obvious to anyone with a functioning neuron? It would have defused all the nonsense about how Snowden’s some kind of hero for releasing all kinds of classified details about NSA spycraft, operations, plans, relationships, etc.

I’m sure Snowden had no ulterior motive to go to someone else. No connections. No plans.

That’s why he just fled to Hong Kong and then Russia. Because he had no idea what to do.

34 wrenchwench  Wed, Feb 26, 2014 11:26:50am

It’s not just Snowden’s failure to ‘start the conversation’ about privacy and the NSA without committing serious crimes. It’s the failure of every journalist and activist who thought the conversation should be started. If they think Snowden is a hero for accomplishing this. they are using him as their human stepping stone every time they use the stuff he stole.

Not just a failure of the journalists and activists, either. Why couldn’t Wyden and Udall and Luap Dnar do anything without a leak?

They are excusing their own failings by pointing to Snowden’s theft.

Calm, rational people who have taken the time to learn/understand the system and work with it think it’s blindingly obvious, but the majority of people:
1. Aren’t calm.
2. Aren’t rational.
3. Aren’t willing to take the time.
4. Aren’t willing to learn or understand.
5. Don’t trust the system.
6. Some combination of 1-5.

You know, for Texas to risk economic boycotts due to passing a law like that is something they might not consider harmful. The cities (Houston, Austin, Dallas, San Antonio) that host those events and conventions are the more liberal bastions of the state.

For Arizona everything is pretty much around Phoenix and to a much lesser extent Tucson. If you hit the Phoenix area you’ve pretty much hit half the population of the state.

Was kind of a BS ruling. Final paragraphs:

We also agree with the magistrate judge’s reference to the Illinois Eavesdropping Act in applying Rule 83.54.4. Contrary to defendants’ assertion, the magistrate judge did not apply the statute to counsel directly. Rather, he properly used it to construe the court’s rules, to which counsel is indisputably subject.

The magistrate judge’s reasoning, once again, is sound. By appearing pro hoc vice, counsel agrees to familiarize himself with and abide by local rules and local law, including substantive law. Regardless of whether this statute is directly applicable to out-of-state recordings, it provides a reference point for what rights must be respected by attorneys practicing here.1 Illinois has conferred on its citizens a right not to be recorded without their consent. Because surreptitiously recording conversations violates a right recognized in this jurisdiction, attorneys appearing before this court may not do so. We also agree with Magistrate Judge Ashman’s analysis of the importance of a level playing field. This court’s rules must apply uniformly to all attorneys appearing here, regardless of their offices’ location. To permit otherwise is not only illogical, but would interfere with the fair administration of justice, in general, and undermine the purpose of the work product doctrine, in particular.

Given the rhetoric in the papers filed with respect to this difficult ethical question, we wish to clarify one last matter. We are applying rules here, not judging character. As the magistrate judge noted, although ultimately unsuccessful, defendants’ arguments were reasonable. Defense counsel could have reasonably believed that his conduct was permissible. Although we find that his conduct did violate the rules, our rejection of his position does not equate to an indictment as an unethical person.

However ending with:

For the foregoing reasons, defendants’ objections are overruled. Per the magistrate judge’s order, they must cease the practice of recording witnesses without consent and disclose any recordings currently in their possession.

Further, Greenwald said, “I find that the people behind these lawsuits are truly so odious and repugnant, that creates its own motivation for me.”

The first suit, filed in state court by Chicago attorney Michael Ian Bender on behalf of two Orthodox Jewish teens shot at in Rogers Park, is pending, though a circuit judge in Chicago threw out allegations that Smith’s parents were somehow responsible for the shootings.

That last paragraph doesn’t change the fact that Greenwald violated the rules and his professional conduct was ruled unethical:

The magistrate judge granted both motions, finding defense counsel’s conduct unethical under two separate rules: Local Rule 83.58.4(a)(4), prohibiting “dishonesty, fraud, deceit or misrepresentation;” and Local Rule 83.54.4, stating “a lawyer shall not … use methods of obtaining evidence that violate the legal rights of [another] person.”

How Glenn Greenwald Became Glenn Greenwald

Greenwald also spent roughly five years defending the First Amendment rights of neo-Nazis, including Matthew Hale, the “Pontifex Maximus” of the Illinois church formerly known as the World Church of the Creator, one of whose disciples went on a murderous spree in 1999.

“I almost always did it pro bono,” Greenwald said. “I was interested in defending political principles that I believed in. I didn’t even care about making money anymore.”

76 lawhawk  Wed, Feb 26, 2014 12:02:28pm

re: #70 Charles Johnson

Lawyers can take on pro bono for any number of reasons:

to fulfill their obligations to the state bar to provide legal assistance (the ABA recommends 50 hours annually, state bars can set their own levels);
to assist underserved populations;
aid individuals or groups in times of crisis - like helping victims after 9/11 or natural disasters navigate claims’ processes; or
providing assistance to a client because they believe in a cause.

There is sometimes an overlap between the reasons, and a lawyer might take on a case at a free/reduced rate to raise their own profile or because they believe in a specific injustice being committed - like a free speech concern.

77 Gus  Wed, Feb 26, 2014 12:04:34pm

On certain issues, though, his prose was suffused with right-wing conceits and catchphrases. One example was immigration, on which Greenwald then held surprisingly hard-line views. “The parade of evils caused by illegal immigration is widely known,” Greenwald wrote in 2005. The facts, to him, were indisputable: “illegal immigration wreaks havoc economically, socially, and culturally; makes a mockery of the rule of law; and is disgraceful just on basic fairness grounds alone.” Defending the nativist congressman Tom Tancredo from charges of racism, Greenwald wrote of “unmanageably endless hordes of people [who] pour over the border in numbers far too large to assimilate, and who consequently have no need, motivation or ability to assimilate.” Those hordes, Greenwald wrote, posed a threat to “middle-class suburban voters.”

Greenwald has since reversed his position and renounced the post about the “parade of evils.” (In his characteristically combative way, though, he blamed the recent rediscovery of his immigration writing on “Obama cultists” out to discredit him.) He ascribes that particular outburst to callow ignorance—a rather inadequate defense of remarks made by a seasoned 38-year-old New York lawyer.

By this point, Greenwald had come to reside in a peculiar corner of the political forest, where the far left meets the far right, often but not always under the rubric of libertarianism. He held positions that appealed to either end of the political spectrum, attacking, for example, U.S. foreign policy as a bipartisan projection of empire. Like most of his writings, his critique of America abroad was congenial both to the isolationist paleo-Right and to post-New Left anti-imperialists. His social liberalism struck an individualist chord pleasing to right-wing libertarians as well as left-wing activists. Greenwald began to envisage bringing these groups together—to dissolve the usual lines of political loyalty and unite the anti-imperialists and civil-liberties activists on the left with the paleoconservatives and free-market libertarians on the right—in a popular front against the establishment alliance of mainstream center-left liberals and neoconservatives….

Later in the same session, Snowden wrote that the elderly “wouldn’t be fucking helpless if you weren’t sending them fucking checks to sit on their ass and lay in hospitals all day.”

Snowden’s disgruntlement with Obama, in other words, was fueled by a deep disdain for progressive policies. The available postings by TheTrueHOOHA do show concerns about society’s “unquestioning obedience to spooky types,” but those date to 2010. Contrary to his claims, he seems to have become an anti-secrecy activist only after the White House was won by a liberal Democrat who, in most ways, represented everything that a right-wing Ron Paul admirer would have detested.

I agree with you, PO, but I think there is more going on here.
I believe the objective was the undermining of the US government and business, the cherry on the top being an African American president at the helm of said government. I’ve wondered since Day 1 why they waited until Obama was elected. The NSA has been around since 1952. Patriot Act and its egregious provisions were passed in 2001. The Bush administration tried to circumvent existing laws several times. But now, wait! The NSA is a problem!!! The Mainslime Media seem to just accept the script without challenge; why are the media not calling out that the “revelations” have involved documents that have nothing to do with the stated concern, i.e., “spying on American citizens”. This whole thing is an exercise in rodent procreation and while egos and greed are involved, I believe there is another agenda as well.

re: #44 Charles Johnson

For my part, this paragraph from the judge’s opinion is the most interesting (emphasis added)

Defendants’ attacks on the magistrate judge’s opinion are unpersuasive. They argue that the plain meaning of the rule does not prohibit surreptitious taping. But the law recognizes, in countless areas, that omitting material facts can be as misleading as affirmative misstatements . Attorneys, as officers of the court, are held to a particularly high standard of candor. This may include volunteering information that is not explicitly requested. That a conversation is being recorded is a material fact that must be disclosed by an attorney. Defendants also argue that modern technology and norms make the 1974 ABA opinion obsolete. The fact that recording conversations is much simpler and more pervasive now does not make it proper. If anything, it makes the need for this rule more compelling. The magistrate judge did not accept the ABA opinion blindly. He addressed each of these arguments, and his reasoning in rejecting them is thorough and logical. We agree with Magistrate Judge Ashman’s reasoning in its entirety, and consequently need not repeat it here.

This leopard has truly not changed its spots. GG’s entire “journalism career” is based on omitting material facts to mislead. Spin doctoring of that sort should be restricted to columnists, and not confused with real reporting.

San Francisco social media consultant Sarah Slocum says she was attacked this weekend for using Google Glass in a local bar. On her Facebook profile, Slocum said she was “verbally and physically assaulted” by bar patrons who jeered at her for using Glass and, she alleges, snatched the device off of her face. Slocum also said that she was robbed after leaving her purse in the bar as she pursued her alleged attackers.

She has posted a video of part of the incident to YouTube, though it doesn’t show the all the details of the alleged attack:

Another video, shared with San Francisco television station KRON4, shows one of the alleged attackers telling Slocum that people like her are “destroying” the city of San Francisco — a comment that ties this incident into a growing backlash against tech companies such as Google, Twitter and others in the city.

She shouldn’t have been attacked, but socially clueless, rich, tech industry fuckwits are in fact destroying SF.

Wearing Google Glass into a bar is pretty damned stupid. The only safe way to do that is if you’re riding a Segway while wearing a fanny pack on your belly, a mesh trucker cap and Crocs with socks, so there’s no doubt as to your ironic hipster bonafides.

Yeah the original Tea Partiers were actually complaining about something legit, they didn’t have a voice in the British parliament. Our tea partiers claimed it was unjust because they didn’t like who they had in Congress and the state legislature. And they weren’t whining about big government while at the same time demanding the government favor their religion/ideology like our tea partiers do with SSM.

The few less than savory characters that you and this site had previous associations with, were back before those people had shown their true colors and came out of the hate closet. As soon as they did, they were immediately kicked to the curb and called out for exactly what they were. (I’m talking about PJMedia crowd and the Gellar/Spencer crowd, not any of the commenters.)

Most of this happened a year or two before the site “Went Left” (which is a cartoonishly simplistic way of viewing this site IMO).

It is ALWAYS dangerous to be a whistleblower and try to work within normal routes. Snowden should have gone directly to the Senate oversight committee since they have the security clearance to evaluate the material. That may have protected him from what happened to Thomas Drake.

It bears repeating that when you punish and engage in bad faith prosecutions of actual whistleblowers…you will inevitably end up with a Snowden (and Snowden knew about the Thomas Drake case)

Oh, so that’s not the Dan Patrick who is the sportscaster. Had me confused for a moment.

We’re in the kamikaze phase of the war for gay rights now. These bills moving through state legislatures are the pilots flying their Zeros into the decks of the American aircraft carriers off Okinawa. The war is lost, and they know it, so they’re just going to go completely nuts in futility.

And 20 years from now, Bryan Fischer will be the lone Japanese soldier in the Filipino jungle who doesn’t know the war is over.

In a generation they’ll be looked upon like those fought frantically but pointlessly against desegregation and their “way of life.” The bitter enders will have either died off or be sitting in the back, making faces any time they see a lesbian couple walk up to the counter before sneering that “in their day,” those folks “knew their place.”

Exclusive: Latinos Are Punch Line at Joe Arpaio Roast

Kavanagh, who made headlines last year for trying to criminalize bathroom use by transgender people, used Latinos as a punch line in one racist joke after another, and the crowd lapped it up. The jokes and laughter, caught in an unguarded moment, reveal why conservatives have such a difficult time connecting with Latinos - there is a fundamental lack of respect. Watch:

“…when he goes out to eat with Arpaio, “most of the waitstaff and cooks dive out the back window.” “And when they don’t, I never know what the hell’s in my food,” he continued.:

I just hope that their endgame for this isn’t the same as it was for the Civil Rights movement in the 1960s and 1970s, since a lot of the same players are involved on the political right. Specifically of concern is the acts of violence these individuals advocated (and perpetrated) against their opponents.

I’m sure GG has changed too, in the opinion of most folks here, just not for the better in regards to the windmills he tilts at. I can see that he styles himself as a fighter for first amendment rights and personal privacy. If you use a broad brush to characterize his actions, yeah perhaps that qualifies, but the fights he chooses to fight and the methodologies that he employs put him beyond the pale for me. Those actions and their ethical ripples make me view him as some sort of self-delusional Don Quixote, fighting the good fight against non-existent villains as he trashes your front yard with a horse that has the trots.

Good that they’re studying the effects of aging on men’s reproductive capacity.

Older Dads at Much Higher Risk of Passing Along Mental Disorders

nbcnews.com

We’ll just have to hope that people can revert back to maturing at an earlier age to take on all the challenges of life. I’ve often said that we have extended a kind of faux adolescence way beyond its usefulness—that could also be a side effect of a materially rich society. That’s not to say that everyone should necessarily have children—it’s always up to the individuals involved. I think it’s also true that the heterosexual sex drive is geared toward mating and moderns have tamed that with birth control, a good thing, also, when you believe in population control and limiting the number of children you have. You can’t fool our biological functions too much, though, if you do want kids, by waiting too long. In the end, the “joke” on nature can backfire.

If women found their “biological clocks” ticking as they tried to get their lives in some semblance of educational, economic and social order before they had children and finding out later that they might have missed their chance without having to resort to extreme measures or adoption, men should be considering the same. Education, jobs, economics, although necessary to different degrees in a modern society—all of those are social constructs that actually can interfere with the optimum age to be having children.

I expect we will see a lot more research into this, along with other considerations about when the best time to have children would be. It’s going to be a societal challenge that I expect many people won’t want to tackle, but having both physically healthy and mentally healthy children should be the goal, not just having children.

…snip.

Why should not old men be mad?
Some have known a likely lad
That had a sound fly-fisher’s wrist
Turn to a drunken journalist;
A girl that knew all Dante once
Live to bear children to a dunce;
A Helen of social welfare dream,
Climb on a wagonette to scream.
Some think it a matter of course that chance
Should starve good men and bad advance,
That if their neighbours figured plain,
As though upon a lighted screen,
No single story would they find
Of an unbroken happy mind,
A finish worthy of the start.
Young men know nothing of this sort,
Observant old men know it well;
And when they know what old books tell
And that no better can be had,
Know why an old man should be mad.

In my case, “waiting too long” wasn’t by choice.

Not that that was necessarily a bad thing.

And now, as it’s getting less and less likely I’ll ever be a father, I have to take this info under advisement.

Super.

Well, I see that Mona Holland has now directly equated me to Matt Hale, the white supremacist in prison for conspiring to kill a federal judge.

Hmm.

Slander is when you say. In print, its libel.

Over February 20-25, a total of 180 Lenin monuments were demolished, which is more than during the whole period of independence.

Infolight.org.ua created an interactive map with the key dates and geography of the demolition of 206 Lenin monuments. Among the territorial units there are 114 cities, 51 townships and 41 villages having faced the “Leninfall” from December 8th, 2013 to February 25th…

Well, yes, I suppose a tweet would be considered “print”. I always think of a tweet as a short “phone call”. Haha.

Barton Gellman aware of legal risks

politico.com

Washington Post reporter Barton Gellman said Tuesday he’s aware of the legal risks that come with his reporting on Edward Snowden’s stolen documents. (my emphasis)

“I’ve certainly given a lot of consideration, so has the Washington Post, to legal risks and exposure and staying on the right side of the line,” Gellman explained during a panel discussion at the Georgetown University Law Center. “And I don’t rule out that there is legal exposure either criminally in an unlikely case or rather more likely civil compulsion. Just because Edward Snowden has outted himself doesn’t mean every part of my interaction or my reporting around these documents has been disclosed or I’d be willing to disclose any more of it.”

“While Attorney General Eric Holder has recently said the U.S. government won’t prosecute American journalists doing their job, Gellman cautioned “there’s lots of wiggle room there” for the Justice Department to continue investigations into the media.”

Please read the whole thing. The risk is there—but it doesn’t mean all older men will have children born with mental problems; the chances simply go up that they will be.

ONE THING IS CLEAR: The Founding Fathers never intended a nation where citizens would sit on their ass in front of a glass screen and grouse about everything they disagree with, don’t understand, or both.

what we need are some amish style constitutional literalists who believe that the constitution mandates we should have a 1789 era country with 2nd amendment flintlocks and militias, and only male propertyholders voting

otherwise i ain’t interested in yer ‘original intent’

Damn. If I had 30K I could actually stop having these freaking panic attacks over money. I could get out of debt and make it through the rest of the year without worrying about losing my house.

Except to do it like this asshole is would require me to steal from people and lie. Damn me and my stupid liberal morals.

{{{A Mom Anon}}}

You’ve gotten through bad times, and have the strength to do it again. Don’t let the worry turn to panic.

re: #277 Justanotherhuman

There are also a LOT of kids out there who need homes. Love is love, if you want to parent, you don’t absolutely need a biological child to do that. Adoption can be expensive, but we need more foster and adoptive parents in this country.

And you realize that Ben Franklin with the internet would blog, and then probably go trolling obnoxious boards simply for giggles.

He’d also be looking at all the hot french babes online too - all in the name of science, I’m sure ;)
