The National Security Agency’s top watchdog slammed Edward Snowden on Tuesday for failing to follow official protocol in relaying his concerns about wayward intelligence gathering and also faulted Congress for not vetting the details of post-9/11 surveillance programs.

“Snowden could have come to me,” George Ellard, the NSA’s inspector general, said during a panel discussion hosted by the Georgetown University Law Center.

Ellard, making his first public comments in seven years working for NSA, insisted that Snowden would have been given the same protections available to other employees who file approximately 1,000 complaints per year on the agency’s hotline system.

“We have surprising success in resolving the complaints that are brought to us,” he said.

It’s not just Snowden’s failure to ‘start the conversation’ about privacy and the NSA without committing serious crimes. It’s the failure of every journalist and activist who thought the conversation should be started. If they think Snowden is a hero for accomplishing this. they are using him as their human stepping stone every time they use the stuff he stole.

Not just a failure of the journalists and activists, either. Why couldn’t Wyden and Udall and Luap Dnar do anything without a leak?

They are excusing their own failings by pointing to Snowden’s theft.

In my opinion?

Calm, rational people who have taken the time to learn/understand the system and work with it think it’s blindingly obvious, but the majority of people:
1. Aren’t calm.
2. Aren’t rational.
3. Aren’t willing to take the time.
4. Aren’t willing to learn or understand.
5. Don’t trust the system.
6. Some combination of 1-5.

You know, for Texas to risk economic boycotts due to passing a law like that is something they might not consider harmful. The cities (Houston, Austin, Dallas, San Antonio) that host those events and conventions are the more liberal bastions of the state.

For Arizona everything is pretty much around Phoenix and to a much lesser extent Tucson. If you hit the Phoenix area you’ve pretty much hit half the population of the state.

We also agree with the magistrate judge’s reference to the Illinois Eavesdropping Act in applying Rule 83.54.4. Regardless of whether this statute is directly applicable to out-of-state recordings, it provides a reference point for what rights must be respected by attorneys practicing here.1 Illinois has conferred on its citizens a right not to be recorded without their consent. Because surreptitiously recording conversations violates a right recognized in this jurisdiction, attorneys appearing before this court may not do so. We also agree with Magistrate Judge Ashman’s analysis of the importance of a level playing field. This court’s rules must apply uniformly to all attorneys appearing here, regardless of their offices’ location. To permit otherwise is not only illogical, but would interfere with the fair administration of justice, in general, and undermine the purpose of the work product doctrine, in particular.

Given the rhetoric in the papers filed with respect to this difficult ethical question, we wish to clarify one last matter. We are applying rules here, not judging character. As the magistrate judge noted, although ultimately unsuccessful, defendants’ arguments were reasonable. Defense counsel could have reasonably believed that his conduct was permissible. Although we find that his conduct did violate the rules, our rejection of his position does not equate to an indictment as an unethical person.

However ending with:

For the foregoing reasons, defendants’ objections are overruled. Per the magistrate judge’s order, they must cease the practice of recording witnesses without consent and disclose any recordings currently in their possession.

A lawyer may tape a conversation without disclosure of that fact to all participants if the lawyer has a reasonable basis for believing that disclosure of the taping would significantly impair pursuit of a generally accepted societal good. However, undisclosed taping entails a sufficient lack of candor and a sufficient element of trickery as to render it ethically impermissible as a routine practice.

Greenwald also spent roughly five years defending the First Amendment rights of neo-Nazis, including Matthew Hale, the “Pontifex Maximus” of the Illinois church formerly known as the World Church of the Creator, one of whose disciples went on a murderous spree in 1999.

“I almost always did it pro bono,” Greenwald said. “I was interested in defending political principles that I believed in. I didn’t even care about making money anymore.”

Lawyers can take on pro bono for any number of reasons:

to fulfill their obligations to the state bar to provide legal assistance (the ABA recommends 50 hours annually, state bars can set their own levels);
to assist underserved populations;
aid individuals or groups in times of crisis - like helping victims after 9/11 or natural disasters navigate claims’ processes; or
providing assistance to a client because they believe in a cause.

There is sometimes an overlap between the reasons, and a lawyer might take on a case at a free/reduced rate to raise their own profile or because they believe in a specific injustice being committed - like a free speech concern.

On certain issues, though, his prose was suffused with right-wing conceits and catchphrases. One example was immigration, on which Greenwald then held surprisingly hard-line views. “The parade of evils caused by illegal immigration is widely known,” Greenwald wrote in 2005. Greenwald has since reversed his position and renounced the post about the “parade of evils.” (In his characteristically combative way, though, he blamed the recent rediscovery of his immigration writing on “Obama cultists” out to discredit him.) He ascribes that particular outburst to callow ignorance—a rather inadequate defense of remarks made by a seasoned 38-year-old New York lawyer.

By this point, Greenwald had come to reside in a peculiar corner of the political forest, where the far left meets the far right, often but not always under the rubric of libertarianism. He held positions that appealed to either end of the political spectrum, attacking, for example, U.S. foreign policy as a bipartisan projection of empire. Like most of his writings, his critique of America abroad was congenial both to the isolationist paleo-Right and to post-New Left anti-imperialists. His social liberalism struck an individualist chord pleasing to right-wing libertarians as well as left-wing activists. Greenwald began to envisage bringing these groups together—to dissolve the usual lines of political loyalty and unite the anti-imperialists and civil-liberties activists on the left with the paleoconservatives and free-market libertarians on the right—in a popular front against the establishment alliance of mainstream center-left liberals and neoconservatives….

I believe the objective was the undermining of the US government and business, the cherry on the top being an African American president at the helm of said government. I’ve wondered since Day 1 why they waited until Obama was elected. The NSA has been around since 1952. Patriot Act and its egregious provisions were passed in 2001. The Bush administration tried to circumvent existing laws several times. But now, wait! The NSA is a problem!!! I just hope that their endgame for this isn’t the same as it was for the Civil Rights movement in the 1960s and 1970s, since a lot of the same players are involved on the political right. Specifically of concern is the acts of violence these individuals advocated (and perpetrated) against their opponents.

i just find it strange, people and things do change, yeah, this site sure isn’t what it was five, ten years ago… people can and do change depending upon the person and what moves and influences them.

I’m sure GG has changed too, in the opinion of most folks here, just not for the better in regards to the windmills he tilts at. I can see that he styles himself as a fighter for first amendment rights and personal privacy. If you use a broad brush to characterize his actions, yeah perhaps that qualifies, but the fights he chooses to fight and the methodologies that he employs put him beyond the pale for me. Those actions and their ethical ripples make me view him as some sort of self-delusional Don Quixote, fighting the good fight against non-existent villains as he trashes your front yard with a horse that has the trots.

If women found their “biological clocks” ticking as they tried to get their lives in some semblance of educational, economic and social order before they had children and finding out later that they might have missed their chance without having to resort to extreme measures or adoption, men should be considering the same. Education, jobs, economics, although necessary to different degrees in a modern society—all of those are social constructs that actually can interfere with the optimum age to be having children.

I expect we will see a lot more research into this, along with other considerations about when the best time to have children would be. It’s going to be a societal challenge that I expect many people won’t want to tackle, but having both physically healthy and mentally healthy children should be the goal, not just having children.

We’ll just have to hope that people can revert back to maturing at an earlier age to take on all the challenges of life. I’ve often said that we have extended a kind of faux adolescence way beyond its usefulness—that could also be a side effect of a materially rich society. You can’t fool our biological functions too much, though, if you do want kids, by waiting too long. In the end, the “joke” on nature can backfire.

Barton Gellman aware of legal risks

Washington Post reporter Barton Gellman said Tuesday he’s aware of the legal risks that come with his reporting on Edward Snowden’s stolen documents. (my emphasis)

“I’ve certainly given a lot of consideration, so has the Washington Post, to legal risks and exposure and staying on the right side of the line,” Gellman explained during a panel discussion at the Georgetown University Law Center. “And I don’t rule out that there is legal exposure either criminally in an unlikely case or rather more likely civil compulsion. Just because Edward Snowden has outted himself doesn’t mean every part of my interaction or my reporting around these documents has been disclosed or I’d be willing to disclose any more of it.”

“While Attorney General Eric Holder has recently said the U.S. government won’t prosecute American journalists doing their job, Gellman cautioned “there’s lots of wiggle room there” for the Justice Department to continue investigations into the media.”

There are also a LOT of kids out there who need homes. Love is love, if you want to parent, you don’t absolutely need a biological child to do that. Adoption can be expensive, but we need more foster and adoptive parents in this country.
