So this happened.

On Wednesday, after former IRS official Lois Lerner invoked her Fifth Amendment rights against self incrimination, Issa quickly moved to adjourn the session, saying he could “see no point in going further.” But as Cummings began to ask a procedural question about the issue, the Chairman tried to cut his mic, leaving Cummings to shout from his seat.

“I am a member of the Congress of the United States of America! I am tired of this,” he said, adding that after spending at least $14 million, the Committee has uncovered “no evidence to support allegations of a political conspiracy against conservative groups.”

Issa tried to abort the meeting after Lerner invoked her 5th Amendment right, and Cummings attempted to ask a question, prompting Rep. Issa (R-National Enquirer) to pull an O’reilly: cutting Rep. Cummings’s mic, and since he can’t cut to commercial, literally running from the room.

It’s exactly the right ruling. Under the law, the current behavior is not technically illegal, and our legal system (for better or worse) is one that hinges very strongly on technical correctness. We don’t get to post-facto criminalize something just because we think it’s really fucked up.

The court explained this in gory detail, explained that a revised law that criminalized this behavior would withstand constitutional scrutiny, and essentially handed the MA legislature a blueprint of exactly what that law would look like, and how it should be phrased and written, and no doubt said legislation will be law in very short order.

This is exactly how the US justice system is supposed to work.

While the court gives the blueprint to “fix” the law, I don’t think it was necessary.

On December 8, 2011, two criminal complaints issued charging the defendant under G.L. c. 274, § 6, with attempting to commit the offense of photographing, videotaping, or electronically surveilling a nude or partially nude person in violation of § 105 (b ).

The point of the activity is to view a woman’s genital region in the hope of viewing skin - in other words, the part in partially nude. It doesn’t just apply to someone who’s topless or completely naked.

The other argument that the law is overbroad or vague, and I’m not sure that is the case either.

The proposed fixes resolve those issues going forward, but here’s the crux of the argument and why the court ruled as it did. It’s in the footnotes:

[FN14] A female passenger on a MBTA trolley who is wearing a skirt, dress, or the like covering these parts of her body is not a person who is “partially nude,” no matter what is or is not underneath the skirt by way of underwear or other clothing. [FN15]

From that position, you can’t find the defendant guilty. Therefore the only way to resolve this is to find him not guilty and call on the legislature to fix the law to give women an expectation of privacy and criminalize the act of upskirting directly.

Autumn Radtke, the CEO of an upstart online currency exchange, died last week under mysterious circumstances at her home in Singapore.

What was omitted during the Fox appearance was that the September 2010 emails reveal Lerner counseling her colleagues to be careful not to focus on political activity while examining 501(c)(4) nonprofit organizations. Early in that email chain, which was obtained by Media Matters, Lerner wrote: “My object is not to look for political activity—more to see whether self-declared c4s are really acting like c4s. Then we’ll move on to c5, c6, c7 - it will fill up the work plan forever!”

Furthermore, the emails do not appear to be about reviewing organizations’ applications for tax exempt status, which is the process the IRS is accused of inappropriately conducting. Instead, the emails reference the “self declarer project,” which attempts to review groups which self-declare as tax exempt but do not file an actual application, to ensure those groups are still following the rules. (The “Self-Declarers Questionnaire” which tracks these groups is entirely voluntary.)

It was April 29, 2010, and Scott Walker was in full campaign mode in his race for governor.

The Milwaukee County executive was feeling the heat from a group of county supervisors, who planned to a hold an 11 a.m. news conference to rip his stewardship of the county’s troubled Mental Health Complex.

Walker, his campaign aides and taxpayer-funded county staff were burning up private email, trying to counter the supervisors’ expected attack. To knock down complaints, aides decided they needed a statement from a political ally, and focused on state Sen. Alberta Darling (R-River Hills).

At 10:25 a.m., Walker — writing from his campaign email account — weighed in.

He would not only write Darling’s response, he would order that the communication be done in a way so that it would remain secret from the public.

Photographer Sergey Prokudin-Gorsky was one of the nation’s leading photographers at the beginning of the Twentieth Century. He was commissioned to capture a photographic record of Russia after the monarch saw his colour portrait of Leo Tolstoy.

During 1909-1912, and again in 1915, Prokudin-Gorsky completed surveys of 11 regions, travelling in a railroad car provided by the government which was equipped with a darkroom.

Prokudin-Gorsky, who was born into an aristocratic family in St Petersburg in 1863 and studied chemistry and art, was granted access to areas of Russia that were forbidden to everyday citizens. This allowed him to document Russia’s people and landscapes at the beginning of what would be a dramatic century for the nation.

The photographer was able to capture the scenes in colour, allowing the audience a vivid sense of what life looked like, through using a three-colour technique. This involved taking three separate photographs, one with a red filter, one with a green filter, one with a blue filter.

These monochromatic images would then be projected through filters of those same colours on to a screen and superimposed. When seen through a final filter, they would appear amazingly realistic.

Many of the photos are genuinely stunning; it’s certainly worth checking out.

Well, I missed the entire Abby Martin thread, but expected it would be her “quitting”, not Liz Wahl, but whatever. But whatever. It was a vacuum gun of some sort. Basically an upgraded air cannon that applies vacuum to the barrel and fires an air pulse into the breech. They tried several iterations before settling on that design.

‘A landmark day’ for Dallas’ LGBT community as council passes comprehensive LGBT resolution

Before the Dallas City Council voted on the so-called “comprehensive statement of support” for Dallas’ LGBT employees, a long line of folks, including former City Council member Veletta Lill, paraded to the lectern to ask for the council’s support. They didn’t need to: The resolution — which, among other things, directs City Manager A.C. Gonzalez to address inequalities in the city’s pension and health-care plans — passed by a vote of 13-2, with council members Sheffie Kadane and Vonciel Jones Hill voting against it, as expected.

But, of course, there wasn’t an entirely smooth pathway to passage: Tennell Atkins chided Gonzalez and city staff for turning a statement into a resolution without first warning him two weeks ago. And Kadane reiterated his complaint that the resolution is “discriminatory,” in that it applies solely to inequalities involving LGBT employees and citizens.

But in the end, after very little discussion, the council passed the resolution. Council member Scott Griggs called it “a landmark day for the city of Dallas.” His colleague Jerry Allen, chair of the committee in which the resolution was born, said today would be remembered as “a historic day — for equality, civil rights, inclusion.” Carolyn Davis said she was voting for the resolution because “this is the right thing to do.”

And Mayor Mike Rawlings, who last year didn’t want the council to discuss a marriage equality resolution that he believed was a “misuse” of time, voted in favor of the resolution.

Buhl Planetarium in PGH had a monster Van De Graaff. They would rope off half the concourse and send ‘lightning’ 20 or 30 feet to earthing bands on the wall. Then they’d cut it back and fuzz out some brave long-haired girl. We neighborhood kids could just drop by. ‘Tricity is cool.

The court explained this in gory detail, explained that a revised law that criminalized this behavior would withstand constitutional scrutiny, and essentially handed the MA legislature a blueprint of exactly what that law would look like, and how it should be phrased and written, and no doubt said legislation will be law in very short order.

This is exactly how the US justice system is supposed to work.

Unless it is politically inconvenient (ACA), then you just waive or delay the requirement that you personally signed into law.

He’s located in Russia, and almost every video he’s posted is heavily slanted pro-Putin, including some attacking Human Rights Watch and the US in regards to Syria. Take this into consideration when judging the credibility of the assertations made in the video.

No surprise there. I think it’s also a safe assumption the “leaked” phone call was another Russian wire tap.

Good for Dallas! A lot of people don’t realize that Houston was the first big city in American history to elect an openly gay mayor. She’s Annise Parker, she’s been in office 3 years, and she recently got married (but had to come to Cali to do it, since TX doesn’t even have civil unions, much less SSM.)

Anyway, these little things show that not all of TX is regressive. But I could never live there again. The weather is just horrendously hot and/or humid during the 6-month summers. No relief at night, either…hot all the fucking time.
