Question:
If one were to want to move away from Dropbox because Condi Rice has joined their BOD, what is the best option for a similar service (free)?

It sucks when you find out that someone you thought you knew …isn’t that person.

Take some space, take a breather, and consider whether you could have a friendship on different terms without politics being involved. It won’t be the same, but …just a thought for a night that’s not tonight.

I do about the same thing, but I cut ‘em, nuke ‘em, then finish them off on the stove top. Timing becomes almost a non-issue that way for me.

But anyway you do it, ‘taters with Olive Oil and Rosemary (and maybe a little Thyme) are a treat.

about the only thing I use cilantro in is when I make Chile Verde with Pork. Even then It’s only part of a small bunch.

On the other hand I do like Coriander, and it’s the same plant. I’ve never cooked with Coriander root, but I’ve seen it at some international markets. I wonder if there are any other plants where we use the leaves, the seeds, and the roots? I can’t think of any off-hand.

It’s always useful, if you can, to frame a shot like that with something man made somewhere in it to give a sense of scale to things. Once done, it is hard. I can get a feel based on what those kinds of geological layers are often like and from knowledge of the few craters out west :) but that doesn’t help you now, alas. Perhaps try to make the trees more noticeable with the a tweak of your curves or channels?

Well, apparently it is an Amida Buddha which this article insists is not Siddharthha Guatama.

But it is in Kamakura, Japan, and was once housed in a great hall which was swept away in a tsunami hundreds of years ago. (And, for the record, the ocean was not really visible from there, although part of that was mountain and city.)

You can go inside it! That was cool.

That site is a tricky one. I have a panorama which shows a few rocks to the side, but your access is limited (and they were under construction to boot) so…

This is 18mm before the digital conversion, I think. But. I travel with an 18-135mm on the camera pretty much full-time, and have been reasonably happy with it.

Primes have their advantages (I won’t deny!) but not having to switch for zooming in the rain also has pluses.

Yeah, mine wasn’t a kit, but from a pro photographer friend who was getting out of SLR in favor of the Fuji mirrorless system. He’d already sold his wides to another photog, so I got the body (and a nice battery pack/speed drive) and the 50mm. I bought the other, thinking I’d use the longer length more. Should have thought that through better.

I wanted to get up to Misawa Air Force Base this past trip, because that’s actually where my aunt was born and Grandpa was stationed twice, but …the train schedules were shit. And there’s stuff I want to do up that direction that would require a car, so we decided to save it for the next trip.

I knew I leaned landscapes, so the wides have always been a draw, and I did some serious research before plunking down for the Pentax. At the time it was best value for money, *especially* on the low-light end. None of the photos I’ve posted have ever used flash.

None.

(I might admit to careful editing in post-process though.)

Girls believe the myth that men can’t help it. The girls interviewed described men as unable to control their sexual desires, often framing men as the sexual aggressors and women as the gatekeepers of sexual activity. They perceived everyday harassment and abuse as normal male behavior, and as something to endure, ignore, or maneuver around.

These Bundy Ranch people are fucking crazy. They apparently believe that Article 1 Section 8 Clause 17 of the Constitution has been violated.

To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings;

Get it? The land was never purchased from the State of Nevada. Well guess what, that’s because federal government ownership of the land predates the creation of the State of Nevada. The land was won in the Mexican American war, and curiously enough Article 1 Section 8 has something to say about that too:

To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water

So yeah, that’s a little bit inconvenient for Bundy, inasmuch as the creation of a State doesn’t automatically give that State government ownership of federal holdings previously established within it. The State never owned that land, that’s why they aren’t the ones going after Bundy for fees. Bundy doesn’t own it either, or he’d have a deed to the property.

Bundy’s argument basically amounts to “I own the land by right of fuck you!” He’s claiming his ancestors have been using the land to raise cattle since the 1800s, so he automatically has dibs despite having no paperwork to show that the land was passed down to him. And of course his refusal of the federal government’s authority has absolutely nothing to do with his decision 20 years ago to stop paying grazing fees because he didn’t like the changes the BLM made to the lease.

In other words, he’s a freeloading squatter who’s becoming a wingnut icon because he’s also a sovereign citizen loon who knows all the right cards to play to convince the fellow loons that he’s a “victim.”

Thing is, Bundy never owned the land. He had a lease to graze his cattle on the land, but decided 20 years ago that he wasn’t going to pay the grazing fees anymore because he didn’t like the new terms of the lease. He was restricted to 150 heads of cattle, but he’s grazing ten times that many. He was restricted to 158,000 square miles, but his cattle are now spread out over 750,000 square miles. There’s so many of them running around that there’s actually feral cattle now who are running wild on federal land because he’s not keeping proper track of them.

He’s not even really asserting he owns the land, he’s asserting that since his family’s been grazing the land since the 1800s, then he has grazing rights that the federal government is denying him. And says that the federal government can’t own the land, only the State of Nevada can, which probably has to do with the State not demanding fees for grazing cattle on the land.

I sympathize with the guy, but according to the feds geothermal resources are unambiguously treated under mineral rights. If BLM owned all the adjacent land or if the feds sold him the deed without transferring those rights then it’s likely he would have lost in the end anyway.

I have seen State issued water rights that grant through passage for hydro-power systems, and for use of the warm water surface output from naturally occurring hotsprings. Magic Hot Springs in Idaho was for sale and used to have all the documents available on a website.

167 goddamnedfrank  Apr 12, 2014 12:50:44am

re: #166 goddamnedfrank

IIRC the Magic Hot Springs property was originally settled in the 1800’s under the Homestead Acts. The water rights to the runoff and therapeutic use of the naturally occurring hot springs dated to that time. The hydro power water rights dated much later to some guy who owned the property in the 1960’s I think. He built a shitty looking run of the river dam with a head of 10 ft or so at something like 17 cubic feet per second. I did the math and came up with a likely maximum output of around three kilowatts. Last year when the place was still for sale the dam was in disrepair and they were getting all their power from diesel generators.

168 goddamnedfrank  Apr 12, 2014 1:04:07am

Here’s an internet archive of the Magic Hot Springs website as it was.

I wonder if anyone has done a title search on the land Bundy claims was “passed down” to him in the last century by his Mormon ancestors?

“Bundy claims ancestral rights to graze his cattle on lands his Mormon family settled in the 19th century. He stopped paying grazing fees and disregarded several court orders to remove his animals.”

washingtonpost.com

We know his ancestors took what they wanted. I doubt that additional land grabs were that uncommon over the years, and a few bucks went a long way. Under “adverse possession” land can often be added under color of title, and in Nevada, that is only 5 yrs. Pay taxes on it, and it’s yours. At the same time, it’s illegal to squat on Federal land, which is what he’s doing with his cattle. I would imagine a lot of western land stakes were simply walked away from, being hostile and/or not worth the work, not suitable for farming or non-productive in some other way, and claimed by others over time, except, of course, that this was denied to the original occupying Native Americans who had an entirely different concept of “private property” than the European concept, which interestingly, sounded closer to squatting itself though not ownership—if you worked the land, that was the “ownership” of it, not the plot of earth itself, so a “title” would never be needed.

Nevada
5 yrs.and Color of Title: 5 yrs. and Color of Title/Payment of Taxes: 5 yrs.

You can look at western states here and see how easy it is (or was) to squat on unoccupied land and the short periods of time it took to claim them, no doubt a holdover from the past when it was open territory and “homesteading” was common and encouraged.

FYI kids, the whole origin of federal ownership of lands in Nevada is easy to document, it’s in the State Constitution.

Third. That the people inhabiting said territory do agree and declare, that they forever disclaim all right and title to the unappropriated public lands lying within said territory, and that the same shall be and remain at the sole and entire disposition of the United States; and that lands belonging to citizens of the United States, residing without the said state, shall never be taxed higher than the land belonging to the residents thereof; and that no taxes shall be imposed by said state on lands or property therein belonging to, or which may hereafter be purchased by, the United States, unless otherwise provided by the congress of the United States.

The #BundyRanch folk don’t like this news at all, I can tell you. Here’s a little history on how this ownership arrangement came about.

A second convention to write a state constitution therefore met from July 4-27, 1864. The defeated 1863 constitution was used as the basis for the new document. The requirements of the congressional enabling act were duly incorporated at the beginning of the constitution in a section called “The Ordinance.” This included the outlawing of slavery, and the statement that all undistributed public lands would be retained by the federal government and could never be taxed by the state. These provisions would be “irrevocable” without the consent of Congress and of the people of Nevada. The new constitution also included a “paramount allegiance” clause, proclaiming the supremacy of the United States government over the states and that no state had the right to secede, both very much Republican party doctrine, and voluntarily inserted into the document by its makers.

Yes, a copy of the NV constitution was rushed by telegraph to DC days before the 1864 election so that NV could cast its 3 electoral votes for Lincoln’s re-election. : )

It does make you wonder just when Bundy’s “Mormon ancestors” made their land claim on what he says constitutes his “ancestral rights”? If it was after 1864, then he may be on land illegally obtained in the first place.

A sign seen near the Bundy ranch.

These people are the closest to an internal enemy we’ve ever had, and they’re dangerous because they don’t mind using force, rather than the courts, to get their way. And even if they do use the courts, when they disagree with the courts, they still intend to flout the law and use force to get their own way.

re: #149 Targetpractice

Almost makes you wish the BLM could arm the desert tortoises with lasers and let them deal with him!

He being of Mormon stock isn’t really germane to the situation is it?

If the family had title to the land being used for grazing he would have produced it years ago in the court cases. So he’s gone sovereign citizen and is out to collect the martyr cookies since he doesn’t have a leg to stand on and the BLM finally opted to do the equivalent of foreclose on him and turned up with the proper paperwork. And these are all “law and order” people (of course) up until the law doesn’t give them exactly what they want.

And Bundy claims only the state court has jurisdiction. And, of course, if it ruled against him, he’d then claim that only the county court had jurisdiction. And when that ruled against him I’m sure some sort of posse commitus (sp) would appear that would rule in his favor and he’d decide that only they had jurisdiction.

I know I’m living on native land which belonged to the Catawba people prior to whites settling here because it’s been documented in the history of this county and their fights with Cherokees, also, over settlements along the now named Catawba River. It’s a comforting thought, actually. I can imagine they might have even lived on the very land I’m on, since it’s very close to a small creek and there is a huge aquifer in this area that has supplied water for wells here for centuries. The land is fertile and was farmed not just by the Catawbas (who were agriculturalists) but up until recently when housing developers started moving into the eastern part, on the lake (man-made by damming the river for Duke Energy power plants in the 1960s) and the farms started being sold off.

re: #147 goddamnedfrank

These Bundy Ranch people are fucking crazy. They apparently believe that Article 1 Section 8 Clause 17 of the Constitution has been violated.

Get it? The land was never purchased from the State of Nevada. Well guess what, that’s because federal government ownership of the land predates the creation of the State of Nevada. The land was won in the Mexican American war, and curiously enough Article 1 Section 8 has something to say about that too:

So yeah, that’s a little bit inconvenient for Bundy, inasmuch as the creation of a State doesn’t automatically give that State government ownership of federal holdings previously established within it. The State never owned that land, that’s why they aren’t the ones going after Bundy for fees. Bundy doesn’t own it either, or he’d have a deed to the property.

Thanks for finding this. I used it to smack an idiot libertarian (but I’m repeating myself) this morning at another site.

There’s also some legal case law on the subject, because of course there is.

In 1885, the Supreme Court ruled that there were two additional ways in which the United States could acquire federal enclaves: (1) the states could “cede” legislative jurisdiction to the United States, and (2) the United States could “reserve” legislative jurisdiction at the time of statehood. The Supreme Court added that these “cessions” and “reservations” were not limited to Enclave Clause (“needful building”) purposes.[11]

re: #259 goddamnedfrank

So the enclave clause actually did govern certain acquisitions outside DC. But because that method sucked the Supremes okayed other methods.

Which is kind of obvious, because otherwise there’d be a bunch of unconstitutionally large military bases, national parks and suchlike.

Exactly. Dude needs to just pay his fees. He would pay a neighbor for water or grazing right? I get grazing lands go way beyond the boundaries of owned ranch land. That might even be better than transporting feed to concentrated herds at least for the environment.

Haven’t his cows pretty much spread out to something insane like 750 sq mi? I think someone here mentioned that last night. Also, some of the cattle are now feral, which is a whole other problem.

That’s far beyond 160 acres. Dude needs to pay his fees or expect the feds to take all his cattle, send them to slaughter, and send him a thank you card for the donated meat to feed the hungry and homeless in his area.

Many are thinking of the Branch Davidian raid what with this big operation going on. I don’t think it’s going to get anything like the Davidian raid.

Anyway for those newly interested I went looking for a review that was not all in for the militias. Obviously that raid went horribly wrong and accusations that friendly fire caused some of the deaths have not been put entirely to rest given the relative silence from ATF,

Interesting to note the agency paid a huge defamation settlement to one of the raid commanders. An indication candor had been lacking from both sides, no?

I found this at policeMag.com

February 27, 2013
Prior to now, the best way to hear from the agents who were in Waco that day was to turn to two retired agents who have given their accounts. Chuck Hustmyre published his in-depth account of the raid in 2003 online. And Robert Rodriguez, who infiltrated the Branch Davidian cult as an undercover agent, spoke to KENS-TV in 2010. Rodriguez sued his supervisors and the ATF in 1995, claiming they defamed him and conspired to make him a scapegoat. The suit was settled out of court and Rodriguez received nearly $2.3 million in damages.

ATF commanders hadn’t spoken about the planning and rationale for the raid. That changed earlier this month.

As part of the National Law Enforcement Museum’s “Witness to History” lecture series, three retired ATF commanders who planned and orchestrated the raid gave their accounts. Their candid remarks offered the most detailed insider’s view yet of the raid. They were joined by Reavis, who said the agency’s search warrant was flawed.

The panelists included Pete Maslin, the raid’s deputy incident commander; Jerry Petrilli, the team leader of the Dallas Special Response Team; and Bill Buford, co-leader of the New Orleans SRT. The event was hosted by Craig Floyd, NLEOMF’s chairman and CEO.

According to sources, the BLM wants to proceed with the sale of the cattle already gathered during the roundup but is reportedly willing to share the revenue from the sale with Bundy.

That’s probably what they mean, instead of just considering the cattle forfeit and not crediting the sale against the debt. BLM should definitely deduct the cost of enforcement from the sale revenue though.

Many are thinking of the Branch Davidian raid what with this big operation going on. I don’t think it’s going to get anything like the Davidian raid.

As is usual for me, I’m going to ramble haphazardly. Feel free to ignore.

I was living in Waco when the Branch Davidian thing went down. The documentary, “Waco: The Rules of Engagement” comes to some conspiracy theory-ish conclusions that I don’t know if I buy entirely, but the parts of the film that deal with the sudden clamor of media activity in the days leading up to the initial raid by ATF absolutely match my memories of what was going on at the time. The Waco Tribune-Herald ran a multi-part, front-page “exposé” about David Koresh out of nowhere that just oh-so-very coincidentally reached its panic-inducing conclusion in the issue printed the day of the raid. It is a fact that the Branch Davidians were alerted to the impending raid by virtue of the fact that TV news trucks arrived at the compound well ahead of the ATF.

Another point made by the documentary that I know to be true from personal experience is that David Koresh and other “top members” of the Branch Davidians were by no means reclusive. They didn’t stay barricaded 24/7 in Mount Carmel. David Koresh was a frequent customer of a couple of music stores in Waco, and I saw him trying out guitars on more than one occasion. The existence of the Mount Carmel compound was not a secret, and it is true that if the feds had wanted to arrest David Koresh without incident, there were common opportunities to pick him up in any one of the many places he frequented in Waco.

I was also heavily into computer bulletin board systems at the time, and there were quite a few in Waco. I got ahold of a list of local BBSs and tried them all out. It was common for certain sysops to require “voice verification”, which basically meant that you would apply for an account, then they would call you up just to briefly chat and get you to confirm that you really were who you claimed to be, and to tell you about the rules of the BBS, etc. A 5-minute conversation at most, usually. Well, one of the BBSs at the time was one called “Brazos de Dios”. It was run by Wayne Martin, one of the “top members” of the cult. I didn’t know any of that at the time. Wayne called me up and told me that the BBS was mainly “church-oriented”, and gave me access. I logged in one time, looked around, and found that there was nothing there that appealed to me. I didn’t look very deeply at it, but it just seemed like boring religious stuff. It certainly was not crazy doomsday hellfire, at least not on the surface. Compared to the Heaven’s Gate website, for instance, it was downright mundane.

When the raid turned into a standoff, the media circus got worse. Alex Friggin Jones was starting to make a name for himself, and he came up from Austin to be Alex Jones as near to the site as he was allowed. There were merchandise vendors who printed T-shirts, buttons, bumper stickers, and the like. I bought a t-shirt, and still have it. There were many designs. For historical purposes, I wish I had bought more stuff.

Front

Back

International press came. One of my friends spoke to a man from the BBC who was very obviously trying to frame the story in terms of Waco being a “one-horse town where the horse has died,” and that the town was so overflowing with religious fundamentalists that these sort of apocalyptic doomsday cults are a feature, not a bug. Now, I’m not a big fan of Waco for a lot of reasons, but that is an absurd exaggeration.

One of the things that supposedly led to the raid was that a UPS driver reported that a package had “broken open” revealing firearms, inert grenade casings, and black powder. Two things: First, all of those items were legal to possess, buy, and ship at the time. Second, although I did not know her or her family at the time, the UPS driver in question was the uncle of the woman I married several years later. I came to know him pretty well, and I can attest that he is a nutter. He’s a lot like “Dale Gribble” from King of the Hill. No conspiracy theory is too crazy for him. His wife was a nut, too, frequently falsely claiming to have various cancers and other severe diseases which of course no doctor would ever agree with because they were all out to get her or something. At any rate, there may very well have been such a package, and it may very well have “broken open”, but honestly if that guy told me that three comes between two and four, I’d feel like I needed to verify it independently.

Another thing is that, although I highly doubt that the conclusion to the Branch Davidian standoff was the conclusion they’d hoped for, both the ATF and FBI could not have fucked up the situation more thoroughly than they did even if they had deployed a computer-assisted, liquid nitrogen-cooled, industrial-grade Situation Up-Fucking Device. If you listen to the tapes of the conversations between the Branch Davidians and the FBI negotiator, it’s hard not to come to the conclusion that any random person off the street could have done a better job of talking them down. They goaded the Branch Davidians, famously employing so-called “psychological warfare” including playing weird noises over loudspeakers for days on end. If you *wanted* to keep a standoff tense and hostile, you could not have done a better job than was done by the Feds at Waco.

I admit I haven’t followed the “Bundy Ranch” thing very closely, but from what I’ve seen it doesn’t seem even remotely similar to Waco.

Only in the sense of a big raid, militia noise, rancher family vs “Big Gov”, and a potential to get out of hand. And if you read the linked piece I think it shows the lessons learned then that helped this go well now.

Interesting perspective on calling people un-American
Dems label foes ‘un-American’

“Thomas Jefferson was considered too French. He was called un-American and a Francomaniac,” said Rosemarie Ostler, author of Slinging Mud, a book covering two centuries of political insults. “He did things that weren’t ‘really American,’ like being interested in wine.

“Every time it comes up, it means something different.”

I don’t know a ton about the standoff, but I do know that it’s totally standard policy for law enforcement to try to arrest people away from their homes, because that’s the time they’re most vulnerable and least likely to have access to, oh, shitloads of guns.

However, maybe they thought that he had standing orders for everyone to kill themselves or something if he got arrested. I don’t know. I think it’s obvious ATF and the FBI wish they could have gotten a better outcome, but in the end the real villain is still Koresh. The FBI and ATF may—and again, I don’t know, because I have no idea how to do the kind of shit they do—have fucked it up, but that’s not malice. Koresh was the madman asshole that started the whole deal.

It will take a bit of adjustment but I think he’ll be able to make it work. His job is probably safe. Late night shows are mainstream, non-political and inoffensive comedy so if he plays it safe for six months everybody will even forget his Colbert character from Comedy Central. I think he’ll be fine.

I’m happy to be a pesca-vegetarian and not support this monstrous industry.

Being unemployed has done wonders for my meat consumption. I think these days I just buy some chicken from the nearby meat market once a week when they put it on sale super cheap and i buy tons of fresh veggies. I’ll take some of it and turn it into large dishes like caldo de pollo (i.e., Mexican chicken soup) or enchiladas and shred the rest for whatever else comes to mind.

Once I start working again I might splurge on the occasional night out for a local burger or some BBQ, but I’ll probably still stick to eating lighter the way I have been.

The thing about Waco is that we hadn’t had Waco yet, and now we have. It does seem like the feds screwed it up, but they also seem to have learned the right lessons from it (fingers crossed).

The blame lies with David Koresh. That being said, that incident led to fundamental changes in how raids are conducted. Law officer gunfights gone bad do that. Not to indict the people involved but to highlight how strongly agencies will change when needed.

From my link-Bold from article

No contingency plan. Buford said he didn’t develop a plan for a strategic withdrawal if the raid went sideways, and ATF agents only began to pull back when they began running out of ammo. “You can’t make a snap decision when you’re under fire,” Buford said. “We were like lost sheep leaving the compound.” A strong contingency plan is now required on every ATF raid.

Overly confident planning involving an unknown threat. The Branch Davidians presented a new kind of threat to law enforcement—a heavily armed doomsday sect. Raid planners didn’t adequately address Koresh’s apocalyptic beliefs and willingness to defend the compound to the death. The ATF also had a nearly flawless track record using entry control teams without a full-fledged tactical unit. “We had never failed before,” Maslin said. Buford added, “We were going to go in there, kick a little booty, and be home by noon. It didn’t work that way.”

A Nevada cattle rancher appears to have won his week-long battle with the federal government over a controversial cattle roundup that had led to the arrest of several protesters.
