Range War: The Bureau of Land Management Blinks

Patriots™ cheering as BLM turns tail and runs
Politics • Views: 17,043

In an interesting twist to the BLM vs. Bundy standoff in Nevada, the BLM has released 400 cattle they rounded up belonging to Cliven Bundy, a rancher at odds with the government for 20 years. See previous LGF posts here and here.

Several hundred Bundy backers converged on Bureau of Land Management holding pens all Saturday afternoon. Many of them were armed.

All over the internet, right wing websites (including Fox News) have painted Bundy as a folk hero, but the fact is he’s been not just grazing, but overgrazing, more than 900 cattle on public land without payment.

Oathkeepers and assorted Patriot nutcases descended on the cause, armed, and threatening a shootout with government authorities if the cattle confiscated by the government weren’t released.

Earlier in the afternoon, about 2 p.m., there was a report that some 25 BLM Rangers were trapped in the Holiday Inn Express by members of a militia who were using their trucks to block the motel. A caller said it was the second time it had happened this week.

Don’t think for one moment this has ended with a release of cattle. The more significant fact was bullying, and showing up armed to the teeth, these rangeland fanatics have scored a victory over a government they refuse to acknowledge as legitimate, and consider every bit as weak as the POTUS they despise.

As an aside, this band of armed whack jobs have earned a spot on SPLC’s Hatewatch, and for good reason. Their gripes don’t end with nearly-free public grazing rights. Basically, we have a perfect storm of the Posse Comitatus, babyklukkers, Dominionists, and gun fanatics, and they’ve just been rewarded magnificently for potentially lethal behavior.

Not a good development. Always glad to see violence avoided but still..

2 CuriousLurker  Apr 12, 2014 7:30:48pm

I hate this. I’ll just repeat what I said on Randall’s page earlier:

Letting them get away with this crap will only embolden them and most likely prompt others to follow in their footsteps. OTOH, I also realize that these morons wanted a violent confrontation and were deprived of it.

Still, either our laws apply to everyone or they don’t. They can’t be allowed to get away with this. It sets a really bad precedent.

I would hope at the least his farm is leined, his assets are seized, and he’s homeless. At the least.

Other people suffer worse consequences for unpaid parking tickets. And you don’t get to show up at the courthouse brandishing a gun and demand your ticket is torn up.

Earlier in the afternoon, about 2 p.m., there was a report that some 25 BLM Rangers were trapped in the Holiday Inn Express by members of a militia who were using their trucks to block the motel

That’s kidnapping.

a) Whoever unlawfully seizes, confines, inveigles, decoys, kidnaps, abducts, or carries away and holds for ransom or reward or otherwise any person, except in the case of a minor by the parent thereof, when—
(1) the person is willfully transported in interstate or foreign commerce, regardless of whether the person was alive when transported across a State boundary, or the offender travels in interstate or foreign commerce or uses the mail or any means, facility, or instrumentality of interstate or foreign commerce in committing or in furtherance of the commission of the offense;
(2) any such act against the person is done within the special maritime and territorial jurisdiction of the United States;
(3) any such act against the person is done within the special aircraft jurisdiction of the United States as defined in section 46501 of title 49;
(4) the person is a foreign official, an internationally protected person, or an official guest as those terms are defined in section 1116 (b) of this title; or
(5) the person is among those officers and employees described in section 1114 of this title and any such act against the person is done while the person is engaged in, or on account of, the performance of official duties,

Nice one. I’m pretty sure that BLM is taking names, faces and license plate numbers. Govt can’t let people confine a bunch of federal officers against their will during the course of their duties and get away with it. Hopefully in a few weeks or months when all these assholes go home BLM will coordinate with FBI and conduct a massive arrest sweep.

The BLM can’t let this set precedent, so they should investigate this crap and see if any laws were broken, noted by GDF.

16 KerFuFFler  Apr 13, 2014 6:01:17am

The expense of rounding up the cattle was going to cost the government about three times the value of the cattle. Surely there is a more cost effective way——-and without risk of gunfire——to get the grazing fees paid. Can’t they freeze his assets or something? The Bundys must be forced to pay or this kind of armed rebellion will become a frequent nightmare.

Ranchers here in the west have been overgrazing the land for decades, spoiling streams and destroying watersheds, and now they want a free ride from the government. I lived in southwest Idaho in the late 90s, so I am familiar with this issue. The BLM has been trying to work with these ranchers in good faith, but they adamantly refuse to cooperate, because they believe they are “good stewards of the land.” They’re not. I have on sympathy for these assholes at all.

I’m not actually that worried about this. BLM radically underestimated the pushback on this. They’ll simply regroup for a week or so, let all the militia folks go home, and then they’ll show Bundy what it looks like when the Feds decide to come in hard. They’ll set up a perimeter with folks in uniform who will have shoot to kill orders for anyone who tries to penetrate it, and they’ll have a 3 a.m. roundup with Bundy getting hogtied and taken into court.

I get the BLM’s move here. The nutters want another Ruby Ridge or Waco. They’re fapping to the thought of shooting one of Obama’s thugs and starting a Second Civil War. It’s not worth giving them the satisfaction of a firefight.

Better to look like you’re backing off, then freeze Bundy’s assets, slap liens on everything he owns, and wait until the nutters leave.

re: #14 CarleeCork

I understand your sentiment. But mistakes like that empowered the nuts that got in the way this week. Even the best raids cause some trouble. When they go very wrong like Ruby Ridge and a FBI sniper taking the 5th, well the consequences are very long term.

If this is about the money they can just put a lien on the ranch. Take it from the estate one day. If it’s really abut the damage being done by the cattle this is an unfortunate setback for the local wildlife. I’ve not seen the in depth environmental report on the damage being done by cattle that have grazed there for a century. So I have zero sense of the necessary rush to take measures.

After sleeping on it-I look at it like this. It’s like the guy with the gun in his pocket walking away from a fight after taking a hit. Wise, patient, and nobody hurt.

36 FemNaziBitch  Apr 13, 2014 9:17:45am

Listening to FOX (under duress) they just reported that the Bundy group was going to put all the women in front, so if they got shot that would b the image that the world would see.

They already have a judgment against him, from what I’ve read. The cattle were removed from an area determined to sustain just over 100 cattle. He had just over 900 in that area.

They’ll set up a perimeter with folks in uniform who will have shoot to kill orders for anyone who tries to penetrate it, and they’ll have a 3 a.m. roundup with Bundy getting hogtied and taken into court.

If the Bundy family lets its guard down, that’ll work. If they’re ready for trouble though, then that could rapidly escalate into a bloody mess.

And a heavy perimeter has its own risks, because when those wingnuts talked about having their own snipers they weren’t kidding. There are indeed some among those wingnuts who really do have the training and the rifles to gun someone down from a kilometer away. And if those people are around, it might not be know till they open fire.

In short, going in hard on Bundy carries its own risks. Better to wait till members of the family leave the ranch for some reason and them arrest them on the move. The odds are much better for the government that way.

They don’t have all of those rounds yet (the DHS ammo contract with ATK is a multi-year procurement contract) and they wouldn’t normally share. The Bureau of Land Management is part of the Department of the Interior and its ammunition is funded from a different pool of money than the Department of Homeland Security.

With the desert sun high, about two dozen cowboys on horseback appeared in a cloud of dust on the hills above the protest area, ready to ride about three miles away to take Bundy’s cattle back. “Until the cows come home!” the crowd cheered. Meanwhile, antigovernment “Patriot” groups such as the Oath Keepers, grew only more excited. Wiley Drake, national chaplain for the Oath Keepers, said the time had come to no longer bow to President Obama, whom he called a “half-breed.”

I have related worry about the “1st chairborne”. Advanced training and small arms skills are way more common than two decades ago. So many returning troops that got urban warfare training. Before then, that was a special unit thing, Recently it seems they all get that training.

I worry a bit that a sprinkling of these militia guys have serious combat experience from overseas. I’d hate to see a skilled guy put a couple officers in the hospital or worse before being taken out. “Oathkeepers” for example.

I hope someone is taking photos, IDs, etc of these scofflaws and the crimes they are participating in since they don’t mind flouting the law as much as they think they’re entitled to do. Let Justice build cases against them, and enforce the fines leveled on Bundy by the BLM, including executing any judgments brought in a court of law. The last part is the truly tricky one, since the “mob” simply doesn’t want this to happen.

However, mob rule should never be an alternative to using the justice system for what it was intended, and this is what the Bundy crowd is indulging themselves in—mob rule.

When your “cause” is turned on you, you might have second thoughts about it and what personal costs defending the indefensible and unlawful will level on you.

cbsnews.com

MESQUITE, Nev. - Federal land managers say “escalating tensions” led them to release all 400 or so head of cattle rounded up on public land in southern Nevada from a rancher who has refused to recognize their authority.

(snip)

“Based on information about conditions on the ground and in consultation with law enforcement, we have made a decision to conclude the cattle gather because of our serious concerns about the safety of employees and members of the public,” Kornze said in a statement.

“Hundreds of states’ rights protesters, including militia members, showed up at corrals outside Mesquite to demand the animals’ return to rancher Cliven Bundy. Some protesters were armed with handguns and rifles at the corrals and at an earlier nearby rally.” More

Christ almighty, but what a bunch of gullible chumps Conservatives are. Going back to at least the Civil War, you could get them to do anything you want by claiming the government is tyrannical. Whether it’s protecting the ‘right’ of rich white folks to own black people and steal their labor, or protecting rich folks from paying their share of taxes, or a decent wage, or here, where they come out in support of a man literally stealing from the rest of us.

Cliven Bundy is an even bigger and even better con artist than the famous ‘Welfare Queen’. He’s got the same people who would cheer the arrest of the original Welfare Queen threatening LEOs for him.

Yeah, I saw Seattle Slew when he was alive, and he was pampered to the end of his days. But even a Derby winner may not live out his days in leisure if he doesn’t perform as a sire.

Still others, like Alydar, have been brutally killed for insurance money. IIRC, it was the father of Reille Hunter (John Edwards’ mistress) that organized that hit. That’s what her puke of a dad did for a living.

That makes me cry.

Exceller bought me my first car. I loved that horse. (1978 Hollywood Cup. I actually had my money on J.O. Tobin, but Stevie Cauthen *spit* fucked up that race so badly it destroyed Tobin’s front legs, but there was a partially shared owner/trainer interest so Exceller and Tobin were a linked entry in the betting… and Willie Shoemaker The Most Awesome brought my baby in. It was only justice that Cauthen never got another mount in America — he just finished riding the races he’d already contracted for, and then went to the UK to run 4-mile steeplechases.)

“Bundy, 67, doesn’t recognize federal authority on land he insists belongs to Nevada. His Mormon family has operated a ranch since the 1870s near the small town of Bunkerville and the Utah and Arizona lines.”

cbsnews.com

There’s a history of people not wanting to pay taxes in that area.

“In 1865 Brigham Young sent colonists to settle on the Muddy River, in present-day Moapa Valley, to grow cotton and other semitropical crops and to assist with possible LDS overland immigration from a projected port on the Colorado River. In 1867 the boundaries of Nevada Territory, which was created from the western part of Utah Territory in 1861, were extended southward, annexing part of Arizona Territory, including the Muddy settlements. Most Latter-day Saints abandoned these towns in 1871 when they were ordered to pay back taxes to Nevada; farming marginal lands, the settlers lacked the cash to meet additional assessments. The LDS resettlement of Moapa Valley was resumed in 1877 with the founding of Bunkerville, a United Order community.”

eom.byu.edu

Bunkerville was started by Commies.

In the Latter Day Saint movement, the United Order (also called the United Order of Enoch) was one of several 19th-century church collectivist programs. Early versions of the Order beginning in 1831 attempted to implement the Law of Consecration, a form of Christian communalism, modeled after the New Testament church which had “all things in common”. These early versions ended after a few years. Later versions within Mormonism, primarily in the Utah Territory, implemented less-ambitious cooperative programs, many of which were very successful. The Order’s full name invoked the city of Enoch, described in Latter Day Saint scripture as having such a virtuous and pure-hearted people that God had taken it to heaven.[1] The United Order established egalitarian communities designed to achieve income equality, eliminate poverty, and increase group self-sufficiency. The movement had much in common with other communalist utopian societies formed in the United States and Europe during the Second Great Awakening which sought to govern aspects of people’s lives through precepts of faith and community organization. However, the Latter Day Saint United Order was more family and property oriented than the utopian experiments at Brook Farm and the Oneida Community.

[…]

One of the last United Order corporations established the new community of Bunkerville, Nevada in 1877. The Bunkerville cooperative dissolved, under pressure from limited water and a lack of individual dedication and initiative, in 1880.[12]

No.

What they should do is this:
He has assets. He has a court ordered obligation. Have a court issue a bench warrant for contempt of court and a lien on his property. He drives anywhere, Federal Marshals arrest him, take him to said Federal Court where he is sentenced to sit for contempt until the cattle are off of the public land and the assets are sold to cover the court ordered obligation. Once paid off, he’s given anything left over & dumped on the street.

Yes, I expect Bundy’s ancestors he likes to invoke were, indeed, sort of commies. : )

Of course, the experiment with collectivism didn’t last long in the LDS church. It was really more of an experiment of the “bootstrap” theory, community by community, each of which was supposed to thrive without outside help (hear that, Bundy?), and Bunkerville failed for the cause(s) cited, which was lack of water. “Individual initiative” can never overcome that, no matter what you do.

Guess what’s coming up next. Just one of many.

Oklahoma-Texas border dispute has ranchers worried

BYERS, Texas (RFD-TV) Most people think the border between Texas and Oklahoma is the Red River. Unfortunately, it’s a little more complicated than that, especially along the part of the river where Tommy Henderson and his family ranch.

Henderson lost a lawsuit 30 years ago that moved part of the northern Texas border over a mile to the south.

The Bureau of Land Management [BLM] took 140 acres of his property and didn’t pay him one cent.

Now, they want to use his case as precedent to seize land along a 116-mile stretch of the river.

“They’re wanting to take the boundaries that the courts placed here and extend those east and west to the forks of the river north of Vernon and east to the 98th Meridian which is about 20 miles east of us,” Henderson explained.

BLM, which oversees public land in the United States, claims this land never belonged to Texas.

The Texas landowners who have lived and cared for that land for hundreds of years beg to differ.

Monarchs drinking and zipping around in speedboats, helping the economy
Prince William and Kate Tour a Vineyard - and Ride a Speedboat

You laugh, but they’re doing New Zealand a favor.

Michelle Morpeth, of Wooing Tree vineyard says, “We also talked about the fact 2013 was an excellent vintage and they should keep a magnum of 2013 wine to drink at George’s 21st birthday. Kate seemed really keen on that and thought it was a nice idea.”

What do you bet that region’s vineyards get a nice sales bump from this promotion? And the boat ride shows off that this might be a fun place to visit…

The Senior Tour used to have a stop in Nashville. I was amazed at how close cut and hard they had the fairways cut. (and they have full sprinklers, so it was intentional). I know as a bogie player there is no way I could play well on them, it wouldn’t be that much different than hitting off a board.

Prince William and Kate Middleton hit taxpayers with ANOTHER £1m bill as Kensington Palace refurb costs double

Looks like they’re stimulating the economy back home too.

The news comes after the couple enjoyed a luxury holiday in the Maldives, where a villa costs up to £9,000 a week.

But it is understood aides have already been discussing how to react to expected criticism of the huge spending.

One source said: “The young royals are extremely popular but when people up and down the country are struggling to make ends meet, this is not going to go down very well.

“The Palace is mindful that they are under the spotlight in these difficult times, and there is a fine line between the expected lifestyle of a royal couple and the perception of excessive and lavish spending.”

So if you actually want to make the argument that the royal family costs the UK more than they generate in tourism revenue, you could do the research, run the numbers—probably some other people have done a lot of the work, so it wouldn’t be that hard.

Edit: Also factor in what the UK would have to pay for a ‘president’ or other figure that did the ceremonial shit the royal family does now.

Or you can just be a knee-jerk contrarian and keep this weird grudge up that makes you look obsessive.

Your ‘point’ is that the royals cost the taxpayers money. You studiously ignore that they also make money for the country through tourism, as well as taking care of ceremonial duties. The concept of ‘beating a dead horse’ is not really at all related to ‘the royals cost money’, in the least.

193 Fairly Sure I'm Still Obdicut  Apr 13, 2014 1:18:15pm

I think the royals are stupid because they help, just a little bit, to enshrine the idea that some people are better than others because of who they’re born to.

However, if the government of the UK booted the royals off any sort of official recognition or pay, not a lot would change. A lot of people would still treat them as though they were their royal family, and they’d be rich as fuck because they already are rich as fuck. The idea of aristocracy is a silly thing to still be alive in 2014, but it is, and at least in the UK they’ve politically neutered their royals.

I just got an email from Amazon about a Prime benefit of a free Kindle book this month. When I went to get one for MrBWS’s Kindle, I clicked on “learn more” and found out that a miniscule percentage of our Amazon purchases can be a free (to us) Amazon donation to a charity of our choice.
So, I went looking and found Planned Parenthood is one of the charities. I picked Planned Parenthood of Louisville, since it was the only Kentucky PP charity, but also noticed that Planned Parenthood of Texas is listed. I’ll be switching to that one next month.
Thanks, Amazon!

The lunar eclipse in a few days, plus a Facebook post from my BiL about burning the stick pile at Dad’s reminded me of my youth:

My parent’s yard had a number of big trees that constantly shed sticks of varying sizes. Elms were the worst, but we also had Sycamore, Maple, Oak, and Linden sticks to deal with. We’d rake/pick them up, and cart/drag them to the back of the yard, and pile ‘em up. Eventually the pile would grow too large and we’d burn the pile.

One year, when I was about 10, the pile reaching critical mass coincided with a total lunar eclipse, so instead of doing it during the day, we waited till midnight. Then we danced around the fire, blowing trumpets, beating on pans, and shouting ‘Here Come the Dragon!’ (inspired by Sammy Davis Jr.’s ‘Here Come Da Judge’ thing on Laugh-In.

Someone called the police, so he came over and asked what we were up to. When we told him, he walked away bemused. It’s the kind of shit they expected from our family.
