I feel very sorry for him and how he must have suffered.

He was a POW and not really stable enough to have been in the service. All the signs were there, but were ignored, including a previous discharge from the Coast Guard after only weeks. Why wasn’t that taken into consideration before he was allowed into the Army?

Those who dragged him through the mud should be condemned.

Headline and body of text don’t exactly match. He was apparently cleared of wrongdoing for the 5 years in captivity, but he might still face charges for AWOL/desertion, and other charges relating to how/when he was captured in the first place. The Army hasn’t begun questioning him on that, so I’d argue that the investigative phase is first starting for him on the key issue of what happened leading to his capture.

I’m going to let the Army complete its investigation before drawing conclusions one way or another - unlike the right wing that wanted to treat him as a hero right up until the moment his release was secured by the prisoner exchange agreed to by the President. That’s when he went from hero that the President ignored to a villain that the President should never have made a deal for - especially for those who he released in the exchange.

Because at the time, the Army needed warm bodies, regardless of background. He was not the first who took a walk outside the wire to get away from the tension of a fire base. He was just the one who didn’t get his head shot off and ended up in hell for five freakin’ years. Poor kid.

Like lawhawk, I’m gonna hold off on any football spiking until after the investigation is completed. Even if they clear him of the accusations of collaboration, he may still be brought up on the charge of desertion. Then again, considering how much bad shit has been unearthed in trying to get to the bottom of this, they may very well clear him of desertion, but give him a less than honorable discharge and get him out of the Army as quickly as possible.

I don’t expect any apologies from the wingnuts on this, just a lot of sneering about how the Army didn’t court-martial Bergdahl for desertion and collaboration because the White House didn’t want the bad press. I’m not so sure, because like most things the GOP has done, they ignore the actual consequences of their actions.

The stock market is watching this, and they’re showing that this will have implications - not only for the small businesses that rely upon the EIB, but the big guys like Boeing and GE. You know - the job creators that the GOP claims they’re all for supporting:

The bank helps facilitate foreign companies efforts to buy U.S. goods. But some members of Congress, like House Financial Services Committee Chairman Jeb Hensarling, believe that it’s crony capitalism, a “sweetheart deal” for politically connected corporations.

Hensarling, a top Republican, is backed by new House Majority Leader Kevin McCarthy, who said on Sunday he wouldn’t support a renewal of the bank’s charter. Steve Scalise, incoming House Majority Whip, is also against renewing the bank’s charter, which expires in September.

Ex-Majority Leader Eric Cantor supported the bank and helped raise its loan limits to $140 billion from $100 billion.

Most Democrats support the Ex-Im Bank. Maxine Waters of California said the bank helps create jobs. President Obama wants to reauthorize the bank for another five years and expand its lending limit from $140 billion to $160 billion.

The bank started 80 years ago in response to the Great Depression and helps exporters by guaranteeing loans to buyers overseas and providing credit insurance.

The bank helped Boeing sell its 787 Dreamliners to India, Poland and Ethiopia, and General Electric (NYSE:GE) sell its trains to Pakistan. Caterpillar (NYSE:CAT) also relies on the bank to sell its heavy equipment overseas.

The criticism is that the bank provides sweetheart deals to businesses that don’t need it, but that’s undermined by the fact that the open market banks aren’t providing loans for these kinds of transactions, and so it falls to the EIB to provide them. And for the most part, the bank has broken even or made money in the past.

I’m not sure what you mean about the headline & body text not matching. The headline at both The Wire “Army Clears Bergdahl of Any Misconduct During Captivity” and at the WSJ “No Evidence of Misconduct by Bergdahl While Captive, Army Says” referred only to his captivity.

I didn’t assert he was cleared of any wrongdoing period. How could I when they clearly aren’t finished with the investigation? There were many on the right who implied and/or outright accused him of having gone over to the other side during his captivity though—I’m simply saying he has been cleared of that, and he has according to both articles.

I said I’m not gonna get overly excited about this story because even if he’s cleared on some of the accusations, the Army still could find reason to charge him with desertion. To be honest I don’t give a hairy rat’s ass if the wingnuts might think I was “crowing” simply because I commented that Bergdhal being cleared of any wrongdoing while held captive means he deserves an apology for that particular smear.

He’s an American soldier and he was accused, at least in part, of something he was NOT guilty of. He could’ve been my younger brother, my son, etc. I get that you guys may not agree with me on that, but I’ll stand by it regardless.

Pentagon clarifies what could happen to Bowe Bergdahl if he went AWOL

Sergeant Bergdahl may be classified as captured, absent without leave (AWOL), or a deserter. “They are all mutually exclusive,” said a senior Army official, who briefed Pentagon reporters Wednesday on condition of anonymity.

While it is possible for a US soldier to be AWOL and also to be held against his will, “In a legal context, you’re going to be one or the other,” the official added.

It is a legal distinction with big implications for Bergdahl. If he is found to be AWOL or a deserter, for example, he may be forced to forfeit some $200,000 in accrued pay during his captivity.

Try reading the article Killgore posted in his #35, it was quite good and very clear on the matters being totally separate:

The IRS claims that many of Lerner’s e-mails were lost when the hard drive on her desktop computer crashed in 2011. In a Monday night hearing, IRS Commissioner John Koskinen told Issa and the Oversight Committee that there was no way to recover these e-mails. “If you have a magical way for me to do that,” he told Issa, “I’d be happy to hear about it.”

The IRS is not the only federal agency to lose e-mails over the past few years. In fact, despite efforts at many agencies to standardize and improve e-mail by moving to services like Google Apps for Government and Microsoft Office 365 Government, many agencies still run their e-mail like it’s 1999. It’s not just a technology issue—it’s an IT policy issue, a staffing issue, and a cultural issue within government, one that the federal government shares with many private corporations.

what I don’t understand about the Tea Party is the collective cognitive dissonance about damn near everything. In 2010 they told us elections have consequences and they were for damn sure right as they attempted to dismantle damn near everything that the Dems had accomplished in pulling the nation (and the collective Western economies) back from the brink of disaster. What did we get? We watched them use the Tea Party as a shiv against the Dems from allowing too much reform to save them from themselves. In doing so, watched them do their collective damndest to crater our global economic standing again and again for the better part of four fucking years. When they could finally be distracted to do something other than the pointless attempts to repeal the only real cost effective health care reform that this country has seen in the last 50 years; they somehow got the notion that because the government is mandating health coverage that this somehow equals watching the insurance companies cancel your coverage once you show a need to use it, a true moment in wtf were you people thinking.

So, finally the big corporate money had decided that perhaps these whackjobs don’t understand the first fucking thing about how the world works financially when they watch these guys threaten to crash and burn first the government and then guess who’s next on the list? Somehow, it’s as if the TP had no fucking idea on how the political process worked and how it was funded and who was bleeping funding it. Et Tu, Karl Rove?

Now the TP folks who informed us that elections have consequences are finding out that yes, indeed they do and while they may be a more effective “populist” front than OWS ever was, a game plan of “burn that fucker down and lets keep the preachers in charge” doesn’t exactly resonate with everyone exactly how they intended.

I’d tell these folks to go fuck themselves, but frankly I’m afraid of them procreating and making more of their ilk. Wish like hell that some of these dipshits had paid better attention in 8th grade civics and read anything more challenging than the menu at McDonalds.

I’m not a big watch person…. it’s just a tool for me. My 99% of the time watch is a Timex Expedition analog, no Date/Time, nothing but 3 hands and an indiglo dial. First one lasted 3 years, this one is on it’s second band (nylon), the waterproof leather one finally broke after 2 years. I never take it off, swimming / showers / sleep. For ‘fancy’ occasions I have a nice thin dark dress watch.

I also wear my watch on my left arm (right handed) and on the INSIDE of my wrist.

I lived in KY for many years, then moved to southern Indiana (the sunny side of Louisville). Election laws for expats allow us to vote in federal elections by absentee ballot in the state of our last residence before expatriation. So, I’ve been voting in Indiana since I came to China.

I’m quite sure my name is on the rolls in both states. My US driver’s license now has a Kentucky address, so if i wanted to, I suppose could really mess with the system — if I happened to be in KY on election day.

Basically, the President is entitled to make intra-session recess appointments, but a 3-day recess is an insufficiently long recess period for which the President can take advantage of the recess appointment right.

I agree that a 1-hour or 1 day recess is insufficiently long for a recess appointment, but Congress has regularly tried limiting the right of the President to make recess appointments even though they have the Constitutional right to do so. And they’ll schedule sessions that try to keep the President from doing just that, even though no actual business is conducted.

This isn’t exactly what I thought when all those “gun rights” folks told me that the key to cutting down on gun accidents was teaching kids to “respect” guns.

My understanding is they struck down the 35 ft buffer zone because it included public walkways.

This does not mean (I don’t think) that some buffers can be established. Just not an arbitrary number of feet, that would include public space.

It was a unanimous decision.

The tie was with Portugal. The last match of the group stage starts in 40 minutes vs Germany. A win or a tie puts us through to the final 16. We can still make it with a loss, but would need some help from the Ghana/Portugal match also going on at the same time (basically a draw there or a Portugal win would do the trick).

A Saudi suicide bomber and his partner had planned to carry out an attack against a popular Hezbollah-affiliated restaurant in Beirut’s southern suburbs, a security source told The Daily Star Thursday.

Congressional investigators say they uncovered emails Wednesday showing that a former Internal Revenue Service official at the heart of the tea party investigation sought an audit involving a Republican senator in 2012.

The emails show former IRS official Lois Lerner mistakenly received an invitation to an event that was meant to go to Sen. Charles Grassley, R-Iowa.

The event organizer apparently offered to pay for Grassley’s wife to attend the event. In an email to another IRS official, Lerner suggests referring the matter for an audit, saying it might be inappropriate for the group to pay for his wife.

“Perhaps we should refer to exam?” Lerner wrote.

It was unclear from the emails whether Lerner was suggesting that Grassley or the group be audited — or both.

The other IRS official, Matthew Giuliano, waved her off, saying an audit would be premature because Grassley hadn’t even accepted the invitation.

“It would be Grassley who would need to report the income,” Giuliano said.

The name of the event organizer was blacked out on copies of the emails released by the House Ways and Means Committee because they were considered confidential taxpayer information. Grassley and his wife signed waivers allowing their names to be released.

In a statement, Grassley’s office said the senator did not attend the event, and did not receive any invitation intended for Lerner.

So, Lerner inquires whether an audit would be needed into the activities of Grassley, the outside group, or both because of income reporting requirements, and gets waived off by Legal counsel for the IRS’s Tax Exempt and Government Entities Division Matthew Giuliano. IOW, it’s a nothing burger. The IRS is supposed to check to make sure that everyone reports the appropriate income, and Lerner was looking at this and was told by Giuliano the audit wasn’t necessary or warranted - because the event had yet to take place.

That isn’t targeting, it’s the IRS doing its job.

The GOP, of course, sees hidden conspiracies in everything the IRS does. They hate the fact it exists, so they’ll find any reason, no matter how strained, to create scandals where none exist.

JOHN adds: I don’t think Lerner meant to have Grassley investigated, but rather the nonprofit organization that issued the speaking invitation. It is helpful to see the emails. This is the one Lois Lerner sent after mistakenly receiving the invitation that was directed to Senator Grassley

Maybe this is an instance of Lerner being trigger-happy when it comes to going after conservative c3s and c4s. We can’t judge that without knowing more about the organization. But we know that the group issued the same invitation to Lerner that it did to Grassley, so there is no obvious basis, that I can see, for making such an assumption.

So I think Lerner is getting something of a bad rap on this one. I don’t see any indication that she wanted to throw a Republican senator in jail, and in the absence of more information, I don’t see any evidence that she wanted to persecute a conservative organization, either. The exchange does indicate that Lerner doesn’t know much about the law that she is charged with administering.

Presumably the organization that issued the invitation to Grassley will be able to identify itself, and maybe it will step forward with a narrative of persecution at the hands of the IRS. For now, though, my judgment is that this email thread may show an over-zealousness on Lois Lerner’s part, and a surprising lack of knowledge of the law that she administered. But I don’t think she was going after Charles Grassley, and so far, at least, I don’t see evidence that this was an instance of anti-conservative bias.

IOW, the IRS without having the funds to examine all applicants for nonprofit status, found a way to check - but the IG later found the methodology needed to be fixed.

Checks and balances within the agency - not an agency out of control - and certainly not a scandal that involves the President, which is what some GOPers are hoping for.

No bright line has ever been established at the Federal level.

It’s all up to the States, even laws that permit you (or not) to carrying a firearm into a polling place. There are still even sale of alcohol prohibitions on election day in some states.

So, the S.Ct. rules that the buffer zone around an abortion clinic is unconstitutional restriction on free speech. How long before the Court is forced to reexamine its own rule on where/how protestors can protest in the Court’s vicinity. The Court seems to recognize that protesters have rights to protest, but those seeking access to the Court (or to a clinic) also have rights to have that access protected. Now, the Court shredded the buffer zone for clinics, but the rationale opens up the door for protesters to sue that they have the right to protest up to the door at the Court. Because free speech (note that the Court will try mightly to distinguish the cases, even though there’s no real difference).

It was a poorly thought out decision given that no one’s right to speech was abridged by setting up a buffer zone; it protected the rights/access of those seeking abortions to the clinics, and those opponents could protest to their heart’s content on the other side of the line. But that wasn’t good enough for the protesters, who argued that they were somehow deprived of their right to confront people seeking abortions, or the providers themselves.

It’s only a matter of time before the inevitable SYG case involving an abortion provider and protester. Because it will happen.

Yes, and there is one of those “pregnancy care” centers (where they pressure women to give up their babies for adoption) 1/4 of a mile from my apt. I don’t know if it’s ever used by anyone, but they have a lot of meetings (as the public spaces are full of cars when that happens), and evidently get money from somewhere since it’s a house that’s been fixed up and is taken care of pretty well. I do think they have access to the high schools in this county, although if I were a HS parent that would upset me as meddling in the affairs of minors without their parents’ consent and I would fight their presence.
