GOP Will Sue Obama for Not Imposing His Nightmare Socialist Scheme Quickly Enough

It’s facepalm time again
Politics • Views: 42,652

Just when you think it’s impossible for the Republican Party’s obstructionism to get any more absurd and ridiculous, John Boehner releases the details of his plan to sue President Obama.

The GOP have spent the last couple of years demonizing the Affordable Care Act as the most nightmarish socialist scheme ever imposed on America. So now they’re going to sue Obama for not imposing it quickly enough.

You can’t make this stuff up; no one would believe it.

House Speaker John Boehner (R-OH) on Thursday revealed that he plans to sue President Barack Obama for his unilateral delay of the Obamacare employer mandate.

The Speaker unveiled a two-page bill that he plans to advance through the House, declaring a right of action to sue the president for exceeding his authority.

“Today we’re releasing a draft resolution that will authorize the House to file suit over the way President Obama unilaterally changed the employer mandate,” Boehner said in a statement. “In 2013, the president changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it. That’s not the way our system of government was designed to work. No president should have the power to make laws on his or her own.”

Good grief.

So after 50+ votes to repeal the law, they’re now suing the White House for not implementing it fast enough.

It’s comedy that writes itself.

Moving this up from downstairs.

What a pile of pearl clutching by the Rs.

Delaying Parts of Obamacare: ‘Blatantly Illegal’ or Routine Adjustment?

The GOP says Obama’s decision to postpone implementing the “employer mandate” stomps all over the Constitution. It doesn’t, and here’s why.

theatlantic.com

“The Administration has not postponed the employer mandate out of policy opposition to the ACA, nor to the specific provision itself. Thus, it’s misleading to characterize the action as a “refusal to enforce.” Rather, the President has authorized a minor temporary course correction regarding individual ACA provisions, necessary in his Administration’s judgment to faithfully execute the overall statute, other related laws, and the purposes of the ACA’s framers. As a legal as well as a practical matter, that’s well within his job description. “

If the Republicans actually knew anything about the Constitution, they might be able to get something done.

So, so tired of their obstructionist bullshit, and now they want to sue so they can get this shit up before their boys on the SC? The same activist judges who are making a mockery of the Constitution every single session?

That is nice and logical as an argument. But BoehnHead knows all he needs is to keep feeding the red meat to the idiots and try and drum up some votes…and money.

It’s all a delay to get control of the Senate. That is their game plan. And then they will tie Obama up for the rest of his term…even more than they have now, while ramming their legislation through best as they can.

re: #133 Targetpractice

Let me get this straight, the GOP wants the courts to order the White House to implement a mandate they’ve predicted will lead to widespread economic doom and has been the crux of many efforts to repeal the entire law?

Why not. Stop and think about. In his speech today PBO pointed out that the economy was recovering, though slower than it should be and we are in better shape than we have been for years.

What better way to sour that recovery than forcing the administration to implement the mandate and possibly causing the economy to tank right at midterm?

We are talking republicans here. You know the ones that didn’t have a problem with letting the U.S. default on its’ debt or forcing a shut down. You know those republicans.

On the other hand, I may be giving them more credit than they deserve.

Except there’s no chance the suit will even get to court before the midterms, much less that Boehner will get a ruling in his favor that needs to be acted upon after appeals etc

11 Testy Toad T  Jul 10, 2014 3:17:46pm

So, okay. Let’s say Boehner wins. Then his big prize will be… a faster employer mandate? That’ll be his big golden calf? The House either will or won’t vote on impeachment; no actual matter of fact is relevant. The Senate won’t convict, barring the most stunning revelation of eeeevil conspiracy this side of Battlestar Galactica.

Is the point actually, honestly, explicitly to slow down his own caucus on voting on articles of impeachment? I feel like it might seriously be.

i’m really not clear on how this “sue” action works in regard to a presidential action

A lawsuit is a civil action brought in a court of law in which a plaintiff, a party who claims to have incurred loss as a result of a defendant’s actions, demands a legal or equitable remedy

i’m not a lawyer, but it seems to me that if you can’t plausibly claim to be an injured party, you will be deemed to have no “standing” to bring suit

who has incurred loss here?

House Republicans are claiming they are injured by the White House’s refusal to implement a law as written by Congress, despite there being plenty of precedent that the White House’s constitutional power over how a law is implemented give it wide latitude.

It would have to be companies that have standing.

They may not like having to pay a tax on the waiver, but I doubt they would sue on their own. This is strictly a Republican red meat gesture—their racist hatred of Pres Obama knows no bounds and no sanity.

The Rs already tried setting up this bullshit in March.

House passes bill making it easier for Congress to sue the president

washingtonpost.com

“The Republican-backed measure passed 233 to 181 and was the latest in a string of Republican measures designed to calm their divided ranks by raising doubts about President Obama’s leadership during a midterm election year. Five moderate Democrats joined with every voting Republican to approve the bill.

“If passed, lawmakers concerned that a president isn’t fully executing a law would be able to file a lawsuit directly to a three-judge panel on a federal district court and appeal directly to the U.S. Supreme Court.

“But the White House said Wednesday that Obama would veto the legislation and Senate Majority Leader Harry M. Reid (D-Nev.) called the measure “dead on arrival” in the Democratic-controlled Senate.” More

Ridiculous story:

ALBUQUERQUE (KRQE) - We now know more about the veteran who died at a VA Hospital cafeteria recently in Albuquerque while he waited for an ambulance.

The family of 71-year-old Jim Napoleon Garcia - a Vietnam veteran - says he died while waiting for an ambulance to take him to the emergency room which was only 500 yards away.

Hospital officials say it took 15 to 20 minutes for an ambulance to be dispatched to take Garcia from one building to another.

VA spokeswoman Sonja Brown says staff followed policy in calling 911 after Garcia collapsed last week.

She went on to say that the policy is under review.

“A state judge says Florida’s Legislature illegally drew the state’s congressional districts and has ordered them redrawn.

“Judge Terry Lewis on Thursday found that the state’s Republican-controlled Legislature broke the law when it drew up political maps in 2012. He rejected arguments from top legislative leaders that they had done nothing wrong.

“Lewis’ ruling, however, is not expected to disrupt this year’s elections because the Legislature is expected to appeal the decision.” More

Oh, it’s fine. We’ll change it to “Just rush the patient over there on a gurney” and the the next story can be “92 year old vet dies on a gurney on 500 yard trip to ER; standard protocol at other hospitals would have been to use an ambulance” and the policy can get switched back again.

Good news!!

Having parents at “their age” is quite scary. I lost it when my Mom didn’t answer the phone for 3 hours only to find she was outside drinking wine with the neighbors and left her phone inside. She’s 78.

Nothing compared to dad in the hospital, but I know the horrible feeling.

Play the downside, though. They could be halfway across the meadow with a corpse when the ambulance with defib and oxygen arrives back at the starting line. This is a sad thing, but a nontroversy. That won’t keep the politicians from adding him to Obama’s Death Tally.

The “Grab bag” is a hockey trunk with the basic gear of an ambulance, like O2, IV needles, drugs which nurses regularly can give, and other assorted goodies.
I don’t know about the US, but in Swedish ER’s it is standard practise for every section in an ER (ortho, neuro, infection, family med etc) to have such a bag, or a number of generic bags in known location throughout the ER (depends on what model ER they use).
The reason being exactly if they get into the situation where a patient “crashes” near the hospital, either by the accident happening there, or a patient being en route in a car.
I’ve seen it broken out three times in my life, twice when my now late girlfriend going into seizure just in front of the entrance to the ER, and this one time when a guy crashed with his motorbike.
And because of my late girlfriends condition, I’ve spent more time in ER and chatting with ER staff than I really want.
Basically, the reason they have the grab or “crash” bags is when something happens near or inside the hospital, because the two trauma nurses that go out with the bag have an attack time of 5 minutes tops, usually 2 or 3, while an ambulance has an attack time of 10-20 minutes.
Which means that care can begin much faster, and if an ambulance is required for transport into the ER, it will be a Scoop’N’Run gig, because care has already begun.
As to the cases with my late ex? Both times, they had given diazepam to
begin breaking the seizure within a minute.
As to reasons, my guess is either that the operators take their oath dead seriously or they’ve had too many incidents of patients dying close to care.

Apparently the idiot stalkers have a new smear:

These assholes are such fucking liars. My very first post on the subject linked to “Buckhead’s” post at Free Republic and quoted it.

Bush Guard Documents: Forgeries?

A post at FreeRepublic sums up the situation:

Howlin, every single one of these memos to file is in a proportionally spaced font, probably Palatino or Times New Roman.

In 1972 people used typewriters for this sort of thing, and typewriters used monospaced fonts.

The use of proportionally spaced fonts did not come into common use for office memos until the introduction of laser printers, word processing software, and personal computers. They were not widespread until the mid to late 90’s. Before then, you needed typesetting equipment, and that wasn’t used for personal memos to file. Even the Wang systems that were dominant in the mid 80’s used monospaced fonts.

I am saying these documents are forgeries, run through a copier for 15 generations to make them look old.

This should be pursued aggressively.

Fucking smear artists and liars.

How we talk about politics is infecting how we talk about culture

We treat people whose interpretations differ from our own as if they are acting in bad faith. We focus on gaffes and supposed gaffes. And we demand that significant figures in cultural commentary have something to say about every big event so we can check their reactions against our sense of what they ought to feel to remain in good standing.

But in discussing big issues, art’s advantage is that it is so different from politics. Art does not need to align with partisan conventions. It can lend moral clarity to the limitations we have accepted on our politics. And speculative fiction can pose scenarios and propose solutions that are liberated from what is actually politically possible. It can hold multiple, even contradictory, ideas in place simultaneously.

I cannot help but wonder if we would enjoy ourselves more and do greater honor to the art we loved so much if we accepted that the conventions of our conversations about art can reflect that same difference.

I am in a fantastic mood this evening. I just scored a HELL of a deal on some camera equipment from a guy on the Scuba Forum I’m on. 2 Olympus PEN E-PL1 (micro 4/3) 12 Megapixel bodies, a kit 14-28 lens, the official Olympus underwater housing, chargers, extra batteries and some other accessories. All for 500 bucks. Cameras both have very low shutter counts, the housing is first quality, it’s a hell of a deal. Still going to have to spend about 250 for a decent U/W flash (unless I can score one used), but it’s a great setup for me to get into mirrorless cameras and U/W photography.

Considering that the equivalent model housing for the newer OLY 4/3 camera (and its very much the same thing) alone is over 500 bucks…. all I can say is that I’m feeling pretty damn good right now.

I’m still not taking a camera down for quite a while, my plan is to get more solid in my diving skills before I start to add additional complex tasks, but it’s a great deal.

Texas Gov. Rick Perry said Wednesday on “Hannity” that President Obama needs to act now to stop the surge in illegal immigrants flooding across his state’s border, calling it “a humanitarian crisis that he has the ability to stop.”

“You know, I was like, Mr. President, you can deal with this. You can unilaterally direct the Department of Defense to put those troops on the border…” he told Fox News, later adding, “The president needs to understand that the single most important thing that he can do is put the National Guard on the border to coordinate with local law”

oh, i forgot - you’re a moron and nobody cares what you say

Back when Bush the Lesser was pres, you heard people saying this but it was a wingnut suggestion from the far, far right, totally ignored by the GOP. Now it’s mainstream GOP policy.

The E-PL1 is a great little camera - it’s what I have - and the best thing about it is that with adapters you can use just about every type of lens ever made on it. I’m currently using a Canon FD 50/1.8 manual focus as a 100 equivalent and loving it. Lots of cheap old lenses out there to play with :D

Look, I get that a bill passed by Congress and signed into law by the President should be enforced as written. But this Congress - the GOP in particular - has opposed the law at every opportunity, and now they’re suing to make the President carry out the law as written.

The same law they’ve sought to repeal 50+ times. The same provisions they claim would adversely affect the public. The same provisions that they were calling for delays for because they claimed it would harm corporations.

Yet, by the time the suit is heard (and after the inevitable appeals), these provisions will be in force since the President only delayed the implementation.

They hope no one was paying attention and now they’re hoping to pivot to this?

This is what they’re hoping will be a winning issue?

I remember it pretty vividly. Snowden had just come out as a whistleblower traitor. I posted a LGF article criticizing the Mighty G and Snowjob. I even posted some tweets with no links that said plainly that I thought Snowden was a traitor to his country. Later that night I log into Twitter and I had something on the order of 30 notifications. I was stunned to see all these random Twitter accounts (none of which used real names) calling me all sorts of nasty names and saying I’m part of the problem and how dare I criticize such heroes to America. It sucked, took me probably an hour to go through, block and report most these nut jobs. And that’s the thing, most of them still tweet to this day, and they harass people that don’t toe the Greensnow line.

It’s standard tactical political warfare, own the media, own the message, control the framing, control the context.

It’s a good reason why progressive ideas get shunted off into the corners and are rarely discussed in the mainstream media.

case in point, how often did you see the budgetary proposal of the progressive congressional caucus used as a discussion point ANYWHERE? Perhaps that’s just ignorance on my part, but none of the places I frequent for engaging political discussion had more than a message or note that it was out there.

I really think this is their last hope at getting rid of the ACA. They truly believe this last bit will ruin companies, and therefore the economy. They see the ACA actually helping people, and a good majority actually liking their coverage. By forcing (not really) the Presudent to implement this part, it’ll turn the momentum backwards. That’s why they want it to go into effect. This is their last ditch effort.

But in reality where the rest of us exist, their idea of doom won’t happen, and the President is now openly mocking them. I wouldn’t have it any other way.

At 14, with his parents dead, Gutierrez followed the path of 700,000 of his countrymen to California. He made the 2,000-mile journey from his Guatemala City neighborhood without entry papers. He hopped 14 freight trains to get through Mexico. U.S. immigration authorities detained him.

Fernando Castillo, Guatemala’s consul general in Los Angeles, says the United States doesn’t deport Guatemalan minors who arrive without family. Gutierrez was made a ward of Los Angeles Juvenile Court. He was placed in a series of group homes and foster families. He learned English and finished high school.

When he reached 18, he got residency documents, Castillo said.

Scott Walker, J.B. Van Hollen appeal gay marriage ruling

Gov. Scott Walker and Attorney General J.B. Van Hollen on Thursday appealed a decision from last month that struck down Wisconsin’s ban on same-sex marriage.

The two Republicans filed a two-page notice of appeal that will soon be followed up with a full brief explaining their legal arguments.

U.S. District Judge Barbara Crabb in June found the state’s gay marriage ban violated the U.S. Constitution, but she stayed her order so Van Hollen and Walker could pursue an appeal.

Thursday’s filing puts the case before the 7th Circuit Court of Appeals in Chicago. It comes amid a wave of court rulings across the nation striking down state bans on same-sex marriage. The U.S. Supreme Court is expected to ultimately determine whether gay and lesbian couples have the right to marry.

Might be legal in the State, but still illegal under Federal law. Which is why States legalizing pot are actually putting their residents in harms way. While the State might say it’s fine for you to grow or posses pot. The Feds says otherwise and an over zealous Federal Prosecutor can and probably will charge you for possession and or production.

I suspect that they think winning the suit will force Obama to implement the law immediately, which, in turn, will cause the list of horribles to come to fruition. In other words, the upshot of the suit is to inflict as much pain as possible for political gain.
