CNN played this audio recording tonight from an unnamed source in Ferguson, Missouri, allegedly an inadvertent recording of the shooting of Michael Brown. The 24 hour rule is in effect, but if this is verified — there are 11 shots clearly audible here. Draw your own conclusions.

If this recording is admissible as evidence, then Wilson is done behind it. It’s one thing to be firing continuously as a perceived threat. But to have hit Brown more than once and then resumed firing is utterly indefensible.

Jim Hoft will of course ignore this recording and continue his race-baiting.

I’m gonna err on the side of caution and just assume that, until we get verification of the authenticity of this audio, that it’s probably fake. Still 11 shots with a pause before the final few shots? That’s pretty damning evidence if true. And since we know 6 shots hit Brown, that leaves five unaccounted for.

If this is true, he was shooting fast enough that he was barely aiming. I can’t hit a target very well if I’m shooting that fast. It would explain why he missed 5 shots.

The witness statements say Wilson fired two distinct shots and then paused and then several in rapid succession. The pause is where Brown stopped and turned around. This audio has one followed by a very short pause, then five more in succession, then another pause, and then five (?) in very rapid succession. I’m not sure about it.

If this is true, he was shooting fast enough that he was barely aiming. I can’t hit a target very well if I’m shooting that fast. It would explain why he missed 5 shots.

Still, 6 out of 11 isn’t bad when you’re shooting with an orbital blowout fracture.

It’s possible that the first two shots, as Wilson was chasing after Brown, occur before this recording, and that all eleven shots are the ones from Brown’s front.

I will say that, if this is authentic, then I’m not sure how Wilson can explain it. “Josie” set up a scenario where only one shot went off before Wilson got out of the SUV, then every shot after that was when Brown turned and “bum rushed” him. The pattern of shots in this audio does not sound like a cop who held off shooting until he had a charging suspect and then fired until the suspect dropped dead.

They carry .40’s in Ferguson? No way you can aim one of those damn things that fast. But the pause? That’s more than enough time to see he’s trying to surrender and consciously decide to execute him.

You know the whole ‘Josie’ story, covered here too. Here’s someone else’s fiction. Some might think it’s in bad taste, but I think it’s just as real as Josie’s story.

For all we know, Officer Wilson’s account goes something like this:

“Yeah, I saw these two jaywalkers, drove up, told them to get the fuck off the street, then moved on a bit, but they were still strolling along in the street, so I decided to teach them a lesson. Threw it into reverse, backed up right next to them, swung the door open giving them a good whack with it, then grabbed the big guy by the neck. He was a pretty strong kid and pushed me off though, then started to run.
I wasn’t really hurt any, other than my pride, but I was kinda pissed at that point. So now I’m thinking, I’m really gonna get this n***. He’s trying to get away, so I get out of the car and start shooting at him. I miss the first couple of shots, but finally I must have hit him, cause then he stops then, puts his hands up, and turns toward me, like I’m just going to arrest him now.
Ha, so I fire a few more shots into him, and he stumbles forward, then I know he’s disabled at that point, and I’ve really got him. I shoot him right in the head, really finished him off good.”

If he was running away when the first group were fired (which even the police say he was) then one of the first six had to hit him. It has to be the wound in his lower arm that could have been from the front or back depending on how his arm was positioned.

In which case Michael then turned, so in approximately three seconds Michael turned and started charging?

It also means that all five shots from the second group hit him somewhere after he turned. I’m starting to believe the he turned and stood still version told by witnesses more and more.

A stationary target is a lot easier to hit… :(

No, I take that back. 3 to 4 seconds is a long gap. Could be many different things but the pace of the last few still sounds more aimed to me. Can’t read too much in though. It’s guesswork.

I’d like to hear it cleaned up and amplified to see if there are any voices — “stop or I’ll shoot” or “don’t shoot!”. I’d also like to know if FPD recovered the five bullets that missed.

My prediction of Wilson’s defense ( if this real): one shot in car from a struggle over the gun. One set of shots at the “fleeing felon” to protect the public. Last set of shots to protect himself from the rushing Brown.

Given how favorable Mo. law is to him on the fleeing felon shots, the last set will be hardest to justify. It’ll be his word against 3-4 witnesses who say Brown was trying to surrender.

In that clearer recording it does sound more like that, weird how a couple of the shots have more echo/reverb than others. Hard to tell if it is a rapid double-tap shot or a single.

Did the police chief say their service weapons only held 11 rounds total, or was it 11 in the mag and one in the chamber? I can’t remember anymore.

Either way with one shot already fired in the car it sure seems like he just kept firing until he ran dry.

The police chief got asked that at the first press conference, as in how many rounds their service weapons held. I just can’t remember if it was 10+1 or 11+1. Went back and looked at some of the youtube videos of the press conferences just now (since my post #40) but I haven’t found that particular Q and A yet.

After the horribly shitty day I’ve had I think I’ve had enough to drink tonight to makes some comments.

I don’t know what the Ferguson PD carries as a sidearm on patrol, but if I had to average it out it was most likely a .40 cal, which a standard sized gun and clip would make for a 10 bullet magazine with one in the chamber.

It sounds like Officer Wilson unloaded his weapon on Michael Brown, bullet for bullet. And the whole first shot theory is blown apart if this audio is credible.

Sig 226 and 229 hold 12 in .40. The +1 won’t come into play unless the officer makes a habit of topping off a magazine after stripping off a round. If one round was fired inside the SUV then it adds up. Might add up anyway, since the second rapid fire group in the recording is difficult to count accurately, at least 4 shots there, could easily be 5 or maybe even 6.

That second round of shots is very difficult to justify in my mind, especially considering the officer still had plenty of distance and Brown had to have been hit a couple of times by then. Of course if as reported the first shots occurred as Brown was running away then those shots aren’t justifiable either. The whole thing stinks.

Well by the morning I am sure some of the internet tech wizards will have it slowed down, enhanced and mapped on a shot by shot sound graph showing shot timing to the millisecond.

I don’t think the police would lie about the shot in the car though, especially since the St. Louis County Chief confirmed that they “found evidence of that shot” inside the SUV.

Sig 226 and 229 hold 12 in .40. The +1 won’t come into play unless the officer makes a habit of topping off a magazine after stripping off a round. If one round was fired inside the SUV then it adds up. Might add up anyway, since the second rapid fire group in the recording is difficult to count accurately, at least 4 shots there, could easily be 5.

This would explain it nicely, damn I need to go find a video of that press conference…

I’m certainly not mistaking state laws, and I am aware of bigger magazines for cops and those who pass the background check (I’ve also shot a H&K MP5, the owner of the weapon served in Vietnam and has been a cop for over 30 years).

Frankly, I confuse the clip capacity of certain calibers of semi-automatic pistols. You’re probably more correct than I am about the number of bullets a clip for a certain caliber of pistol can handle.

Still, the fusillade of bullets we hear in the recording is suspicious, tragic, and totally unavoidable. What about the police’s numerous non-lethal methods of compliance?

After some careful listening with headphones I count six shots, an almost 4 second pause, followed by four more shots. Total of 10 altogether.

How does that work with the other known facts? If it is only possible for one of the wounds to come from behind (the forearm wound) according to Dr. Baden something here does not add up.

He could not have been hit five more times after turning (during pause?) if only four more shots were fired.

Did he turn while the first group of shots was still being fired and get hit then?

Did the wound on his hand come earlier, from the shot that was fired in the police car maybe? (what happened to the gunshot residue then?)

Sigh, with only four shots in that second group it seems there is still no easily guessable or straightforward theory to explain what happened. :(

I also tried to isolate a bunch of different frequency bands to see if I could separate the shots from the guy’s voice, but the results weren’t spectacular. That shit overlaps like crazy. I’m an imaging geek, I have some forensic audio tools lying around from a past life but it’s not something I really have any expertise in.

Acc. to DJ, the first shot did wound him. So the 5 shots in the 2nd group were enough to reach the autopsy’s 6. This assumes that none of the 6 1st group shots hit and none of the 5 2nd group shots missed. Which seems unusual, though of course far from impossible.

The problem is that the witnesses seem to indicate that there were 2-3 shots in the 1st group. That’s not an insurmountable problem, since witness perception is always faulty in some way, but still.

So, seemingly one can make the recording and the witnesses mesh, but it’s still imperative to wait for a confirmation.

Sure, though I would argue that there is a noticeable difference between hearing 2-3 and 6. That said, this is not unusual for eyewitnesses. I’ve seen such contradictions hundreds of times. All I’m saying is, let’s see if this is at all confirmed. If it is, then we can accept it as a case of slightly faulty perception.

Personally, I would say that if this is confirmed as genuine, the focus should not be on the number of shots but instead the spacing between them. The audible pause and the more focused manner the final shots come in suggest that Wilson was not as panicked as we’ve been told he was when Brown “charged.”

They handed the investigation off to the St. Louis County Police, Ferguson chief said from the morning of day two that all paperwork, reports, investigation work would be from the county, not them. Press filed FOIAs with Ferguson instead of county anyway and then seemed surprised when Ferguson didn’t have any paperwork except routine dispatch logs.

I never expected the officer to file a report or make a formal statement because that could compromise his possible defense options. If he had been stupid enough to put something down on paper he would have done it with the county police and not with Ferguson P.D. anyway.

Police officers are covered by the Garrity ruling…

In 1961, the New Jersey attorney general began investigating allegations that traffic tickets were being “fixed” in the townships of Bellmawr and Barrington. The investigation focused on Bellmawr police chief Edward Garrity and five other employees. When questioned, each was warned that anything they said might be used against them in a criminal proceeding, and that they could refuse to answer questions in order to avoid self-incrimination. However, they were also told that if they refused to answer, they would be terminated. Rather than lose their jobs, they answered the investigators’ questions. Their statements were then used in their prosecutions - over their objections - and they were convicted.

The U.S. Supreme Court then ruled in 1967’s Garrity v. New Jersey that the employees’ statements, made under threat of termination, were compelled by the state in violation of the Fifth and Fourteenth Amendments. The decision asserted that “the option to lose their means of livelihood or pay the penalty of self-incrimination is the antithesis of free choice to speak or to remain silent.” Therefore, because the employees’ statements were compelled, it was unconstitutional to use the statements in a prosecution. Their convictions were overturned.

Before questioning the officer is given a “Garrity Warning” just as a civilian gets a Miranda Warning…

A typical Garrity warning (exact wording varies between State or local investigative agencies) may read as follows:

You are being asked to provide information as part of an internal and/or administrative investigation. This is a voluntary interview and you do not have to answer questions if your answers would tend to implicate you in a crime. No disciplinary action will be taken against you solely for refusing to answer questions. However, the evidentiary value of your silence may be considered in administrative proceedings as part of the facts surrounding your case. Any statement you do choose to provide may be used as evidence in criminal and/or administrative proceedings.

So the answer is no, it would violate the officers fifth and fourteenth amendment rights to compel him to file a report or make a formal statement about an incident for which he may be prosecuted.

It may very well be that if an officer feels that creating such a report would risk prosecution, he won’t write it and cannot be compelled to do so. Just as a brute fact, without respect for “should”.

But the fact that he didn’t do his job (by filing a report) still remains and should lead to an automatic firing. No, it’s not analogous to the Garrity case, since taking a part in an investigation is not a part of the job, so threats of termination for lack of compliance are unconstitutional. Filing a report, however, is a part of the job.

An officer who has a shooting incident is not ever the one to fill out the investigative/incident report on it. The officer and witnesses are questioned and evidence is reviewed by detectives of his own or another agency and then they file a report on the incident.

Officer statements during an internal investigation are confidential and are often given after the signing of a Garrity Advisement granting them immunity. In other words they can’t be prosecuted based upon anything they reveal during the interview. This is for a “normal” shooting investigation where there is no indication of wrongdoing or intention of filing charges against the officer.

If a DA is seriously contemplating charges against the officer then the police will be told not to offer the officer Garrity advisement immunity. Because if they get a full and complete statement from the officer that implicates him in wrongdoing they may then face accusations by his defense lawyer. He can possibly argue that they obtained certain evidence solely based on his statement thereby making it inadmissible.

The department has an obligation to file a report that states the facts of the case as shown by their investigation. The officer has an administrative obligation to assist the incident investigators by giving them a full and accurate accounting of the event.

But due to the Supreme Court Garrity ruling they can’t fire him for refusing to give that accounting. Unless they offer him immunity on the information given in his account first.

Question. Why do some of the witnesses have a lawyer? I can understand why Dorian Johnson needs one but why others?

To make sure that the cops or prosecutor don’t try to twist their stories or threaten them. If its just a witness alone, telling a story the cops don’t want to hear, some dishonest cops have threatened such witnesses with trumped up charges if the witness does not fall into line. Having a lawyer with you greatly reduces the chance of that.

Tim Horton’s would do well in the States as a solid competitor to Dunkin’ Donuts and Starbucks, and if you co-locate the BK with TH, you’d have a better breakfast lineup than McDonalds. It works out well for both brands and companies, which is why it makes sense.

It doesn’t make much sense to move the corporate headquarters to Canada.

Instead, we have audio that seems to show that Wilson managed to fire off two sets of shots, 11 in total, and 6 hit Brown. That’s more than a few (and debunks the nonsense that the STL county police chief Belmar’s claims that it was a few, but probably not more than that). Wilson essentially unloaded his firearm at Brown.

Since the county police took over the investigation, that means that the firearm should be in their possession. Do they have all 11 casings? Do they have all the bullets recovered from the scene, including those that missed?

Still, if this isn’t authentic, then the person(s) behind the audio has to be held accountable for putting it out there as though it was.

Morning all!

The air is thick here in Columbus Oh Hi. Luckily we have only been hovering right around 88° to 90° but I wish we still had that weather we had a few weeks back.

But no complaints. Having some heat right now means that at least we may have a decent fall and are not going to plunge into winter too fast and deep.

But who knows? The weather is all over the place any more.

And yes…those I know with allergy issues are suffering…high ragweed counts. And it has been dry which ramps it up.

Exactly. Brown turning towards Wilson and just coming back towards him doesn’t justify the second barrage of bullets. The ONLY thing that would is if Brown was charging or otherwise running towards Wilson.

That’s why Scenario 2 is far more plausible. All the witnesses there said that Brown turned towards Wilson but put his hands up in surrender and begged for his life. That makes Wilson’s actions murder.

Their coffee is much better than that of Starbucks. Probably about even with Dunkin’ Donuts.

Tim Hortons has regional corporate offices here in the States. They also sell their coffee in big chains like Bed Bath & Beyond and Target. They’re hardly confined to Canada.

At one time Tim Horton’s was merged with Wendy’s who is here in Columbus. So, there are a gazillion of them here in Oh Hi O. Then they went back to being independent in (I think) 2005.

Now they are back in with a burger giant. I wonder if the Tim Horton head honchos still have all their Wendy’s stock from the merger? Would they have to sell it if they join up with another burger slinger?

Today’s weird news in Kentucky:
Officials: Inmate Overdosed On Methadone Soaked Underwear

Deputies at the jail found 33-year-old Corey McQueary of Stanford unresponsive in his cell Wednesday night. He was taken to St. Joe Jessamine and later pronounced dead by the coroner.
The investigation revealed that 55-year-old Michael Jones of Lexington had soaked a pair of underwear with methadone while he was out of jail on a court ordered furlough. He brought that back to the jail, allegedly shared it with his cell mates and Corey McQueary died as a result of it.
Jones is now charged with murder and other charges.

A poll by the Albuquerque Journal shows that Tom Udall has a large lead over Allen Weh in the U.S. Senate race.

The poll shows Udall, the incumbent, has a 53 percent to 35 percent lead over Weh. There are 11 percent who are undecided.

A big part of Udall’s lead comes from his popularity among his base — the Democratic Party. Udall has the support of 79 percent of Democrats according to the poll. He also has the support of 70 percent of Hispanic voters — a massive voting bloc in New Mexico.

Weh actually leads among Anglos, but it is a narrow lead — 48 percent to 43 percent, within the margin of error, especially among subgroups.

‘You Stupid Jackass!’: Darren Wilson Supporters Clash with Ferguson Business Owner on CNN

Tensions may have eased between protesters and police in Ferguson since the height of the unrest there last week following the fatal shooting of 18-year-old unarmed Michael Brown by officer Darren Wilson. But as a report aired by CNN this morning demonstrated, the increasingly vocal supporters of Wilson are fueling new conflicts in that Missouri suburb.

Jake Tapper was interviewing a Wilson supporter on the street in Ferguson when a local business owner approached him and started saying he did not want the “controversy” they were bringing to the situation given the fact that his store is in a predominately black area.

“It’s my First Amendment right and I am a United States citizen,” one of the pro-Wilson demonstrators told the business owner.

“I am a United States citizen too!” the man shot back. When another protester asked him if he speaks English, he grew even angrier, responding, “I am speaking English, do you understand that?! You stupid jackass!”

And the cops changed their story from “he shot himself in the back while handcuffed” to “he shot himself in the chest while handcuffed.”

The Iberia Parish Coroner’s Office has released only the first page of the autopsy report, which contradicts statements initially made by State Police who said White shot himself in the back while handcuffed in the back of a sheriff’s unit.

According to the autopsy, the bullet entered White’s chest, then perforated his left lung and heart before exiting his armpit area and lacerating his upper arm.

The report rules White’s death a suicide.

One time, in the taxi, this Hispanic guy (native Texan judging by his accent-) gets into my car at the airport and tells me his address. As we head towars the freeway I ask him, “Would you rather take route a-b-c or route x-y-z?” He turns to me with a totally WTF look on his face and deadpans, “Well I’ll be damned—that’s one HELL of an accent you’ve got there!” Then we both cracked up.

Tim Horton’s (hears a who) can be found across Western and Northern NY, MA, and New England. They’ve even got outposts here in NYC.

Their coffee is much better than that of Starbucks. Probably about even with Dunkin’ Donuts.

They’ve been in Columbus, OH for many years. One of the locations is/was about a block from Wendy’s corporate headquarters.

Somehow, I suspect that if someone with an accent were describing directions to a buried treasure worth millions, said people would suddenly stop having so much trouble understanding, or at least they’d be very attentive & patient in asking the speaker to please repeat what s/he said.

No I don’t, and I’ve worked hard at it.

I never had much of a Texas accent as neither one of my parents had it, but I’d slip into it when pissed off (it was, and still is, good for cursing in). Nonetheless, I still retain some southernisms that I don’t even notice till someone points them out, like saying “I’m fixin’ to….”

Oh, and talking to someone with a Texas accent, or any southern accent. It doesn’t matter if it’s on the phone or in person, no matter how hard I consciously try not to, I’ll immediately and involuntarily slip into the the twangiest Texas drawl you’ve ever heard.
