New Michael Brown Shooting Witnesses: Brown Had His Hands Up When He Was Shot to Death

More damning evidence against officer Darren Wilson
US News • Views: 32,837

Video

CNN has new video showing two men who witnessed the shooting of Michael Brown, describing what they saw; and once again, their accounts are consistent with other witness reports. The two men in the video say they were about 50 feet away when officer Darren Wilson opened fire, and they saw Brown with his hands up when Wilson fired the barrage of shots that ended Brown’s life.

One of the men told CNN Brown was running away from the police car as Wilson fired at his back — which, again, is consistent with reports from eyewitnesses and with a statement from law enforcement officials to the New York Times.

An exclusive cell phone video captures their reactions during the moments just after the shooting.

“He had his f**n hands up,” one of the men says in the video.

The man told CNN he heard one gunshot, then another shot about 30 seconds later.

“The cop didn’t say get on the ground. He just kept shooting,” the man said. That same witness described the gruesome scene, saying he saw Brown’s “brains come out of his head,” again stating, “his hands were up.”

The video shows the man raising his arms in the air — just as, he says, Brown was doing when he was shot.

The other contractor told CNN he saw Brown running away from a police car. Brown “put his hands up,” the construction worker said, and “the officer was chasing him.”

The contractor says he saw Wilson fire a shot at Brown while his back was turned.

Daren Wilson could hold a press conference tomorrow and announce he shot the kid in cold blood and FPD/STL Police would sill not arrest him.

I’ll stick to believing Josey, whoever she was, as opposed to those people who were actually there.

Charge Wilson DA McCulloch.

Not getting a clear idea of how immediate the cell-phone video is. How long after the shooting was it, and the witnesses’ statements, made? Minutes, hours?

Was the video shot moments after, or is it just describing their immediate reactions?

The video, recorded several minutes after the shooting, gives new insight into the case…

Still not definitive but should give us an idea of the timeline.

8 lawhawk  Sep 11, 2014 11:04:27am

I have little faith in the DA to charge Wilson, let alone the FPD/County police investigation into the shooting.

Like the NFL, they’d much like all this evidence, including videos and audio recordings, to disappear. They’ll treat it as though it doesn’t exist, and say with a straight face that it wasn’t available (or some other nonsensical excuse).

Wilson should be indicted on the strength of the eyewitnesses that have come forward up to this point. The audio of the shots fired and now this video confirm what everyone has known up to this point - that Wilson shot an unarmed Brown who had his hands up at the time of the fatal shots.

That’s excessive force.

That’s police brutality.

That’s homicide.

It’s up to the prosecutor to make that case, and the evidence we are aware of at this point all points to at least manslaughter, if not 2d degree murder.

But knowing what we do about the FPD and county police, their ability to collect, preserve, and report on the facts of the case is anything but honest and accurate. That will affect the outcome, and that’s but one reason why the DOJ is involved with their own separate investigation.

Since it appears the video was taken at the scene and you can see the police cars there, it would be soon after the incident.

You can see a police officer in the background putting up police tape around the scene. It’s within minutes of the backup units responding and showing up.

The response by the worker is within minutes of witnessing the shooting.

There was another shooting a few days after this one that was caught on video where the police backup showed up about 1-2 minutes after the shooting to tape off the scene. I estimate it would take no more than 3-4 minutes for someone to show up and start taping off the crime scene here, and I think the police dispatch logs back that up.

We have an immediate testimony from 2 disinterested witnesses, confirmed by the video. Which, in turn, confirms all the other witnesses. Would the jury convict? Depends on their biases, but as far as I’m concerned, a reasonable, rational, objective jury would.

I am almost willing to bet Wilson told his superiors as well as the officer that arrived after exactly that and they helped him cover it up and get his story straight. Given the behavior of the police both after and based on reports of how they’ve acted before they sound just like the stereotype some have of cops thinking they can do whatever the hell they want and are above the law.

The other thing that sticks out about this account is that it was recorded without the witness’ knowledge. That’s been the lynchpin of an audio snippet that wingnuts have been passing around, claiming it to be “proof” that Brown charged Wilson. If the validity of a witness’ testimony is that he didn’t know he was being recorded when he gave it, then this is all the more damning.

Probably the most important thing here is the timing. If this is relatively contemporaneous with the event, allegations of coaching or being influenced by a narrative previously reported, or other witnesses reactions are less likely.
Looks to me like you have 2 witnesses shouting in shock at what they had just witnessed. Repeatedly stating that the victim had his hands up.

Certainly sufficient for a charge particularly since corroborated by others. No need for Grand Jury. They should indict, and I suspect they need to indict soon or things are going to spin out of control again.

Hahahahahahahahaha:

There’s some sort of unofficial birthday/Iron Dog-type/snowmachine party in Anchorage. A nice, mellow party, until the Palin’s show up. There’s beer, of course, and maybe other things. Which is all fine, but just about the time when some people might have had one too many, a Track Palin stumbles out of a stretch Hummer, and immediately spots an ex-boyfriend of Willow’s. Track isn’t happy with this guy, the story goes. There’s words, and more. The owner of the house gets involved, and he probably wished he hadn’t. At this point, he’s up against nearly the whole Palin tribe: Palin women screaming. Palin men thumping their chests.

Word is that Bristol has a particularly strong right hook, which she employed repeatedly, and it’s something to hear when Sarah screams, “Don’t you know who I am!” And it was particularly wonderful when someone in the crowd screamed back, “This isn’t some damned Hillbilly reality show!” No, it’s what happens when the former First Family of Alaska comes knocking. As people were leaving in a cab, Track was seen on the street, shirtless, flipping people off, with Sarah right behind him, and Todd somewhere in the foreground, tending to his bloody nose.

It’s not always immediately clear why ppl retweet some things. Weigel seems to be too intelligent to be a troofer.

The kindest interpretation of Weigel is that he’s a shit-stirrer. I think some less kind things about him ever since I saw Steve Sailer in his blogroll at his old blog, and a pic of him partying with RS McCain.

This is yet another attempt at forcing people into not having abortions by making the conditions to get them so onerous and/or expensive that you can’t obtain one.

This is yet another attempt at forcing people into not having abortions by making the conditions to get them so onerous and/or expensive that you can’t obtain one.

I don’t know which I find more repugnant: That somebody honestly believes forcing a woman to spend three days as an emotional wreck will help her decide not to go through with an abortion, or that they don’t care because a three day wait just makes obtaining an abortion that much more difficult for people without the means to take two days off from work in the same week.

Sad commentary on our nation when the same people who think you should wait three days before having an abortion argue that making the same woman wait a day longer to take possession of a handgun she bought is putting her life in danger.

Part II was even worse.

The box office take totaled $3,286,255 through November 4, 2012, the last date for which the producers released numbers. When adjusted for inflation, the film had one of the two hundred least profitable wide openings of the past thirty years, followed by one of the two hundred largest week-over-week drops recorded for the same period. By the third week of release it was down to under 150 screens, taking in under $100,000 on its third weekend.

They’ll be lucky if the take for part III even covers the catering bill.

I just reconnected with a group of friends that I had been out of touch with for a long time. To the last one, they are all right wing conservatives, some of them even birthers, which freaks me the fuck out. These were total Sex Drugs and Rock and Roll people in the 80s, and now a lot of them are born again or super Christian. It’s like they replaced all the fun stuff with hate, fear and racism disguised as patriotism and Christianity. One of the biggest druggies of the group is in seminary school now and going into prison ministry (she however doesn’t seem to be as off the rails as some of the others). It’s a weird thing, these are really nice people, kind, their kids are all really cool, they care for each other like a big family, etc. I’m really thinking if they find out I’m liberal they’ll dump us, which would suck but not shock me really. But I can only take so much of this shit, it’s bound to get uncomfortable at some point. Sigh. THIS is the shit the GOP has done to the country that they really need to be taken to task for. I wonder if they will put that mind-numbing John Galt speech into the movie in full. I read like 10 pages of it and saying mind-numbing is an understatement. It was like 50 pages long. A passionless diatribe of tripe.

I still liked the book overall as a work of fiction.

I don’t mind a good dystopian novel. I read the Hunger Games series and thought the writing was good enough but the premise so violent I had (and have) a hard time with this ever being considered young adult reading. No matter…do people take that as reality? How could you read Atlas Shrugged and consider it any sort of reality?

Yeah, the nihilist sermons are perhaps the most interesting part of de Sade’s work. When reading de Sade, I learned to basically skip past the sex murders and get to the sermon parts, which basically contain de Sade’s thoughts and overall philosophy.

I’ve seen Pasolini’s Salo; indeed, I have it on Blu-Ray, and I have to give him credit for - in my view - successfully adapting de Sade’s 120 Days of Sodom into an allegory of fascism.

Sigh. Yesterday it was bitching about the speech before the speech was given. Not a word about it since though.

Making people afraid of each other is just what the 9/11 attackers were hoping for and they got their wish.

Knew a couple people in college who were heavy drinkers, smoked weed, etc. and were either amoralistic or outright “might makes right” types. A few of them did 180 degree turns into born-again holy roller types. It’s like they traded in one set of fanatical beliefs for another set without really addressing any of the underlying personality issues. (The one that was basically a nice guy remained a nice guy. The judgmental bigoted asshole remained an bigoted asshole - but he quoted the bible at you instead of swearing at you.)

I quite agree that de Sade is essentially unfilmable, which is why I give Pasolini the credit I do for his film. Hell, even if an adult film production company decided to shoot the works by making a big-budget version of, let’s say, Justine, I get the feeling it would never be shown in cinemas, and it’s sale on DVD or Blu-Ray would likely be banned in several countries for its extreme and violent pornography.
