I just read the whole 6th Circuit decision and dissent and all I can say is, I don’t think her fellow judges on the panel will be inviting Martha Craig Daughtrey (the dissenting judge) to lunch anytime soon.

(I know there are a few pages about this ruling, but I thought I’d offer some of the highlights of the dissent for your overnight reading enjoyment.)

She painted them as the buffoons they are, showing no mercy.
From her opening

The author of the majority opinion has drafted what would make an engrossing TED Talk or, possibly, an introductory lecture in Political Philosophy. But as an appellate court decision, it wholly fails to grapple with the relevant constitutional question in this appeal…

Today, my colleagues seem to have fallen prey to the misguided notion that the intent of the framers of the United States Constitution can be effectuated only by cleaving to the legislative will and ignoring and demonizing an independent judiciary. Of course, the framers presciently recognized that two of the three co-equal branches of government were representative in nature and necessarily would be guided by self-interest and the pull of popular opinion. To restrain those natural, human impulses, the framers crafted Article III to ensure that rights, liberties, and duties need not be held hostage by popular whims.

BTW, I asked my Ukrainian neighbors about who they favor. Both said they are trying to remain neutral; they’re musicians not politicians, they said. Mostly they worry about their families, about the lack of municipal utilities and food. I sensed they both would prefer to be governed by Ukraine and not by Putin surrogates, and would just as soon the pro-Russian, extreme right wing factions get the hell out of Luhansk.

I also gather both have family members who are pro-separatist, which may explain why they are trying to remain neutral.

Got a reminder this morning-How sharp are we if woken suddenly? Had the classic banging and sounds of something / someone in my living room. Had an adrenaline rush big enough to make my fingers tingle. Took a look from concealment, left the guns in the quick safe, and discovered my cat was the likely (?) culprit. Whew. But I am wide awake. And not too quick to go to the gun safe..

Right. Inholfe in charge of the environment committee. I think McConnell showed what the GOP is all about in a nutshell with that placement. Anyone who believes that since they got the majority in the Senate, the Republicans are going to be reasonable is nuts, in fact I think this will embolden them.
