The entire wingnut universe is screaming in unison, as is their wont, over the SMOKING GUN that’s finally going to DESTROY OBAMACARE, and its name is … Gruber.

Jonathan Gruber, who apparently said something rather impolitic about the Affordable Care Act; he admitted that parts of the bill were written to be … less than clear. In particular, they tried to avoid using the word “tax.” And Gruber publicly used the word “stupid” to refer to American voters, which of course one must never do.

Wingnut Twitter is yelling that the media aren’t covering it enough, but they always do that whenever they have a nice juicy fake outrage — and that’s what this is. It may not be very smart to admit it (because this kind of pearl-clutching is what happens) but anyone who didn’t already know government legislation is sometimes written deliberately to obscure the truth has never read a piece of government legislation, or tried to figure out if a local ballot proposition actually does what it says it does. This ain’t news, and both sides do it all the time.

And it won’t “kill” Obamacare, no matter how much Gruber-related noise the Wingnut Unison Chorus makes.

The law has been available for anyone willing to read and parse through it since it was enacted in 2009. Or view any of the versions that worked their way through Congress before it was enacted.

That there were parts that are obtuse and that members of Congress sought to obscure - like how parts of the IM were a tax - even as it was obvious to anyone paying attention that it was a tax (like those provisions that were enacted as part of the Internal Revenue Code).

And there were bits that were written at different times and not reconciled - such as the provisions that relate to state exchanges and what happens when states don’t create them and the feds step in.

The stupidity is that all the law is out there to be parsed and understood, but we’ve got GOP nitwits who are looking for any opportunity and chance to repeal the whole thing - and replace it with vaporware. They’d rather see millions lose access to affordable health insurance than admit that they don’t have a solution to the soaring costs of health care and insurance.

They’ll blame Obamacare for higher premiums that are within the range of increases seen in employer-sponsored plans. They’ll blame Obamacare for not being perfect - even though it’s subject to many of the same problems found with other private health insurance plans (because it’s comprised of private insurers pooled in exchanges). They complain about higher costs of insurance, even though they don’t have alternatives.

They just complain. And agitate for repeal.

The individual mandate was a GOP proposal countering Democratic ones that included single payer. Heritage authors came up with it. And they were gung ho to go ahead with it, right up until President Obama made it central to the ACA after seeing it work in Massachusetts (and modeled on the Romneycare plan that likewise included an individual mandate).

Because the GOP touted the individual mandate as a way to foster responsibility among people who might otherwise skip out on getting health insurance. They’d either pay into the insurance plans or else pay penalties.

Try telling the difference between the ACA and Masscare. The differences are slight. Other than the fact that the GOP wants to destroy the ACA and deny health insurance to millions.

This isn’t going to kill Obamacare. The Supreme Court will do that (in 34 states at least) next June when they announce their ruling. The Roberts court won’t miss their second chance to dismantle as much of the ACA as possible. No other plausible reason they would have taken the case.

If Obamacare remains in 16 states, the GOP probably can’t kill it there until 2017. At which point, the disparity in social services and economic inequality will be further exacerbated. Many blue states would set up their own versions of Romneycare at the state level (a huge success, as Mass. has the highest insured rate in the country).

Red states would mostly go back to the status quo ante ACA. In other words, they would continue their race to the bottom in everything from health insurance to occupational safety to minimum wages to anti-discrimination protection in housing/employment for gays and other minorities. My advice: if you live in a red state, fight like hell. Or move.

Really, if I could, I’d ask every single GOP elected official that objects to ACA on it being “socialized medicine” to drop their own insurance paid for by the US taxpayer. I still say the thing that terrifies the RWNJs the most about ACA is the possibility of it not only working but being economically feasible. No wonder why they want to repeal it so bad. The idea that Obama and the Democrats were right on one of the most heated issues of Obama’s presidency and they were wrong probably infuriates them. This isn’t going to kill Obamacare. The Supreme Court will do that (in 34 states at least) next June when they announce their ruling. The Roberts court won’t miss their second chance to dismantle as much of the ACA as possible. No other plausible reason they would have taken the case.

If Obamacare remains in 16 states, the GOP probably can’t kill it there until 2017. At which point, the disparity in social services and economic inequality will be further exacerbated. Many blue states would set up their own versions of Romneycare at the state level (a huge success, as Mass. has the highest insured rate in the country).

Red states would mostly go back to the status quo ante ACA. In other words, they would continue their race to the bottom in everything from health insurance to occupational safety to minimum wages to anti-discrimination protection in housing/employment for gays and other minorities. My advice: if you live in a red state, fight like hell. Or move.

Obamacare, for better or worse, provides insurance companies a lot of new revenue. Preventing folks in more than half the states from the mechanism necessary to obtain insurance would cause a significant dent in that revenue stream.

Not to mention that invalidating the subsidies for the federal exchanges would require a significant re-write on precedents dealing with statutory interpretation.

Couldn’t agree more. It’s time to turn the “states rights” argument on its head, and use it not to maintain a racist hegemony (as in the south for pretty much all our history). Instead, states like CA, NY, VT, HI, WA, OR, MA, etc. will progress into the 21st century regarding health insurance, occupational safety standards, min. wage, non-discrimination towards gays, etc, as have virtually all other developed democracies worldwide.

The rest of the states have the right to continue shithole status on such issues if they so choose.

That’s what I used to think, given the ACA’s boon to private health insurers. But I think the current right’s hatred of Obama (and anything with his name attached) outweighs even their romantic love of big business.

There’s not really another plausible explanation for 4 SC Justices agreeing to take a case that amounts to nothing more than some sloppy language that clearly wasn’t intended to be interpreted as the anti-Obamacare plaintiffs argue. You can look at one Gruber quote, or thousands of quotes by actual Democratic members of Congress. The case is a joke. A truly deferential non-activist SC wouldn’t even give such a case a second look.

As usual, you’re just totally wrong. The bill was sold as two things—expanded coverage and reduced costs. So far, we have both of those results. So the bill is actually what it was advertised to be, since it has cut costs and expanded coverage. You’re focussing on one quote because you think it helps your side, and in the process you’re ignoring what thousands of other people have said. This is not the way that honest informed people debate.

Policies like the ACA work in every other developed nation, but the reactionaries in the US reflexively oppose it because it would disproportionately help the poor and minorities, whose health they don’t give a flying fuck about. Congrats on supporting the party that will celebrate when millions lose their health care coverage.

In Washington state, there were two ballot initiatives about gun control—one to expand background checks to private sales and transfers; the other (pushed and and made as confusing as possible by the NRA) to take away the state’s authority to make such a law.

Fortunately, the first passed and the second failed, but six counties voted yes on both, and one county voted no on both.

Gruber’s comments just seem to me to illustrate that there is a vast difference between being intelligent and being smart.

It was fairly obvious, for example, and no real deception, that taxes on Cadillac plans would be passed on to those who paid for the plans, but that it would be easier to get tax through as a tax on the insurance companies that way than to tax those paying the premiums directly.

But the idiotic part was for him to publicly flaunt an exaggerated characterizations of something like that as some major deception, apparently just to impress his audience about some point he was trying to make, without the slightest concern that there are RWNJs and Fox news out there eager use anything of that sort to propagandize against the health care law.

Still doesn’t mean Roberts is going to vote for it. Kennedy wanted to kill the ACA, because he wants to be the decider. However the current challenge is exactly the kind of thing that so called conservative textualists purportedly hate, using the most strained and hyper literalist interpretation possible of a wording in order to invalidate clear legislative intent. I actually pretty much doubt that Roberts will go for it, he’s seriously into his legacy and the reputation of his Court. I have no doubt that Scalia, Alito, Thomas and Kennedy are of a mind to try and shame him into a backing their play for a second bite at the apple, but if he stood up to them once on a case that was much stronger legally speaking I see no reason why he’d go for this thin and obvious pretext of a reason for gutting the law.

I’ve been going back and forth between both systems and asking people who own them. Of course whatever gaming system they own is the one they say is the best. The guy at BestBuy said PS4 has more age friendly games which is good synce it’s for the kids.

Seeing how much the gaming systems cost the laptop is going to be put on hold.

Putin’s state has a schizophrenic stance on the Russian (ethnic) nationalism. It promotes various figures that earlier used to be taboo, David-Duke-like (cf. Prokhanov, Dugin). It promotes the expressly nationalist DNR/LNR. The nationalist rhetoric is certainly on the rise.

Yet at the same time there are practical considerations, namely, that Russia is a multiethnic state with some problem regions (like Chechnya), that stop the state apparatus from going full-on Adolf. And indeed, they also make use of the anti-nationalist rhetoric, like in the case of Ukraine. And the more radical, anti-system nationalists are quite often persecuted.

So it’s more of a wink-wink-nudge-nudge approach: “We’re a great international family, nationalism is bad, but the Russian people - is it great or is it great?”

I have no problem with such tentative hypotheses about the supposed historical Jesus from “the general sociological principles” (like, “Jesus probably belonged to a class A, it was customary for the members of this class to do/be B, therefore, probably, Jesus did/was B”).

It’s how one arrives at the conclusions that matters. Taking a late apocryphon, substituting “Jesus” for “Joseph” and “Mary” for “Aseneth” and saying this proves something is just intellectual fraudulence. Even if one found a 5th century apocryphal book explicitly saying that Jesus was married, it still would not prove anything about the real Jesus.

There are plenty of “lapsed” Christians who don’t accept the official version of Christianity anymore, but are not quite willing to give up their faith completely. They’re in a nebulous region between believer and agnostic.

Just as there are Christians who observe rituals, attend church regularly but do not believe or act according to their faith at all.

There is a good reason that the Founding Fathers separated Church and State, religion is too subjective and nebulous a concept to be part of the language of law or the Constitution.

I remember reading a book as a teenager, The Word by Irving Wallace. It is a work of fiction, but it enlightened me a lot about the whole concept of the history and archaeology of early Christian scripture, much in the way that Dan Brown “enlightened” a lot of people decades later.

The Office of Inspector General initiated an investigation based on information gathered by the Audit Division of this Office for its Audit of NOPD’s Uniform Crime Reporting of Forcible Rapes (May 2014). I absolutely think Obama and his team thought along those lines. However, I believe that it was less about what Republicans would or wouldn’t vote for (although he probably naively thought that there was no way the GOP could double back on itself so thoroughly on ACA)—it was more about what Blue Dog Senate Dems would approve. I mean, let’s not forget that the House passed far more progressive legislation, and it was promptly dismantled by the Senate.

Now of course, there were elements of the old right that opposed that but when yes progressivism became about sharing taxes and benefits with the lower classes and minorities, that’s when all hell broke loose and we saw the revolt against the New Deal consensus.

The reason it came off that way (PRish) is two-fold:

1) There’s no bad or scurrilous news in it (other than the fact of John’s departure itself); it depicts the departure as amicable and the Intercept as stable and growing. We depicted those things that way because they’re true, but any time you write about yourself and don’t include a bunch of bad things, then it will come off as PR-ish. John’s departure really is amicable and the Intercept really is stable and growing, so there wasn’t much we could do about that.

2) As I said, we knew that people would try to use John’s leaving, in conjunction with Matt’s departure, to depict FLM and the Intercept as crashing, unraveling, etc. It just isn’t true, and only we are in the position to make that clear. When we do so, of course it’s going to come off a bit PR-ish: I suppose on some level it is, since part of the purpose is to address bad press by refuting it. But I’m totally comfortable with it because I know it’s all true.

This is one of the ways the internet can distort reality. In four days, nobody will remember this, even though today it seems like some earth-shattering event. We’ll soon have a new editor-in-chief who will be impressive; we’ll continue to have a large staff of journalists and editors; and we’ll be churning out good journalism. In a couple weeks, let alone 3-4 months, that’s all we’ll be judged by.

I have never seen or heard as many deliberate deceptions and lies from anyone about anything as from the rightwing about “ObamaCare,” from death panels, to “Congress is exempt” to “only six people signed up” to “government getting between you and your doctor.”

But it is hard to understand is why Democrats, especially those running for office, have done so little to counter the lies, to defend the law, and to explain to Americans what it does for them. The Affordable Care Act is a major accomplishment for Democrats to be proud of, not something to distance themselves from.

And one always need to count in Kanye West and what part he played into the whole thing with Kim’s images.

Yep. I mean it’s textbook white privilege frankly to say “Just cooperate with the police and they’ll leave you alone.” I thankfully have never been harassed by the police but that doesn’t mean it never happens to people.

Part of me wonders if the authorities in StL are purposefully stoking anger and resentment amongst the locals in anticipation of a failure to indict, if only to smother any talk of a miscarriage of justice under assertions of “mob justice.” That their decision not to indict is “right” because they can’t allow themselves to be swayed by angry locals “rioting.”

The authorities there from the Ferguson chief of police on up to the officialdom of St. Louis County are all in this up to their necks. They will do whatever it takes to appear to be victims.

And how many of those eyewitness accounts were taken into evidence by authorities and given to that grand jury? If the first link of the chain doesn’t happen it pretty much doesn’t exist as far as the grand jury is concerned.

I think that it’s heartbreaking that some of us still believe that things like facts, justice, eyewitness accounts, will convince the pig-ignorant bigots of anything other than that they’re the real victims here.

Anymore it seems that you could swap out ‘angry black man’ for angry white man and it’d probably be more factual.

And what are ‘angry white men’ pissed off about? I guess all the trumped up bullshit that the TeaParty types and then the mainstream conservatives that decided to bring the TeaParty along as a part of their base drummed up. Much of it having nothing to do with reality. And of course they got even more angry because of black president.

The African Americans have plenty to be upset with, but I fear the real trouble would come form the ‘angry white man.’ Which just means that if the bomb is lit it is going to go off big time.

I really do fear Ferguson could become the fuse that leads to troubles this country hasn’t seen since the 65 through 67 or so race riots.
