Missouri Gov. Nixon Declares State of Emergency in Expectation of Brown Grand Jury Decision

If the reports we’ve been getting about the Grand Jury in the Michael Brown case in Ferguson are accurate, it seems like a foregone conclusion that officer Darren Wilson is not going to be charged in Brown’s killing.

And now in preparation for the soon-to-be released decision of the Grand Jury, Missouri Gov. Jay Nixon is declaring a state of emergency and activating the National Guard, obviously expecting trouble even though recent protests have been peaceful. That actually makes sense - the NG can only be called in by the Governor, and this gives the MO NG time to organize and prepare for deployment. The decision by the grand jury can come at any time now - whether it’s this week, or in early December. Either way, it makes sense to issue this declaration ahead of time (much like governors issue disaster declarations before storms hit so as to expedite emergency actions after the storms pass).

The problem isn’t the declaration as it relates to the national guard though.

It’s that he’s putting the STL County police in operational control.

This is the same police force that recklessly disregarded policy and procedure, aimed loaded sniper rifles at peaceful protesters, accosted peaceful protesters and reporters who were doing nothing other than their jobs and not interfering with law enforcement.

This is the same group of law enforcement officers that issued a 5 second rule that was facially and blatantly unconstitutional to prevent crowds from congregating as is their right to free assembly under the US and state constitution.

The same groups that are part of the problem with law enforcement in Ferguson are being tasked with policing the very community traumatized by these same police departments on a regular basis.

At a minimum, he should have put the state highway patrol in operational control.

I was a little kid the last time I remember things being this volatile, that was in 1992 with the whole Rodney King thing. That was an unmitigated disaster.

I hope north St. Louis County doesn’t befall the same fate as south-central Los Angeles 22 years ago.

I’m thinking that the grand jury decision is coming very soon because I can also see there might be some legal issues with a state of emergency for which there is no justification. That said, I could also see people getting upset by this preemptive state of emergency and taking to the streets.

I have to wonder about the legal aspects of providing the governor with advance notice of a decision. Does anyone know? It would seem to me that if the grand jury can delay an announcement at all, it would only be for a very short time.
I’m really beginning to think the announcement may come at any moment.

There is something very wrong with the system, when a grand jury which notoriously can indict a ham sandwich cannot indict based on numerous witness testimonies.

When you have a prosecutor who is tight with law enforcement (after all, prosecutors rely on law enforcement to help make all of their cases, and the relationship is one that is far stronger than the prosecutors’ relationship with the public at large), and has a history of refusing to indict on excessive force cases, then when you have a shooting death of an unarmed man by a cop under suspicious circumstances, the prosecutor Bob McCullough isn’t exactly going to go out of his way to indict a cop.

The local police departments didn’t exactly help make a case either - limiting what evidence was gathered, taking eyewitness testimony, and selectively leaking information to the public that would put the shooting victim in a bad light all while giving Wilson any and all excuses to claim justification in shooting Brown.

And that’s even with the MO statute being pretty generous towards law enforcement justification on force. The problem as I see it is that once Brown turned and had his hands up, the justified use of force was no longer there - and the additional killing shots were unjustified and therefore criminal.

The highlighted portion is a very good point. I think the governor would take this into consideration and not allow time for the state of emergency to provoke a reaction by itself.
If so, it would mean the decision is imminent.

Things calmed down once MHP took over, but flared up once again when the local/county PD went off the reservation and issued the inflammatory video of the robbery that the FPD officials said was unrelated to the shooting (and claimed to justify it as part of the FOIA).

At each step, the FPD and STL County PD both undermined the MHP efforts to pacify the situation. And I have bad feelings about what they’re going to do should the grand jury fail to indict. The FPD and county PD are exhibits A and B of out of control police forces that deserve to be disbanded for their egregious and well documented actions.

I think this is it. It’s meant to be a forum for police officers and if I remember hearing right that you have to have a badge number to post so we know it’s not a bunch of people posing as cops. The postings from that site during the days initially after Brown’s death were really telling to me because you saw the condescending and hate that many officers of the law showed to their fellow citizens.

It is a supposedly mainstream cop forum. Very slick and professional unlike Thee Rant which is a borderline neo-facist NYPD website.

The problem is that cops tend to self select towards a certain mindset which becomes highly authoritarian and antagonistic to many of the rest of us.

Now, policeone.com is not a scientific poll selection of officers across the country, so you cannot extrapolate too much. However, that being said, you do start to recognize certain common trends that you can enounter with all too many officers, and it is not at all healthy for civil liberty.

Thanksgiving is going to be a pita. Most of family is fortunately pretty sane but my grandmother will ALWAYS take the side of a cop or white person shooting an unarmed black person. Saw it with her in Treyvon’s case and now Michael’s. I try not to be too harsh because she’s eighty seven years old but her prejudices couldn’t be more blatant.

What struck me when hearing it last week was how he started off the speech by focusing on the worries about property damage. Yes, not possible physical injuries, not possible fatalities, and certainly not the violation of civil rights.

No, when it comes to the government of the state of Missouri, the biggest worry is that some people might have their businesses damaged or burned.

Something similar happend in Nevada last year that actually did prompt a 3rd amendment lawsuit. Local PD forcibly took over a private home to use in a possible hostage standoff in the neighborhood and arrested family members when they didn’t want to turn over their house.

The lawsuit basically says that modern police have become funtionally indistinguisable from the military…and in any event, nothing gives uniformed services the power to take over your home and arrest you without warrant or cause when ever they feel like it.

I worked at a jewelry store in Rancho Cucamonga. It closed up when shit started breaking out the next city over.

I temember watching it in amazment on tv…and I was equal parts appalled and empathetic. I could not fucking believe the officers were aquitted (I now know that it is almost impossible to convict any officer on charges related to force no matter how preposterous the actions were) but at the same time I was horrified that the mobs were attacking all the wrong people.

Hell, I’m shocked that the bay area transit cop who shot that prone and handcuffed African American man in the back was even convicted…and even then he got less then a year in jail for killing a man who was handcuffed and prone and not moving.

Police can kill you at any time…and they will almost certainly be excused for it no matter what the circumstance. We are banking on cops hopefully not being sociopaths for the most part, since we have no actual protection from our own legal system.

If Jerry Brown runs for President I would very likely vote for him. L<ots of executive experience, understand how to budget with a sharp edge and the party would likely get right behind him. Hell he could do the same thing to any Tea Party candidate he did to Kashkari. More experience, finely honed machine and a real deficit hawk.

I would be very surprised if they did. However, that isn’t a predictor of “violence” as it’s being alleged.

If there were, maybe they would have reconsidered, like some of them did with some parts of the story of Genesis. Then again, maybe not. Everybody remembers Galileo. Albeit the men who repressed him weren’t the top-notch theologians…

If Jerry Brown runs for President I would very likely vote for him. L<ots of executive experience, understand how to budget with a sharp edge and the party would likely get right behind him. Hell he could do the same thing to any Tea Party candidate he did to Kashkari. More experience, finely honed machine and a real deficit hawk.

I kind of like Jerry Brown. He is honest, he works at the duties he assumes, and he’s intelligent. He’s discharged those duties not just honorably but effectively, on the whole.

He’d make a better president than most of the names being bandied about, from either party.

This statement alone should disqualify him from the Presidency since it shows a profound lack of understanding of the legislative process.

Of course,that wont stop Fox, the right wing, and the GOP from flogging this nonsense through and beyond 2016. They want yet another bite of the apple to destroy Obamacare, and who cares what happens to the millions who have gotten health insurance for the first time as a result of the program.

The GOP alternative plans are vaporware. There’s no other way around it. The GOP has fixated on repeal, and Carson’s yet another talking head/wannabe presidential contender to embrace repeal (by yet another vote to defund, delay, destroy).

The sad thing is that everyone who knows anything about the pre-ACA health care system was unworkable, failing, and need of serious reforms. The GOP themselves came up with individual mandate as a way of promoting reform and putting the onus on people to get insurance rather than on employers. Yet, the moment the Obama Administration adopted the idea in the name of bipartisanship to get GOPers to vote for the reform, the GOP abandoned it. Moreover, they then turned the whole argument on its head by claiming the individual mandate was unconstitutional.
