So explain Tamir Rice. /

He’s black. He’s 12. Has he got a gun? Yup? Then shoot away. Is it a real gun? Who cares, the cop thought he had a gun.

Rice wasn’t resisting arrest. Heck, Rice never even had a moment to try and follow the police instructions because the cop started firing within 3 seconds of exiting the car. He was dead before anyone not named Quicksilver or The Flash could react.

Or let’s explain Akai Gurley?

Was he black? Did he have a gun? Nope. Just blast away anyway, and then text to the union rep even as Gurley is bleeding out before me. [and nope, that’s not sarcasm, because that’s actually what happened]

Maybe Rumain Brisbon?

Was he black? Did he have a gun? Did he have a bottle of pills that looks like it was a gun? Shoot away.

Yup, you’re a walking weapon so shooting you is completely reasonable (as long as you’re black). Crazy looking white men carrying weapons are exempt from this rule.

Open carry state applies only to being white.

If you’re black, and carrying or playing with an air gun or toy gun, the open carry rules don’t apply. It’s shoot first, and not be questioned later.

If you’re too big. If you’re selling loose cigarettes. If you’re a 12 year old with a toy gun. If you reach for a pill bottle in your pocket.

But mostly, they’re justified if you’re black. At least according to the RWNJs I see online.

He wasn’t even reaching for it. The cop felt what he thought was a gun during the struggle. Turned out to be a pill bottle.

Methinks someone mixed up reporting:

Rolling Stone thought it could play real journalism.

Newsweek (ex-Newsweek) The Daily Beast thinks it’s playing music critic/historian:

Fact is that media outlets that fancy themselves as doing journalism need strong fact checkers who will proof everything written. And if they find discrepancies, they have the power to kill a story. Rather that some writer’s feelings are hurt than to kill the credibility of the outlet (or harm the cause of women who are sexually assaulted as in the current instance).

Rolling Stone never bothered to do its due diligence to check and see whether any of the story could be confirmed.

That’s going to do incalculable damage to womens’ rights groups who are struggling to deal with rampant sexual assaults on college campuses nationally.

But it’s laughable to read right wing outlets chide anyone over fact checking - not when they willingly spread all kinds of nonsense so long as it smears the President (Benghazi, IRS, etc.).

The practice will inevitably spread to those white people of whom the cops disapprove. When that happens, no matter how far in the future it does, the RW will blame Obama.

A friend with legal training pointed me to the eggshell skull rule, which is in tort law but also a variation in criminal law. Lawhawk could probably correct me if I’m in error, but in criminal law the rule says that a person “takes their victim as they find them,” as in it doesn’t matter if a person had a heart condition that could have led to death, what matters is the person on trial did something that led to their death. So saying “He had a bad heart” does not absolve these cops of the result their actions led to, which was his death.

If I wave a gun around and threaten you and scare you into a heart attack, that’s murder. Even though I didn’t shoot you.

If you jumped off my roof, and as you fell past my window I shot you so you died before you hit the ground, that’s murder. Even though your own actions were going to kill you within seconds anyway.

By the same token I’ve been reading a bit about the Mishnah and the Talmud as a way to better understand Jesus in his historical context. And one thing the talmud makes clear is that to bury someone immediately even if no one else is willing is a very important mitzvah, The one I claim as the anointed one was buried thanks to someone who believed this. For them to do this makes me shudder at how little charity I have really performed in this life.

If you kill an innocent person walking downstairs in his own apartment building…I think you are starting to reach the textbook definitiion of negligent.

If cops were held to the same level of scrutiny as airline mechanics…we would not be having this problem.

48 lawhawk  Dec 5, 2014 11:49:32am

re: #35 Ace-o-aces

The NYPD were quick to label it accidental, but there’s nothing accidental about the officer doing the sweep with his finger on the trigger in such a way that he’d fire and kill Akai as he entered the stairs.

It was a combination of negligence and incompetence, as well as policy. Accident implies that no one was at fault and no one can be blamed.

Heck, the NYPD even stopped calling their motor vehicle investigation unit the accident investigation unit. It’s now a collision investigation unit because not all collisions are accidents. Most involve some sort of fault and blame.

Here, the blame rests squarely on Officer Liang, who while showing remorse in firing the shot that killed Akai, also thought first to call his union rep. That’s a pretty screwed up priority.

Then I remembered, White People set the standard.

I had forgotten.

“Money” magazine had a special issue on racism about 20 years ago — there was an article about mortgages, one about small business financing, one about blue collar wages…

The small business one, the magazine staff made up a few business prospectus packages. Market research, cash flow projections, owners’ background and credit report and personal references. They hired a bunch of actors, half white and half black, trained them in bankingese, and sent them out to apply for loans. 70% of the white actors, and 40% of the black actors, got the loans. For the exact same package.

There’s no way to prove racism in any particular case. They’re not obvious gimmes, or 30% of the white people wouldn’t have been turned down. They’re not obvious rejections or obvious overt racists, or 40% of the black people wouldn’t have been approved. Some part of it is just subjective feeling from the loan officer, what the bank’s looking to do this quarter, etc. Sometimes, the only way to “prove” racism is with a big enough sample size for statistical evidence to be meaningful.

That’s what a lot of the excessive force cases come down to. It’s easy to have a “feeling” about a particular case, but the only proof is going to be when we look at a statistically significant sample size.

Now here’s a study in contrasts. This little snippet happened in Uganda.

The officer in charge of Abako police post in Alebtong district, Corporal Anthony Ogwal, has been arrested hours after the death of a 22-year old man he allegedly shot.

He reportedly shot and severely injured Daniel Odongo, a resident of Abako trading centre and a former student of Buluge Comprehensive School, last night after he failed to heed to a police directive to stop for an ordinary check. Odongo was rushed to Alanyi Health Centre II where he breathed his last early today.

Manshur Suwed, Central North regional police spokesperson, says Odongo was moving in the group of three people but when they were asked to stop, he reportedly took off, promoting the police personnel on patrol to shoot at him.

He added that the deceased succumbed to severe bullet wounds that caused deep internal bleeding.

Ogwal was picked [up] by a team of personnel from Central North regional headquarters in Lira and is being held at Alebtong Central Police station.

Investigations are underway, although Manshur confirms that a murder charge has been preferred against [Corporal] Ogwal.

redpepper.co.ug

So a cop shoots and kills a young fellow who ran away, and the case goes in front of a grand jury where nothing whatsoever happens as a result and a charge of murder is filed against the officer in question.

In Uganda.

Well, there goes what’s left of my faith in humanity.

The NYPD is particularly aggresive in victim blaming.

An especially nasty example last year happened when an officer shot and killed a female New York college student while she was being held hostage in her own apartment by an intruder. The officer never called for backup, was not trained for hostage situations, and shot her through the head.

huffingtonpost.com

The NYPD went into victim smear mode immediately. It didn’t help that the girl was model level gorgeous and popular. They went after her fiance with allegations they had both been selling drugs from the apartment and that the intruder was there to shake them down, with the result her fiance was compelled to lawyer up and refused any more questions. They went after her sister and family.

That is the NYPD. If they fuck up, they will come after you even after your death.

Ramsey runs through five key guidelines for allyship:

1. Understand your privilege.
2. Listen and do your homework.
3. Speak up, not over.
4. You’ll make mistakes, apologize when you do.
5. Ally is a verb — saying you’re an ally is not enough.

I might add #6: Accept you will never fully understand, you are white.

Relax, soon we may not have the brain cells to become outraged:

If this union is consummated the resulting Black Hole of Stupidity will engulf us all within days.

A Tebow quiver full.

It’s only okay when the cops are white and the victims aren’t.

I can promise you that if Michael Brown, Tamir Rice, and Eric Garner were white, conservatives would have been uniformly outraged over their deaths.

They have them. What we need are better cops.

Rod Dreher is in an especially despicable streak right now over at the American Conservative mocking liberal whites who are shocked at what police do.

Funny story. My neighbor, who is my age, linked to Ted Nugent’s comment on Ferguson protests and said:

If you don’t want to be stereotyped, don’t be a stereotype.

Then he posted that clip of that viral video.

I thought I knew this dude, I guess not.

If the GJ takes longer than a day to return a bill, the fix is in. Who am I kidding, the fix is in.

Why do they never have preliminary hearings with a judge in these cases instead of Grand Jury? (They seem to be presenting defense cross-examination anyway, albeit it seems to be the prosecution presenting the defense case.)

Just look at the way they rallied around Bundy who was pointing guns AT law enforcement and owed the government a boatload more money than Mr. Garner did.

The racists in this country have been emboldened to show what they really are lately. And why the fuck not, they seem to be fucking winning all over the goddamn place at this point. We’ve had how many goddamn examples that show that you can just about do anything to a person with darker skin than you and not only escape the consequences but become a fucking folk hero.

This country never got less racist. It just hid it well. And even a cursory glance through facebook and twitter tells you that time isn’t and may never heal this wound ever. If anything, it’s become worse.

TJ Lane shot up a school in Chardon, OH.
They threw his butt in prison, alive.
TJ Lane escapes from prison.
He’s still alive.

Ah, but he is an unrepentant white guy so…

Rod Dreher has been an insufferable douche for years. I remember reading his smug ass over at Beliefnet years ago. He tried to present himself as a “crunchy conservative” that ate granola but voted Republican. He’s a guy who converted from Catholicism to Orthodoxy because he thought the Vatican was too liberal.

Cliven Bundy was an old white conservative rancher. He embodied the GOP trifecta.

If he’d been a black man, the loons that supported him would’ve called him a moocher and a deadbeat and would’ve called for drone strikes on his ranch.

When did we stop being Mayberry?

Even in Mayberry-esque one cop towns (for a population of about 300) it’s happening—although this guy did actually get indicted and it only took 3 years.

The indictment of Richard Combs, the former chief and sole officer in the small town of Eutawville (YOO’-tah-vihl), was released Thursday. He faces 30 years to life in prison if convicted in the death of Bernard Bailey.

New Twist in Lynch’s Confirmation After New York Grand Jury Decision

“…This is what “states’ rights” are all about folks. Retaining the power to discriminate. The federal system has always been the instrument of power to force this country to end racist and other discriminatory policies. And the conservatives have fought it from the get. Libertarians are, obviously, not for federal power either, which reveals why Paul is twisted up like a pretzel on these race issues.”

“Why does the federal government feel like it is its responsibility and role to be the leader in an investigation in a local instance?” asked [White] Senator John Cornyn, [White] Republican of Texas, who said all state and local options should first be exhausted.

Nah, this cop will definitely be made an example of and indicted (and maybe even convicted), simply because he himself is a minority and a rookie without any likely personal/political connections within the NYPD.

Not that this makes what Officer Peter Liang did any less moronic or tragic, but he will be sacrificed to the growing public sentiment that cops who kill senselessly should be held to the same (or stricter) standards as “civilians” and he will be held up by the RWNJ cop-sucking gunfuckers, who will say, “See! This cop got punished, the system works!”

As for me, throw the fucking book at him, because he fucking deserves it; I just don’t want RWNJs pissing on my leg and telling me it’s raining.
