The Woman Chuck C. Johnson Falsely Identified as “Jackie” Is “Pursuing Legal Action” Against Him

Poetic justice?
Wingnuts • Views: 47,205

YouTube

This video report by Touchvision has more details on right wing hatchet man Chuck C. Johnson’s identification of the wrong woman as “Jackie,” the purported victim of sexual assault in Rolling Stone’s now-discredited article. (For some reason they’ve disabled embedding for the video, so you’ll have to click through to YouTube to watch it.)

They’ve actually been in contact with the woman whose picture Johnson published, and she says she’s “pursuing legal action against Johnson” — which would be poetic justice for the sociopath who threatens to sue everyone who criticizes his dishonest tactics.

And we should point out that Johnson’s sleazy “correction” for his post still contains the photo in question, and he still insists “it’s very possible that it is Jackie.”

It’s cute how he pretends to have journalistic standards in that last screen shot. He didn’t give a shit whether it was the wrong woman or not, and everyone knows it.

If it was Jackie then he’s exposed her to harassment and threats. If it wasn’t Jackie, well, she was at Slut Walk so that makes her just as bad, amirite?

She should get a very large piece of every dollar CCJ raises for his muckraking and hatchet journalism.

Good. I hope she takes him for everything in his parents basement. I highly doubt that upChuck would have any kind of professional or liability insurance, that would imply that he would entertain the possibility of being wrong.

Like somebody said earlier, he may be the first person to be a defendant in a “Class Action Libel Suit”. I can see the commercials now… “Have you been libeled by Charles Johnson (the crazy, not the jazzy ponytailed one)? Has he mis-identified you as a rape victim, felon or serial hall pooper. If so, you’re entitled to your day in court and big bucks. Call the law firm of Tinker, Evers and Chance for a free consult”

Good on this young lady.

Somebody might want to give Chucky a heads-up, that he’ll want to save that money he was planning to pay his lawyer to file a libel suit to defend himself from the one against him.

7 EmmaAnne  Dec 14, 2014 12:09:12pm

I, of course, find the idea of Chuck being sued hilarious. I am not sure what Angie’s cause of action is, though. Is it really libel to misidentify someone in a publicly available photo, even as carelessly as he did? Maybe he sicced his followers on her - I’d believe that.

That’s the whole “If you’re taking flak, you’re over the target” and “Living rent free in their brains” Bull-Caca that Palin and her ilk keep regurgitating. The possibility that they are getting all the push back simply because they are utterly and incontestably wrong in every way possible isn’t even part of their mindsets.

Well, he’s falsely identifying her as a woman who lied about being raped, and continues to do so even after he’s been shown to be mistaken. That means he’s doing it deliberately at this point, so there’s malice involved.

The photograph was also the only proof offered to support his claim that Jackie had “cried rape” prior to the alleged incident at UVA. A claim that he so far has refused to retract. Meaning that Jackie would seem to have a very strong case against him as well.

That was 13 yrs ago. Today, 65% of New Yorkers think the white cop should have been indicted by that Staten Island grand jury for killing Eric Garner.

Hero worship is usually not that long-lasting. The public can be very fickle.

46 goddamnedfrank  Dec 14, 2014 1:30:05pm

CCJ’s open reliance on random unknown d-bags he meets on Twitter has already burned him badly. @STKnutsen is a church secretary / bored housewife from Georgia who he’s hired to do his opposition research, and she’s the one who apparently found the photo of Angie, thinking it was Jackie. She’s the one who convinced Chuck to run with the story, and she attempted to take the blame on Twitter when it all blew up in his face.

Now Chuck is advertising on Twitter for people to do legwork for him in Philadelphia and has some random pro-life fanatic wanting to do the same in NYC.

This is reckless and stupid for multiple reasons. First off, these people aren’t reporters, they have no real journalistic training or research background, which doesn’t bother Chuck because he doesn’t either. This makes them equally as reckless as he is, and what he desperately needs is a rational voice, someone who can hit the brakes.

This willingness to hire unknown stringers also opens him up to infiltration, being fed bad information on purpose by those who oppose him. Sooner or later this is bound to happen, someone with no real online political opinion fingerprint, or a faked background, will be able to slide themselves into his confidences and Dan Rather his ass with a deliberate hoax.

Inside The Koch-Backed History Lessons North Carolina Wants To Teach High School Students

thinkprogress.org

“Public high school students in North Carolina will be taught from a lesson plans and worksheets prepared by a organization closely tied to the billionaire Koch brothers, if the state’s Department of Public Instruction gets its way. According to the Raleigh News and Observer, the Virginia-based Bill of Rights Institute received a “$100,000, sole-source contract with [North Carolina] to help develop materials for teachers to use in a course on founding principles that the state requires students to take.”

“The N&O also notes that the organization receives funding directly from David Koch and from two Koch family foundations, although, if anything, this description understates the Institute’s ties to the conservative billionaires. Two of the Institutes four board members are employed by Koch entities — one is a senior vice president at Koch Industries and another is director of higher education programs at the Charles G. Koch Charitable Foundation — and many of the Institute’s other top leaders also appear likely to push a political agenda in line with the Koch brothers’ anti-government views. Board member Todd Zywicki, is a George Mason law professor and a leading opponent of Wall Street reforms such as the Consumer Financial Protection Bureau. The Institute’s president, David J. Bobb, founded two centers at Hillsdale College, a conservative institution of higher education that proclaims its opposition to “the dehumanizing, discriminatory trend of so called ‘social justice’ and ‘multicultural diversity.’” More

He lives in Clovis, Curry County. Yes, they almost certainly will issue him a permit.

I’m actually able to get a permit because I live in Ventura County, have been for awhile now. Because the VC police have publicly stated that they will voluntarily abide by the ruling established in Peruta v. San Diego. If Ventura jumped on board then I’m absolutely certain that deeply red Curry County did as well.

Also, the Peruta precedent may be here to stay.

Relaxed rules for carrying concealed guns in public may not be challenged by California state officials or advocacy groups, a federal appeals panel decided Wednesday.

The decision was another victory for gun rights advocates, but it was not likely to be the last word. The state has the right to appeal Wednesday’s order and legal analysts expect the state to do so. There is another pending gun case involving the right to carry concealed weapons in California and a ruling in that case could resolve the debate.

In its 2-1 ruling Wednesday, the U.S. 9th Circuit Court of Appeals denied an attempt by Atty. Gen. Kamala D. Harris, a gun control group and law enforcement associations to intervene in a case that struck down San Diego County’s policy of tightly restricting the carrying of concealed guns. Gun owner Edward Peruta was the lead challenger of the San Diego rules.

Essentially what happened here is that San Diego chose not to appeal the District Court rule in Peruta, so Kamala Harris tried to on behalf of the State. However the State wasn’t a party to the original lawsuit, and the “good cause” requirement wasn’t part of state law, it was a County requirement, so the 9th told them they didn’t have standing to file the appeal.

Lying bastards.

“The State Attorney was forced to drop the charges against Holloway [the police victim] after the 1:49 cell video surfaced in June that contradicted parts of the officer’s police report. The video also prompted prosecutors to ask about body cam video, even though Escobar had put in the police report that there wasn’t any body cam video of the arrest. The incident happened in March, but the body cam video was not presented to prosecutors until October — four months after the cell phone video surfaced.”

Since this did not involve a public figure, there is no need for the case to rise to the level of Times v. Sullivan and its burden of proving “actual malice.”

That said, a lesser-known way of proving actual malice is to demonstrate “reckless disregard for the truth.” Thus, even were a judge to determine that Chuckles was making a good-faith effort to comment on a matter of deep public interest, he would be guilty of reckless disregard. The many mistakes that he has made in the past and the deep disregard for truth he has demonstrated in his tawdry career will be admissable, and will be assessed when figuring damages during the penalty phase, after the verdict is reached.

If he has any half-bright legal counsel, right now they are screaming at him to publish a retraction, act penitent and to shape the fuck up & stop being such an asshole. In those exact words.

And also why, if he ever does go forward with any of his ridiculous libel suits, I do hope somebody uses this defense against him:

Claimant is incapable of further defamation - e.g., the claimant’s position in the community is so poor that defamation could not do further damage to the plaintiff. Such a claimant could be said to be “libel-proof”, since in most jurisdictions, actual damage is an essential element for a libel claim. Essentially, the defensee is that the person had such a bad reputation before the libel, that no further damage could possibly have been caused by the making of the statement

He would have to have a very specific policy for indie journalists called “Errors and Omissions,” commonly known as “E&O Insurance.” An example of this can be found here (by no means does this link constitute endorsement of this policy). The policy here covers punitive damages up to $250K, which is a pretty fair amount. However, the riders to the policies typically say they will not cover you if you knowingly commit fraudulent or reckless acts - just if you’re negligent and screw up.

Thus, as the trial approaches, the insurance company that would be defending CCJ (see? I used the new&improved acronym!) could reasonably be expected to start “exploring its options” in regards to its coverage. Translation: they’d look to shift blame to CCJ and deny his claim to coverage of his legal bills or payment for the claim, were he to lose (as seems likely in this instance).

The real worry UpChuck has is if he really is sued is that it’s going to cost him real money to put on a defense. I don’t think the royalty payments from Why Stoolidge Matters are going to be enough.

Depends on if he has E&O (see reply above). If he has a robust policy, the defense would be paid for … up to a point. Usually, at about the deposition phase is where the wind starts coming out of their sails, and the insurers start to get squirrelly. All those billable hours … and if you lose a case like this, part of the punitives tend to be paying the other side’s legal bills.

Once the verdict starts looking like a foregone conclusion, the plaintiff’s attorneys tend to start gilding the lily. Calling depositions of everyone & their pet salamander, just so’s they can boost the billable hours. Six attorneys show up, all billing $400/hr. and then charge an extra 40 hours to review the transcript of the depo.

Gets expensive fast. Trust me. I know.

In a previous universe I worked a bit as an EMT for a Medevac unit. There were a lot of incidents we flew on where the medics report would include the phrase “The strong smell of alcohol was noted on the patient”. My favorite was the guy that was painting his work shop with a power sprayer. Got tired of climbing up and down the 8 foot step ladder. Had a buddy come over with a pickup, ladder goes in bed of truck… buddy drives slowly along the shop while the guy sprays. Yea…. who would think that that standing on a ladder in the back of a pickup being driven over dirt could end poorly.

Yep. The insurance company will fund the fight against the suit, just to see what kind of flex the plaintiffs show. If they’re determined & funded, at that point, the settlement letters start getting fed into the fax machines.

What are the chances that CCJ could call upon a deep-pocketed wingnut to pay for his screwup? I could see a Foster Fries wanting to jump into the fray and pay for some slut-shaming, but not too many others.

My best guess is that this guy is Chuck’s primary “angel investor.” He’s been tweeting in support of him lately and has a long history of backing wingnut media projects.

Maloney posted the Moore footage on his web site, and after the war started, he set about shooting anti-war demonstrators, posting that video as well. Maloney’s work was seen by Stuart Browning, a very wealthy 44-year-old from Miami Beach with “deeply conservative political views,” and was also given the stamp of approval by Glenn Reynolds, the author of Instapundit (dot) com, a well-known right-wing weblog.

In the fall of 2003, Maloney and Browning founded On the Fence Films, and budgeted $250,000 for Brainwashing 101. According to Gershman, the expanded version of the film has the working title Ministry of Truth .

And there’s more …

Maloney spent two and a half years making the documentary by conducting interviews on various college campuses and with various thinkers. The film was preceded by two shorter versions, Brainwashing 101 and Brainwashing 201: The Second Semester. The two shorts led the 2004 American Film Renaissance festival to select Indoctrinate U as its “most anticipated documentary.”

Indoctrinate U was produced by On the Fence Films with the support of the Moving Picture Institute, and Stuart Browning, Blaine Greenberg, and Thor Halvorssen. The film’s executive producers are Stuart Browning and Blaine Greenberg. Its associate producer is Frayda Levy. It was edited by Chandler Tuttle.

Here’s a clip of Browning on Hannity’s America.

So Chuck doesn’t know what FOIA is?

FOIA? You know how slow that is?

UpChuck just wants someone to break into the place and steal everything they can, then give it all to him.

Journalism, UpChuck style.

That sounds like too much work for UpChuck. Its easier to just go to the cesspool and skim off some random lies and filth to use as the next “story”.

Editor’s note: Hours before the hostage situation began in Sydney, A 25-year-old man was arrested for alleged financing of terrorism in the city. At this point, there’s there’s no suggestion that the incidents are related. - Jillian

Will Chucky be able to distinguish when he is being lampooned by media?

And as far as him not understanding FOIA, that may be a good thing. As hyper as he can be, his knowing he can request government documents could be a problem. He will be filing FOIA requests on everything, starting with Obama’s records, then all of Holder’s on down the line.

Orly Taitz is years ahead of him on this, and she still can’t find her ass with both hands. She also claims to have a high IQ, is always expecting others do all her legwork for her, for free, and also expects her supporters to pay her airfare, hotel, and FedEx bills.

She has to be related to UpChuck in some way. What are the odds that there are two people like this who both live in the same state?

I would have thought it VERY clear by now that he has ZERO compunction about citing anything or anyone that he feels supports his own point of view.

Video just shown here abc.net.au shows a man with a backpack directing hostages in front of the glass door of the Lindt cafe. Not sure what his status is, worker, customer, hostage-taker.

But it seems a worker wouldn’t have a backpack on, and a customer would have probably taken his off to sit down? So who is this guy?

Hostages were being held inside a central Sydney cafe where a black flag with white Arabic writing could be seen in the window, local television showed on Monday, raising fears of an attack linked to Islamic militants.

Prime Minister Tony Abbott said he was convening a meeting of the cabinet’s national security committee for a briefing on what he called a hostage situation in Australia’s commercial capital.

Australia, which is backing the United States and its escalating action against Islamic State in Syria and Iraq, is on high alert for attacks by radicalised Muslims or by home-grown fighters returning from the conflict in the Middle East.

Dozens of heavily armed police surrounded the Lindt Cafe in Martin Place, home to the Reserve Bank of Australia, commercial banks and close to the New South Wales (NSW) state parliament.
