Darren Wilson Grand Juror Sues Prosecutor McCulloch for “Mischaracterizing” the Case

Here’s a fascinating bit of news from Ferguson, Missouri, where one of the grand jurors in the Darren Wilson case is suing prosecutor Bob McCulloch, saying he presented a distorted picture of the case to the jurors and the public.

The grand juror, referred to only as “Grand Juror Doe” in the lawsuit, takes issue with how McCulloch characterized the case. McCulloch released evidence presented to the grand jury and publicly discussed the case after the grand jury decided not to indict Wilson, then a Ferguson police officer, in the shooting death of Michael Brown, an 18-year-old African American.

“In [the grand juror]’s view, the current information available about the grand jurors’ views is not entirely accurate — especially the implication that all grand jurors believed that there was no support for any charges,” the lawsuit says. “Moreover, the public characterization of the grand jurors’ view of witnesses and evidence does not accord with [Doe]’s own.”

“From [the grand juror]’s perspective, the investigation of Wilson had a stronger focus on the victim than in other cases presented to the grand jury,” the lawsuit states. Doe also believes the legal standards were conveyed in a “muddled” and “untimely” manner to the grand jury.

It’s a novel theory to get the grand jury secrecy restrictions lifted; a judge might actually go this route rather than see the grand juror come forward publicly and potentially face criminal sanction for it.

And the prosecutor who would sanction someone with more jail time than Wilson has thus far? McCullouch - who is the named party to this action. Yeah, lots of politics involved too.

If a judge doesn’t rule on the suit, the juror might take his chances and go public - risking the possible prosecution - and note that prosecuting on the grand jury violation was a slap at the very system that McCullouch set in motion by putting people on the witness stand he knew had no business being there - someone who wasn’t even at the scene and was known to be a liar (witness 40). If McCullouch attempts to prosecute the grand jury violations, it would be putting his own actions under an even greater microscope - even though the grand jury secrecy laws are pretty airtight in this regards. It’s the optics that matter as much as the law and policy behind them.

It should be. McCullouch is an officer of the court, and knew or had reason to know that her testimony was bogus, and yet he put her on the stand to testify about things that she had no personal knowledge. She wasted everyone’s time - but worse than that - muddied the waters and used her testimony to counter other witnesses that identified Brown with his hands up and surrendering to Wilson, yet Wilson shot away.

This is a tremendous miscarriage of justice, and McCullouch should be held accountable.

Which is why is repeatedly reelected as prosecutor in St. Louis county running unopposed. [spit]

It is a clear violation of the Missouri Rules of Professional Conduct.

Rule 4-3.3(a)(3) indicates that a lawyer shall not “offer evidence that the lawyer knows to be false”

[2] Rule 4-3.3 sets forth the special duties of lawyers as officers of the court to avoid conduct that undermines the integrity of the adjudicative process. A lawyer acting as an advocate in an adjudicative proceeding has an obligation to present the client’s case with persuasive force. Performance of that duty while maintaining confidences of the client, however, is qualified by the advocate’s duty of candor to the tribunal. Consequently, although a lawyer in an adversary proceeding is not required to present an impartial exposition of the law or to vouch for the evidence submitted in a cause, the lawyer must not allow the tribunal to be misled by false statements of law or fact or evidence that the lawyer knows to be false.

Now, apply this to McCullouch’s position, and it’s even worse - he not only put this witness on the stand, but allowed the grand jury to hear and consider it, even though it undermined the entire grand jury process.

It’s the claim that McCullouch mischaracterized what was presented, how the evidence was handled, and what the jurors could and actually did address in not handing down an indictment. It’s a suit to allow a grand juror to exercise their 1st Amendment rights against the prosecutor’s statements, which have already been suspect for some time in this case - especially because of his admissions on allowing someone to commit perjury in testifying against Brown [lying about being present at the shooting, reciting information that supports Wilson, but only providing information that was publicly available, etc.].

It’s an interesting 1A case because it runs up against the traditional grand jury system, which is a secret process - but that’s not an absolute either.

I don’t know, I could see where this could be interpreted as “the grand jury reached a unanimous decision” where as the lawsuit pointed out …only 4 jurors had to decide they didn’t want to file charges.

It is important to note here, and say again, that they are the only people, the only people who have heard and examined every witness and every piece of evidence. They discussed and debated the evidence among themselves before arriving at their collective decision. After their exhaustive review, the grand jury deliberated and made their final decision.They determined that no probable cause exists to file any charges against Officer Wilson and returned a “no true bill” on each of the five indictments.

This picture was taken at the Pajamas Media launch party in New York, the only time I have ever been in the same room with Pamela Geller. This was at a dinner for the PJ crew; Geller wasn’t invited, she showed up and sat at the table for a few minutes. That was it.

And by the way, I spent a lot of time avoiding Geller at that event, for pretty obvious reasons. I certainly have never “partied” with her — there were thousands of people at this event.

Holland got the photo from the loons at the stalker site, who frequently bring this up. It’s a zombie smear.

HUGH WILSON: I was allowed to see everything, and then Jerry Blum, the station manager, told me about a promotion - I believe in Texas, and I want to say Dallas, but I’m not sure - in which he threw turkeys out of a helicopter, and they didn’t fly. They crashed to the ground, it was just a horrible disaster, and he wound up losing his job over it. So I said to him at the time, “Jerry, I think you just won me an Emmy.”

CLARKE BROWN: The turkey drop was actually a real incident. It was at a shopping center in Atlanta; I think it was Broadview Plaza, which no longer exists. It was a Thankgiving promotion. We thought that we could throw these live turkeys out into the crowd for their Thanksgiving dinners. All of us, naïve and uneducated, thought that turkeys could fly. Of course, they went just fuckin’ splat.

People were laughing at us, not with us. But it became a legend. There were other stories of this nature that were embellished [on WRKP]; that one was really not embellished that much. Although the turkeys were thrown off the back of a truck, as opposed to how it was depicted on the [show].

HUGH WILSON: I didn’t dream up the helicopter. My memory is Jerry said a helicopter.

CLARKE BROWN: It just ended with, the joke’s on us. And of course, our guys played it up. It turned out to be a great little unintended publicity gimmick, the fact that it failed the way that it did. Probably got more mileage out of it being screwed up than had it not been.

HUGH WILSON: Since that time, a couple of people have claimed that story, but Jerry said it was him. He’s the one that said to me, “You know, Hugh, turkeys can’t fly.”

Commenting about the “dark space” behind the woman’s hair? Seriously? This was probably taken on a smartphone or basic point and shoot with the built in flash (which you see distinctly in the window reflection. Flash at that distance would cause the “halo” effect of the dark shadows behind them because the flash was unidirectional and not bounced off the ceiling or wall to reduce the effect and give more natural light.

But hey, let’s go basing the legitimacy of a photo based on an image already edited by goatnews with their logo smeared all over it. Because something…

I believe this photo is more than ten years old - before the digital photo age, and has been copied and processed over and over. It was a probably a cheap disposable flash camera from the look of it.

Bottom line is that with a photo in this condition it’s impossible to tell whether it was faked, but it seems very unlikely that somebody faked it a decade ago just for this occasion.

The guys I know that do forensic verification on photos (such as the good folks at stopfake.org) tend to take a good long time in doing so. Of course, it is easier when you start with a digital image, rather than a scan of an analog image — the errors and artifacts introduced during the scanning process tend to muddy the waters. And if you’ve run an auto clean-up after scanning (as is common on low-end flatbeds, rather than the big-ass Drum Scanners used by magazines & archivists), then this will leave even more “evidence” of alteration.

Bottom line: none of the amateur sleuths in Wingnutistan are likely to be able to handle the task.

The grand juror is merely asking for permission to speak about the proceedings (He has been sworn to secrecy under penalty of law) He (she) is claiming they have the first amendment right to do so and McCulloch already spoke and misrepresented things.
