Mark Knopfler is one of my favorite guitarists. Very distinctive style, I can usually identify his playing when I hear a tune. My spouse took me to a Mark Knopfler concert for my birthday one year. Even though she wasn’t a big fan before that, we both agreed it was one of the most enjoyable concerts we’ve attended.

Wish I’d seen this tour.

Just…the seductive lure of reactionary fear-based crazy has lured far too many people who I knew as staunchly liberal toward the right wing to the point of being utterly unreachable on everything else. This is why I have so little hope on any kind of fucking progress on this, or just in politics in general. Trying to pull people toward more sane, left-wing platforms is like rolling a stone up the hill. One mistake, and they run screaming back and are even further unreachable than before.

Okay…who said golf wasn’t an addicting sport? My wife and I recently took it up and we’ve been out almost every weekend - and we played twice this weekend. Mostly nine hole par-3 courses - which is perfect as neither of us has a great deal of understanding of range, so starting with the short game makes sense - but we’re already improving, which makes it suck even more as we’ve begun to talk about how to sneak a round in before we go up to Tahoe to go skiing, which is why we have a fucking winter in the first place.

So, I went to see The Hobbit, Part III today in IMAX 3d. Visually? It was amazing. The sfx was outstanding and thought it was beautifully shot.

But I couldn’t help but think that this was a movie that was made because Peter Jackson wanted to make a trilogy when a single film was doable (or a 2-parter). It also suffers the same problem as LOTR: RoTK - it had 15 endings.

The story suffered as a result too. It’s a shame, because had Jackson been ruthless in cutting material down the length and combined the movies, it would have been a far better journey.

I really have no respect at all for Bibi. He really seems to be eager to poison the pot. Rabin being assassinated and I’m showing my youth here is one of my earliest memories of something involving Israel and I just remember it being a sad moment. What Frank has posted about Bibi’s role in stirring up hatred against Rabin following the Oslo Accords just disgusts me about the man. I mean it’s bad enough that he constantly panders to the American wingnut crowd who really seek to use Israel as a tool without actually giving two shits about peace. The photo of his foreign or defense minister Lieberman with Pam Geller was awfully telling as was Bibi himself giving an award to Glenn Beck.

That was my attitude, too. Then I watched it. And got hooked.

It’s a very well written, well acted soap opera with a decent budget, The writers know how to keep you yearning for the next episode.

Given everyone’s so very proper British, there’s not much bombast, crying and yelling. They keep all those emotions properly stifled, you know. Stiff upper lip and all that.

It’s worth it just to watch Maggie Smith steal every scene she’s in.

Also, there is a vacuum of unified voices among the more “progressive” portions of our society. It’s not that they aren’t talking, but rather that there are a thousand different and at times quite disparate conversations underway concurrently.

For instance, group A might be warning about the low wage mindset of Walmart.

Group B only talks about climate change.

Group C are the “social justice” warriors, who might conference with groups A and B on occasion, but then go their merry way.

Group D are the gay rights activists - who on the whole will work with just about anyone but the reverse is not so.

And so on…

Meanwhile, all the bigots and xenophobes have to do is pull the “Jesus” card out, or the “MUSLIM!” card out, and the wingnuts rally together.

Yes, what I am saying, and this is anecdotal I admit, is that there is more coherence among the hate right, an orthodoxy if you will.

Another problem I think we’re looking at is a sort of post-modern deconstruction of the FDR Democratic Party. What FDR and TR were able to glue together is now more like a brownian motion dominated mass of flies, and small groups easily go off. E.g., the “Reagan Democrats”, those who RWR were able to peel off by wrapping himself in Americana (which btw FDR could do also.)

Just getting home from a long night, but I saw Selma tonight. The theatre I was in was all people of color (although I do believe I saw one white young man with his girlfriend, who was Black). There was a lot of elderly men and women, who seemed of the correct age to have been living under Jim Crow South. Not as many young people as I would have wanted to see (I dragged my nephew to see it). compare that to when I saw Taken, the crowd was predom white, young and middle aged, with a sprinkling of people of color, most of which were young like my nephew.

So back to the film. From the shock of the opening sequence (even knowing what was gonna happen), to the scenes on the actual Edmund Pettis bridge (god bless John Lewis) and the final scenes in Montgomery, the entire audience was riveted. Powerful doesn’t even begin to describe it. I saw it over 5 hours ago and the movie is still on my mind.

I know we’ve talked a bit about the LBJ stuff here, and I don’t know if the audience I was with even knew about the controversy, but from the overheard conversations, the last thing on anyone’s mind was the portrayal of LBJ. At the end the majority of the people just stayed in their seats and there was essentially silence until people started leaving their seats.

I don’t have time for a full fledged review, but I can say if you are a movie goers like myself or if you decide you’d only go see a film that was worth the price of admission, then RUN DON’T WALK to see Selma. it def more than a “Black” story or a “Southern” story, it’s truly an American story, and I’d like to think it def deserves as much of a diverse audience as it can get.

I also loved the way Wendy Jo Sperber goes after Treat Wiliams. He slices through a crowd and she bulldozes a path.

Interestingly enough, some blogger at NRO went through Dershowitz’s response and found that he mischaracterized the accuser’s claims in order to debunk them. E.g. she writes about private planes, and he responds with info about Epstein’s plane. She writes about New Mexico and he writes about a particular house in NM, and so on.

Roberts is accusing him of statutory rape, which is a crime. The fact that his reputation would be hurt is a byproduct, not the aim of the lawsuit. He, on the other hand, wishes to destroy Roberts and her lawyers specifically in retaliation for those allegations. He could just file slander and/or libel charges, but in his statement to Reuters it’s clear he’s out for revenge.

Nothing wrong with defending anyone. Though IIRC he continued to defend him outside the court, in a book. That’s something else. A lawyer’s obligations do not extend that far.

I’m unfamiliar with the book but I would assume it contains the case he helped make. I don’t think that really is the same as continuing to defend OJ. He was done defending OJ.

Interestingly enough, some blogger at NRO went through Dershowitz’s response and found that he mischaracterized the accuser’s claims in order to debunk them. E.g. she writes about private planes, and he responds with info about Epstein’s plane. She writes about New Mexico and he writes about a particular house in NM, and so on.

It’s not inevitable. It’s always something people make an active choice to do because they have no principles, honor or integrity.

There is no realistic ticking time bomb scenario. It’s a fantasy action adventure trope, predicated on a convoluted set of insanely unrealistic circumstances. In the real world there is no perfect knowledge of the terrorist plot in progress, and no cut scenes cluing the audience in to their guilt so that everyone can cheer and know the good guys are doing the right thing.

Shows like 24 were designed to deaden both the conscience and intelligence of the American public, to move us towards accepting a blatant betrayal of our national heritage. We’d been hit and were feeling raw and vulnerable, and the Bush Administration and their apologists use the resulting fear to justify an official policy based on sheer atavism, in spite of how counter productive and frankly damaging to our national security it actually was.

Actually evidence suggests that once in a while, torture actually worked. As he actually says in his paper (which I seem to be the only one who read the damn thing because you guys can’t quote it), “The Israeli experience suggested that information obtained as a result of torture should never be believed, unless it can be independently confirmed, but such information can sometimes be self-proving, as when the subject leads law enforcement to the actual location of the bomb.”
Dershowitz argues that requiring warrants would reduce the instances of torture, like requiring warrants reduced the number of wiretaps.

There is no fucking ticking time bomb scenario. And yes, he was attempting to provide some deodorizing cover for people like Yoo. He was saying, “here’s how we do torture right.” I’m saying there is no right way to do torture. The time bomb scenario is the thin edge of an incredibly horrible, intellectually rotten and cancerous wedge. The entire line of reasoning is both morally and logically bankrupt, it’s designed to get people to think about torture in a context where it is pre-defined as legitimate. That context however is antithetical to actual reality.

That’s what I mean by fantasy, that shit never actually happens outside of fictional settings.

You are simply wrong about that. Timothy McVeigh lit a fuse that ran about 10 minutes or so. That is a ticking time bomb. The fact that there is little chance he would have been caught and interrogated in that time doesn’t make it impossible.
The example Dershowitz makes is the Israeli Supreme court’s ban on torture, which puts security officials in an impossible dilemma. Forcing an official to do it under the table means that the torture will be worse, and may never be heard about. Requiring warrants at least makes is public, and even gives the suspect some measure of legal protection.
What we have is the utopic idea of “all torture is bad and it must never be permitted” clashing with the real-life idea that somebody is inevitably going to abuse a suspect, and what are we going to do about it?”

Excuse me, but I was busy meeting with a student. I have read the paper, since you are so keen on us doing so. I suppose one’s reaction to Dershowitz’ arguments for “torture warrants” depends on one’s acceptance of torture as a legitimate means of obtaining information. Clearly, Dershowitz has no qualms about torture being acceptable, as long as there are clear legal avenues for its use.

Moreover the rights of the suspect would be better protected with a warrant requirement. He would be granted immunity, told that he was now compelled to testify, threatened with imprisonment if he refuses to do so and given the option of providing the requested information. Only if he refused to do what he was legally compelled to do - - provide necessary information which could not incriminate him because of the immunity - - would he be threatened with torture. Knowing that such a threat was authorized by the law, he might well provide the information. If he still refused to, he would be subjected to judicially monitored physical measures designed to cause excruciating pain without leaving any lasting damage. A sterilized needle underneath the nail might be one such approved method. This may sound brutal, but it does not compare in brutality with the prospect of thousands of preventable deaths at the hands of fellow terrorists.

There are many hypotheticals in just this one extract, enough to make the entire argument pretty weak.

1. We have someone in custody who may have information about a terroristic act.
2. He refuses to cooperate.
3. There are no other possible sources of information.
4. We get a “torture warrant.”
5. He still refuses.
6. We stick needles under his fingernails.
7. He sings like a canary.
8. Problem solved!

He refers to Israeli cases in which some useful information was obtained by mild torture techniques. Then the Israeli courts declared such techniques illegal. Yet, in the same paper, using the aforesaid hypotheticals, he says basically that the Israeli Supreme Court was wrong in its decision, because torture sometimes is justified.

I don’t find his argument convincing in the least. I also find his suggestion that torture should be legally condoned abhorrent.

But since we’re dealing with hypotheticals, here’s one I would offer to Dersh and his ilk: let there be warrants as you wish, but any such warrant will be accompanied by sort of a contract: the torturer willingly goes to prison for the minimum of 5 years (or more, depending), without a trial (to exclude any “necessity” defenses) or any possibility of parole or pardon. This guarantees that torture is not psychologically normalized or that people are not tortured “just because”. If the case is so grave that one allegedly must torture, it is also so grave that the same person must be willing to sacrifice himself for the sake of the greater good.

If the person is innocent, or doesn’t have the information you think they do, how exactly would you know when to stop? Similarly, if they lie, how would you know, they can easily send you on a wild goose chase and waste precious resources, and will say anything to make the torture stop.

The exigent circumstances argument is simply crap with regards to this. People rarely say what valuable information was gained in the few circumstances they assert it’s worked, and the amount of bad information gained and assimilated is similarly never discussed by the proponents of torture. Reportedly the only actionable information the US was able to get via torture under Bush had already been told in normal non-torture interrogation sessions. And predictably the the torture program’s cheerleaders lied their asses off about the actual origin of these results:

Those responsible for the program have tried to portray this as a CIA-versus-FBI matter, or as a debate between those who will do whatever it takes to defend the homeland versus those with softer hearts. The reality is that these techniques endangered our homeland. They didn’t work. We lost valuable time - years of time. Intelligence that could have been gained wasn’t. And plots that could have been stopped weren’t.

There was no actionable intelligence gained from using enhanced interrogation techniques on Abu Zubaydah that wasn’t, or couldn’t have been, gained from regular tactics. In addition, I saw that using these alternative methods on other terrorists backfired on more than a few occasions — all of which are still classified. The short sightedness behind the use of these techniques ignored the unreliability of the methods, the nature of the threat, the mentality and modus operandi of the terrorists, and due process.

Defenders of these techniques have claimed that they got Abu Zubaydah to give up information leading to the capture of Ramzi bin al-Shibh, a top aide to Khalid Shaikh Mohammed, and Mr. Padilla. This is false. The information that led to Mr. Shibh’s capture came primarily from a different terrorist operative who was interviewed using traditional methods. As for Mr. Padilla, the dates just don’t add up: the harsh techniques were approved in the memo of August 2002, Mr. Padilla had been arrested that May.

What amuses me most about their continued defense of what they did is that they’re still wrong. Within minutes of the report’s release, the Wall Street Journal published an op-ed by three former CIA directors, and they still called Abu Zubaydah a senior al-Qaida operative. This error is, in many ways, a microcosm for everything that went wrong. When the agency’s contractors arrived at that black site, they said that as Abu Zubaydah was giving us information, he wasn’t fully cooperating because he wasn’t admitting to being the number three in al-Qaida.

We knew Abu Zubaydah’s background well: We had been investigating terrorist attacks in which he was involved in Jordan and terrorists who had come through his training camp. The reality is that Abu Zubaydah was an independent operator with close ties to al-Qaida, but he was never a member. He had actually tried to join earlier on in his career, but al-Qaida deemed him unstable; later, when they wanted him to join, Abu Zubaydah refused.

We pointed this out at the time, but the “enhanced” interrogators refused to listen. A few years ago, very quietly, the US government changed its claims about Abu Zubaydah, reflecting the reality that he was never a member.

And the thing of it is, our own aging interrogators from WWII who’d been in charge of questioning high level Nazi prisoners understood all this and tried to tell us what we were doing in the WoT was both wrong and inherently ineffective.

Blunt criticism of modern enemy interrogations was a common refrain at the ceremonies held beside the Potomac River near Alexandria. Across the river, President Bush defended his administration’s methods of detaining and questioning terrorism suspects during an Oval Office appearance.

Several of the veterans, all men in their 80s and 90s, denounced the controversial techniques. And when the time came for them to accept honors from the Army’s Freedom Team Salute, one veteran refused, citing his opposition to the war in Iraq and procedures that have been used at Guantanamo Bay in Cuba.

“I feel like the military is using us to say, ‘We did spooky stuff then, so it’s okay to do it now,’ ” said Arno Mayer, 81, a professor of European history at Princeton University.

Wow I’ve never seen him so young. I really enjoy his work. He was hilarious as the older George Bluth on Arrested Development and he had a small role in There’s Something About Mary. Plus he’s good as the father in law in the Hangover movies too. Oh and one of my childhood favorites, Heavyweights.

I also enjoyed him in the Gary Shandling Show which was on HBO in the 90’s. He played the much put upon “sidekick”. Such a versatile, nuanced actor. He can do comedy and drama with equal ease.

Morning! Have I mentioned I hate colds. It feels like today will be the last…but damn…there are not enough tissues.

Weather wise, it appears Columbus was spared the ice storm that was feared. Looks like the warmer air moved north a bit, so anything 20 miles north of the city got a little ice, but more snow. I hope we get those 40° days at the end of this week. Hello January thaw.

And one more thing…I see Decatur Deb posted up a nice version of a great classic song by Bonnie Dobson…Walk me out in the Morning Dew.

There was a semi-successful band out of Cleveland Ohio, Damnation of Adam Blessing, who did a great version of the song. Tons of version have been done by rockers, but to me Damnation does one of the best for a rock band. Of course Adam Blessing (Ken Constable) has a great somewhat gospel somewhat bluesy voice to really carry it off. In my opinion anyway, see what you think.

As a reminder, this is the true demographic picture in Europe, and far from being a majority anywhere, there’s a range from insignificant minority to a substantial minority.

In Birmingham, Muslims make up 22% of the population, which is hardly a majority (unless you’re playing RWNJ math).

Excuse me, but I was busy meeting with a student. I have read the paper, since you are so keen on us doing so. I suppose one’s reaction to Dershowitz’ arguments for “torture warrants” depends on one’s acceptance of torture as a legitimate means of obtaining information. Clearly, Dershowitz has no qualms about torture being acceptable, as long as there are clear legal avenues for its use.

There are many hypotheticals in just this one extract, enough to make the entire argument pretty weak.

1. We have someone in custody who may have information about a terroristic act.
2. He refuses to cooperate.
3. There are no other possible sources of information.
4. We get a “torture warrant.”
5. He still refuses.
6. We stick needles under his fingernails.
7. He sings like a canary.
8. Problem solved!

He refers to Israeli cases in which some useful information was obtained by mild torture techniques. Then the Israeli courts declared such techniques illegal. Yet, in the same paper, using the aforesaid hypotheticals, he says basically that the Israeli Supreme Court was wrong in its decision, because torture sometimes is justified.

I don’t find his argument convincing in the least. I also find his suggestion that torture should be legally condoned abhorrent.

If that’s what you think his points are than you managed to look at the paper without reading it. You also have a knack for mischaracterizing my arguments. I guess that’s what you get when you have a pre-conceived notion, not about torture, but about Alan Dershowitz.

(My spell-checker doesn’t like pre-conceived, so when I right-clicked it one of the acceptable options was “pee-conceived.)

If you are say 63 with a pension, and your job is on the bubble, it may, depending upon what you can get from Social Security/Pension combined, be easier to simply retire or go to half-time rather than hold on for dear life. That’s also what happened during the Great Recession: many people decided to take retirement/had to take retirement in order to have something to live on. So these people are out of the workforce entirely or only in partly. These people are now off of unemployment, so they aren’t being counted anymore.

1956 is the peak of the Baby Boom in terms of births. I was born that year. In four years (age 62), depending upon economic conditions and what’s available, many may choose to retire early. In seven years or so, the wave of retirements will drop considerably. When that happens, a lot of positions will start opening up as the smaller Generation Xers and last remaining Jonesers move up to middle or senior management and leave those positions open for younger workers.

Because other artifacts and structures have survived. But those artifacts are typically buried or made out of stone and therefore not likely to decompose. Since the Ark itself was built out of wood, it is probable that it would have decomposed.
