Bill Would Allow Texas Teachers to Use Deadly Force Against Students

AUSTIN - Teachers would be able to use deadly force against students, and would be safe from prosecution, under legislation filed last week in the state House.

The Teacher’s Protection Act by Rep. Dan Flynn, R-Van, would allow educators to use force or deadly force if they feel they need to protect themselves against a student or anyone else on school grounds. It also allows teachers to use deadly force to protect school property, and to avoid prosecution “for injury or death that results from the educator’s use of deadly force.”

The bill was filed just days before a video of a New Jersey physics teacher being body slammed by his 9th grade student went viral. In the video, it’s clear the teacher is avoiding fighting back or touching the student.

Not so sure it’s as bad as implied. Not sure as I’m just getting started looking into this-But it may be intended as legal cover for a teacher or staffer who fights a mass killer with lethal force, perhaps a gun. It does not mean a teacher can execute a student for breaking a pencil.

“We understand he’s trying to carve out some liability protections. But, we can’t see that the liability protection in that particular bill is any different than the protection that exists in law for a regular citizen.”

Exter added the ATPE’s legal team doesn’t believe Flynn’s legislation adds any additional protections for teachers that don’t already exist for every Texan claiming self-defense: “We understand he’s trying to carve out some liability protections. “Educators in Texas actually do have some legal protections that do allow them to use physical force to protect themselves and protect others, as long as the use of physical force is reasonable,” said ATPE managing attorney Paul Tapp.

Just imagine when kids from one high school prank another high school during football season. Under the whole “protection of property” thing, a coach or staffer could shoot AND KILL those kids and not face consequences for it. You know, since they were protecting school property.

Not necessarily. According to the 2013 New York Police Department (NYPD) Annual Firearms Discharge Report, “[p]olice shall not discharge their weapons in defense of property.” (page 4)

As far as crime goes, the NRA pretty much does believe that. They don’t talk about much else, and their primary focus is making guns as easily available as possible, and allowing them to be taken just about everywhere.

The language of this new fucking law is too ambiguous. It’s wildly open to interpretation. This gives teachers all kinds of justification to light up a student with their weapon.

I’m surprised this is even being debated, even in Texas. We’re not going to evolve as a society and as a species if we have to have guns on us around everybody we interact with. A student/pupil weapon relationship like the one they want to set up in Texas is a devolving process.

I just did a cursory read of Palo Pinto County. A county of just over 20,000 people is close enough to be included in the Dallas/Ft. Worth Micropolitan Statistical Area. Mineral Wells is over 50 miles from downtown Ft. Worth.

Sprawl. I’ve been watching it in Denver. It’s definitely bigger than it was when I was younger. But the sprawl in north Texas? Kind of blows my mind.

That’s a really weird stretch. PETA and the NRA are anagrams, but what other connection do they have in a debate about guns in the classroom…other than some balance that likely doesn’t exist outside your head.

I could have brought up a group like NAMBLA and introduced them into the debate. But why the hell would I? They’re completely irrelevant, as is PETA. There are thousands of extreme groups out there that have nothing to do with gun ownership. PETA is one, NAMBLA is another. You could play that inane game all day long. But why on earth would you?

I think it is unwise to argue about intentions, particularly among us.

However, the wording of the law IS unwise, as it does allow the use of deadly force in defense of property. It is bad enough the law allows overly subjective judgements as a defense; this wording widens to an extreme extent and requires little judgement and careful thought from the shooter.

You can argue defense of self/other people could demand quick judgements as to threat; property should NOT fall into that territory.

Putting aside the insanity of arming everybody everywhere to the teeth and making Mutual Assured Destruction a domestic policy -

I must be behind the curve because I wasn’t aware of teachers being allowed to have guns in school here. And that part about defending property… Big no-no… Pretty much every legislative body everywhere agrees that deadly force to defend mere property is criminal.

I think what they intended was to provide legal protection to an armed teacher who stops a shooter anywhere on school grounds. I really don’t know why that needs its own law, though. This just reads like get-tough grandstanding for somebody’s campaign.

Reaching the right conclusion for the wrong reasons isn’t really to the long-term benefit of other people, and in the realm of the scientific it’s exactly the same as being wrong. The Nazis were up to their elbows in quack science, especially in and around biology. We remember the “hits”—the stuff that worked—but forget the heaping mass of misses. Heck, there wasn’t even a coherent set of quackery that all Nazis followed. The people of influence dabbled, and used their authority to encode their personal beliefs into mandates—the most blatant example being Himmler’s various occult fixations. It’s like if you gave the stupidest, New Age-y celebrity real, immediate power over state policy.

And a declaration of values (“let’s preserve nature,” “let’s ban smoking”) doesn’t really float unattached within the world of ideas. Its the midsection of a chain between base assumptions and conclusions drawn…and the Nazis don’t deserve any credit for having a few “good” values—like about personal health—since the motives for and ends desired were utterly fucking bonkers, quackier than a duck herd, and usually involved a lot of people dying. Take the base assumptions about not smoking: it wasn’t just about health, it was about your body not belonging to you. As a man, you were to be healthy to fight or labor in war industry, as a woman, you were expected to be healthy to make babies, because you were a sub-unit of the race. And the combined assertions—you body is not yours plus personal health as racial hygiene—meant that ultimately the individual were expected to die if you were unhealthy for the body politic, even if they were Hot Shit Aryan, #1 grade. Mind you, the ur-assumption of all Nazi policy was war preparation. Giving people the warm fuzzies with free vacations and a cheap VW Beetle is a bit short shrift when you’re prepping them for a total war followed by gruesome process of rendering colonized territory into a new racial state.

The other creepy thing about the “good” Nazi ideas is that they’re cut flowers: the country went to war, lost the war, and the party was effectively stamped out. We’re looking at their incomplete projects, starts without finishes, when we look at their non-military efforts. “Strength through Joy” vacations were goofy fun for the participants, but only because the Nazis hadn’t nailed down the details on making the trips about racial history and solidarity. Their building projects that we remember—the Autobahn—are the practical ones, but their plans for post-war new cities and new monuments were enormous, expensive follies.

You mentioned the KdF vacations, and I recall reading from Shirer’s Rise and Fall of the Third Reich that he went on one of those junkets as a reporter and he noticed a substantial amount of Nazi propaganda being disseminated.

But you’re quite right - as far as the Nazis and their anti-smoking campaigns, the fundamental assumption behind it was healthy soldiers for the conquering Reich and healthy women to breed healthy future soliders for the ever-conquering Reich. It had very little - if anything at all - to do with individual health.

One thing I didn’t know until I’d read up more about it was that Hitler himself was quite the heavy smoker during his halcyon days lounging about in Vienna, and he quit out of economic necessity; he was living in a men’s hostel as I recall, because he was pretty much broke.

I’ve quit because I was finding it well-nigh impossible to breathe. I figured in a few more years - I’m 45 now - I’d be lugging around one of those little oxygen tanks with tubes up my nose and it would certainly limit my mobility.

No thanks. So far, BTW, the quitting’s going easier than I thought. Maybe because this time, I really do want to quit.

Both my parents smoked, so I’m pretty sure that’s where I got it from. Like I said, I’m using nicotine patches - a 10-week program - and the one thing I still “crave” is almost purely psychological. It’s putting cigarette in my mouth, and taking a drag, and feeling the burn as I draw the smoke down. It sounds horrible (and healthwise, it certainly is) but there’s a psychological factor involved in that. It feels good, as weird as that sounds.

Fortunately, this is a 10-week program, and knowing myself, by the end of that 10 weeks, I likely won’t miss it at all.

ETA: I was a pretty heavy smoker. At minimum, a pack a day. Sometimes, close to two.

That shooting was pretty much a black swan (and unsuccessful). Hanging around the militia sites, I don’t pick up any great interest in armor, largely because other elements like medevac are not in their nutcase scenarios. IIRC there was no kevlar showing at the Great Bundy FTX. It’s probably better if they spend the last of their social security checks on armor rather than ammo.

(The more passionate threeper sites are getting very interested in secure commo.)

My take is that if something isn’t a notable factor in crime, it should not be restricted unless it is an area-fire weapon (grenades, automatic weapons, mortars, etc (there are very clear reasons to restrict those types of weapons)).

But if something isn’t a notable factor in crime and is not an area-fire weapon, then it should not be restricted. To me, the onus is always on those wanting a restriction, with the question not “Why do you want this?” but rather “Why should people not be allowed to own this.”

And with that, I’m out.

9.43 refers to use of deadly force to protect one’s property:

(2) the actor reasonably believes that:

So, the potential theft of a pen or a backpack would be sufficient grounds for the use of deadly force as construed since a theft of a the pen or backpack is the theft of a item of tangible personal property, and the student who owns the backpack or pen requests help and the teacher would have a duty to protect that student’s property (since the student is under the teacher’s care).

It was more a case that his generals had planned things out so that the start to war would be no earlier than 1940, when they expected to have most of the infantry mechanized and the panzer units fitted out with PzKpfw IIIs and at full strength. Oddly enough, the Brits and French had much the same idea and didn’t expect war to happen any sooner than 1940, which is why they slow-walked their own rearmament programs.

You know those things and I know those things. The voters don’t seem to know them and both Speaker Boehner and Majority Leader Mitch McConnell are glad that they don’t . If the voters had profound objections to GOP obstructionism or if they felt that ACA was worth fighting for then they sure have funny ways of showing it.

The U6 unemployment rate is still hovering around 11%. Oil prices will go back up as soon as producers stop over-producing. Neither of those things really matter because it’s perception that matters. If Romney is perceived by voters as the answer and our candidate is not then he’ll be elected. SCOTUS? Don’t bother. I don’t recall anyone campaigning on the crucial importance of nominations to the Supreme Court. At this point in time that issue is rendered moot for Democrats because no one who is one millimeter to the left Of Chief Justice Roberts will be confirmed by a Republican Senate.

Don’t mean to be insensitive, I have always wondered about that. I know SWAT and military also wear the protective helmet…so in the case of the topic discussions…are we all going to have to go out in public dressed head to toe in armor?

Then came Romney 2.0 in 2012, with almost all of the liberal routines stripped out and the values on the conservative ones cranked up to the max. Apparently the Kickstarter campaign for 3.0 stalled, which is why we’re going to get Bush 3.1 instead.

I like Tim Kaine as someone with a future for the party nationally. He was someone that was vetted for Obama’s running mate spot and I think fairly progressive minded for a Southerner. I like him more than I do Warner. Not sure how our other Virginians feel. Saw that Jim Webb was contemplating a run. Not a huge fan of his though he has talked about some issues that should be talked more about i.e. criminal justice reform.

I’m not actually sold on this. From my observations, the Republicans will turn any Democrat’s candidacy and term into a circus, so it really isn’t a useful factor in the decision. Yes all the Republican candidates sound like old white men with the same ideas we’ve heard a thousand times but with the exception of Jeb, they’re all fairly young too. I think it does the Democratic Party a lot of good to be the party of the future with youthful people as key parts of that. That’s one reason why I’m for a shakeup in Congressoinal leadership. Reid and Pelosi are both over 70 and have been in their offices since the 80’s.

I participated in a Quinnipiac Poll earlier this month, and they ran through the presidential campaign of 2016 - potential candidates and matchups.

Of the choices offered for the Democrats, I said Warren, but their matchups with GOPers offered only Hillary versus __GOP__. Picked Hillary over every single possible GOPer, from Jeb to Carson to Christie to Romney to Paul.

It’s not that I like Clinton, it’s just that I dislike all the GOP alternatives even more. No one is particularly engaging at this point, and the Democrats are still trying to size things up with Hillary being the presumptive front runner even though she hasn’t declared.

Shooting someone in the head is a great deal more difficult than the movies would have you believe, nor is it the sure kill they portray. The head is a very small target.

The spot for an instant kill, the spinal cord, is infinitesimal in size. The quick kills, the arteries in the neck, likewise. A hit in the brain might or might not kill instantly, or even cause much debilitation. The skull is very hard and a small calibre pistol bullet might not penetrate. Nor is it certain a small calibre pistol bullet would do massive damage to the brain.

A bullet that would destroy the brain in a single shot would have to be very big and/or very fast (Energy=1/2 mass times velocity squared). Both make accurate aiming difficult.

So, center of mass when firing weapons in combat. Body armour covers that area.

They are crude, but as long as it gets to last I am glad they do get to do what they do without being taken out back of the Capitol and shot.

I get the feeling some people in this country are all for the shooting of any protester. Like John McCain, and half the populations of Texas, Arizona, Florida, Arkansas and a few other states.

That’s why I’d vote for her. I just think Hillary as president would bring the same old Clinton nonsense that we had to live through under her husband’s presidency. It’s been bad enough under Obama and it wouldn’t get any better with Hillary.

It probably won’t get any better under *any* Democrat elected President. Too much outrage and emotional capital invested in the hate-fest.

Newsflash: Teachers in Texas can already do that if they fear for their lives. So can any citizen of this state. Plus, there are already officers on every high school campus. There is no need for this bill. It’s just a political stunt.

Most teachers simply do not think of killing their students for any reason. That’s not where their minds go. Those are their KIDS, even the violent ones, even the damaged ones.

Now, I will say this…some teachers are scared of their students. If there’s a fight they leave the room and leave the other students in there to deal with it while they go look for an officer or another teacher that will intervene. If a kid gets belligerent in class they let it escalate. They simply will not back some of those kids down. But it’s a funny thing…I’ve seen some of my husband’s tiny female colleagues who can give one glare and any nonsense STOPS. They’re more cowed by the Mom Glare than a campus police officer.

It’s a vanity law. Teachers can already protect themselves if needed.
