After President Obama said Elizabeth Warren was wrong about her objections to the Trans-Pacific Partnership deal, she appeared last night on the Rachel Maddow show to explain her objection to the process. In the interest of promoting a reasoned discussion on this deal (instead of what I see as a blizzard of propaganda) I’m presenting this video to you, dear readers.

I have to say, though, that it doesn’t strike me as unusual or unreasonable to keep draft negotiations of a sensitive multi-national trade agreement secret. One reason for doing so is illustrated by the reaction we’re seeing now — to prevent the deal from being undermined or even completely sabotaged by uninformed public pressure before there’s even a final agreement.

One of the main objections to the deal I’m seeing is the emphasis on intellectual property rights — but do these people realize how completely out of control piracy and theft of IP is in the Asian countries that are part of the deal? It’s absolutely rampant, and this definitely hurts the US economy, big time. Getting some control over this situation is a GOOD thing, not a bad thing, and if these countries will finally agree to respect the property rights of US creators that will be historic.

Yes, I have issues with some of the way the DMCA works. But the US is being badly hurt by the copyright chaos in Asian countries.

The allegations are from the “tell-all” book that the Grey Lady is pimping on behalf of Rupert Murdoch. Thing is, Time Magazine did the legwork to actually investigate if there’s anything to the allegations. And wouldn’t you know it, everybody they talked to at the State Department says she was never a part of the negotiations, and that State was only one of nine agencies who had to give approval for the deal to go through.

I want pressure being applied from the left because working people have concerns about how this affects them. Having said that I don’t think it’s good strategy to box yourself into a position, considering widespread sympathy for the concerns give enough political advantage to focus where that energy may be needed as info develops. OK, as I understand it, one of the big pieces of the TPP is a giveaway to the RIAA and MPAA studio types that Obama and the big-money (D) coalition have been milking for money the past six years (which is why there are choppers & traffic jams in my neighborhood every few months, when Obama comes for a dinner at some super-agent’s house).

Now this is coming out of a the Fight For the Future group - kinda associated with the EFF - which I tend to agree with a lot of issues. Trying hard to parse whether this is something to be concerned about - or if this is just a “well, this COULD happen” type deal.

[…] as of right now the Trans-Pacific Partnership will do all of the following:

Force sites to remove allegedly infringing content from the web without a court order - scarily similar to SOPA.

Create harsh criminal penalties for journalists and whistleblowers. Any disclosure of information with “commercial value” would be criminalized — and there would be absolutely no public interest of free speech exemption.

Punish Internet users who share copyrighted material, even without any personal gain. Here’s the proposed punishment from the leaked text: “sentences of imprisonment as well as monetary fines sufficiently high to provide a deterrent to future acts of infringement.” Again, that’s potential prison time for sharing something without any personal gain.

Limit Fair Use to make copyright even more restrictive on creative innovation. Last week, WikiLeaks revealed a series of emails surrounding the TPP where the Motion Picture Association of America (MPAA) explicitly argued against including any fair use provisions. And it looks pretty clear that if the TPP passes, they’ll have their way. That means remixes, sampling, and quoting of copyrighted material could become illegal outside the US.

Allow foreign corporations to sue the United States government if they think that our laws infringe on their profits. This is, quite simply, the most devastating part of the Trans-Pacific Partnership. It opens the door to undermining every good law we’ve ever passed to protect the Internet — the only thing corporations have to do is prove they could make more money if those laws didn’t exist.

In short, the TPP isn’t just bad — it’s zombie bad. It has parts of every misguided Internet policy we’ve killed over the last decade trying to become law by completely bypassing every part of our democratic process.

I just watched the Elizabeth Warren segment above for the second time and it’s striking how murky her objections are. Since the deal is classified she isn’t allowed to get into specifics - I understand that. But to be honest she sounds a bit like a conspiracy nut here. Surely she could have at least gone into detail about the parts covered in the public summary, and explained her objections.

I’m kind of disappointed in her reaction to this. If it’s really a bad deal explain why, don’t mutter about “people tell me the public wouldn’t like it if they knew what was in it.” That’s bullshit.

Basically, as I read the internet-related provisions of TPP, it’s a wishlist for all the angry music/movie guys who are still butthurt over BitTorrent sites. And I get that. Piracy is out of control.

But their remedies for piracy are the internet equivalent of summary field executions. This is the kind of stuff that we pushed through in Russia … and then Putin’s guys used the anti-piracy laws as pretexts to seize the computers of an opposition party members, or pro-democracy bloggers, because you could be sure that somewhere on those hard drives was something that was pirated.

People will pay a price that makes sense to them. When that is not possible - and demand remains inelastic - they will find other ways (aka black market).

The harshest critics are almost always way off base. They are not the kind to double check, rather these are the people most subject of all to confirmation bias.Seems a universal rule in and around Washington DC.

Both sides are capable of attempting to set the frame of the debate before the facts are officially allowed to be released. Partially due to knowing human nature and that arguing on the basis of an old version in advance is going to give your version of the facts greater initial traction.

Nothing is well protected in Asia except Chinese interests. Not heavy equipment, not software, not even Apple. In China there are whole stores dedicated to faking out the consumer it’s a real Apple store. Tariffs etc can drop, but rights must be protected. it would be the Senate’s job to see to that.

Agree. What is the big issue with waiting until the deal is posted? Then if Warren and others still have a problem, they will have 60 days to convince Democrats to vote no. Public pressure will be applied as well.

One big problem to me is that some Democrats are behaving like tea party folks. That is not good. Disagreements are fine, expressing caution is fine, but we do not need a nasty split in the party. I like Warren, but I think she is overreacting here.

One big problem to me is that some Democrats are behaving like tea party folks. That is not good. Disagreements are fine, expressing caution is fine, but we do not need a nasty split in the party. I like Warren, but I think she is overreacting here.

Maybe it’s deliberate? I tend to shy away from conspiracy theory stuff, but could it be that Warren is firing away at the TPP from the left to give cover to business-friendly (aka what passes for moderate these days) GOP types to support the TPP?

It’s the kind of thing that Rove was always good at orchestrating - have far-right wingnuts criticize Bush as being too squishy, so that whatever law doesn’t get pulled any further left, because there are some that are claiming that it’s too left-wing already…

One of the main objections to the deal I’m seeing is the emphasis on intellectual property rights — but do these people realize how completely out of control piracy and theft of IP is in the Asian countries that are part of the deal? It’s absolutely rampant, and this definitely hurts the US economy, big time. Getting some control over this situation is a GOOD thing, not a bad thing, and if these countries will finally agree to respect the property rights of US creators that will be historic.

Yes, I have issues with some of the way the DMCA works. But the US is being badly hurt by the copyright chaos in Asian countries.

Congress has been playing games with the copyright duration for decades. And it’s gotten to the point where they’ve got a Mickey Mouse rule (essentially written to protect Disney’s rights to Mickey from going into the public domain).

I get that patents for drugs might need special durations, in part because of the time to pass through FDA approval and the safety gauntlet, but copyright is a different breed - that life of the author plus X should be sufficient and that additional extensions actually reduce who can use the IP openly. Allow the author and successor/owners to maximize their profits for a period of time, and let it pass into the public domain.

US copyright is effectively infinite in duration. Nothing that came out after Steamboat Willie will ever go into the public domain by expiration of its copyright. Idealists who believe in the public good will file suit against each copyright extension, which will fail in the courts, assuming Congress always keeps the copyright term finite.

I agree with all the above — and what we’re talking about right now is fast track authority, not the treaty itself. I’m agin it. Not that I think the current Senate is a great forum for discussing the individual parts of TPP, but it’s all we got.

And who knows, maybe all this will start after the next election, and the new Senate will be made up of people who will give serious and intelligent consideration to the treaty’s provisions. Now if you’ll excuse me, I need to go exercise my unicorn.

He got caught. He lost everything…all equipment, all paper stock, his building and his house. I think he even got a bit of behind-the-bars time.

And, all this stuff was being sold exactly as you said, at flea markets and small little shops and stores. All right here in America.

It’s Sheriff Joe Arpaio versus a federal court judge. Today Arapio’s civil contempt hearing begins. U.S. District Court Judge Murray Snow *could* end up recommending criminal charges for Arpaio, if the judge chooses to go that route.

The judge is deciding what will happen to the Sheriff for disobeying his orders to put a stop to immigration operations that date back to 2011.

Several witnesses are expected to testify that the civil rights of Latino citizens has been violated.

A former U.S. attorney says he’s never seen anyone charged with criminal contempt and he isn’t ruling anything out.

That’s a really good start to these proceedings. I hope the judge throws the book at Arpaio as harshly as possible while still keeping things legal. It wouldn’t do to give Arpaio a chance to escape justice by over-reaching.

Of course it has to be noted that the real problem here is the majority of Maricopa county voters who affirmatively vote for a thug like Arpaio as county sheriff.

None of the Christian Organizations raised a finger to help. None of the ones I saw in the city, anyway.

It was at least a contributor to my eventual conversion. Especially combined with how Islamic Relief went out and did a lot of stuff.

It turned cold here in Jersey too. It was 70° yesterday and the dogwood tree across the street finally bloomed so I was going to go out and take photos of it today. Unfortunately, the temp dropped down into the 30s overnight and I woke up freezing (because I left the bedroom window cracked open).

I think it’s supposed to warm back up by the weekend, so I guess the photos will have to wait until then. Hopefully, it won’t be too late as the blossoms tend to start drooping & turning brown pretty quickly.

Arpaio admits he hired PI to investigate judge’s wife

News that Arpaio, an elected official who was once the subject of an FBI investigation that he abused his law-enforcement power, decided to have someone investigate a federal judge who is overseeing efforts to reform the Sheriff’s Office was met with gasps and murmurs in the downtown Phoenix courtroom.

Arpaio made the confession to Snow himself, after the judge questioned him about allegations made in a New Times article in June.

Snow took center stage after plaintiffs’ and defense attorneys finished their examinations with Arpaio on civil-contempt of court allegations.

After a few questions on the contempt and immigration matters, Snow shifted his focus to some of Arpaio’s more unorthodox operations.

Arpaio carefully skirted Snow’s line questioning at the beginning, and only under intense scrutiny provided detail of the covert mission.

Arpaio said he that he had come into the possession of an email from a tipster who said he had met Snow’s wife at a restaurant, and that she said Snow “wanted to do everything to make sure I’m not elected.”

Arpaio said his counsel then hired a private investigator to look into the matter.

“Results confirmed that your wife was in that restaurant,” Arpaio told Snow. “I guess (the investigator) talked to the witness, confirmed that that remark was made.”

Snow additionally questioned Arpaio about county funds being paid to posse members conducting private investigations, and investigations into the Department of Justice, who is heading an ongoing racial-profiling lawsuit against the Sheriff’s Office.

The answers to those questions are at this point unclear, based on Arpaio’s responses.

That’s a really good start to these proceedings. I hope the judge throws the book at Arpaio as harshly as possible while still keeping things legal. It wouldn’t do to give Arpaio a chance to escape justice by over-reaching.

Of course it has to be noted that the real problem here is the majority of Maricopa county voters who affirmatively vote for a thug like Arpaio as county sheriff.

If there is a fine, who pays? The Sheriff’s office or Arpaio personally? Not that I would mind the taxpaying assholes that keep voting for him to be on the hook for the fines but I’m just curious.

I would say though that the Calvinist Way of thinking is probably the Dominant Strain of the thinking in American Protestant Christianity. The Mainline Churches have dwindled in favor of Evangelical Churches. Having been part of them in the past, I can attest to the fact they are relatively insular communities, where little thought is done, and you don’t have to interact with minorities, though I also noticed a token couple in prominent positions. This is not an accident.

The contemporary Christian right became increasingly vocal and organized in reaction to a series of United States Supreme Court decisions, most notably Bob Jones University v. Simon and Bob Jones University v. United States. It has also engaged in battles over pornography, obscenity, abortion, state sanctioned prayer in public schools, textbook contents (concerning creationism), homosexuality, and sexual education. It was long believed that the Supreme Court’s decision to make abortion a Constitution-protected right in the 1973 Roe v Wade ruling was the driving force behind the New Christian Right Movement’s rise in the 1970s.[25] Despite the large grassroots campaigns that were organized by the movement to protest the Roe decision, comments made by senior figures, including the movement’s chief architect Paul Weyrich, have suggested that the New Christian Right Movement’s rise was not centered around the issue of abortion, but rather Bob Jones University’s refusal to comply with the Supreme Court’s 1971 Green v. I would argue that this is the crux of the problem in American Christianity right now. The suburbanites have left mainstream churches which wish for their congregations to go and serve and help out their fellow man, in exchange for the lazy and easy way, where focus is more towards bible studies and judging others. There were very, very few opportunities for volunteer work at the churches I went to in both OKC and COS.

Heck, my Imam is getting frustrated, because a lot of churches in the area are now having these sunday sermons telling the “truth” of Islam, which is the usual pack of lies about how we are all extremists.

I personally think they are doing this because, they know that the twisted, perverted form of Protestant Christianity that now dominates the Christian scene in the US (the small remaining mainline churches, and the Catholics notwithstanding), are morally bankrupt and having nothing to offer. They have become the Pharisees that Jesus/Isa (PBUH) worked so hard against.

The Springs’ transition to a veritable Holy Roller Empire might have something to do with the city’s explosive growth over the intervening decades (a factor of 7 in 50 years) but I am not sure how that might work. My brother was born there and still lives there. He says it is quite rare for someone his age (56) to be an actual native of the place.

The hearing took the strange turn after Arpaio had finished his testimony and Judge Murray Snow began asking him questions, including whether the sheriff was investigating his family.

Arpaio said he believed his former lawyer, Tim Casey, had hired a private investigator to look into his wife. The investigation stemmed from a purported comment Snow’s wife made about the judge not wanting Arpaio to get re-elected in 2012.

Casey declined comment, citing attorney-client privilege, when The Associated Press reached him after the development in court.

And made sure when answering to get out there that the reason he sicced a PI on her was because of a tip that she said her husband wanted Arpaio to lose reelection.

I can see the method in the madness: Yeah, he called a PI on the judge, but the judge has a conflict of interest in wanting to see Arpaio gone. So now, if the judge takes action against Arpaio, his lawyers argue that its a vendetta and push for dismissal of any charges.

The state Forest Service and Colorado State University completed a study in 2013 that found that about 20% of Colorado’s population and 25% of Colorado homes are within in a “red zone”, or a place with high likelihood of fires. El Paso County is one of the top three counties for fire danger with 45% of its residents within a red zone.[g] Colorado has seen a 300 percent increase in wildfires between 2003 and 2013.

The footnote is more blunt and specific.

Approximately 45 percent of the population of El Paso County, or about 278,000 people, live in a fire danger zone. About 20,000 people and about 7,000 homes are located in the Black Forest Fire evacuation zone. Census data shows that half of those homes were built in the last decade. The Colorado Springs Briargate subdivision, just south of Black Forest, is certain to be exposed to fire in the future. Houses built in the forests are particularly in danger of fires.

Black Forest has already mostly burned down in 2013. The range of the fire scorched most of the forest.

Briargate, and for that matter, most of the city has an artificial forest of sorts, with large numbers of trees in most backyard.

Colorado Springs will likely suffer the fate of Sodom and Gomarrah. Considering my sister lost 4 friends to suicide there, and she now also has mental issues, my family has said they will not be sad to see it happen.

When Waldo Canyon happened, and forced its way into Colorado Springs, we had to call in every fire department from Trinidad to Fort Collins, and everywhere in between. The town of Beulah sent there entire force over.

But, that took 6-10 hours. Denver’s departments didn’t arrive till near midnight.

By that point, the areas in trouble would already be cut off, and it would be too late.

Oh God, please no. Already bad enough that we spent last season basically watching them go through a very messy quasi-breakup. That was the entire point of the Danny Pink storyline, that she’d wanted a normal life after Chinny had been replaced by Malcolm Tucker. If they start a new romantic subplot, I’m abandoning the series.

The thing is, there’s NO LIE in the New York Times article. It doesn’t accuse Ted Cruz of being “anti-woman” at all. This is the section Chuck is freaking out about - it clearly says Cruz was making an attempt at humor. That’s all.

Notice that in Chuck’s stupid post, he leaves out the first sentence of this paragraph.

I read the NYT story, then (shudder) read the ginger avenger’s “debunking” story, which not only didn’t debunk anything but gish-galloped away on an argument that the NYT story didn’t even begin to make.

(CNN) -

Trek bicycles is recalling nearly a million bikes due to an issue that left one biker paralyzed.

The issue is a quick release lever on the bike’s front wheel that can interfere with the disk brakes.

The problem can cause the wheel to stop turning or break away from the bike frame.

The bikes are model years 2000 to 2015 and were made in China and Taiwan.

Trek says it will replace the lever for free, and provide a $20 coupon for bike accessories made by Bontrager.

Trek should be in trouble— I’m a dealer of a competitor of theirs, who had to send me a letter explaining why they weren’t recalling their model with the same fork: the recall notice Trek sent out blamed the fork and not their proprietary quick release they put the wheel on with.

Chrome has over the past several months been transforming into a monster on my machine. Google’s latest invention of new and improved bookmarks “stars” was the final straw.

I finally looked up how to change some of the innards, and discovered that if I set some flags to “disable”, including the stupid new bookmark stars innovation, life is better.

I think that depends on whether the show writers ever choose to address his family from before he went on the run from Gallifrey. We know he was married long enough to have children, as one of his earliest companions was his granddaughter Susan. But whether his first wife is alive is a total mystery. Since then, the only relationship of his that rose above “affection friend” was River Song, and it’s confirmed that she’s dead…ish. Kinda hard to classify whether an imprint of one’s consciousness in a computer is technically alive or dead.

What transformed Colorado Springs from nice little town into a Holy Roller Empire was Family Research Institute and Focus on the Family moving in.

I didn’t really know about the fundy take-over of the area until about 2000, when my nephew (then 13) told me that his middle-school science teacher was an outspoken (ie very stupid) young Earth creationist. I was astonished since I had not been there in 30 years. He said, “Oh, yeah, lots of teachers here are Bible thumpers. They’ve like taken over since I was in kindergarten.”
Focus on the Family had moved to Colorado Springs from Pomona, Ca in 1993.

One of my cousins was on Colorado Springs city council back then.
He was a die-hard libertarian but was horrified at what was happening. In recent years has turned toward the light (with a little help from me) and is now actively questioning everything that he took as Libertarian gospel back in the day.
