That new thread smell! Thanks, Charles. Between Baltimore and Tibet, I need to disengage a bit from reality, which seems to consist of equal parts human viscousness and random acts of senseless geological destruction.

I work with several Nepalis and their families are all safe. On the other hand, we have a friend from Arkansas staying with us whose high school classmate (the Google engineer) got killed on Everest.

Life, and the world, is random. But it sure sucks to be a young black man in America.

4 Targetpractice  Apr 27, 2015 9:28:46pm

I think it a rather stark contrast how wingnuts are reacting to events in Baltimore today to the pearl-clutching they’ve tried to feign over NRO’s reports about “midnight raids” of “random conservatives” who supported Scott Walker.

9 BeachDem  Apr 27, 2015 9:32:05pm

Why in the hell does this country never learn? Why does it never learn that invasion and occupation and bombing is not the way to spread democracy and virtually always comes to blowback and ruin? Why does it never learn that reactionary, militarized policing will inevitably lead to rioting, which will inevitably lead to repressive techniques that the rest of the country, watching on television, will approve?

The whole world is watching? Yes, the whole world is watching and applauding every burst of the water cannon and every swing of the truncheon. The country never learns because, goddammit, Americans never learn. Dr. King was right about an eye for an eye. The country is blind.

Freddie Gray should not be dead. He didn’t do anything before his arrest for which he should have been killed. He didn’t do anything during his arrest for which he should have been killed. He didn’t do anything after his arrest for which he should have been killed.

Very few of us live in a place where you can be killed for how you are riding your bicycle or walking down the street. Very few of us understand the frustration of living in a place like that, day after day, petty insult after petty insult. Very few of us understand.

Of *course* violence is the answer. Just ask the founding fathers if reasoned arguments and pleading works with entrenched interests.

11 teleskiguy  Apr 27, 2015 9:34:30pm

Conor Friedersdorf is not the most liked guy around these parts, rightly so due to his sometimes orthodoxy thinking on “libertarianism.” But he’s a pretty good writer, and he’s right on with this article. Him and Radley Balko (another “libertine” with a nice job writing for a big publication) have been writing good stuff about racism and the police.

Anyone who says violence never solves anything is ignoring several thousand years of recorded history.

13 darthstar  Apr 27, 2015 9:36:18pm

Hey everyone…can’t watch the riots. I’ve got peaceful protest/riot overload. Ferguson, New York, Baltimore…it’s like we’ve got a new national past time - kill innocent young men and then stoke the community until they riot and then blame them for being unstable so you can increase ‘security’ measures.

Fuck this shit. If I wanted to be oppressed like this I’d live in Israel or Burma.

Anyone who says violence never solves anything is ignoring several thousand years of recorded history.

” … I was not making fun of you personally; I was heaping scorn on an inexcusably silly idea — a practice I shall always follow. Anyone who clings to the historically untrue and thoroughly immoral doctrine that violence never settles anything I would advise to conjure up the ghosts of Napoleon Bonaparte and the Duke of Wellington and let them debate it. The ghost of Hitler could referee and the jury might well be the Dodo, the Great Auk, and the Passenger Pigeon. Violence, naked force, has settled more issues in history than has any other factor, and the contrary opinion is wishful thinking at its worst. Breeds that forget this basic truth have always paid for it with their lives and their freedoms.”

Say what you will about Heinlein (and I’m sure a great deal could be said), but he had a way of coming up with quotes that stick with you.

”..I went back to the Kerner Report when Wolf Blitzer, on CNN, pronounced himself gobsmacked that something like this “could take place in an American city.” Jesus, Wolf, the Kerner Report was issued in 1968, after two years of serious rioting in places like Detroit, Newark, and Washington, D.C. It was issued in good faith. It was forgotten within a decade. It remained forgotten in Los Angeles in 1992, and in Ferguson last year. It was forgotten by both sides. It was forgotten by the criminals, on both sides, and it was forgotten by the victims, on both sides. No wonder Blitzer’s gob was so thoroughly smacked.”

What does Wolf Blitzer do so well that he has a job?

I’ve never been able to figure it out. He’s not smart (evidenced by his stellar Jeopardy appearance.) He’s not charismatic (I have socks that are more exciting.) He doesn’t have any particular area of expertise that makes him invaluable for discussion purposes. He’s not good-looking.

He either has the goods on some CNN exec or has serious family connections—that’s all I can come up with.

He got his start as a reporter with Pat Robertson…

yuricareport.com

it’s scary to hear someone carry-on like Pat. But it’s sort of strange to realize that Pat and Wolf Blitzer go way back together. Yep! Wolf used to work for Pat Robertson’s CBN way back when Pat was setting up his news bureau and Wolf was the 700 Club’s reporter from the Middle East. He was a lot younger in those days, but in those beginning days Pat exposed Wolf Blitzer to a viewing audience that topped the Nielsen ratings at 28.7 million monthly viewers! Thats a great way to launch one’s career. But Wolf Blitzer likes to keep that part of his career kind of quiet. He doesn’t list the 700 Clubs news bureau in his biography. He doesn’t tell CNN’s audience that Pat was like an angel to him when he was just an independent reporter starting out. But those of us who watched Pat’s show could never forget Wolf Blitzers reports. He was presented to us as such an expert and we were just so proud of him! And look how high he’s gone. You’d; think he’d; give Pat a little credit. No doubt he says thanks by inviting him on CNN!

I’m not going to be a Pollyanna about it, I’m just thinking of message discipline and how to make it better. This is a big political win for the other guys. I haven’t followed too closely this series of demonstrations, but it seemed to me that until this, the cops were on the run for moral ground. They have no good excuse for this torture and killing. But now, this gives every local news station what to run. It bleeds, it scare whites, and it leads. The FEAR BLACKS meme is alive. The police are being strategic, accusing the demonstrators of being an alliance of gangs and African national movements — yeah, BS for sure; why not some “Black Muslims,” too? — the “crips and the bloods” are not political at all, they’re criminal dealers. This is a sad, but predictable cycle to news of racial injustice. Demonstrations, rallies, with an agenda, and then the cops figure out a way to make the young kids go nuts. Result: white backlash. The “la-la-la, we won’t listen” mode.

re: #32 Swift2991

No offense, but what should be done instead? Like Ferguson and in NYC, the cops just kept escalating and fanning the flames until finally people went off. Yesterday, while people caught video of a press photographer getting beaten by several cops and another dragged off in cuffs only to be released on a “disorderly conduct” charge, the media focused on 12 arrests. Today, when the city shut down public transportation, had cops deploy in riot gear, and using force to break-up any gathering of kids stuck without a way to get home, the media reports on the explosion of the powder keg that the city leaders allowed to grow.

See, the days of water hoses and police dogs being used to intimidate are long gone. Cops got wise a long time back and realized that all they have to do to win the moral high ground is just keep the media on their side. Keep pressing on the demonstrators until they act out, then crack down and blame any violence on the “rioters.” If Dr. King were alive today, he’d be receiving sneers about being a “race pimp” and fanning racial animosity to make money.

36 LastYearsMan  Apr 27, 2015 10:50:36pm

RWNJs find message discipline easy because it’s easier to agree on a fantasy narrative than to make sense of the murk of the real world. It’s quicker, easier, more seductive … but ultimately it’s not stronger.

37 Targetpractice  Apr 27, 2015 10:53:04pm

Let’s be honest, the cops had already begun to win in Baltimore. After the initial wave of shock and outrage in the press about Gray’s death, the slow-walking of the investigation and the “missing” footage led to the press dropping coverage of the story. Is it any coincidence that the day before the funeral, when the story would get national attention again, that the police suddenly started showing up in riot gear and talking about “credible threats” as excuses for locking down the city?

I wouldn’t say cops got wise, that how they’ve been doing things in the North as opposed to the fire hose treatment in South. Reminds me of how the cops handled the media and the protesters during the Chicago ‘68 riot, surrounding and agitating the Yippies and then blaming them for the violence.

Baltimore Orioles COO John Angelos:

“Brett, speaking only for myself, I agree with your point that the principle of peaceful, non-violent protest and the observance of the rule of law is of utmost importance in any society. MLK, Gandhi, Mandela and all great opposition leaders throughout history have always preached this precept.

Further, it is critical that in any democracy, investigation must be completed and due process must be honored before any government or police members are judged responsible.

That said, my greater source of personal concern, outrage and sympathy beyond this particular case is focused neither upon one night’s property damage nor upon the acts, but is focused rather upon the past four-decade period during which an American political elite have shipped middle class and working class jobs away from Baltimore and cities and towns around the U.S. to third-world dictatorships like China and others, plunged tens of millions of good, hard-working Americans into economic devastation, and then followed that action around the nation by diminishing every American’s civil rights protections in order to control an unfairly impoverished population living under an ever-declining standard of living and suffering at the butt end of an ever-more militarized and aggressive surveillance state.

The innocent working families of all backgrounds whose lives and dreams have been cut short by excessive violence, surveillance, and other abuses of the Bill of Rights by government pay the true price, and ultimate price, and one that far exceeds the importances of any kids’ game played tonight, or ever, at Camden Yards. We need to keep in mind people are suffering and dying around the U.S., and while we are thankful no one was injured at Camden Yards, there is a far bigger picture for poor Americans in Baltimore and everywhere who don’t have jobs and are losing economic civil and legal rights, and this makes inconvenience at a ballgame irrelevant in light of the needless suffering government is inflicting upon ordinary Americans.”

I’m impressed.

No, these young vets I’m meeting are different than the ‘Nam vets I met back in the day who were returning, even if they are having the same kind of problems. Many of the Vietnam vets were racked w/guilt over innocents they were forced to kill—not a few of those vets were very young draftees who couldn’t get out of it. Maryland’s governor has declared a state of emergency and activated the National Guard. City officials imposed a weeklong curfew from 10 p.m. to 5 a.m., starting Tuesday.
At least 15 officers were injured Monday, mostly from thrown rocks and bricks.
The police said they made at least 27 arrests on Monday.
Several businesses were looted, including a CVS. There were at least two large fires overnight.

My heart is with Baltimore tonight just as it is with all those who must suffer the brunt of the ‘law’.

Here, we are waiting for word of the executions of nine people convicted by Indonesia of drug trafficking, including two Australian citizens, Andrew Chan and Myuran Sukumaran.

It’s all so sad.

I can’t feel too bad for people who would engage in drug trafficking in Indonesia knowing the consequences, but I do feel bad for people in America who cannot simply live their lives without facing the “consequences” of walking, driving or working while black.

Early days. It takes the authorities a couple years to radicalize a generation. Then it takes the radicals a couple years to discipline themselves. That self-discipline will bring the clarity you want.

Morning all. What a night. I am so disappointed with much of the news media, but the damn use of the word “suspect” for Freddie Gray by CNN just drove it home.

I hope those CNN idiots realize that this whole mess was caused by the Baltimore police thinking the same way, a young black man must be a suspect. So the young man knowing that he is being looked at as a suspect panics and runs…and then all of this.

I’m going to use the words of a preacher that many will recognize.

“God damn America — that’s in the Bible — for killing innocent people. God damn America, for treating our citizens as less than human. God damn America, as long as she tries to act like she is God, and she is supreme. The United States government has failed the vast majority of her citizens of African descent”

Sigh. And summer is coming. It is going to be hot.

And oh yeah…take it back FOX and all the RWNJs that took Reverend Wright’s words to task. He was/is right!

On the other hand.

Falkenberg looked at him grimly, then pointed to the bodies below. “Damn you, don’t say that,’ he shouted. “I haven’t saved anything. All a soldier can do is buy time.” from The Mercenary by Jerry Pournelle

Also:

“Oh, there’s one thing more,” Hawker added in a gentle voice as he willingly accepted the handclasp. “Profile, I’ll bet the Chief Executive thinks we were firing long bursts when we cleared the cave.”

“What,” said Radescu in amazement, pausing with the mercenary’s hand still in his.

“Oh, Via, no,” Profile Bourne blurted, his directed at the suggestion rather than the fact that the Loot had voiced it. “Blood ‘n martyrs, General, single shots only. Lord, the polish that stone had, the ricochets’d fry us all like pork rinds if we’d just tries to hose those things down.” He stared at Radescu in the hopeful horror of a specialist who prays he’s been able to prevent a friend from doing something lethally dangerous through ignorance.

“That’s right, sir,” said Enzo Hawker as he met the Chief Executive’s wondering eyes. “You have to know exactly what you’re doing before you decide to use guns.” From At Any Price by David Drake

On riots:

I have been in a riot. It was a riot was caused by a sports team whose fans were mostly white people rioting. There were some arrests and the white rioters were called ‘hooligans’ at one point which was a rather charming and cheeky descriptor. Quite different than ‘thugs’.

These riots clearly disturbed the white population, but it didn’t really scare them.

Riots of black people, on the other hand, scare ordinary white folk because ordinary white folk have an understanding of just how badly black people have been abused in this country and they fear that black people want vengeance.

In answer to that, i’d say the only thing that forestalls vengeance is justice.

I can’t tell you how many times I’ve heard that exact same argument. I get it, though. They committed a crime that carries a capital punishment.
The existence of the death penalty for drug importation must in part be considered what makes the trade so lucrative.
I won’t even ask for sympathy on their behalf. Isn’t mercy enough? Just because it’s not my county’s law doesn’t mean I can’t protest.
Executing these young men, in a manner also reserved for the Bali bombers is repulsive.
To diminish their lives for an act of stupidity, for which they’ve atoned one might say spiritually whilst incarcerated, is to undermine one’s own humanity.

It’s not the same grinding injustice as that which confronts the African American community every day, but have some sympathy.

124 lawhawk  Apr 28, 2015 6:31:47am

Greets and saluts from the NYC metro area. Sadly and predictably, the media and law enforcement (plus the LEO sychophants who are all about cracking skulls and killing thugs who riot, but also simultaneously hold to 2A solutions, supported Cliven Bundy’s theft of federal services) are all holding to their predestined memes.

The media gets its riot. The police and political leaders establish the conditions for which a riot to occur, and those within the community take advantage and commit acts of violence themselves.

Who needs The Wire when you’ve got real world violence that is so much worse.

None of this brings back Freddie Gray. He’s dead. Arrested by police. Spine severed. No explanations. Nothing. His family left to grieve, and a community wondering who exactly the Baltimore PD is protecting and serving when they kill suspects with rough rides. It’s not the first time that this has happened (rough rides) or officer involved shootings.

Reforming law enforcement in the country has to happen. And it wont happen overnight, as much as that has to happen. Law enforcement will resist, and aided by politicians who feed/fan the flames of lawlessness will seek to absolve law enforcement when unarmed people - disproportionately black - are killed by cops.

We are supposed to uphold justice and equal protection under the law, but that ideal isn’t being followed. 150 years after the end of slavery, there is still racial injustice in the nation. I don’t have to be black to see it. I don’t have to be a minority to see it.

It’s there for all to see, if you just bother to look and open your eyes.

Elizabeth Warren Targets Cruises, iPads in Probe of Finance Perks

The senator has a new target: the biggest sellers of annuities and the diamond-encrusted rings, iPads, stock options and cruises she says they’re using to entice brokers to sell their investments.

bloomberg.com

(snip)

“In the letters, Warren said car leases, National Football League Super Bowl-style rings and other perks are widely known in the industry and appear to be “kickbacks directed at annuity agents and brokers.” Warren’s office is asking the companies to provide by May 11 a list of all incentives offered to middlemen.

“Warren is latching onto incentives in the $235 billion market for annuities to build support for proposed Labor Department regulations that require brokers to act in their retirement clients’ best interest, a standard known as a fiduciary duty. The proposal issued this month is expected to face stiff opposition from Wall Street, Republicans and some Democrats.

“President Barack Obama endorsed Labor’s plan in February, putting new momentum behind the effort to revise rules that affect tens of millions of baby boomers nearing retirement age and workers who don’t have pension plans.” More

He pointed out that the definition of marriage had prevailed for millennia and it seemed a fast change; on the other hand, he noted that the time between Lawrence and this case was about equal to the time between Brown and Loving — this raised the question for him of whether this might all be too fast to redefine such a long standing institution

Not sure I follow Kennedy’s “One the one hand, on the other hand” point here.

Also in the news:

Think Progress: RFRA in KY protects business, Judge says.

A Kentucky judge has validated a printing company’s discrimination against an LGBT group under the state’s “Religious Freedom Restoration Act” (RFRA).
The case in question dates back to 2012, when Hands On Originals and its owner, Blaine Adamson, refused to produce T-shirts for the the Gay and Lesbian Services Organization (GLSO), which coordinates the Lexington Pride Festival. GLSO filed a complaint, and the Lexington-Fayette Urban County Human Rights Commission ruled that Hands On Originals (HOO) violated the city’s nondiscrimination order, which protects sexual orientation.
But Kentucky Circuit Court Judge James Ishmael overturned the Commission’s ruling, arguing that it impeded HOO’s freedoms of speech and religion. In terms of speech, Ishmael reasoned that the decision not to print was not because of the sexual orientation of GLSO or its members, but because the Pride Festival advocates “sexual activity outside of a marriage between one man and one woman.” In other words, that message, though inherent to the identity of gay, lesbian, and bisexual people, overrides the right of those people to be protected from discrimination.
Moreover, Ishmael ruled that the Commission’s ruling violates HOO’s protections under Kentucky’s “Religious Freedom Restoration Act” (RFRA), passed in 2013. The law, a simpler version of the more controversial bills introduced recently in Indiana, Arkansas, and other states, states that “government shall not substantially burden a person’s freedom of religion” except under limited circumstances. As Ishmael noted, Kentucky’s definition of “person” includes corporate bodies and other companies, so HOO was entitled to assert a claim under RFRA. “The Commission’s Order substantially burdens HOO’s and its owners’ free exercise of religion,” he wrote, “wherein the government (Commission) punished HOO and its owners by its order for exercising their sincerely held religious beliefs.” Because the shop would have been forced to “print shirts that convey messages contrary to their faith,” the Order “inflicts a substantial burden on their free exercise of religion.”

I’ll be honest, I remember this all as it happened, but I couldn’t tell you what messages were on the shirts that seem to be a big part of the issue. I will say this; Hands On Originals had been a staple of where many small groups ordered T-Shirts in Lexington for years. I have hazy memories of shirts from there with slogans of vague reference to drug and alcohol use, double entendres, and other things the might be questionable for a company with such “sincerely held religious beliefs” Of course, I and pretty sure others can’t remember them in any way referring to themselves as “Christian Outfitters” or anything like that before now.

One seemingly striking moment came when Justice Ginsburg spoke of how it was recent changes to the institution of marriage that made it appropriate for gay and lesbian couples — in particular, it becoming an egalitarian institution rather than one dominated by the male partners who determined where and how the couple would live

Roberts is really a simpleton:

After Ginsburg’s Q, the Chief Justice went next. The petrs had said they were looking to “join the institution of marriage.” The chief objected that perhaps they were not looking to redefine it, not join it. And he emphasized that he had looked up all the definitions he could find, and it was always a man and a woman

re: #166 Fourth Football of the Apocalypse

Eric has maybe left the bldg.

After Eric left the lounge, there was one interesting exchange between Justice Scalia and two of his more liberal colleagues. Scalia asked whether, if petitioners win, a minister who objects to same sex marriages could refuse to perform a civil same-sex wedding. Bonauto answered yes. Scalia pressed the point though, arguing that he could not understand how a state could permit somebody to hold a license to marry people if that person would not exercise the power consistently with the Constitution. After a little more back-and-forth, Justice Kagan reminded the Court that many rabbis refuse to perform weddings between Jews and gentiles, even though there has long been a prohibition against religious discrimination. Justice Breyer then chimed in and quoted the First Amendment. Ultimately, Justice Scalia seemed satisfied that a minister could refuse to perform those weddings.

Ms Rawlings-Blake has ordered a week-long curfew from 22:00 to 05:00 local time (02:00 GMT to 09:00 GMT) starting on Tuesday. Public schools are to be closed on Tuesday.

National Guard commander Linda Singh said that up to 5,000 troops could be put on the streets.

“We will be out in massive force,” she said, adding that armoured vehicles would be used, but the city would not be under martial law.

Extra police officers are also being drafted in from the Mid-Atlantic region.

Yes, that’s correct. In the first part of the argument, the parties will discuss whether states are required to allow same sex marriages. In the second part, it will discuss whether they must recognize valid same sex marriages from other states.

The Kerner report was commissioned by LBJ and essentially tried to get to the bottom of why the riots in Newark and Detroit occurred.

On the issue of what can be done to prevent it from happening again? We’re just fractionally closer to addressing the underlying problems than we were then. But law enforcement continues to treat the lives of minorities as less than they should, and will use deadly force far more than they should.

When law enforcement can bring in a serial killer, mass murderer, or even a terror suspect without shots fired, but kill unarmed black men for jaywalking, or selling unlicensed cigarettes, or for no specific criminality at all, or for playing with a toy gun, something is seriously wrong.

From what I’ve read, it was a matter of the Greek upper class being “mentors” to young boys coming in to what we term puberty now. Most married and had a “boy” on the side, who was taught the “masculine arts” (including sex). It appeared to be more of a practical arrangement in which the youngster was taught his privileges as a man, although I don’t know if this interpretation is correct or not.

The earth was largely underpopulated in those bygone millennia to which Kennedy alludes. A close reading of ancient history reveals towns and cities that had been depopulated by plague or warfare offering free houses, farms and even bounties to immigrants. That same reading reveals kings who conquered various groups of people with the stated intention of resettling them in their territory. It was all about building population back then. It isn’t about that now. Would Justice Kennedy approve of bleeding as a cure because that’s how they did it in the old days?

Our contemporary concept of homosexuality as a black/white, either/or things is fairly recent, even the term is a recent one. There was a time when it was seen as unhealthy for men to go too long without sex, and turning to other men in need or desperation was not really frowned on.

The Greeks, however, did see it as part of one’s civic duties to sire soldiers to defend the Republic, and anyone who shirked his duties at that because he was into boys exclusively was in violation of the law.

They throw similar conniptions fits when they are called out for racism, bigotry, homophobia or misogyny. They act as if we are trying to silence them or throw them in jail, we are just asking them to own their words and accept the economic and social consequences.

These are people who seriously think being called a bigot is the same as Kristallnacht. They love to talk about how they love the Jewish people but they continue to show no respect at all for what the Jewish people have gone through for generations when they liken being called a bigot which make no mistake they certainly are to genocide and pogroms.

Roberts just turned 60 in Jan. He was brought in from the outside specifically because of his age by GWB. It’s not known if he has a history of epilepsy because Justices are not required to reveal their health history, but it appears he had 2 publicized seizures, one in 2007 in which he fell, sustaining injuries. According to his neurologist, there is no “cause for concern”, but he has limited his driving.

Originally, when Sandra Day O’Connor announced her retirement, he was supposed to have filled her seat, but Renquist died, so GWB took that opportunity to elevate him to CJ.

The Nazis aren’t some punch line for some evangelical asshole to use every time an evangelical Christian acts like a bigoted jackass and someone calls him out on it. The Nazis were a real evil. Their actions resulted in the deaths of millions of people. Whole generations were wiped out. Whole villages destroy. You? You’re in America butt hurt because you’re being called out for the homophobic religious bigot you are. You’re nothing like a victim of the Nazis. Hell I would even go as far to suggest that you’re even more like the Nazis but I won’t insult the victims of Nazism by likening you to them because unlike you I have actually compassion for what the people of Europe went through from 1933-1945.

You treat people how you want to be treated. Well, I missed all the excitement yesterday and didn’t want to comment till I’d caught up, but that took a looong time.

I just don’t understand the cop-worship in this country. I’m an extremely white guy who grew up in what was then an almost completely white suburb, before the militarization of the police. I’ve never thought of cops as anything but the enemy.

I’ve had people ask me after one or two incidents: “Why didn’t you call the cops?” I was completely baffled by this question. “I already had trouble enough—why would I call the fucking cops?”

I’ve always thought of them as the bullies I grew up with, only now with guns. I can’t have any of them anywhere near me. If I’m driving and see a cop car, I take the next turn and go around the block to let them get out of sight—and as I said, I’m one of the demographic that has the least to fear from them.

It says a lot about the basic humanity of black people in America that they haven’t burned the whole fucking place down long before now. Anybody who can look at what’s been going on—the very small percentage of it that we even know about—and blame the victims for inflicting a little property damage is a waste of skin.

That’s great. One of the things that fascinates me about him is how he went from as governor of California interning the Japanese-Americans to the writer of the decision in Brown and many other cases. Eisenhower shouldn’t have regretted Warren at all. Should have regretted Nixon.

He didnt just write the Brown decision; he did some heavy arm-twisting to ensure that it would be 9-0. It wasn’t enough for him that it would be a win — he wanted a very clear, unanimous, GODDAMN IT WE MEAN IT! vibe.

Then he pressed Ike to vigorously enforce it; that the authority of the entire justice system and all the courts in the land was at stake if Arkansas could ignore a unanimous SCOTSU decision.

There is kind of an Legend,or Tradition in the black community about “Grandmothers Home”. Every black grandmother is supposed to have three pictures hanging on the wall of the living room(outside of family). In the middle is a picture of Jesus. There is a picture of Martin Luther King Jr., and then depending upon the time period and the year another figure that has high importance in the black community. She was?

Dana Eaton dropped out of Webster after meeting Chris Loesch, her husband-to-be. She disclosed some of her own personal background while guest hosting the Glenn Beck program.

“I was a broke, unwed student from a single-parent household when I became pregnant with my first child,” she said.

Loesch has had money troubles. St. Louis County Court records show she was sued in 2002 by a New Hampshire corporation for failing to pay a credit-card bill. When she did not appear in court, a default judgment was issued, ordering payment of $2,008 in principal, interest and fees.

Jefferson County Circuit Court records show the Missouri Department of Revenue filed a case against Christopher and Dana Loesch in January 2011, seeking $2,009 in back taxes. A tax lien was filed, and in June of this year the amount was repaid.

We had something like that in the homes of my older women relatives too. It was often Jesus, FDR, and in my great grandparents’ home John L. Lewis (The labor leader.) He really deserves more focus from history. I mean I did learn about what he did but the name really wasn’t brought up much. I’ve been thinking about Justice Warren and his court’s legacy a lot lately since I started taking my paralegal certificate course and seeing his court’s role on important decisions. My instructor brings up Loving quite a bit since he is a white man married to a black woman and Loving thankfully did away with interracial marriage bans. I also have a personal connection to Loving given my mom’s dad employed Richard Loving when the Lovings were living in D.C. before the court ruled in their favor.

Wait, what?

Riots/civil unrest in 1980s.

Riots in 1990s.

Riots in the 2000s.

Riots since 2010.

Common threads? Well, you’ve got the sports hooliganism that gets excused as rowdy folks who drank too much, but who also destroy property, cause injuries, and are otherwise excused by a certain sort of people, and then you’ve got those civil disturbances that follow officer-involved shootings/excessive force incidents (LA riots, Ferguson, etc.). Often, those latter ones are in minority communities and the police force is largely white.

Today, another wingnut has jumped up to declare that the animosity between the police and the black community in Baltimore is due to O’Malley’s governorship. What did O’Malley do to make things “worse”? He implemented his own version of “Broken Windows” and had cops conducting “Stop and Frisk.”

The Court’s conservatives fixated upon their belief that same-sex marriages are a very new institution. “Every definition [of marriage] I looked up prior to about a dozen years ago,” Chief Justice John Roberts claimed, limited marriages to opposite-sex couples. Advocates for equality, Roberts continued, are “seeking to change what the institution is.”

Meanwhile, Justice Samuel Alito argued that even “ancient Greece,” a society he perceived as welcoming to same-sex relationships, did not permit same-sex marriage. Justice Antonin Scalia insisted that “for millennia, not a single society” supported marriage equality.

Guess Scalia hasn’t heard about Canada.

Exactly. The argument that I’m seeing Scalia make and I’ve seen it from Alito in the past is that gay marriage is “new” so ergo it shouldn’t be valid. What on earth kind of legal logic is that? And the whole idea that “Well most states have it, so the prejudices will die out” thing that I think Roberts has pushed is stupid too. Most states had gotten rid of their bans on itnerracial marriage pre-Loving but didn’t make Virginia’s ban on same sex marriage any less unconstitutional. Bursch doesn’t have a clue what he’s doing.

“When you change the definition of marriage,” Bursch declared, that has “consequences.”

When pressed to explain the consequences, Bursch asked the Court to consider two different couples, one of which believes that marriage exists for the benefit of children, and the other which believes that it exists to foster relationships between adults. If the Court adopts the view of the second couple — a position he claimed the justices would implicitly embrace if they allowed same-sex couples, who cannot procreate, to marry — that will send the message that marriage has little to do with children, which will in turn lead to more children being born out-of-wedlock. The “reasonable voter,” Bursch insisted, could conclude that it was necessary to ban same-sex couples from marrying in order to halt this attenuated chain of events that allegedly ends in more children being born to unmarried couples.

He’s wandering into Rube Goldberg territory.

I’m guessing it will be 5-4, with Kennedy writing the opinion.

I think Roberts really does value his legacy ergo my 6-3 bet. We do agree about Kennedy writing the opinion though.

Oh, good. The SCOTUS has been interrupted by a protester shouting about the Bible teaching that gays will burn in hell for eternity.

This should prove persuasive.

I would say, more appropriately, they’re interested in all of what MLK Jr. had to say, with respective context, than cherry picked MLK Jr. soundbites that make for good twitter memes.

Meme that has been running around the “WingnuttySphere” the last few days is that if the Court rules against them, the ruling is invalid. The argument is that since both Ginsburg and Kegan have attended or perfomed the ceremeony at Gay Marriages, they are not impartial, and should have recused themselves.

It’s sort of like un-skewing the polls.

Um Ben, “race-baiting leftists” are not breaking peoples’ necks, chocking out people so they can’t breathe, shooting little kids in the park, tasing people while they are tied up….

And once they establish that marriage is not simply about procreation the corporations can start marrying each other since spin-off of subsidiary companies is no longer expected to be mandatory.

Isn’t “good twitter meme” sort of contradictory?

They tried to claim that the California judge that ruled against them on Prop 8 was “biased” because he’s gay. But yet you know they would have been just fine with a Regent University and dues paying Christian Coalition member making that decision. They’re desperate and unfortunately I think they’re going to get even more bigoted towards gays than they already are.

Sadly, I have to agree - the wingnuts are gonna get even more assholish towards LGBT Americans going forward.

Which is why we’ve seen the rise in things like the Indiana law. It’s not unlike how after the Brown decision, you saw the KKK make a comeback after it had declined after the Depression and WWII.

539 HappyWarrior  Apr 28, 2015 11:35:49am

We’re going to see cries for nullification if the court rules against them and more cries about “tyrants” in robes. Because you know it’s down right tyrannical to rule that someone has the same rights you do. Wingnuts don’t know jack shit about what tyranny is and when they do, they cheer it on.

Ben has almost as much knowledge and empathy with African Americans living in urban areas with boarded up housing and poor services as Dana and Rush.

If procreation is the basis for a valid marriage, then the end result should obviously be that NO marriage should be declared valid until a child is produced.
Do the wingnuts really want to test that?

Time to ban marriage between adults over the age of 50. Sorry Newt and Calista.

I’ve seen some comments (mainly FB) from “a pox on both their houses” libertarians on how we need a dictatorship for a period of time in order to set up re-establishing non-corrupt democratic government.

I didn’t feel like getting into an argument with their pipe dream* since history is replete with example after example of “reformer” governments whose temporary seizure of power to form the republic or return rule to the people seems to never get to the stage where power is given up. (Rome, Russia, France, etc. - take your pick.)

Libertarian philosophy disregards human nature as much as communist and the other political philosophies - it does not apply to our species. And therefore it really is a pipe dream - you only get it when you’re smoking an opium pipe or some other wild substance.

Libertarianism is the selfish asshole version of Marxism. They’re both pipe dream fantasies that completely misunderstand human nature and are totally illiterate when it comes to economics.
