How Online Fundraising Confusion, Lawyers & Chuck C. Johnson Kept $60k From Tamir Rice’s Family

Shaun King was furious.

The author and life coach turned activist has been one of the most prominent online voices in recent months, as protests of police impunity that began in Ferguson, Mo., spawned demonstrations in cities across the country. For those following the ever-growing roster of names of black men and boys killed by police, he has been one of the essential follows.

But his latest tweet storm, published Monday afternoon, was not about a new police shooting. In fact, it was about an old one.

For King and many of the other activists who have been some of the driving forces online behind the Black Lives Matter protests, the shooting of 12-year-old Tamir Rice last November as he played in a park near his home was one of the most difficult of the many anecdotes.

For many of the most vocal activists, that Tamir was a child and that his shooting was captured on grainy camera footage makes this case the most difficult to stomach. When extended video of the shooting — which showed Cleveland police tackling Tamir’s sister to the ground as she ran to his dying body — was released late last year, one of the top protest organizers in Ferguson texted to tell me it had made him physically sick, imagining what he would do if his younger sister was wounded and he was tackled while trying to help her.

So when a new court filing in the Rice family’s civil suit against the city of Cleveland revealed that Tamir has yet to be buried and that his mother was, at least temporarily, living in a homeless shelter, King was incensed.

“Absurd!” he insisted to me in a direct message on Monday afternoon, especially, he noted, because just months earlier an army of online samaritans had raised almost $60,000 for the Rice family.

So where had all of that money gone?

Timothy Kucharski had been one of two attorneys representing the Rice family for several weeks when he got a call from a friend in early December, asking about an online fundraiser he was seeing in the Rice name.

Created on the Web site youcaring.com, thousands of dollars were pouring into a fund for the Rice family. But Kucharski had never heard of King — one of the fund’s primary organizers — and Rice’s mother told him that she was unaware of the fundraiser.

As the fund surpassed $27,000, Kucharski contacted law enforcement as well as youcaring.com directly, asking that the assets being donated to the fund be seized and held for the Rice family. He contacted King, who has previously used his social media following to raise money for victims of police shootings and natural disasters and who insisted that his plan was always to give the money to the family. As they went back and forth, a number of Twitter users — led in part by right-wing blogger Charles C. Johnson — began insisting that the fundraiser was a scam and demanding it be halted.

Of course, that hasn’t stopped CCJ from claiming he saved the Rice family’s money. This was, of course, after several posts claiming that Tamir rice was a criminal thug who deserved to get shot.

Also, notice how Wesley Lowery offers a well written, easily understandable narrative of the issue, as opposed to Upchuck’s usual offering of multiple twitter posts strung together by ungrammatical ranting. No wonder CCJ hates Lowery so much.

Don’t forget that those former lawyers charged for every single phone call, copy, postage, etc, plus whatever they were charging per hour. For instance, a call from the hospital telling the attorneys that Tamir had died. They took $27K from the original fundraiser for their fees as arranged by the “trustee” who actually controllled it. Don’t know exactly how they earned it, but there it is.

So, here’s that grand jury bullshit again, too.

Some of this is the result of a family overwhelmed with grief and heartache and having to deal with media, lawyers, and people like CCJ at the worst possible moment in their lives.

You’ve got some people who come in with the best of intentions, but there are issues with execution and follow through so it causes more problems than it should. I think that explains Shaun’s involvement. He had the right intentions, but the follow through was a mess.

The lawyers initially involved also bungled things, and putting an administrator in charge also meant that the family would have to go through them for all manner of expenses relating to their son’s death. That could/should have been avoidable. Ticky tack fees/charges by the initial lawyers also shows how unscrupulous some can be and that there are all manner of hidden costs to victims/survivors of these officer-involved shootings.

And then you have CCJ, who epitomizes the worst of humanity in one fell swoop and whose actions here didn’t stop an injustice, but continued one and inflicted more heartbreak on the family at a time when they could least deal with it.

Yes and Flags of Our Fathers released in the same year was hardly gung-ho pro-war. It really got heavily into how Ira Hayes got treated like a hero but then as his 15 minutes of fame ended, he became an alcoholic and many people just forgot about him. I have a special weakness for that film since one of my grandmother’s hometown residents was one of the six flagraisers, Michael Strank. She always said we were related to the Stranks somehow too given that her father and Mike’s family came from the same town in Slovakia.

It’s an amazing story really. Mike Strank wasn’t even an American citizen when he enlisted and when he was KIA. I always bring it up to people who claim immigrants aren’t patriotic. “Letters From Iwo Jima” was essentially the counterpart film to “Flags of Our Fathers”. The latter was framed by flashback story of three veterans who survived the fight on Iwo Jima. The former did not have the survivors, so it had the framing of a buried bag of letters being found on the island in a cave years after the war was over.

“Letters From Iwo Jima” well deserved the Best Picture Oscar nomination it got in 2006. It was one of the films I saw in a theater during a special, pretty much all day, session where they showed all the Best Picture nominee films for that year in a row. (That was the year “The Departed” won.)

I think FOF was the last film my grandfather, a Korean War vet like Clint saw in theaters. One thing that fascinates me is seeing how different veterans respond to war. You see guys like Graham and McCain who have seen war but are eager for the next war and then there are men like my grandfather who become almost pacifists as a result. What I didn’t know until the end of my grandfather’s life is that he wanted to request conscientious objector status. That surprised me. He had never been gung ho about his service mind you but it just did given I always had pictured as a guy who didn’t think much of the young men who did the same during Vietnam but then I think about it and realize he had seen older men like his brothers go off to WWII and some like Sgt. Strank never did come home.

The charges have to be dealt with one by one. Some of the charges are based on a theory of false arrest, and these charges can (and should) be dropped if the arrest turned out to be legal.

Meanwhile, other charges relate to death in custody, including a murder-2 charge for the driver. These charges are completely unaffected by whether or not the arrest was legal.

On what planet is Huckabee capable of communicating (presumably persuasively) with liberals? For example, I’m well left of the US center, and it is completely obvious that Huckabee and I do not inhabit the same reality or speak the same language.

The Maryland State law by comparison makes it clear that the mechanism for opening a switchblade is housed in the handle. The trend in US knife legislation has been to make it clear that a folding knife that has a “bias towards closure” and no mechanism in the handle for opening is neither an automatic/switchblade nor a gravity knife. This is why Spyderco / Benchmade / etc brand folding designs that can be opened with one hand, and with practice even be opened with a flick of the wrist, are generally legal. Because there’s always a spring tension towards closure that must be overcome.

Here’s an Appeals Court opinion in a California case where they threw out a juvenile court decision that had previously found a kid delinquent for carrying a “switchblade.”

“We find the statutory definition of a switchblade and its exempting language quite clear.  (Angel R., supra, 163 Cal.App.4th at p. 911, 77 Cal.Rptr.3d 905 [section 653k is “clear and unambiguous”].)   As we explained in Angel R., for the exemption to apply, “the knife must be one that ‘opens with one hand utilizing thumb pressure applied solely to the blade of the knife or a thumb stud attached to the blade’ and has the detent or resistance mechanism.”  (Angel R., supra, 163 Cal.App.4th at p. 912, 77 Cal.Rptr.3d 905.)   Nothing in these requirements prevents a user from more quickly opening a knife by employing a wrist flip in conjunction with pressure on the blade or its thumb stud and disengaging the detent or other resistance mechanism.

Reviewing courts may turn to the legislative history behind even unambiguous statutes when it confirms or bolsters their interpretation, and that is the case here.2  (See, e.g., Samantar v. Yousuf (2010) —-U.S. ——, ——, 130 S.Ct. 2278, 2287, 176 L.Ed.2d 1047, fn. 9;  In re Tobacco II Cases (2009) 46 Cal.4th 298, 316, 93 Cal.Rptr.3d 559, 207 P.3d 20.)   Before 2001, the switchblade exemption covered “a knife that opens with one hand utilizing thumb pressure applied solely to the blade of the knife or a thumb stud attached to the blade,” which unquestionably would include defendant’s knife.   In 2001, the Legislature in Senate Bill No. 274 added to the exemption the current language requiring a detent or similar resistance mechanism.

The legislative history for Senate Bill No. 274 reflects its purpose was to “narrow[ ]” existing statutory “language to only allow knives to fall under the exemption from the switchblade law if that one-handed opening knife contains a detent or other mechanism.   Such mechanisms ensure there is a measure of resistance (no matter how slight) that prevents the knife from being easily opened with a flick of the wrist.   Moreover, a detent or similar mechanism is prudent and a matter of public safety as it will ensure that a blade will not inadvertently come open.  [¶] Although some one-handed opening knives can be opened with a strong flick of the wrist, so long as they contain a detent or similar mechanism that provides some resistance to opening the knife, then the exemption is triggered.   These knives serve an important utility to many knife users, as well as firefighters, EMT personnel, hunters, fishermen, and others.”  (Assem. 𠀬om. on Public Safety, Analysis of Sen. Bill No. 274 (2001-2002 Reg. Sess.) as introduced Feb. 16, 2001, pp. 1-2, italics added.)

Here, the uncontradicted testimony of the expert demonstrated Gilbert’s knife had both the necessary thumb stud “intended for this knife to stay closed” and “a detent mechanism” to hold the blade “in the fixed and closed position” until “opened with pressure to the thumb [stud] overcoming the positive detent mechanism.”   The expert acknowledged the detent mechanism required “minor maintenance” because it had loosened to where it provided 85 percent of the resistance it achieved when the knife was new.   But 85 percent effectiveness is still a substantial measure of resistance and falls within the plain terms of the exemption language requiring “resistance that must be overcome in opening the blade.”  (Former §𠀦53k.)   The expert, for example, shook the knife upside down and it did not open.   The juvenile court, however, imposed a standard beyond that required by law, namely, that the knife could not be opened by any flip of the wrist, even in conjunction with the requisite thumb pressure and disengaging the detent mechanism. Consequently, we must reverse.

The question the Baltimore cops face is one of consistency. I see no exemption for workmen, cops, etc in the Baltimore city code, so how often do the cops charge themselves, carpenters, upholsterers, rando white kids carrying Spyderco / Benchmade knives under the switchblade law?

He was born and raised in the school of hard knocks, Bakersfield, CA division, and was politically to the right of Mussolini, but other than that he was a total sweetheart. The Senate on Tuesday adopted a GOP budget that paves the way for an assault on President Barack Obama’s health care law this summer and a partisan showdown over spending bills this fall.

The Senate passed the nonbinding measure by a nearly party-line 51-48 vote. The House adopted it last week.

The measure sets a potential path for a balanced budget within a decade. It promises to cut domestic agencies and safety net programs like Medicaid and food stamps, carve up transportation spending and student aid, and curb tax breaks for the poor.

I think Huck’s gonna be fun.

He caters just enough to the middle class and lower with nice fat statements on never cutting social security or allowing it to be privatized. Hopefully he has other such off-the-beaten-GOP-path gems to wreak havoc in the debates and screw all of them up. And then he offers enough over-the-top Evangelical stuff to make other Republicans take him to task to get the moderate (?) GOP votes at the cost of the RWNJs.

In other words, I hope they all out crazy each other enough that none of them come out looking good to America. The GOP deserves it, and maybe it will hasten the time they either get reality back in or tear the damn thing down and completely clean out the trash.

I saw that lineup of the band (minus Davey) in their first East Coast show - at the old Electric Factory in Philly, opening up for The Faces.

EJ came out on stage in yellow overalls and gold lame Doc Martens, and everybody was like ‘Who’s this guy?’ An hour later, everybody knew.

Even Rod The Mod had a hard time following him that night.

HappyWarrior, in reply to your #47 and Nyet’s replies, Arabic did influence peninsular Spanish quite a bit, since the Arabs occupied a large part of the Iberian peninsula during the early Middle Ages.

The Spanish article “el” is in fact derived from the Arabic “al.” The definite article in Latin would have been expressed by declining the noun, not by preceding it with an article. Some Spanish expessions also come from Arabic. For example, “Ojala!” or “Ojala que si!” (I hope so!) comes from the Arabic “Inshallah” (If Allah so wills).

My Spanish professors told me all this, and I think my memory still is accurate.
