Ben Carson Says the Dred Scott Decision Allows the President to Ignore SCOTUS on Gay Marriage

This is why young Earth creationist Ben Carson will never be President of the United States; his grasp of history and government is… tenuous, to say the least: Ben Carson Invokes Dred Scott Decision as Precedent for Ignoring Supreme Court Rulings.

Republican presidential candidate Ben Carson raised eyebrows last week when he told Newsmax that a potential Supreme Court ruling to legalize same-sex marriage across the country would not have to be implemented, because “the laws of the land come from the legislative branch.”

It’s not a commonly held opinion, given that the high court has long asserted the right to invalidate laws it deems unconstitutional, and no other presidential candidate has suggested that the court’s ultimate ruling on same-sex marriage could be ignored.

During a Republican gathering Saturday in Greenville, S.C., Bloomberg asked Carson to explain his assertion.

“What I would really love to see, as the Constitution states, civil matters being taken care of in the state and the states.”

“Probably the best thing to do is go back and read about the Dred Scott case,” Carson responded, referring to the 1857 case in which the Supreme Court validated slavery; today it is widely viewed as the worst ruling in the Court’s history. “And as you know, President Lincoln wasn’t too much in favor of that. And his policies indicated that. Clearly it created a lot of division. We ended up fighting a war over it but in the long run it was the right thing to do.”

What Carson doesn’t get is that the Constitution had to be amended after the Civil War to reverse Dred Scott. The Emancipation Proclamation was justified as a provision to advance the Union’s war aims, and had no affect on slavery in slave states which stayed in the Union. So no, this doesn’t justify simply ignoring the Supreme Court’s rulings.

Well, the worst part of the Dred Scott decision was the throwaway at the end (a la Citizens United) that the Missouri Compromise was unconstitutional to begin with. That invalidated the Kansas-Nebraska Act, and said it was all right for the slave power to try to spread slavery into whichever territories they could, which the free states would never accept. It made civil war inevitable—although the form it took, of secession by the slave states, was a result of Lincoln’s election.

Carson’s a moran and anti-gay zealot.

But I think the point he may be trying to make is that even after the Dred Scott decision in 1857—which declared unconstitutional Congressional attempts (like the Missouri Compromise) to ban or restrict slavery in the territories—Lincoln and the Republicans continued to make the opposition to slavery in the territories a key plank in their platform. I’ve always been a bit curious about this. Did Lincoln and the Republicans assume that the Dred Scott decision was only a prohibition on Congressional action in the territories and that the Executive could still act in prohibit slavery in the territories?

But I don’t think continued opposition to a court ruling is the same thing as defying that ruling—and that’s what Carson seems to want here. In fact if he wants an analogy to a state’s opposing a SCOTUS ruling, the South’s initial opposition and efforts to frustrate Brown vs Bd of Ed is a better comparison. But I doubt that’s an analogy he’d like.

I think we do a disservice when we lump every single police shooting together under one big umbrella of police brutality or profiling.

Wisconsin has some measures in place that we all want… state DOJ investigation of all police killings rather than local.

Tragic as it may be, with possible mistakes made…the Tony Robinson case does not appear to be in the same league as some of the other recent shootings. Unfortunately it seems he was acting with violence to many people while under the influence of several drugs. He was in an altered state. This is really sad.

Maybe the cop could have done something else, I don’t know. But from what I have read and heard there is nothing that rises to the level of a criminal act by this officer.

Someone should point out to this idiot, that the thing that overturned Dredd Scott and finally got rid of slavery was the civil war, and the passage of the 13th amendment, not the government just refusing to recognize the ruling. In fact the only time I know of that a president openly defied the supreme court, was Andrew Jackson, and that lead to the trail of tears. People need to keep that in mind.

College kids get a slap on the wrist and maybe explulsion, and we’ve seen sports riots where people were carted off to jail to “sleep it off”, if they bothered to catch them at all. If Robinson was exhibiting “crazy” behavior, and had no weapon, why weren’t other means used to subdue him? Surely Kenny was not the only cop on the scene, but he was the one who shot him.

Of course, Robinson, an 18 yr old, isn’t here to defend himself, either, so I take the DA’s (who wasn’t at the scene) conclusions with a grain of salt.

It was more than “busting up a house”. He was hitting and choking people on the street and allegedly attacked the officer too. Several 911 calls came in reporting his violent behavior.

And I am not claiming there is any kind of parity between White and Black victims of police shootings or treatment. There is not, and that has to change. I just think each case must be weighed on the merits.

As for guns and cops. I wish (like in GB) they were severely limited as to who can carry them, but as long as we have the gun culture we have in the US that aint gonna happen.

We had a psycho fearmonger with a lifetime lock on the FBI. The difference is that most of the real CT-like shit he pulled was targeted at the lefties.
