Chuck C. Johnson Misses Gawker Suit Deadline, Gets Suspended from Facebook

Not a good day for Chuck
Humor • Views: 58,891

A few days ago the Internet’s most incompetent “journalist” posted this on Facebook, denying early reports that he missed the deadline for filing his response to Gawker’s motion to dismiss his lawsuit and their anti-SLAPP motion (that might end up costing Chuck a lot of money).

And then, today his lawyer made a liar out of Chuck and filed a late motion for another extension of time to respond, acknowledging that they had missed the deadline.

(Thanks to @AdamSteinbaugh for posting this.)

In his usual fashion, Chuck lashed out at people who are laughing at him for his latest inane screw-up.

And about those “whistle-blowers” who are “coming out” to help Chuck: Chuck C. Johnson Is the Easiest Man in the World to Troll.

But wait — there’s more! Because our boy Chuck is really not having a good day.

This morning Facebook briefly shut down his page and suspended his account for violating their Terms of Service; the offending posts were the ones where he threatened to out federal prosecutors (and others) who were listed in the hacked Ashley Madison databases.

However, as of this writing, he still has a post on his Facebook page asking people to help him expose more government employees.

At this rate it won’t be long before Chuck Johnson gets kicked off Facebook for good — just like he was from Twitter.

UPDATE at 10/13/15 12:31:24 pm by Charles Johnson

Gawker has responded to Chuck’s request for another extension, and the answer is “No.” Not only that, they’re pointing out to the judge that Chuck has been trying to pay for internal Gawker memos, and threatening people with more lawsuits. They refer to this as “improperly obtaining evidence.”

Oh man, Chuck’s in hot water now.

UPDATE at 10/13/15 12:43:13 pm by Charles Johnson

And now, to make Chuck Johnson’s already bad day even worse, he just got suspended from Facebook again.

(A few minutes later, he’s back on Facebook. I wonder how many chances they’ll give him?)

UPDATE at 10/13/15 1:59:29 pm by Charles Johnson

Chuck’s very bad day just keeps getting worse: Facebook has now removed his GotNewsDotCom page for violating their Community Standards.

Agreed, and I’d say we’re close enough to that point already.

As much as I enjoy the clown show and the schadenfreude, I wouldn’t miss hearing about CCJ one bit if no one talked about him anymore, as he deserves.

Items 5-8 show just how incompetent Chucky’s lawyers are:

5.Plaintiffs’ were unable to complete their Response by October 9, 2015.

6.Plaintiffs’ counsel’s intent in seeking small time extensions was in the hope, at each instance, that the time extension would be as modest as possible.

7.Plaintiffs’ counsel was over-optimistic in estimating time.

8.Plaintiffs’ counsel notes that in retrospect, and given some of the unique elements of this matter and attendant technological issues, on September 29, he should have simply sought a fourteen (14) days extension.

That’s directly from the filing by Chucky’s lawyers. They admit they missed the deadline, and are now wishing for the court to indulge them with yet another extension. They admit that they couldn’t estimate the time needed to prepare the needed filings, got extensions, but even those were insufficient.

I hope the court indulges them with a can of STFU and dismisses the case with prejudice or alternatively SLAPPs him silly.

I think of the three O’Malley is polling the best but it’s clearly a two man race between Sanders and Clinton. I liked what I knew about O’Malley but I was disappointed to see a lot of criticism of his record regarding the police as mayor of Baltimore and governor of Maryland. I’ll still call him “cousin” until I find out we’re definitely not related though lol. Now that said, O’Malley deserves a lot of credit for being one of the first governors to support SSM. I think he took initiative on another key issue which is honestly escaping me at the moment.

Math isn’t Chucky’s legal team’s strong suit either, especially given that if they sought a 14 day extension from September 29 (identified in Item 8), they would have still been in the same position as they are right now - on the cusp of demanding yet another extension. That’s what they’re requesting once again (after missing the deadline they negotiated).

SMOTI strikes again.

Based on a WaTimes article claiming that the EPA is spending $75 million guns, and amphibious assault ships. I kid you not:

The Environmental Protection Agency has spent millions of dollars over the last decade on military-style weapons to arm its 200 “special agents” to fight environmental crime.

Among the weapons purchased are guns, body armor, camouflage equipment, unmanned aircraft, amphibious assault ships, radar and night-vision gear and other military-style weaponry and surveillance activities, according to a new report by the watchdog group Open the Books.

That includes spending about $216k to pay, train, and equip each of the 200 special agents (though the report also indicates that only a handful of EPA employees actually make more than $100k a year). That’s actually not an unreasonable amount given the kind of work done in law enforcement.

And while they claim that they’re nonpartisan, they’re headlining Tom Coburn and Hillsdale College (wingnut U).

Better yet, here’s what that report actually states:

Outfitting the 200 ‘Special Agents’ of the EPA to protect the environment and investigate enviro-crime is a costly endeavor. Disclosed EPA spending shows that the agents have the latest state-of-the-art ‘policing’ gear such as “guns and ammunition up to 300MM,” “camouflage and other deceptive equipment,” “night vision,” “unmanned aircraft,” “radar,” “body armor,” “surveillance equipment,” “mobile GPS monitors,” and train and investigate frequently alongside “joint projects with Home Land Security.”

HERE IS A SAMPLE OF EPA CHECKBOOK
SPENDING DETAIL:

$1.4 million was spent on “guns up to 30MM,” $9,907 on “guns over 300MM,” $682,712 spent on “communications security equipment and components,” $234,753 on “armorpersonnel,” $330,000 on “ammunition through 30MM,” $213,000 on “tactical sets, kits, and outfits,” $24,700 “ammunition 75MM through 125MM,” $23,000 on “ammunition over 125MM,” $210,000 on “camouflage and other deceptive equipment,” nearly $1 million on “security vehicle services,” $143,780 on “guns over 30MM up to 75MM,” $85,490 on “night vision and equipment,” $146,000 on “optical sighting and range equipment,” $122,400 on “radar equipment, airborne/non-airborne,” $85,600 on “transport vehicles passenger and troop,” $113,000 on “operation of government troop housing,” $57,762 on “miscellaneous weapons,” $7,579 on “unmanned aircraft,” $43,733 on “body armor (43 sets),” $31,500 on “CID agent jackets,” $31,300 on “armament training devices,” $41,700 spent on “special ammunition and ordinance,” $12,495 on lease/rent of troop housing,” thousands spent on Sikorsky aircraft, 9MM ammunition, and shotgun ammunition, Bushmaster rifles, mobile GPS units, puncture-protective gloves, amphibious assault ships, and much, much more…

Except notice how they don’t actually produce a dollar amount for the “amphibious assault ships”. And what is likely going on is that the EPA was piggybacking on a DHS, Coast Guard or Navy ship so that they could conduct maritime patrols to make sure that people were not violating the EPA rules, and there was a reimbursement for the services. It’s not like the EPA was obtaining their own amphibious assault ships. But hey, it makes for a SMOTI headline, and that’s all that counts.

The part where he turns around, gets back into his car, and leaves before the paramedics arrive is just …why has he been given a pass? Why do the police seem to think this is acceptable behavior?

I honestly think a certain objectionable personality type gets drawn to the power and departments do not screen for it.

If they did screen for it, the new hires would turn in the existing police for excessive force and other crimes. It’s hard to motivate someone into hiring a person who’s likely to turn them over to prosecutors. You have to clean house and start over.

What went wrong in the last 15 years?

Let’s start with 9/11 and the subsequent militarization of police forces across the country (with small departments getting “mobile terrorism command centers” and big departments getting everything). Then add to that several cops were in the military reserve or returned from duty and got jobs as cops - the war zone mentality remained. Plus you’ve got a political climate that doesn’t abide anything that might appear “soft on crime and terrorism”, and the broad definition of terrorism.

Basically, we’re going to be able to add “blame 9/11” to the rules of “when in doubt blame the fall of the Roman Empire or the industrial revolution”

The whole “shoot the dogs the moment we enter a property” is just inexplicable, however.

When you google “cops shooting dogs” you are inundated with websites that do nothing but track dogs killed by the police. I saw a video three years ago of SWAT officers discussing among themselves who would shoot all the dogs in a house the moment they entered. They were not remotely concerned that the dogs may well be frightened or harmless. The officers seemed to regard the shootings as a means of asserting lethal authority authority over the people in the house: “We just killed your pets and if you move, we will kill you too…”

I have seen older officers bitterly denounce this trend, but the current atmosphere of asserting violent control and immediately escalating to gunfire on any and all animals seems to be norm.

Mathew Ajibade died alone in an isolation cell, bound by the hands and feet, strapped into a restraint chair.

He had been brutally beaten, his body covered with bruises and abrasions. There were scrapes and bumps on his upper body and head, the result of being repeatedly punched and kicked by his jailers. Minutes later, secured and compliant in a special unit, a Taser was pressed directly into his genitals. Hit with 50,000 volts, the young man is heard on video screaming in pain.

My God.

Sanctions aren’t out of the realm of possibility, but I doubt that it would end his legal career. Chucky’s a loose cannon and he’s clearly not controllable - that falls to some extent on his legal team, but there’s limits for what can be attributed to his lawyers.

Chucky, on the other hand, should truly be anti-SLAPPed silly, and at this point, the judge has evidence in hand that suggests that Chucky was engaging in all manner of illicit activities so as to try and make his nonsensical case that was filed in the wrong jurisdiction on purpose so as to avoid the expansive CA anti-SLAPP statute (where Chucky lives). He didn’t file in NY (Gawker’s home turf), even though NY anti-SLAPP is very narrow - which is particularly odd. He filed in Missouri, which has no real contact for either Chucky or Gawker.

At a bare minimum, the case should be dismissed with prejudice with defendant costs paid by Chucky. A referral to prosecutors in MO might not be out of order, given that he was soliciting illicit activities.

I’ve made this observation before but racial minority GOPers seem to “comphensate” by taking outlandish positions. Take Carson for example or Alan Keyes before him and all three of these you mentioned are incredibly bigoted towards gays, Muslims, and non-Christians. So yeah the GOP loves to strut out that they have African-American members who are bigots in their own way.

I don’t know how true it is about his personal claims about being autistic, but there is certainly some issues there. Dr. Matt  Oct 13, 2015 • 1:06:49pm

Taibbi can be a dude-bro on certain issues, but he’s dead-on here:

Taibbi: Rupert Murdoch Is Deviant Scum

It all comes back to Rupert Murdoch. As multiple recent news stories have proven, the 2016 presidential race is fast becoming a referendum on the News Corp CEO and reigning media gorgon.

The two top candidates in the Republican field are a Fox News contributor (Ben Carson opened his Fox career two years ago comparing Obama to Lenin) and a onetime Fox favorite who is fast becoming the network’s archenemy: Donald Trump is the fallen angel in the Fox story, a traitor who’s trying to tempt away Murdoch’s lovingly nurtured stable of idiot viewers by denouncing their favorite “news” network as a false conservative God.

The fact that Trump is succeeding with this message on some level has to be a source of terrible stress to Murdoch. He must be petrified at the prospect of losing his hard-won viewership at the end of his life.

This, in turn, might explain last week. Otherwise: what was Rupert Murdoch doing tweeting?

Yet Murdoch apparently still doesn’t feel like he’s getting his point across. At 8:59 p.m. last Wednesday night, the 84 year-old scandal-sheet merchant had to turn to Twitter to offer his personal opinion on Ben Carson and the American presidential race. To recap:

“Ben and Candy Carson terrific. What about a real black President who can properly address the racial divide?”

Forget for a minute what Murdoch said. Think about the why.

Gary Parsley II said the officer was following up with him about Parsley’s being struck by a car a couple weeks ago. When the girl’s aunt called out to the officer, the officer walked over and Parsley returned to his house, when he heard a shot.

Neighbors say the officer walked back to his patrol car after the shooting.

“He seemed a little disoriented, like he was really bothered,” said Norman Jones, who called the police after hearing the shot. Columbus and Whitehall police arrived at the scene shortly afterward.

Neighbors say Ellis came out of the house saying her daughter had been shot.

Why is he proud of that target?

Seriously. I think Chuck’s lawyer got the day of the week wrong for the new deadline in the sample order he’s requesting the Judge sign.

he was probably looking at the calendar page for November

re: #241 lawhawk

There’s no doubt. His lawyer screwed that up too. But that’s a de minimis error - the problem is that he missed the existing deadline, and his excuses to request a longer deadline still fall flat.

I guess my question is, regardless of how badly Burns fucked up by missing the deadline, exactly how many de minimis errors will a Judge happily overlook before they start to take a very dim view of plaintiff’s counsel? Because every single document the guy files seems to have multiple fuck-ups and omissions.

It’s the part where they note that CCJ has been attempting to purchase privileged attorney-client communications, and threatening 3rd parties when they balk at providing it …

If CCJ’s attorney has even a smidgen of a brain in his incompetent head, he is going to read that and immediately recuse himself. Because that is disbarment and criminal proceedings, and jail time.

A Federal judge is going to sharpen up the roto-fucking instruments upon reading this. They take that shit really, really, seriously. You CANNOT come into Federal Court, a serious goddam place if ever there was one, and demonstrate such flagrant contempt for the rule of law. Well, you *can* and by all indications, CCJ and his shyster have … but there will be consequences. Deep, severe and irrevocable.

Jesus. This is spot-on:

Some people think the media business is tough, but think of it like teaching preschool. There’s a whole range of strategies, but one of them, guaranteed to work, is walking into class every morning and handing out giant tubs of ice cream. The Fox lineup is the media equivalent of this: a giant pile of tits, explosions and football.

So anyhow although there’s five of them and I think you’ll see a much more diverse range of opinions at tonight’s debate. I mean you got one self described socialist and another guy who was Reagan’s Naval secretary. I’ve come to dislike Webb though.

Webb is a dishonest shit. He pays his kid a ton of money for his website, something updated once a year, if that. Almost $500k. We don’t need real controversies. Made up ones are bad enough. Plus, Webber policies are too far to the right for me.

I am completely serious about this:

Given his penchant for reckless and self-destructive behavior, Chuck C may be headed for a real tragedy.
Charles C. Johnson, if you’re reading this (and I think you might be) stop this downward spiral right now and get help. It may be easier than you think. There may even be a good story in it once you have made some progress. There is no shame in it, none. You are a young man with potentially a bright future. Don’t waste it.

I hope whoever gets asked the first Trump question (I’m betting it’s Hillary) calls CNN out and tells them to cut the shit, and points out that there are bigger things to worry about in this country than what the Democratic candidates think of Donald Trump.

And talk about policy, not bullshit. Thus far, all the “debates” have been policy free, unless you count the things they want to do to their considered lessers.

Today’s TBI tip: eliminate all sugar from your diet.

This is from a customer who had her head injury 6 weeks before I had mine. She crashed her mountain bike and doesn’t remember anything, but she thinks it was because her front tire went flat. She brought me her bike. I put a new tire on the front and had a hell of a time getting it to seat (tubeless), until I got a tip from my lineman buddy, who said to spray silicone around the seating point. Worked instantly. Now I’m waiting for new brake pads to arrive (disc brakes), because my lineman buddy test rode the thing, and was disappointed with the brakes. The customer is fine with waiting, she paid for half the job today, and we have MUCH to talk about, but not as much as I thought when I first met her.

She was a customer of the OTHER shop before her accident. She has been a professional road bike racer, before that a model, and after that, she’s was a 911 dispatch operator, then unemployed, and now cleans houses. She has an eating disorder and menopause. She’s going through a divorce. Does this sound like a person who should be dishing out nutrition advice? I was not eating much sugar before my head injury, but certainly have been since. Also, I’m a coffee junkie.

So much nonsense could be eliminated if people just thought of foods from a practical standpoint. Sugar, starch, fat - these are just fuel. They’re not evil, they’re not poison. They’re just fuel. If you’re burning a lot of calories, there’s no problem ingesting a lot of fuel in addition to the other things you need. Eat only fuel, and you’ll end up fat and sick.

considering one of the things your brain runs on/needs is sugar I don’t think eliminating it completely is a good idea. Sure, don’t overload on it because it can lead to weight gain and possible diabetic issues but you do need some sugar unless you want to turn into a snickers commercial.

Right now I am reverse dieting and working on putting on muscle which means eating a ton of carbs in addition to the high protein diet I’ve been on. I still try and control for sugar but won’t lie, sugar is carbs and an easy source to get (though I get it from actual food, not sugary soft drinks).

I know a couple people with actual gluten issues but to me it’s just crazy. I love seeing “gluten free” on packages of beef, cracks me up every time. I’m also not a huge fan of the whole low carb craze but I will say that when I was working to lose weight, the weight came off quicker when I avoided a lot of bread. When I was eating salads for lunch the weight was coming off pretty easy (2lbs a week) but when I ate a lunch consisting of a sandwich and fruit (all totaled both lunches had the same calorie count) it took longer to lose said weight.

Diabetes is damned serious, but you’re in a much better position to know your risk of that than she is and people should learn to shut the fuck up about other people’s eating habits and bodies. I only put sugar in hot coffee, which I only have twice a week. Also the very occasional ice cream sandwich because yum. Otherwise I just have iced coffee black, no cream. It’s easy for me because I don’t have much of a sweet tooth. Beyond that I don’t restrict ingredients per se, but I do try to watch calories.

IIRC, sugar is not ‘one of the’ things your brain runs on. It’s the ONLY thing your brain runs on. Glucose, to be exact. When you’re all out of reserves, your body CAN make it out of things like fats and proteins, but not well, or efficiently, which explains why when your blood glucose levels get really low you may make really bad decisions.

People have been asking me how I lost 50 lbs over the course of the first 4-5 months of the year. It was simple: I didn’t change what I ate. I didn’t even change my exercise routine. I simply stopped eating 4000 calories a day. My diet has been mostly the same, just smaller, and it worked. I grant that there are people with biological difficulties regarding weight loss, but understanding how calorie counts work is not rocket surgery.

One might argue that using the food we eat efficiently is exactly what’s happening to the folks who can’t seem to lose weight on low calorie diets. Exercise isn’t about efficient use of calories, really. It’s about intentionally burning them off.

This is one problem with dieting without adding exercise - your body starts thinking it’s starving, so it becomes more efficient, i.e. burning fewer calories at rest.

As a type 1 diabetic, I can vouch for that. Hypoglycemia sucks.

As the husband of a type 1 diabetic I can second that.

He’s a slime but he’s not that stupid. The job of speaker right now is much like the job of being in charge of Pearl Harbor on December 1, 1941.

Or number 2 al Qaeda leader.

The nice thing about disc brakes on bicycles is that you can ride them in all-seasons.

Plus you can keep rims a lot longer, what with the sidewall not getting worn down.
I’m just feeling bummed because I finally have to replace a rear rim - a WTB Powerbeam - that was first laced to a Chris King hub for me in probably ‘96 or ‘97. It has many miles on it, but surprisingly it isn’t the brakewall - I found the start of longitudinal cracks in the inner web (the bit above and parallel to the spoke bed.)

re: #234 Dr. Matt

Taibbi can be a dude-bro on certain issues, but he’s dead-on here:

Taibbi: Rupert Murdoch Is Deviant Scum

Taibbi certainly can be a dudebro douche, but he also has a way with words:

Speaking of Trump: The orangutoid real estate mogul’s presence in this presidential race is a real and hilarious threat to Murdoch’s political influence, at least in the United States. The on-again, off-again romance between Fox and Trump seems destined to end in permanent divorce, which could force Murdoch into a serious conundrum, because Trump has essentially been calling out Murdoch’s own “realness.”

Until Trump arrived, Murdoch owned the lowest common denominator in the media space. He didn’t just play to our worst instincts, he wrapped both arms around them and squeezed as hard as he could.

Perhaps Chuck’s lawyer is purposely trying to fuck over Chuck?

Sometimes, what can be ascribed as malevolence is simply incompetence.

re: #194 KGxvi

Decades of civil rights violations all across the country prove that problems with the police pre-date 911. First police departments were infiltrated by racists, over 100 years ago. Institutionalized racism has been passed down from generation to generation. Secondly, 30 years of tax cuts have trickled down to every level of government, making every agency or department dysfunctional. Police departments are no exception.

Cops like every other government employee have to prove they are worthy of a job in the next fiscal year. In order to prove you should still be employed, like every government employee you need to reach whatever strategic goal is set for you or your department. In the case of cops its generally something tangible like arrests and issuing tickets because quality of life or crime prevention are a lot harder to statistically prove. Arrests and tickets are easy to document. Plus ticketing provides more money in the coffers of an under-funded police department. No longer are citizens seen by cops as people they need to protect and serve, but as walking/talking funding sources. There is no incentive to let someone off with a warning. There are financial incentives to escalate a situation into arrest or in the case of Ferguson or Baltimore a riot. Cops need the overtime pay.

Every citizens relationship with government has been warped by tax cuts and forcing government to run like a business.

Of course the militarization of our departments has only made matters worse, but those problems already existed.

I wonder if we’ll see legislation named for Chucksie. Somebody’s going to get finally fed up with these doxing, instigating, utterly self-absorbed Millennial Shithead Professional Trolls and find a way to make their particular form of harassment into an actual crime.

Fucking with federal employees is a first step down that path.
