In Which a Federal Judge Makes It Clear He’s Getting Fed Up With the Inept Legal Fumbling of Chuck C. Johnson

Warning

It didn’t take the judge very long to react to Chuck Johnson’s latest awful filing in his lawsuit against Gawker, and if you guessed that he wasn’t very happy with Johnson and his crack legal team, you’d be right. It seems these nimrods ignored several parts of what the judge directed them to do, and now he’s striking their amended complaint from the record but still giving them another chance by ordering a clerk to correct their filing error.

He also threw out a second copy of the amended complaint that was filed apparently by mistake — and included a note to let them know his patience is running out:

Plaintiffs are cautioned that the Court will not take similar corrective action on their behalf in the future.

Here’s the judge’s rather terse order to the team of Johnson and Burns:

I know some people around here were salivating at the prospect of Burns getting sanctioned, but I mentioned this upstairs: I don’t think lawyers really get sanctioned much unless they’re doing something so egregious so as to be bordering on disbarment. This is about as humiliating as it gets for a practicing attorney at law, to get dressed down by the court like this. And yet, I imagine they aren’t done with the stupid.

With the federal courts’ electronic filing system, filing documents is ridiculously easy, and lawyers, of all people, ought to be able to comprehend rules and follow them. It looks like Chuck’s lawyer is at the Orly Taitz level of incompetence.

It’s not just stupidity; this is how they think law—and ethics, and justice—works…mutable to their whim and antagonism.

I predict Gawker’s attorneys’ response to this is going to be highly amusing. I’m sure they’ve already started working on it, based on the ridiculous filings already submitted.

More likely pissed off. This entire order amounts to an emphatic “fuck you, you incompetent fucking fuck!” Strictly speaking it’s unnecessary, he could have simply let it all slide. In reality it changes nothing at all, Burns’ filings remain intact this time and there’s nothing new the Court wants him to do or redo, yet nonetheless the Judge wanted to spank him very, very publicly for his continued ineptitude.

Gawker’s lawyers’ best play right now is to sit back and look good by comparison. The Judge is clearly angry, best to stay the fuck out of his way and let him focus on the person who angered him.

Not that I tend to hang out with judges, but the few that I know take their jobs seriously. Given the never-ending caseloads, they don’t like having their time wasted. This is wasting the judge’s time, and it didn’t even solve the initial problem.
Something tells me Chuckles is getting what he paid for this “lawyer“‘s service.

No. Nope, I don’t think so. This reads like someone who is exasperated & getting really steamed. Right now, the judge is basically laying the groundwork for a series of really damaging rulings.

The 2nd, 3rd and 4th chances that CCJ has gotten are basically so that there is no basis for appeal and kicking it back into Shaw’s court.

This shit is basically on the level of the handwritten pleadings we used to see come in from vexatious litigants suing the Zionist Occupation Government of AmeriKKKa for TEN TRILLION DOLLARS!

They might file for an extension, just to justify the billable hours they’re gonna slap him with if this gets axed under Cali’s Anti-SLAPP laws.

Yeah, because if/when the SLAPP case comes down on Chuckles, you can be damn sure that there are going to be multiple screech/whining appeals filed, desperately clawing for any basis by which to reverse the rulings. Right now, CCJ *might* have a basis for claiming “harmless error” in his pleadings, and thus trying to reverse the judgments he’ll be getting hammered with. Might.

But with each go-round, as the judge extends more rope, CCJ and his dimwit attorney obligingly twist it into a noose and stick their heads through it.

Heh. Well, there is certainly ample evidence that plaintiff’s counsel is apparently unacquainted with things like following local rules in a Federal court, organizing exhibits, having a sound legal basis for motions, meeting deadlines, crafting a coherent argument, etc. etc.

Minor stuff, really.

I’ve seen decent attorneys, when representing batshit crazy clients, have to stand in court with a pained, stoic expression on their faces, as the judge takes them out to the woodshed.

In this case, both plaintiff and counsel are Not Operating On This Plane Of Reality.

This is kind of cool: Houston Texans owner Robert McNair asks for his $10,000 back after haters overplay their hand in the effort to repeal Houston’s equal rights ammendment.

“I recently made a personal contribution to Campaign for Houston because my thorough review of the HERO ordinance led me to believe that a thoughtful rewrite would provide a better ordinance that would provide strong non-discrimination protections for all Houstonians, which I would support, and would be less divisive of our city.
It was on these principles that I made my personal contribution to Campaign for Houston. To my great dismay, Campaign for Houston made numerous unauthorized statements about my opposition to HERO in print, broadcast and social media - including attributing certain statements of belief to me. Their actions and statements were never discussed with nor approved by me. Therefore I instructed the Campaign to return my contribution.
I do not believe in or tolerate personal or professional discrimination of any kind. I also believe that we Houstonians should have an ordinance that unites our community and provides a bold statement of non-discrimination. I encourage all Houstonians to vote on November 3.

He didn’t like them using his name when they spewed their BS, and he basically told them to fuck off.

It was a UDI U818A-HD. All of the U818A family have a 1280x720 video camera included and are the same basic physical machine, just with different options as far as storage, battery capacity, and avionics. They are extremely lightweight (read: easily buffeted by wind) but are very mild-mannered, capable, and resilient introductory quadcopters.

thedopefishlives  Oct 23, 2015 • 5:03:00pm

re: #42 thedopefishlives

One thing to note is the U818A family do not allow the video to be broadcast live; it can only record. Some of the more advanced quads can broadcast their video stream during flight, but I wanted to start with something cheap and easy to fly before possibly investing in a fancy flyer.

Can GotNews.com Be Stopped From Distributing the Center for Medical Progress Abortion-Related Videos?

The short answer: if he got the videos from David Daleiden or anyone else associated with the Center for Medical Progress, yes, he can be stopped.

If he got them from an anonymous “congressional staffer” as he claims, no, he can’t be stopped.

Given: Chuck Johnson is a horrible pathological liar, and nothing he says can be taken at face value. So the only way to find out the truth about where he got the videos is to do a serious investigation which would mean subpoenas for Chuck’s computer and phone records.

Chuck’s trumpeting this at his Facebook page as if it gives him free rein. But he doesn’t realize the trouble is just starting for him.

I, um, have something in common with CCJ. And Jim Webb. Well, and Zuckerberg.

I say this because tomorrow son#1 plays his last high school freshman game against his team’s arch rivals. DW said at dinner “I should have made ‘katsu’.”* “Katsu” is the Japanese word for “cutlet,” but because it is also the verb for “win” pork cutlet dishes are sometimes served before important games in Japanese households.

I quickly said “that’s why I eat steak before I go vampire hunting.”

crickets

I turned to my son to start to explain, but he just said, “yeah, I get it: Dad joke.”

I thought, “Dad joke? oh, I can go BLUE mother….” But I acknowledged the stupid dad joke and thought again, “he’s almost gone.”

*sorry, forgot to add that that there is a whole rich tradition in east Asian cultures of eating foods that share a homophonic (?) sound with something auspicious. For example, in Japan, they eat Sea Bream (Tai) at New Years because it is part of the phrase “omede-tai” (fortune or fortunate).

I just watched some of the videos Chuck’s neo-Nazi pal posted at YouTube, and they’re just more of the same meaningless nonsense. There’s nothing damning in them. Just Daleiden doing his best to try to trick PP representatives into saying something he can use to smear them.

I’m Scotch and Irish. Is there such a thing as a whiskey fridge?///

…who puts whiskey in the fridge?

Apparently there is this horrible liquor from Sweden that roughly translates as “beaver butt” due to the source of part of the flavoring. Or at least that is how he translates it.

He has brought some in to share with the coworkers.

I have forbidden the husband from bringing any home.

That’s why the sarc tags. I did try a glass of The Macallan for my birthday a week ago. It was a delightful experience, although whether it was worth the price is debatable.

If you do end out this way for whatever reason, let me know. There’s a few Scotch places in SF I can recommend.

re: #71 klys (maker of Silmarils)

One of mr. klys’s coworkers has a fridge just for beer.

Just for the beer he is aging in the fridge.

I think it’s full size.

He’s Swedish.

In Massachusetts in the 50’s and 60’s most folks we knew, lotsa of hunters and fishers, had an extra ice box for the meat they caught. (Knowing that loveable crew, a bit of poaching was probably involved.)

Speaking of food, my grandda Patty brewed his beer (mostly porter and stout) in a clawfoot tub during the chilly and cold months out on the back porch.

He was Irish. ;-)

Holy shit. I don’t think I’ve ever had over 100 tweets for Pages post. Is the counter broken?

This is about the point where I chime in with the remote-operated beer-launching drone fridge.

I’m going to have to calculate how much that drone can lift. I can just about guarantee my mounting either a drink carrier or a Nerf gun to it.

This is why I walked out of a church for the last time in 1986 and I’ll never go back.

re: #2 b.d.

The judge is either getting really pissed or laughing really hard, I’m betting on laughing.

He’s pissed off. Federal judges do NOT like having their time wasted by incompetent lawyers.

There was a federal judge here in Austin who famously bitchslapped some lawyers who couldn’t handle basic procedure and wasted his office’s time. He hauled them into court and threatened to jail them:
