I mentioned this in a previous thread discussing the possibility that now appears to be becoming reality. Morrison and Foerster, or MoFo as they are colloquially known, are widely renowned in the technology community as the “sharks in suits” who represented IBM when they devoured a technology/patent troll in the SCO v. IBM case. The end result of that case was SCO filing for bankruptcy. Folks, you don’t fuck around with MoFo.
On the long ride home from a son’s soccer event this evening I was listening to “This American Life” about a guy who came up with a great scam (pre-internet) to dupe lonely men out of their money. He created bought or rented several mailing lists from magazines that specialized in men and then had women with “needs” mail letters to them . Of course, there were really no women. The guy wrote form letters by the thousands, only changing a few details, such as the sucker’s name, and sweetening the deal by including photos of ravishing models that he also purchased. He made millions. Even after he and a woman who assisted were charged with mail fraud and other crimes, many of the duped men continued to believe in the existence of the women they had been exchanging letters with. Some even testified at the trial about how the letters, while making them poorer by thousands of dollars (they were encouraged over the years to send money for this and that on behalf of the non-existent women they were supposed to be engaging with), had made their lives better by giving them something to believe in….
This is how you can explain a Ben Carson or Donald Trump, I think.

Hi Gang. The Zombie Scuba Apocalypse dives went well, as did all the rest of the training this weekend. It was the last weekend for the quarry to be open until next spring, so we packed a royal shitte-tonne into the weekend. I’ve NEVER been so tired after a dive weekend, the diving itself wasn’t hard, but had some students that really kept you on your toes, so it was a bit stressful. Add in wearing gear that’s almost 50% of my body weight while helping the students all get into the water… All I know is that I’m taking a naproxin tonight before I go to bed.

Also, I believe I got my history wrong. Morrison and Foerster was SCO v. Novell, not SCO v. IBM (I believe IBM has their own internal sharks that handled that particular case). Nevertheless, they did get their ass handed to them in that case, and in fact, that case is what caused them to get destroyed in the following SCO v. IBM debacle.

Most likely if he refuses to produce docs, he will get hit with monetary sanctions. It’s either a court date or a deposition so they will either ask him question under oath in a court of law or under oath in a lawyers office. From a quick Wikipedia’ing (IANAL), it seems like a criminal charge is possible in certain jurisdictions, but it also appears that the evidence that has been destroyed can be assumed as unfavorable to the party doing the destroying. In other words, it amounts to a tacit admission of guilt.
