In Which Right Wing Troll Chuck C. Johnson Gets Hit With a Subpoena From the National Abortion Federation

Bad decisions coming home to roost

Chuck C. Johnson poses with Center for Medical Progress head David Daleiden, October 25, 2015

Yes, folks, the other shoe has dropped tonight, as cyberstalker Chuck C. Johnson announced on Facebook that he’s been served with a subpoena by the law firm for the National Abortion Federation.

He posted this page from his subpoena:

“Patriotgeist” is the anonymous person Chuck publicly boasted had supplied him with the Center for Medical Progress videos. He also publicly announced it was a “Congressional staffer.”

Tonight Chuck boasted he’s not going to comply with the subpoena, and begged his Facebook friends to help him find a lawyer to fight it.

But wait a minute. Didn’t Chuck just tell the Washington Post he has five lawyers on call?

Johnson then uploaded the first video, a mere 76 seconds in length, to YouTube. Then, he said, he got a call from one of his five lawyers saying that the NAF wanted to file a restraining order against him, claiming he was an “agent” of Daleiden’s.

Why does he need a sixth lawyer? Just askin’.

And by the way, here’s the law firm that just subpoenaed Chuck C. Johnson: mofo.com. One of the 30 biggest law firms in the US. Notorious hard-asses. Just sayin’.

Like I said downstairs, if Chucky were smart, he’d already be working a deal to bail his ass out by rolling on his source, turn over all the evidence in his possession, and even agree to testify against them in court. But he’s not that smart, so destroying evidence and refusing to obey the subpoena in the hopes that the court will just drop the matter seem more likely.

I’d love to be the Judge handing down that sentence:

“Defendant is hereby barred from using Twitter or Facebook for a period of two years. Defendant is also directed to pay all of plaintiffs legal fees. Further, defendant is also required to find a barber and get that shit on his face cleaned up as soon as possible. Defendant is also henceforth barred from using the name “Charles Johnson” in any online capacity save for official government communications. For all blogs and social media defendant will be required to go by the name “Chuck”, “Chuckles” or “Upchuck”.

Yeah, but UpChuck doesn’t have the the militia types who rallied around Bundy. He can’t get people to rally around him in real life because he’s too repulsive. Who wants to man the battlements of Fort Floor-Pooper?

I don’t see how Chuck avoids court on this one. Even if he rolls on his source, he’ll have to provide evidence and testimony.

But I think he’ll be successful in getting a better lawyer, either from the far-right or far-left. I noticed the repeated use of the term “abortionists” in his latest beg-fest (after saying he didn’t really care about the issue), so I think he’s gunning for the far-right now. His previous pleas to turn this into a First Amendment issue have failed.

Fred Thompson, former U.S. senator and actor, dies in Tennessee

Fred Thompson, a former U.S. senator for Tennessee and actor, has died. He was 73.

Thompson died after a recurrence of lymphoma, his family said in a statement Sunday. He was first diagnosed with non-Hodgkin’s lymphoma more than a decade ago.

“It is with a heavy heart and a deep sense of grief that we share the passing of our brother, husband, father, and grandfather who died peacefully in Nashville surrounded by his family,” the statement read.

“Our nation has lost a servant, Tennessee has lost a son, and our family has lost its rock.”

RIP, Fred.

Back in the mid 80s, when Marvel comics was publishing the Star Wars comics, one of the issues had a small border world with a imperial base on it. They had the local kids complaining about the Imperials come across a band of Rebels planning to attack the base and getting caught in the crossfire. In the aftermath, the local town was destroyed and it featured the teenage kid deciding to join the Empire because they blamed the Rebels for causing the carnage.

It’s possible to drink responsibly but it requires paying attention to what you can and can’t do under the influence.

There are a number of safety procedures that if followed reduce the risk of working with loaded weapons.

In their minds, they are protecting anonymous sources, as many journalists do. But journalists also stop and consider the veracity of the material being leaked. It’s very clear the CMP tapes are fabricated and deliberately misleading — pure propaganda — so a legitimate journalist would probably not disseminate them, but check their veracity and work from there. The NAF is within its rights, under the law, to prevent further distribution of those videos. Whether Chuck is within his rights to publish them online is a different matter. Whether he can take advantage of “shield laws” to protect his source is also a sticky question. It’s not a clear cut case. The right lawyers arguing in front of the right judge could result in Chuck getting off scotfree and the videos out in public. The fact that a Congressional staffer was the leak adds another layer of intrigue to the legal issues.

Since IANAL, take my words with a barrel of salt, but this case could very well end up in front of SCOTUS.

Actually, Fred was first a lawyer by trade; among other things, he was minority counsel on the Watergate committee [the question “What did the President know and when did he know it?” that Howard Baker asked is widely attributed to Thompson and he had a role in the revelation of the White House tapes] and he successfully represented Marie Ragghianti in her wrongful termination suit against the state of Tennessee that exposed Gov. Ray Blanton’s corruption and led to his resignation. He got into the acting business when he appeared as himself in the movie Marie (starring Sissy Spacek) about Ragghianti’s life and experiences going up against Blanton’s administration; the rest is history.

So, needless to say, it was not a good weekend if you’re a New York sports fan (though it made for compelling tv - especially with the Marathon running Sunday morning). Jets lost, which was the least surprising of the events this weekend). Islanders lost (meh; but one of the losses were to the Devils so I’m cool with that) . Then we get to the entertaining portion of the weekend. Giants and Saints decided that defense was optional and ran up a score even Donald Trump would find yoooge by his standards (and the Giants lost on a FG no less). Manning threw 6 TDs and surpassed both Vinny Testaverde and Joe Montana on the all time TD list. Yeah, that’s just mind boggling - I’d have thought Montana was higher up on the list.

And then we have the Mets. The Mrs. is in mourning/sleep deprivation/walking dead/zombie mode due to them losing to the Royals. She’s also in mourning since my brother was at the game and she wasn’t.

The Royals deserved the Series win. They outplayed the Mets at every aspect of the game. Out hit, out hustled, and outpitched when it counted.

The Mets pitching wasn’t actually bad in the Series; it’s just that when they needed their fielders to come up big with making plays, the fielders didn’t. It started with the first game, and it continued throughout. Too many errors gave too many chances to the Royals, and they took advantage of it.

Good for the Royals. And for the Mets, retooling to improve the holes that were exposed. They’ve got the pitching to hold up - and to plug holes that were exposed.

I think I have a promising line of defense that upChuck could use. The videos DON’T exist, since they are just a collection of “1”s and “0”s on a disk, or a series of electrons in transmission across a medium. There are no physical files or film, and even a DVD of the videos aren’t the videos, just 1’s and 0’s.

Most of those old feudal houses acquired their estates and stations in life by doing something for the king, either in battle or in politics. After that, their main problem was hanging on to everything and not going broke, or not getting wiped out by some other feudal house. Libertarians (and fantasy fans) all think that would be just really swell if we could return to those halcyon days.

I’ve found Calvinism one of the most confusing theologies in Christianity. If everyone is predestined from birth to enter heaven or not, and there’s no way to tell which afterlife you will go to before you die, then why bother trying to be all godly and stuff?

Sounds more like astrology and tarot card readings than a theology.

Calvin himself was bothered by those same thoughts and basically ignored the doctrine in his own life. Unfortunately for the world one of his students, John Knox, fell in love with that doctrine and took it back to Scotland where he infested the Presbyterian Church with that pernicious heresy. He was, IIRC, the one who tied the idea that worldly success proved you had God’s blessing and were predestined for heaven while the poor were predestined for hell. It is about as utterly opposite from the teachings of Christ Jesus as one can get.

I was raised in a more liberal Christian atmosphere by parents who kept me away from Sunday school. So, a lot of so-called Christian thought I find very perplexing. And I never bought into the old saw that these mysteries are more than we mere mortals can fathom, so just listen to the pastor and stop making trouble.

After many years, I found all religions have the same perplexing nature. Quantum physics is much less perplexing, because as difficult as it is to comprehend, there is an underlying logic and physical basis to it.

WTF:

Who the heck thinks this makes a good prank - dressing up as a Klanner, and burning a cross? Apparently the husband of an Oklahoma town mayor.

A disturbing picture surfaced on social media of what appears to be inspired by the Ku Klux Klan.
The Garfield County sheriff said it was part of a “Halloween prank” in the town of Lahoma.

What was almost as shocking as the picture itself was who deputies said was under the white hood.

It was Cary Sharp wearing the white robe and hat last night.

He is married to the Lahoma mayor Theresa Sharp.

Prank? Toilet paper is a prank. Cross burning? Not so much.

If politicians are outed, that’ll be plenty bad, but the real issue is when it’s law enforcement that turn out to be Klan members, because we know how that goes. They’re the ones who are likely abusing their power and treating minorities as piggy banks or worse.

One of the coaches was upset about Anthony Bourdain basically saying that the restaurant industry would be fucked if we deported all the illegals and having had family work in the restaurant industry, he was right. COach though goes on about how celebs should shut their mouths about political matters. Nevermind that Donald is a celebrity himself and that he actually was talking about something he has credibility to speak on. And then Carson came up. Oh he’s such an inspiration I heard. I felt like mentioning that he wants to cut the same programs he rose out of poverty from but I knew I was outnumbered and I really did not want to get into an argument. Yeah there’s Ted Nugent and so many other conservative celebs that give their opinions. My problem with Carson is this arrogance he has that he thinks he should be president despite having never even ran for any elected office before. We have had previous people who have never been elected before but the were all generals who would have had experience dealing with the government in some way or form. And generals are hardly a safe bet for presidential success. The only above average general presidents that I can really think of are Washington and Ike. Add Campell’s to the list of things RWNJs are going to “boycott”

When Bigots Freaked Out About Campbell’s Ad With Gay Dads, This Man Had A Brilliant Response

How are those boycotts against MNF, Cheerios, Oreos, Levi’s, Starbucks, Google, Apple, and Macy’s coming along?

As I keep doing this, I am realizing that it’s harder for me to be as funny as the previous times. Not just because it’s a repeat of what I’ve done already, but because seeing this same bigotry over and over again can really dig into a person.

After the flier was uploaded, Twitter accounts associated with the hacktivist collective started posting Facebook accounts of people they said were involved with the Klan, which rattled some of the remaining members.

I’ve had Conservatives tell me that 1) taxes, or wage increases, are never paid by business, but rather are simply passed through to consumers to pay, and 2) Consumers control prices.

I pointed out that both things cannot be true at the same time. If 2 is true, then there is a limit to how much cost can be passed on to consumers, and the difference comes out of the profits.

I was told I was “economically illiterate”, but nobody offered an actual counterargument.

Barefoot Grin  Nov 2, 2015 • 8:58:20am

I was listening to NPR story about Supremes taking on case of racial bias in jury selection for a man on death row. Here is a snippet:

At Timothy Foster’s trial in Rome, Ga., the prosecutor used four of his nine peremptory strikes to knock out all the qualified black jurors in the jury pool. The defense cried foul, but the trial judge and every appellate court after that, including the Georgia Supreme Court, accepted the non-racial reasons. The prosecutors gave as many as a dozen reasons for striking each black prospective juror. These justifications included things like “failure to make eye contact,” looking “bored,” being “divorced,” or “a social worker,” and so on.

The appellate courts continued to accept these excuses even after Foster’s lawyers obtained the prosecutor’s notes in 2006 under the Georgia Open Records Act. It is rare that defense lawyers ever see these notes, and in this case, the prosecution’s worksheets were not subtle.

The name of each black prospective juror was highlighted in green, circled, and labelled with a “B.” At the Supreme Court Monday, defense lawyer Stephen Bright, of the Southern Center for Human Rights, will tell the justices that everything about those notes reeks of racial discrimination.

“They were referred to by B1, B2, B3,” Bright says. “There were comparisons made among the black jurors that, if we have to take a black, maybe Ms. Hardge will be okay, or maybe Ms. Garrett will be okay. They didn’t, of course, take either one of those.”

Now, what on earth might the ‘B’ stand for?

Consumers control how high a price can go, but not how low. That is determined by the cost of the materials and the labor.

Almighty God created the races white, black, yellow, malay and red, and he placed them on separate continents. And but for the interference with his arrangement there would be no cause for such marriages. The fact that he separated the races shows that he did not intend for the races to mix.

Yeah, I would take that list with a freaking box of salt. Some of the names on there are the more moderate Rs…which is not saying a lot. But I don’t believe that list, at all.

The GOP is so scared of being shown as habitual liars that they absolutely insist upon controlling the manner in which debates are conducted.

Meanwhile, the DNC has made no such demands, is not stamping their feet about the treatment by the networks, or demanding they be allowed to vet the moderators.

Oh I just noticed its Twitter handle. “Marxists suck” I don’t even know any “Marxists”

Most of them only exist in the addled minds of wingnuts. To them, anyone remotely civilized is a Marxist.

If they made the GOP debates into the Hunger Games, I’d watch them for free instead of only watching if I’m obligated to by work.

Postscript on the World Series between the Mets/Royals.

The Mets open their season in 2016 - at the Royals.

newyork.mets.mlb.com

Watching the Royals raise the banner/flag and get their WS rings.

That’s going to be interesting. Any bets one of the first pitches from the Mets will be throat high and inside?

Who in there right mind chases foxes with an articulated bus? Everybody knows that’s WAY too big a vehicle to be effective. You need something like a Mini-Cooper to do it right.

Geeze.

COach though goes on about how celebs should shut their mouths about political matters.

If you are feeling less accommodating next time, you could ask him why. Why, exactly, should celebs shut up about politics? Assuming that the answer is some variation of “we pay them to act/sing” etc. you can ask him: “And what do we pay YOU for? We don’t pay you for political analysis, so maybe you ought to shut up about politics too.”
It is weird and stupid, this idea some people have that if you are good enough at something to be really well-known for it, you aren’t allowed to talk about politics.

Then ask him what qualifies a real estate developer or a neurosurgeon to talk about politics…
