This is the dashcam video released today, showing Officer Jason Van Dyke executing teenager Laquan McDonald in the street, and continuing to fire even as he lay helpless and dying on the ground. Warning: there’s nothing too graphic here, but it’s very disturbing to watch. Viewer discretion advised.

Police released a dashcam video Tuesday evening that shows a police officer shooting 17-year-old Laquan McDonald 16 times in 2014.

The confrontation begins at approximately 5:00

I’m way too much of a cynic to see this case ending in either a plea deal, an acquittal, or a mistrial. I’ve just seen too many recent cases where there was video showing the cop committing cold-blooded murder and walking because “he was afraid for his life” to believe that he’s facing criminal charges for any other reason than because the city lost its court battle to keep the video under wraps.

lawhawk  Nov 24, 2015 • 4:17:51pm

That’s not the disturbing thing. It’s that it took more than a year to get to this point.

It’s disturbing that police apparently erased video taken from a nearby Burger King that showed events unfolding.

It’s that the Department had the cop on its payroll all this time.

It’s that the politicians were more interested in appearances than they were in seeing justice done for yet another victim of excessive force.

Oh, and the most disturbing thing of all? Tamir Rice was killed in less time (from the time cops arrived to the time the first shots were fired by cops).

Mattand  Nov 24, 2015 • 4:18:10pm

I was reading over at Pharyngula that according to one protester in Minneapolis, once it was clear that that BLM protesters got shot, the police were basically “This is what you wanted, so fuck off” and refused to render aid. They also let the perps get away unhindered.

Now this video comes to light. Jesus Christ, ever since Ferguson, I just cannot wrap my head around how much terror African Americans and other minorities live in due to the police.

Sixteen times. After sizing up the situation in under 30 seconds. And stayed on the force. Any wonder why people run from police?

I think they erased the audio. Cop car screaming through the streets, going around the left lane turners, running stop signs.

No audio?

No, the most disturbing thing is that he fired sixteen shots…and then attempted to reload. 9 out of the 16 bullets that struck McDonald were downward shots, meaning the majority of the shots were after he was on the ground and had ceased to present a danger to any of the cops. And yet, Van Dyke tried to reload so as to keep shooting a downed suspect.

re: #6 Targetpractice

The amount of disturbing things about the whole shooting can make for its own thread.

Reloading while he was already on the ground (and dying) so he could fire more… yeah, definitely disturbing.

Third suspect now in custody in the Minneapolis shooting of BLM protesters.

Police in Minneapolis say they have released one man, but two others have turned themselves in as they investigate the overnight shooting of five Black Lives Matter protesters.

The two are identified as two white men, ages 26 and 21.

That means three people are now in custody in the shootings that happened at a north side police precinct that has been besieged since a police-involved shooting that left a black man, 24-year-old Jamar Clark, dead.

12
Targetpractice  Nov 24, 2015 • 4:33:03pm

Oh, and as noted downstairs, Van Dyke’s wife tried to get around GoFundMe’s rules against donations going to people facing criminal charges by not using hubby’s name, instead calling him a “Chicago police officer of 15 years” and saying the reason for the fund was to afford to bond him out of prison. Why?

“My husband is having a bond hearing and if we do not raise the money he will be detained on 11/24/15,” the GoFundMe post continued. “With the holidays approaching our husband and father needs to be home with his family.”

I’m sure Laquan McDonald’s family would love nothing more than to have had him home, alive, for the holidays.

There is an audio track but it’s very low volume; you have to turn up your speakers pretty high. But all that’s on it is the sound of sirens. You don’t hear the gunshots.

According to the “official report,” Laquan was high on PCP and lunged at Van Dyke and his partner, forcing the officer to take him down with a single shot.

He most likely disregarded an officers commands while carrying a small knife.

The result was a death sentence. Instant trial, jury of one. Sentence cannot be overturned. Rule of law.

One more angry comment for the evening and then time to go.

I can see why there is a reluctance to allow Syrian refugees into America.

We worry about the spread of terrorism.

We already have a lot of terrorism in this country now, so no need to increase. Some of our police officers seem to be their own brand of terrorist. Ask all the young men of color. Then we have White citizens out hunting down protesters of color too.

We already know how welcoming our politicians are.

Everyone maintain your places…do not step out of line. You over there, let’s check that databse, show me your papers.

So, it probably is best for the Syrians. They might find some aspects of American life growing a little too close to some of that they have left.

I’m sorry, I’m just having trouble wrapping my head around this. Shooting a guy once in the heat of the moment, I can almost understand. It’s bad, but once can be justified as a bad snap judgement. Unloading a clip into someone, well, that’s pretty deliberate and evil; that speaks to intent. Reloading your gun… Shit, man, that’s what we call overkill.

There was the stories earlier this year about a cop who tried to do exactly that in Baltimore, going against the advice of other cops to report a superior for viciously beating a suspect. The thin blue line ended up terrorizing him to the point he moved all the way to Florida to get away from it.

In some ways, I think it’s even worse here in the far north, because we don’t have a lot of exposure to non-white cultures, which only magnifies the racism that does occur. That is to say, the good here is certainly very good, but the bad just keeps getting progressively worse because there is no other perspective.

“Of course, it was also Democrats who helped usher the bill through the House, Senate, and ultimately a Democratic president who signed it into law. The bill wouldn’t have passed without the support of Majority Leader Mike Mansfield of Montana, a Democrat. Majority Whip Hubert Humphrey, who basically split the Democratic party in two with his 1948 Democratic National Convention speech calling for equal rights for all, kept tabs on individual members to ensure the bill had the numbers to overcome the filibuster.”

after he hung up, jfk said “imagine that - mlk’s father is a bigot”

Another case where the voice of the city is the local police union’s president. One begins to suspect that the police union is the one that’s calling the shots with regards to how officer’s are treated.

Pretty much. After a while of working with IA, I learned that the Chief of Police, far from being in charge of the department, was viewed pretty much like Homer Simpson. A useful dolt, but not really the guy in charge.

The cop they all listened to, the one who called the shots, the one who could paralyze the city by calling for a “job action” when salary negotiations broke down, was the president of the POA (Police Officer’s Association). The POA gets the city councilmen elected, and if they cross the POA, they quickly find themselves back out of office, and their businesses and homes better get used to not getting any help when they dial 911.

Hey lizards.

Haven’t posted much of late due to intense work schedules and general craziness. But just got a phone call that made me want to either dance or share; sharing won, to the great relief of Mrs Cranky.

One of the rescue dogs, who we got when he was still a puppy, started showing signs of distress. They found a large mass, probably a tumor near his anal sack. The most likely diagnosis was Anal sac adenocarcinoma, which is extremely aggressive and tends to recur even with aggressive treatment.

Havoc (named for his personality) is the favorite of all the grandkids and even the other dogs, all of whom play with him although they rarely play with each other (we have 5 dogs and would rescue more if emotion overruled rationality). He’s a rotten little dog with a knack for getting everyone around to play with him no matter what else they’d planned to do.

We did a bunch of tests and poor guy had to have surgery to remove the tumor/tissue. He’s laying in a dog bed away from the crowd, hurting and wearing a cone of shame. Vet bills really hurt us too. Guess I’ll have the wallet of shame.

Just heard from the vet: it’s not cancer and so the prognosis is excellent.

So I can look forward to more years of Havoc, even without following politics. ;)

Creating havoc, as usual

Honestly, I think the jury verdict in the Fruitvale Station case was the correct one. The prosecution wasn’t able to show that the cop acted with malice (2nd Degree Murder) or was so reckless as to make it 1st Degree Manslaughter. Given the facts of the case, the jury found that Oscar Grant died as a result of a fuck-up and thus found the officer guilty of 2nd Degree Manslaughter.

The other thing to know is that the normal sentencing enhancement for manslaughter committed with a gun was not imposed by the judge as the jury, in its capacity as finders of fact, had found that the cop had been intending to use his Taser. Thus the judge felt that that enhancement could not be imposed on someone who had used a gun unwittingly.

I say all these things knowing that they are deeply unsatisfactory. But those findings and rulings were the ones the law required.

I think it’s more a case of getting caught up in the moment. The training is that belligerence against you or your brothers in arms is to be punished; and so mouthy young black kids get unintentionally targeted by escalating violence. How and why it reaches the stage where shooting seems acceptable, I can only attribute to letting adrenaline take over. Subconscious - or conscious, but suppressed - racism probably surges to the forefront during this time, which would explain why this response is disproportionately directed against blacks.

re: #170 thedopefishlives

I think it’s more a case of getting caught up in the moment. The training is that belligerence against you or your brothers in arms is to be punished; and so mouthy young black kids get unintentionally targeted by escalating violence. How and why it reaches the stage where shooting seems acceptable, I can only attribute to letting adrenaline take over. Subconscious - or conscious, but suppressed - racism probably surges to the forefront during this time, which would explain why this response is disproportionately directed against blacks.

It’s more than that, though. There have been a number of studies on this, and cops tend to remember seeing guns on sample black targets even when no gun was present and NOT remember guns on sample white targets even though the target had a gun.

You know, if you agree with that, I have nothing else to say. You think a mans life is only worth a few months in prison…for an officer who was supposedly trained on the weapons he had on him and knew what he was doing.

If that is the result called for by the law in place at the time of the shooting, then that is the required result. I’m all for changing the law afterwards if the result is too light a sentence, but I don’t favor convicting someone of a offense they did not commit or imposing a sentence enhancement their actions did not merit.

I know that’s not likely to be acceptable to you, but I’m not going to do you the disservice of lying to you.

The cop shot Grant while he was handcuffed on the ground, and said he mistook his gun for his Taser. That is up there among the biggest bullshit excuses in the history of bullshit excuses. That should have either been voluntary manslaughter or second-degree murder. There is no chance that Grant was shot by accident. None.

Therein lies a solution.
a) Institute a National Service draft (with GI bill benefits).
b) Select from it community police, also by lottery, for 6 mos training and 18 mos service.
c) Supervise with a small highly-trained cadre.
d) No exemptions.

That’s 3 murder-by-cop indictments just this year;

Walter Scott (random passerby with cellphone camera)
Sam Dubose (bodycam)
Laquan McDonald (dashcam)

In all three cases, “I feared for my life, I had to defend myself” would have worked had their been no video.

I’d love to have some statistician try to extrapolate what percentage of feared-for-my-life “justified use of force” cases, out of all the No Video Available cases there are in an average year, are equally bullshit.

In some ways, I think it’s even worse here in the far north, because we don’t have a lot of exposure to non-white cultures, which only magnifies the racism that does occur. That is to say, the good here is certainly very good, but the bad just keeps getting progressively worse because there is no other perspective.

It’s actually pretty hard to miss Somalli culture in Minneapolis, but if you want to be a bigot (like the shooters), you can pretty easily keep your head up your ass. Bloomington is a pretty big suburb that goes from service class to pretty rich. I’m going to guess that he came from the ‘poorer’ part of Bloomington and blames his non-fabulous life on ‘others’.

Many, many years ago I did a few days in a county jail in the midwest for something stupid. It was clear that most of the deputies and inmates knew each other. Out picking up trash along a highway, a guy told me ‘most of us went to high school together; we all did the same shit—getting drunk and shooting up signs and getting into trouble—they just wanted to play “deputy dog”.’

Now, that might have been sour grapes, but I think in some cases it’s not a bad description of the motivations for becoming a LEO.

re: #209 Dark_Falcon

Dark, I saved this for you from Sunday. When you talked about Syrians the other day it was very much a stereotypical description, a caricature almost. Maybe this will give you more insight into them and how different each individual is. It also explains how some young women end up falling in with Da’esh.

It’s very interesting as it makes everything more real, like you can see yourself in their situation and maybe begin to understand how drastically their lives have changed over the past four years, and it helps you understand that everything is not black & white, good & evil… there are a bunch of shades of gray in between where people’s (poor) choices take over their lives:

ISIS Women and Enforcers in Syria Recount Collaboration, Anguish and Escape

SOUTHERN TURKEY — Dua had only been working for two months with the Khansaa Brigade, the all-female morality police of the Islamic State, when her friends were brought to the station to be whipped.

The police had hauled in two women she had known since childhood, a mother and her teenage daughter, both distraught. Their abayas, flowing black robes, had been deemed too form-fitting.

When the mother saw Dua, she rushed over and begged her to intercede. The room felt stuffy as Dua weighed what to do.

“Their abayas really were very tight. I told her it was their own fault; they had come out wearing the wrong thing,” she said. “They were unhappy with that.”

Dua sat back down and watched as the other officers took the women into a back room to be whipped. When they removed their face-concealing niqabs, her friends were also found to be wearing makeup. It was 20 lashes for the abaya offense, five for the makeup, and another five for not being meek enough when detained.

Their cries began ringing out, and Dua stared hard at the ceiling, a lump building in her throat. […]

Those buildings are near McCormick Place, Chicago’s convention center on the lakefront (it’s just south of Soldier Field). The photo of the cops is either of them training to disperse Occupy Chicago (OC)-organized protesters* and it was shot by a cop, or it was shot by a protester who came face to face with what was clearly a very amped-up cop.

The other image is of a t-shirt sold prior to the NATO summit that was quite popular with Chicago police officers, to such an extent that police organizations bought out a complete productions run of it and bought an entire shipment of it at the store where I found it.

And no, I don’t own one of those shirts, but I’d wager Jason van Dyke owns one.

Note: I’m not going Killgore on you, but OC was the coordinating organization for the protests

re: #169 KGxvi

I grew up around a lot of cops (trained in karate while a teenager with many of them), I have friends who are cops, and a friend who runs a law firm that specializes in representing law enforcement. They are good people and mean well. And I agree with you that something has gone wrong with the process

I’ve known cops as friends and neighbors, and agree that many are good people. I’ve also been falsely arrested by a cop who is currently in prison for murder. I don’t generalize the behavior of the bad cops to the rest of the police. However, even many good cops are complicit in covering up for the bad actors and so certainly aren’t guilt free. Official reports and the film are radically different and evidence was destroyed. Given the differences between the official police report and the tape, are other cops under investigation for conspiracy or obstruction?

My experience has been that police have a strong “us vs. them” mentality where “them” is everybody but police. And for many cops, being the wrong color, religion, etc just makes people even more “them”, i.e. a bad guy.

My other primary observation of police is that the great majority are control freaks. They react badly to any perceived questioning of their authority and make more demands in an attempt to assert their power. That’s why it’s smart to acknowledge it immediately. Of course, the more “them” you are the longer it takes some cops to stop the dick waving. With the worse examples, simply asserting constitutional rights is tantamount to laughing at their genitalia waving display and can result in severe, tragic consequences.

A major cultural change in policing is needed, including demilitarization and a cultural shift in the us vs. them mentality. Screening for those likely to abuse their authority and real consequences for those who do are also needed. Transparency in the justice system is also critical. Body and dash cams are a first good step as demonstrated by the thread topic. It’s useful evidence in the us. vs. them disputes.

The police do a necessary and often thankless job. A job that we need done. But they don’t have a pass to commit criminal acts any more than any other person.

re: #78 plansbandc

You have hit the nail on the head on racism in America and what it’s like to live in a nation where your very existence is seen as a threat to others. I can tell you it’s hell. No matter how much you achieve in your life, no matter how you’ve never run afoul of the law, and no matter how much you mind your own business, you’re a target of racism. It’s demoralizing, and it never ends. I’m black, female, well-educated, law-abiding, I’m a homeowner, and I pay my taxes. My only child graduated from high school and college with honors, is 34, female and has no kids, but yet, she and I are stereotyped by many. It’s a helluva way to live, always walking on egg shells and being suspected of being something you’re not. I was raised under Jim Crow and lived through the height of the Civil Rights Era in the 1960s. It takes a lot of courage to live through these life-changing periods in our history and not resort to hate. I have my parents to thank for not hating every white person I see. They taught me not to hold every white person responsible for the evil acts of a few, and for that, I am very thankful because it has made my life better in that I can have friends of any race. If I had been allowed to embrace hate, I think my life would have been miserable, and the hate would have eaten me up. Am I still frustrated at times by the racist attitudes I still see being expressed? Yes, but I always keep the hope alive that as time passes by, more Americans will reject hating others because of their race, sexual orientation, religion, etc., and realize that no one is better than anyone else because we’re all headed to the same place—-the grave.
