Chuck C. Johnson Is Now Suing Gawker in California; Anti-SLAPP Here We Come

Cyberstalker and vexatious litigant Chuck C. Johnson has now filed suit against Gawker Media in California, walking right into an anti-SLAPP statute that’s likely to get him in deep financial trouble. He proudly announced it on Facebook (because he’s permanently banned from Twitter) with a picture of his receipt from the court.

Johnson probably rushed into this because the statute of limitations is expiring on the case, and his Missouri lawsuit is likely to be dismissed because it should never have been filed in Missouri in the first place.

His filing is below, courtesy of @AdamSteinbaugh, who points out that Johnson is actually filing this pro se, which means he’s representing himself — and a corporation cannot legally file a lawsuit without a lawyer. So right off the bat our boy Chuck is in trouble; if the anti-SLAPP motion goes against him (which it almost certainly will), he’ll be on the hook for all of Gawker’s by-now very expensive legal fees.

But if you read this, and you remember what Johnson filed in Missouri, you’ll notice that he simply copied and pasted almost the entire document from his Missouri filing, even leaving intact several sections that refer specifically to Missouri! For example:

13. Per Quantcast, Gawker Media has over one million unique Missouri readers.

[…]

16. Gawker has over a million readers in Missouri, as evidenced Quantcast data showing Gawker​.com’s web traffic.

[…]

18. Further, Deadspin​.com, a Gawker media property dedicated to sports, famously, viciously, repeatedly, and continuously, attacked the St. Louis Cardinals recently.

And then there’s paragraph 2, which is basically an outright lie:

“Plaintiff Charles C. Johnson has never before initiated a lawsuit for defamation.”

Right, except for the one he filed in Missouri. Oops.

And just as in his Missouri suit, Johnson is actually trying to argue that Gawker is not protected by section 230 of the Communications Decency Act, because they’re a government actor. “Far-fetched” doesn’t even begin to describe this argument.

So, now he’s got a CA case (along with the MO federal court case, which should be wrapping any day now), and he’s going to find himself in a world of hurt as the anti-SLAPP suit comes a knocking.

This new filing? That all but guarantees another anti-SLAPP suit. That Chucky most certainly would lose.

So, that must mean Chucky thinks he’s winning because he’s filed another suit. *facepalm*

I think what disturbs me after the 37% who say yes are the 13% who don’t know. I admit it, I’ve been lucky, I’ve known Muslims my entire life. Anyhow, I think after my job interview which is interestingly enough in my hometown, I’m going to stop by my favorite kabob place, the last time we went there as a family, the owner approached my mom and complimented her about how her boys have grown up. Nowhere did I say that either was OK or that Christianity was “just as bad”. What I pointed out was that A) the things you demand to see are already happening but you won’t acknowledge it, and B) the things you are demanding are never demanded of other groups who are also not responsible for the actions of people in their group who do bad things.

I should also point out that the main target of groups like Da’esh are Muslims. So the idea that we demand the victims of these monsters “prove” their loyalty to civilized society is a double insult.

Michael Keaton - he wasn’t bad - didn’t watch a minute of that one as I had conference calls…wasn’t Jack Nicholson the Joker?. Val Kilmer - fucking juvenile Batman with relationship issues (and NCIS wannabe Robin) - but Ace Ventura made a good Riddler, though Tommy Jones was a pathetic Two-Face. George fucking Clooney? And his villain was asshole Schwarzenegger? And Christian Bale going up against one of the guys from Catch 22 - Michael Kane saves this version. Are there any I’m missing? Was there a Jerry Seinfeld Batman (who does battle against the evil Pee-Wee Herman)?

It’s bad enough I know all the James Bonds.

Can’t read the timeline on the heading but that’s at least 1905 which means my dad would have aunts and uncles still alive for that. I was thinking about this earlier. I recently (as you all know, I’m my family’s historian) found out that my great grandfather was Lutheran and married a Catholic. I had previously thought the entire line was Catholic upon arrival in the U.S. But yeah Anti-Catholicism was part of why my username’s namesake Al Smith lost in 1928, Not the main reason mind you but it did play a role.

It’s all good. It’s not something I would have wanted to do forever but as a temp gig, I loved it mostly for the people. I got myself re-enrolled in my old community college too. I’m going to be taking creative writing on Tuesday nights. I’m still hoping that I get a chance to prove myself in a paralegal setting. Research is my biggest passion. I love finding information. You’d think there’d be a big need for that.

I never would have guessed that shrapnel came from someone’s name. Boycott I know is another. The colonists weren’t boycotting when they did what they did to the Tea Acts, the term only came about later in late 19th century Ireland when a priest, a Father O’Malley of Mayo who could well long shot given the surname’s popularity be a distant kin had people protest a particularly harsh landlord.

Oh hell no. Nobody gets to use this to deny a gun purchase. Really don’t see how anyone can endorse that mess. The no fly list is far and away more emblematic of what we have done wrong in the war on terrorists than right.

How about this? If you are on the no fly list you are not allowed to post your opinions on the internet, via the postal service or print. After all you might make hate speech. Or slander someone. Or something. Yes that’s just to make one think in terms of rights less controversial than self defense.

Unfortunately, the government’s new redress process still falls far short of constitutional requirements. In our case, it refuses to provide meaningful notice of the reasons our clients are blacklisted, the basis for those reasons, and a hearing before a neutral decision-maker. Much as before, our clients are left to guess at the government’s case and can’t clear their names. That’s unconstitutional.

There’s another important aspect to the government’s case at this stage. The government has emphasized that it is making predictive judgments that people like our clients — who have never been charged let alone convicted of a crime — might nevertheless pose a threat. That’s a perilous thing for it to do. As we’ve told the court based on evidence from experts, these kinds of predictions guarantee a high risk of error. If the government is going to predict that Americans pose a threat and blacklist them, that’s even more reason for the fundamental safeguards we seek.

Yeah I plan on bringing up my research skills. I’m not totally sure if this is the best fit but as I said, I do need to practice interviewing and this really is the first time I’ve ever free disclosed my AS. I’m finally comfortable with disclosing it. I’m no longer ashamed of it.

May be a bit of the ‘not me on the list so why worry’ going on. I don’t expect any change in the policy either. Sadly, we are headed back to over-reaction in our laws.

Cat behavior experiment underway. Cleaning up the apartment yesterday I collected all the small cat toys and put them in an empty shoebox. This included getting out the yard stick and knocking stuff out from under the dryer, stove, fridge, and couch.

I was curious to see what toys the cats opted to select out of there as “favorites” given free access to it. I have also bought innumerable small and cheap “mouse” toys that rattle a bit. They constantly disappear, and I get more. There were none in the box.

1. Initial favorites were a plastic golf ball, a large fuzzy mouse toy, and… a cardboard packing ring about 2” in diameter.

2. Yesterday evening before going to bed I found one of the small mouse toys in the middle of the kitchen. So I put it in the box. Came home from work this afternoon and saw Tuxedo Cat playing with something red while I was scooping litter boxes. Not recalling a red toy I then went and checked. Another small mouse toy.

My guess is that for some reason Tuxedo Cat is digging into her stash of toys rather than getting stuff from the box. (I also caught her stripping fake needles off the Christmas tree as well.)

Gotham is noir detective fiction with added superhero backstory. It really delves into the whole Batman mythos, and Bruce has only just discovered the secret cave under Wayne Manor. He’s still a scrawny teenager with a keen mind and a burning desire to do right. Meanwhile, Gotham City is already a clusterfuck of crime and graft.

The acting and writing are really tight. You need to watch it, fer sure, yo!

I’m trying to understand the “why” of his California filing and I’m going to need help from somebody with more legal knowledge. Am I mistaken in assigning rational strategic intent to a guy who clearly needs medication and therapy?

Changing the battlefield to CA clearly sets him up for anti-SLAPP action, but since this is technically a new case, doesn’t that mean a new judge will need to be brought up to speed? With the Batman movies, stick with Tim Burton and Christopher Nolan and you can’t really go wrong, though each director’s versions are completely different takes on Gotham. True, Batman Returns (Burton) and The Dark Knight Rises (Nolan) aren’t as strong as their preceding respective installments, but they’re still pretty good.

Yeah and they will probably be right. I’ve lived in California since 1960 and for the past 20 years we have not had the rain and snow that we had in the the past. I think the last time I saw Lake Shasta full to overflowing was when my wife was pregnant with our first in 1993. The most important thing for California is the snow pack. If the storms aren’t cold enough the snow level can get pretty high. Last year we had decent rain amounts but it was so warm no snow stuck below 7000 feet. Here’s my Photo from February, 2015 at Wrights lake at 7000 feet, on the edge of Desolation Wilderness.

So far we have had less rain than last year. If my memory serves me right we are about 60% of last year at this time. We need moisture and cold, and lots of it.

Off work this week and spent last two days moving around my home office. Got rid of an old school traditional desk that was an ergonomic nightmare for computer work. I replaced it with a maple butcherblock workbench I had in the basement collecting garbage on top of it. I also have a brand new die cast replica of a WM dumpster that I’m waiting to breakin in tomorrow. I’m going to get some cone incense to burn in there for my very own desktop dumpster fires. ( credit Teleskiguy for his awesome dumpster fire jpegs.) I have lost all drawer space for now as it’s basically a table. Also the enclosed nature of the traditional desk is gone, exposing the rats nest of cables that I am pretty confident I can reduce to a minimal, clearly labelled and low key organization. I have my total desk height set at 27.5” inches and I feel this is the best height for my body type. I could go higher but sadly no lower unless I took the feet off (about another inch). Also I am more spread out so I hoped George would be pleased. Nope, face still on my keyboard. I changed my monitor back to its original stand leaving me with a pretty sweet articulating VESA arm the smoothly handles about 50 lbs. Dunno what to do but spitballing I could used it for a mic stand or a sheet music stand that could be stuffed with books and always ready to swing out for action. Still early but I have high hopes I can do this in a modern way that wont get offensive.

On one hand, I can understand why people wouldn’t want their kids reading a book with the n-word in it, given the hurt it can cause. On the other hand, literary works deserve to be read in their original form (as long as they’re intelligible to the reader) and their historical context studied, too. A good teacher can help students (middle school and older) see how Twain portrays Jim as a human being, not as a piece of property, and how Huck sees Jim as a brother, despite the differences in their social status. Students can also see the truth behind that line you quote, if the teacher then presents a history of Jim Crow laws, forced segregation, and the Civil Rights movement.

Thing is, schoolchildren are often much smarter than their parents and other adults give them credit for.

It couldn’t happen to a more deserving person. He is truly the among the worst of what humanity has to offer less the criminals.

He may deserve punishment, but his wife apparently is an officer of his two LLCs, so any financial penalties might have to be shared. I’m hazy about the legal issues there, but in any event, the penalties he faces could be quite substantial and would affect his whole family.

I mean, this is a guy who avoids hotels and stays on people’s couches. He’s not exactly a millionaire.

I could see keeping the original but having an abridged version to accompany for historical perspective. Done well it could be a great bridge. I do not like going back and changing shit like it never existed however. The original language endears the 2 friends closer and as more sympathetic characters while making the external forces all the more challenging and evil, as I’m sure that would be the next change to the book.

On one hand, I can understand why people wouldn’t want their kids reading a book with the n-word in it, given the hurt it can cause. On the other hand, literary works deserve to be read in their original form (as long as they’re intelligible to the reader) and their historical context studied, too. A good teacher can help students (middle school and older) see how Twain portrays Jim as a human being, not as a piece of property, and how Huck sees Jim as a brother, despite the differences in their social status. Students can also see the truth behind that line you quote, if the teacher then presents a history of Jim Crow laws, forced segregation, and the Civil Rights movement.

Thing is, schoolchildren are often much smarter than their parents and other adults give them credit for.

It’s all about context and not the words themselves, which is just too much nuance for FB and Twitter campaigners to grasp. I will not be drawn into any “But Chris Rock can say it!” discussions

I finally got around to reading the Kareem Abdul-Jabaar piece in Time. If that op-ed were a prize fight, they would have stopped it.

Trump’s latest enemy du jour are Muslims. He’s the schoolyard bully rallying classmates to make fun of the skinny kid with glasses. When President Obama said that “Muslim-Americans are our friends and our neighbors; our co-workers, our sports heroes,” Trump quickly tweeted: “What sport is he talking about, and who?” The press immediately provided him with a list, as well as photos of Trump with prominent Muslim-American sports figures, including Shaquille O’Neal, Mike Tyson, Muhammad Ali and, yes, me. What makes his statement even more insidious is the suggestion that, even if there were no Muslim sports heroes, Muslims would somehow be lesser people, less worthy. This cruel and dim-witted thinking is not the stuff presidents are made of.

That’s good news. I’d recommend backing up everything to be on the safe side. External USB hard drives are fairly inexpensive, and the Windows built-in backup app will save your whole hard drives, Windows and all, to the external drive. Western Digital external drives are pretty reliable, but I can’t recommend their backup software. On my old computer, it would hog CPU cycles and slow my laptop to a crawl. Now my external HD is a Lenovo unit — 2 TB for $125, and no kludgy software.

NoKo has a national intranet, and very little connection to the worldwide Internet, except for government and military officials. You know, you could say this is an outrageous thought, it will never happen.

But all bets are off as far as I can see. That’s not saying it is going to happen…just that all the elements are in place.

I caught my usual 15-20 minute opening to Morning Joke and today Mika seemed like she is now scared about terrorists getting into the country due to our VISA background checking issues. It appears the latest about the California terror couple has caused her to start thinking maybe Trump is right.

That’s how it starts…right there.

And the whole time they were all talking about how we need tougher laws for this and that and more money for government agencies to be better at their jobs, etc., I could only think why is this same thinking not being done about guns?

Sure, California was bad and I understand the desire to weed out terrorists…but more people were killed at Sandy Hook and most of them were kids…but nothing was done to work to eliminate another Adam Lanza. Other shootings have had almost the same number of deaths as California, but still no big freak out to make sure anyone wanting a gun is kept from getting one until they are as thoroughly checked out as everyone seems to want to do anyone coming into this country from the ME.

The hot toy of the season is causing a firestorm of trouble.

The ubiquitous hoverboard, which doesn’t actually hover, does actually have a disturbing tendency to catch fire - and set fire to stuff around it.

Airlines are considering bans on bringing the item on board. There’s already quite a few house fires associated with the gizmo, and public safety folks are looking at recalls or other measures. Even the maker of one of the boards has issued a recall.

The UK has seized 90% of the hoverboards entering the country over the fire risk.

The items are largely made in China, but there’s a bunch of counterfeiters out there, and it’s hard to tell what components are involved, or which brands are more susceptible to catching fire.

Edit: Roberts, who doesn’t seem to have trouble legislating from the bench, was considering the possibility of having any changes take affect after the next census, so someone can count the actual number of eligible voters.

Here’s how that works.

The feds use the census to attribute Congressional seats on state by state. They use total population from the census data - all persons, not just voters, persons eligible to vote.

The states arguing in favor of allowing this would disenfranchise communities that have a large number of persons under 18, or those who aren’t voters (or aren’t allowed to be voters - like say felons) or say non-citizens, who are counted for census purposes and for giving a seat to a given state, but not in dividing up those seats in state.

The net effect would be to accumulate seats in certain areas of the state, while entire populations are ignored. One of the results is likely to be shifting seats away from urban areas to rural districts - eroding power of those urban areas (moving power from traditional Democrat areas to GOP dominated areas).

Scrub external view ports? etc? ) The crew is always the most important weapon on a tank but all else being equal, old is not always as much worse as people think.

I’ll drop one last thought on the subject… Isherman M-51.

The ubiquitous hoverboard, which doesn’t actually hover, does actually have a disturbing tendency to catch fire - and set fire to stuff around it.

Airlines are considering bans on bringing the item on board. There’s already quite a few house fires associated with the gizmo, and public safety folks are looking at recalls or other measures. Even the maker of one of the boards has issued a recall.

The UK has seized 90% of the hoverboards entering the country over the fire risk.

The items are largely made in China, but there’s a bunch of counterfeiters out there, and it’s hard to tell what components are involved, or which brands are more susceptible to catching fire.

That’s a damn shame. I really wanted one of those…the poor man’s Segway.

I saw the FP diary on Daily Kos about the Supreme Court considering basing redistricting on eligible voters versus population. All of the conservative justices seemed to be open to the idea.

Edit: Roberts, who doesn’t seem to have trouble legislating from the bench, was considering the possibility of having any changes take affect after the next census, so someone can count the actual number of eligible voters.

Oh,I know what they can do, but you should know those Syrian tanks weren’t issued the Boltok. Assad has those, but none were sent to Deir Ezzor and his government still controls the armories where they are stored. Moreover, only a few of Syria’s T-55 were fitted to fire those missiles, and this might not be one of them.

And with that digression out of the way your point is well made. Any decently-maintained and properly supplied tank can be a threat if given a decent crew. But head-to-head the M60 is far superior and Turkey will have better crews than Daesh.

Edit: Roberts, who doesn’t seem to have trouble legislating from the bench, was considering the possibility of having any changes take affect after the next census, so someone can count the actual number of eligible voters.

My best friend and I at a “town hall” called out my Congressman, Scott Gunderson on the Reagan administration lie that Archbishop Romero was killed by leftists when he was actually murdered by the right wing government. He was a rarity - an honorable Republican who later, after researching the facts of the case, admitted in the newspaper that we were right. I believe his last election was the last time I voted for a Republican because I wanted one to win and not because the alternative was even worse.

But recall that right before Trump made his case for broad exclusion of all Muslim immigrants from the United States, the GOP leadership was excited about its success in boxing Obama and the Democratic leadership into a corner over the Syrian refugee issue. Republicans, in other words, are disagreeing with Trump about how to leverage voter fear of Muslim immigrants into electoral advantage, not whether to do so. They had a nice, politically savvy plan that attracted broad consensus, and then Trump messed it up by saying something crass. I remember that one. Over this side of the pond, it’s known as the Lockerbie Bombing, named after the town over which the wreckage fell.

My husband at the time was living in Ayr, which under 60 miles away from Lockerbie, and on one of the major air routes, so you could hear planes going by high up. One night he noticed a plane that was a regular as clockwork failed to pass by, and less than hour later, he found out what had happened in Lockerbie.

Tatiana Duva-Rodriguez pleaded no contest shortly after the October shooting to reckless discharge of a firearm, and she was sentenced Wednesday to 18 months of probation.

Her concealed carry permit was also revoked until 2023.

Duva-Rodriguez said she had learned a lesson from the incident.

“I tried to help, and I learned my lesson that I will never help anybody again,” she said after her sentencing.

That was when I was at UT. Today, something would have been said. Then, we had the statues of Confederate war criminals on campus, so you can pretty much see how it was then.

That said, the UT cops had a bad reputation when I was there. My (white) boyfriend went out and purchased a gun after a scary run in with a campus cop. The cop went apeshit after boyfriend illegally parked so he could return some books to the Perry Castaneda Library book drop. He was very rattled by the experience and since he lived less than 150 yards off campus, he decided to arm himself.

We know Cruz is economically illiterate. He helped create the GOP shutdown in 2013 that cost the nation billions more than he thought it would save (even as every frickin’ economist said that it would cost more than save).

His tax proposals are DOA and would explode the deficit and national debt. Even with the most advantageous reading and dynamic scoring, he’s still crushing the debt and will fall short on creating economic growth with the plan, because he’s effectively shifting the tax burden from the rich and corporations on to everyone else. Those who have the means to pay get massive tax breaks, while everyone else sees their tax burdens increase.

Basically, Cruz’s economic policies do not pass the smell test. Heck, they don’t even get into the same universe as a smell test because that’s how devoid from reality it is.

How’d it go?

I think it went well but I really don’t think I Want ot work in financial services. However, it was nice going into an interview knowing that the interviewer knew about my AS so I felt more relaxed. My eye contact was solid too IMO.

Reuters reports that DAMAC properties had said it would stand by Donald Trump amid backlash from his proposal to ban Muslims from traveling to the U.S. But on Thursday the GOP presidential candidate’s name and image were removed from the “Akoya by DAMAC” site.
