GOP Sen. Sessions Says It’s “Appropriate to Discuss” Trump’s Muslim Ban

After initially making a big show of being horrified by Donald Trump’s call to ban Muslims from entering the US, conservative pundits and politicians are now executing an about-face. The talking point they seem to have settled on is that Trump’s astoundingly bigoted position is “opening a discussion” on this issue — with the implicit assumption that it’s actually worth discussing.

Call me cynical, but I thought they’d do it even sooner; I’m only surprised it’s taken them a few days to start the walk-back. Because let’s face it — bigotry, prejudice and racism are now some of the main defining characteristics of conservative ideology. Donald Trump didn’t create this; he’s simply exploiting and exacerbating a virulently xenophobic strain that’s always been there.

Here’s an example from Right Wing Watch; Alabama Republican Sen. Jeff Sessions first offers a weak caution about Trump’s ban, then proceeds to endorse it as an idea that is “appropriate to discuss.”

“Well, he’s treading on dangerous ground,” Sessions told Stephen Bannon on Breitbart News’ SiriusXM program this morning, “because Americans are so deeply committed to freedom of religion, that is a major part of who we are.”

But,” he added, “at the same time, we’re in an age that’s very dangerous and we’re seeing more and more persons enter and a lot of them have done terrorist acts and a lot of them believe it’s commanded by their religion … So I think it’s appropriate to begin to discuss this, and he has forced that discussion. We may even have a discussion about it in Judiciary Committee today. But, you know, it’s time for us to think this through and the classical, internal American religious principles I don’t think apply providing constitutional protections to persons not citizens who want to come here.”

“As a principle, we want to be not condemnatory of other people’s religion,” he continued. “And there are millions of wonderful, decent, good Muslims, hundreds of millions worldwide, and so we’ve got to be really careful that we don’t cross that line and I guess Mr. Trump has caused us all to think about it more concretely.”

Nothing exposes the fraud of the conservative “religious freedom” talking points like their support of Trump’s call to ban Muslims from the US. In their world, “religious freedom” only applies to Christianity, and only the more extreme conservative versions.

This is the same shit we’ve heard time and time again, “Yeah, it sounds bad BUT he was right to start the discussion…,” and it’s always used to excuse remarks or proposals that once would have blackballed you permanently from a career in politics. First time I can remember was when Ryan first put his “Budget” out there, that was so toxic that Republicans would not sign on to it openly, before they quietly began their “Yeah, granny-starving is bad, BUT at least he started a discussion on it…”

I’m on the young end for the Lizards (and I’ll welcome you again hatchling in a thread folks will see it in!) and haven’t seen anything else from the supposedly conservative GOP. Maybe historically they were better and it wasn’t as conflated, but as things stand now, that’s the only GOP I’ve ever known.

It’s a shame, because the two party system sort of relies on both parties being sane.

Personal responsibility is just one of those things they pay lipservice to, though. Not an actual principle they believe in.

A member of one of the groups I am a part of is running for Justice of the Peace. While she’s active in the Republican group, I would not have expected her to run. They must have convinced her to. I think that’s what the local Democrats need to start doing, not only getting people together, but encouraging members to run for offices, and telling them how.

Cruz is a potential spoiler for a Trump nomination, with Rubio a closer second. I’m of the opinion that Cruz will be the guy who wins the nomination on a “Trump-lite” platform, selling himself as being every bit as conservative but “more electable,” while Rubio will try for the VP spot as the “up-and-coming rookie.”

I find myself marveling at just how many predictions made this time last year about the course of the GOP primaries were wrong. I don’t think anybody saw Trump being taken seriously as a candidate, let alone becoming the front-runner in such a commanding fashion. Most of us assumed it would be a race to see who could be the most in-tune with the wingnut base while remaining “electable.”

It’ll be interesting to see what happens. If Trump loses Iowa (very possible), that could have an effect in the three other early contests (New Hampshire, South Carolina, Nevada). I could see that opening the door for Rubio in New Hampshire because he’d lose some of his inevitability polish. My guess is most of the candidates would drop out at that point and we’d be looking at somewhere between 3-5 candidates.

If it becomes a three man race between Rubio, Trump, and Cruz I’d figure Rubio has the best chance of capturing the most Republican primary voters who aren’t full blown crazies and are more the type who tune in every two or three years.

Some of what I’ve seen on this point is sleight of hand by RWNJs. Some will argue that the US constitution does not provide any rights to non-citizens that aren’t in the US. This is true, but besides the point.

The first amendment prohibits an establishment of religion, and it is difficult to see how a religious test in federal immigration policy does not amount to an establishment of religion. IANAL, but it really does seem this simple to me.

I had to laugh sympathetically at Steve Sailer’s notion of Trump’s Luck, which Sailer defines as “the pattern that whenever the national media announces that This Time, Trump Has Gone Too Far, the next day’s headlines will be about some outrage validating Trump’s general point.” Like so many of my fellow pundits, I have rolled my eyes at Trump all year, and figured he would be a footnote to the campaign by now. I watched his rally in Mobile this August, and could not understand why anybody would take this egotistical demagogue seriously. But here we are in December, and the man who was expected to be the GOP front runner, Jeb Bush, is in low single digits in the polls, despite all his money and GOP establishment cred, and Trump is dominating the race on the Right.

I commend to you again Noah Millman’s piece pointing out that Establishment politicians of the Left and Right are in many ways no better than Trump on the whole “fascist” thing. They just have a different way of talking about the things they do, to keep them respectable in polite society. In the end, I don’t believe that Trump is going to be the GOP nominee, and I believe that the American people will be forced to choose between a Democrat and a Republican who are the problem, not the solution. Don’t get me wrong here: Trump’s not a solution either. What his candidacy reveals, at least to me, is how little authority the US political establishment has.

Also, ethnicity (race) isn’t specified in the Constitution beyond the 15th Amendment right to vote. Subsequent protections have either been inferred via the 14th Amendment Equal Protection Clause, the 5th Amendment inferred EPA created in Boling v. Sharpe, or Congressional legislation like the Civil Rights Acts. On the other hand the 1st Amendment prohibition against government interference in religion is FAR more broad.

The provision he’s relying on is 8 U.S.C. 1182(f) which says:

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.

I haven’t actually read any case law on it. I’m not even sure there is any case law on it as it strikes me as something where there’d be a serious question of standing and whether the political question doctrine would be invoked.

Also, apparently this is something that President Obama used in Presidential Proclamation 8697, Suspension of Entry as Immigrants and Nonimmigrants of Persons Who Participate in Serious Human Rights and Humanitarian Law Violations and Other Abuses. And Carter apparently used it to bar Iranians during the hostage crisis.

That said, it may be technically constitutional, but that doesn’t make it good policy. Like the death penalty is technically constitutional (the due process clauses say no one may be deprived of life, liberty, or property without the due process of law, suggesting that some process is due that would allow one to be executed) but that doesn’t make it good policy. This is one of those spots where, from the legal perspective, it is very much a question of the details.

I work at a hotel that’s in the midst of renovations to join a major chain next year. We’ve got facilities down and banging going on into the night. But management still wants us to do everything possible to convince people to book stays. I’ve been told several times since they started working in the lobby to keep wiping down the front desk religiously, because they seem to think that what will turn people off is drywall dust on the desk and not the fact that half the lobby is currently demoed down to the wall frames.

Perhaps, I’d have to read up on Everson. But then the question becomes whether someone outside the United States could have standing to sue in order to strike down the ban. There’s probably a few hundred legal questions that would have to be raised and sorted out on something like this - to the point where I would posit if a newly inaugurated president were to issue a proclamation like this, it might not be resolved until his first term expired (I could literally see this going up and down from District Court to Court of Appeal to Supreme Court and back again and forth again multiple times).

That does not account for women not allowed in uniform, slaves, loyalists, disabled men, the very young and those too old to be in the army…not to mention the freaking militia which held just about every other able bodied male citizen in many areas and which was often called out to fight.

In actuality, between the militia and the Continental Army, just about every patriot who could bear arms was serving in some capacity and many who could not have stood the physical challenges of the Continental Army did great service in the militia. In truth, young men who could fight full time were just about fished out in most areas of the colonies.

And of course, those types of provisions are always subject to abuse. I don’t see why it would necessarily have to be someone outside the US. A citizen could sue when their family is denied entry on a religious basis, a spouse possibly under an alienation of affection tort.

Outside of legal challenges, any number of organizations could invite Malala Yousafzai to speak here in the US and point out the absolute absurdity that Trump’s proposal would bar someone like her from entry.

It’s a question of standing. You only have standing to sue if you’re injured or could potentially be injured. That’s why I’m assuming it’d have to be someone outside the US. One interesting way might be using the Alien Tort Act to establish jurisdiction.

The nonlegal challenges like you suggest would be great for the court of public opinion. But I’m not sure President Donald Trump (those might be the three most terrifying words in the English language) would give a shit about public opinion.

Still, my guess is that Syrian Kurds will take a similar position as Iraqi Kurds and agitate for an independent Kurdistan. And that’s going to be a problem for Turkey, Iraq, Iran, and whatever comes of this Syrian conference. I guess it comes down to the old saying - a journey of a thousand miles begins with a single step.

Then it was supposed to be on Saturday. Saturday afternoon and it still wasn’t on the truck.

It arrived Monday afternoon, dry ice all gone, food visibly thawed in several cases. It hurt so much to have to toss that, but couldn’t be sure it was safe to eat any more. Props to the company, full refund and free shipping on the next order, for what was FedEx’s screw up through and through.

However, officers were told that Bartelt “was already seeking medical assistance” when they arrived at his home.

The whole ‘94 million unemployed!’ thing is just because it’s the only statistic they can use that seems to be going their way.
