I was wondering what the deal was with throwing the pennies and found this:

Montana resident Ryan Payne, an associate of Bundy’s and who participated in the standoff with federal officials at the Bundy Ranch, said Wednesday he hoped the Hammonds will reconsider and accept “protection.”

“They’re not in prison yet,” Payne said.

Payne said he expected “a lot” protesters Saturday. Organizers have asked protesters to bring pennies, nickels and dimes to toss at a county office building to symbolize how county authorities have “sold out” the Hammonds by not offering refuge.

Ah, this helps things make sense:

The Hammonds originally received much shorter sentences from a U.S. District Court judge, who said the mandatory minimum sentence of five years was far too long. The lenient sentences, however, were overturned by the U.S. 9th Circuit Court of Appeals, leading to the Hammonds’ resentencing.

So the “resentencing” business is the 9th Court overturning a District Court judge’s ruling that was based upon personal opinion rather than the letter of the law.

You have to remember that, in the wingnut mind, they have the ability to differentiate between federal and state/local government when it suits them. It’s the federal government who are “railroading” the Hammonds, so the militia nutters have thus convinced themselves that the local government could flip off the feds and offer “sanctuary” to the Hammonds from federal law.

There’s a legit point buried under all that hot mess though, mandatory minimums completely do away with judicial discretion, which at least used to be a valuable tool in mitigating prosecutorial overreach. It doesn’t sound like the Hammonds are the most deserving recipients for leniency, and local corruption may well be at the root of the district court judge’s decision in this case, but minimum sentencing is also why we have such an appallingly high rate of incarceration.

Yes, but a lot of these militia folks are completely for mandatory minimums when applied to the “wrong” sort of people.

For what it is worth, I have a small amount of respect for the Hammonds because it sounds like they’re willing to serve their time and likely proceed with the appeal in the correct way of things, and have asked the militias to go away. I would agree that mandatory minimums are a horrible thing - but the judicial branch has to follow the law until the law is changed, which is why the prosecutors had to appeal. Failure to do so would have caused a mess in other cases down the road, because this isn’t something that can be decided on the district level but would ultimately be up to either lawmakers or the Supreme Court.

If they want to start the ball rolling while serving out their time, that’s great. Let’s look at them for the drug laws, etc. too while we’re at it.

According to Mexican news reports, Benitez represented former Tijuana Mayor Jorge Hank Rhon when he was arrested on weapons charges. Guns found inside Rhon’s home were linked to several murders, authorities said.
Rhon argued that police never had a search warrant to search the house so everything they found was inadmissible in court, and according to the reports, a judge agreed and the charges were dropped.

Asked Friday if Benitez was the same attorney who represented Rhon, he said, “Yes, I had the privilege of representing Mr. Hank in 2011, with good results.”
In 2014, Benitez also represented U.S. Marine Sgt. Andrew Tahmooressi, arrested for crossing the border into Mexico with three weapons in his truck. After 214 days in jail, prosecutors dropped the charges and he was freed.

My latest photo on Flickr is actually quite a personal one:

My husband, Dave.

This has been in a strange way, the best Christmas we’ve had together. About 10 weeks ago, he phoned me, saying he had breathing trouble. A couple of days later he was in the Doctor’s being prescribed medicine for heart problems.

A couple of weeks later, he had an angiogram, and was told: you have heart problems: it looks like a bypass or stent.

We had a check couple weeks later, and were told: It’s a bypass. 4-6 weeks before we tell you.

Next day: You’re in next Tuesday. We’re thinking: what the hell? One week later, I’m saying hello to my husband, as he’s in the intensive care hours after the operation. We’re both dazed, both not there, thinking “Did we just dodge a bullet, without thinking about it?”

And so, he we are weeks later, in a cafe, just going off to meet in-laws for a post Christmas meal. The post Christmas milleu is around us in this cafe. But somehow it doesn’t matter. We have each other, and that’s the best Christmas present.
