Constitutional Law Professor: Ted Cruz Is Not Eligible to Be President

This isn’t “birtherism,” because Cruz really wasn’t born in the US

Some people are referring to the debate about Ted Cruz’s eligibility as “Cruz birtherism,” and there’s no doubt that the most visible person advancing the argument is Donald Trump — a notorious Birther who built his right wing base by pandering to the conspiracy theorists who believe President Obama is a secret Muslim non-citizen.

But there’s a crucial difference in the case of Ted Cruz that makes the conspiracy-flavored term “birtherism” inaccurate.

It’s an ineluctable fact that Ted Cruz was born in Canada, not the United States; and in today’s Washington Post constitutional law professor Mary Brigid McManamon makes a pretty good argument that this means Cruz is not eligible to be president.

Donald Trump is actually right about something: Sen. Ted Cruz (R-Tex.) is not a natural-born citizen and therefore is not eligible to be president or vice president of the United States.

The Constitution provides that “No person except a natural born Citizen . . . shall be eligible to the Office of President.” The concept of “natural born” comes from common law, and it is that law the Supreme Court has said we must turn to for the concept’s definition. On this subject, common law is clear and unambiguous. The 18th-century English jurist William Blackstone, the preeminent authority on it, declared natural-born citizens are “such as are born within the dominions of the crown of England,” while aliens are “such as are born out of it.” The key to this division is the assumption of allegiance to one’s country of birth. The Americans who drafted the Constitution adopted this principle for the United States. James Madison, known as the “father of the Constitution,” stated, “It is an established maxim that birth is a criterion of allegiance. . . . [And] place is the most certain criterion; it is what applies in the United States.”

Note that I’m not endorsing this argument, but it’s pretty delicious to see the right wing obsession with birth certificates coming back to bite them in the nether regions.

“Judge” Bruce Doucette:

At a meeting on Oct. 6, Marsh told a group of residents that he had come to the county to help solve their problems. “Sometimes the solutions come easy, through negotiations, sometimes they come a little rough. Everybody knows about the Bundy Ranch and the stuff that happened there. We need to try to avoid those types of situations, but at the same time you have to stand up for your constitutional rights,” he told the crowd during the video-recorded meeting.

He said a “superior court judge” had called him and offered help, telling him that the county was violating the newcomers’ constitutional rights.

Residents came to a meeting where the judge was supposed to speak, thinking that maybe they could get some help from the legal system, said Alex Ansary, a video blogger who lives off the grid in Costilla County.

“Instead of any judge being present, he whips out a phone, and there was someone on the phone” who told the crowd that county officials weren’t legally holding office.

That person identified himself as Bruce Doucette, a Denver resident who has never been to law school or been appointed to a state, county or federal judgeship. “I’m a very honest man with a lot of integrity, also very educated,” he told The Denver Post. “I wouldn’t credit any institution for the knowledge I have,” he said.

Asked for documentation of his judicial position, he referred to an official-looking oath of office posted on his Facebook page.

“I am the warrior protector for those who know not how to speak of the crimes against them,” read the document, labeled the oath of a superior court judge of the continental United States.

Doucette did come to a later meeting, at which videotaping was not allowed. Ansary, who had already raised concerns among residents about Marsh, left the meeting after objecting to that stipulation.

If GOPers want to make the argument that Cruz is ineligible to be President, that’s their right. I think he’s eligible as being a child of US citizens and the federal law is pretty clear on this despite the professor’s inclination to suggest that anyone born outside the US, despite being a child of US citizens would not be natural born.

I consider it karma that since GOPers went bugnuts over Obama’s citizenship, that they are now circling (and soon to be feasting on) one of the most despised GOPers around in Ted Cruz. “The child of an alien, if born in the country, is as much a citizen as the natural born child of a citizen, and by operation of the same principle.” United States v. Wong Kim Ark, 169 U.S. 649 (March 28, 1898).

Ironically this is the sentence from the Supreme Court case cited that contains the term “natural born.”

US Boats could easily have been at fault no way to really know and not likely either side will admit fault and as it appears that everyone was smart enough not to escalate that this will be a nothing burger as long as it is an isolated incident. Odds are that the Iranians are going to claim that the US boats (and I’m figuring that they’re small water craft, like dingys or semi rigid small boats) were somehow in Iranian waters, while the US would claim that they were international waters. With the Persian Gulf being as narrow as it is - especially in the Strait of Hormuz, it’s conceivable that the Navy could say that they were in international waters while the Iranians say otherwise, all over the difference of a few yards.

No doubt the GOP will expect the worst, and deliver the worst based on this news.

According to Sky News, which is the only report I could find that wasn’t hyperventilating over it, the boats were en route from Kuwait to Bahrain. That wouldn’t involve the Strait of Hormuz, so at present it’s not clear to me how Iranian maritime boundaries could be involved since both Kuwait & Bahrain are on the western side of the Persian Gulf.

The GOP will no doubt pounce on it and blow whatever happened all out of proportion.

As for the subject of this thread, as one Lizard posted (and for some reason I can’t find his or her page), it really isn’t that hard to know what a natural born citizen is. It is a citizen at birth. If someone was born abroad, they are still natural born citizens as long as at least one parent was a US citizen at the time of birth. This is why John McCain is a natural born citizen, it is why Barack Obama would still be a natural born citizen had he actually been born in Kenya, and it’s why Ted Cruz is a natural born citizen.

The professor quoted in this story is flat out wrong. It is impossible to be a US citizen at birth without also being a natural born citizen.

I’m seeing reports that the incident took place in the waters off the Farsi Islands, which are Iranian and located in the central Persian Gulf. Extending the territorial waters 12 miles claim means that Iran controls a chunk of the Gulf waters right in the middle of the route being suggested.

Also, it appears that there were mechanical issues with one of the two boats that were on a training mission, and the Iranians are operating per laws of the seas and everyone’s acting professionally, which means that the right wingers are bloviating bugnuts (as per usual).

A couple years back I’d see him on some of the now gone MSNBC shows. He always made the most cumbersome points about the topics they asked him to cover.

So many times it just seemed like he was one of those types of people that see their own quirky take on things being some kind of profound enlightenment. For some that is the case. For Siorta he never seem to catch on he wasn’t being seen as all that smart.

Haven’t seen him since, so I am guessing he didn’t get good reviews and MSNBC dropped him as one of their guest analysts.

I did a page about this the other day. You’re either a citizen at birth (a natural born citizen) or you’re a naturalized citizen. While the Fourteenth Amendment says that persons born in the US and subject to the jurisdiction thereof are natural born citizens, Congress has includes several other people in the definition by making them citizens at birth. And yes, Congress can do that because it is one of their powers listed in Article I, Section 8.

So, I am off the reservation (uni campus) for a month beginning yesterday. And I’ve discovered that the troubles I’ve had using LGF with my cellphone are not the fault of the Great Firewall of China, but the crappy PPPoE connection at school. Maybe it’s time to invest in a China Mobile wifi plan.

When I get back. I’ll be in Hong Kong later today, and Kuala lumpur tomorrow. Warm weather, here I come!

Wong Kim Ark most children born overseas to American citizen parents would not qualify as natural born. That being said, I think the electors can vote for whoever they like and use their own judgment as to what “natural born” means, and no court can reverse their decision. Karma’s a bitch, Ted.

That’s not really true. To my knowledge, WKA doesn’t attempt to provide an overall definition of NBC, it merely says that the subject of the case was a citizen by birth, and thus not subject to the Chinese Exclusion Act.

WKA simply does not pertain to children of citizens born overseas though. Cruz’s NBC status is based on the Naturalization Act.

They talk about a lot, but the actual ruling is pretty narrow, and does not contain an overarching definition of NBC. It manly just says that WKA (or someone else in his poosition) is a citizen at birth. They were answering a specific question, not a general one.

Justice Gray seems to have fallen prey to the Fallacy of the Excluded Middle, a classic logical fallacy. There’s no reason whatsoever to think that Congress’s Article 1 Section 8 power “to establish an uniform Rule of Naturalization,” somehow excludes the ability to determine who is and who is not “natural born.” The Naturalization Acts, as amended, do in fact cover Cruz rather explicitly.

In fact the reason that the 14th Amendment jus solis citizenship clause was necessary was fears that a future Congress might limit the NBC as it related to black Americans. However nothing about 14th Amendment jus solis clause prevents Congress exercising its delegated authority to expand NBC beyond jus solis.
