Ted Cruz Lies Again: Supreme Court Might ‘Strike Down the 2nd Amendment’ if Democrats Win

More fear-mongering untruths from Cruz
Politics • Views: 42,300

YouTube

Interviewed by right wing activist Michael Quinn Sullivan last week, Ted Cruz said, “Every justice I put on the court will be a principled conservative jurist.”

Then Cruz blatantly lied once again to conservative voters:

We are one justice away from the Supreme Court striking down the Second Amendment, ruling that no individual American has any right whatsoever to keep and bear arms, we are one justice away from that. We are one justice away from the Supreme Court striking down Ten Commandments monuments all over the United States, just like the one we have in front of the Texas State Capitol that I was proud to stand with Greg Abbott, defend before the Supreme Court and win 5-4 upholding it.

This febrile right wing doomsday scenario is complete nonsense. Constitutional amendments are part of the US constitution and can’t be “struck down” by the Supreme Court. SCOTUS can only strike down legislation that’s deemed unconstitutional, and a constitutional amendment is by definition constitutional. If you believe the conventional wisdom that Cruz is a smart guy (I’m not sure I do), he has to know this.

It’s just one more blatant horrible fear-mongering lie from a Republican candidate who specializes in them. Wait, come to think of it… all the Republican candidates specialize in lying, don’t they?

The Court could return to the traditional understanding of the Second Amendment before its recent rulings. That is, that it does not confer an individual right to keep and bear arms and it does not apply to state gun control laws. Which, when one reads what the Second Amendment actually says, is how its supposed to be applied.

We are one SC justice away from reinterpreting the 2nd Amendment to revise its application to individuals having nearly unlimited access to all the firepower they can afford?

It is truly the End Times!!!

Even more bat-crap insane is that Cruz attended Harvard Law School. He should know better, but has decided that his abject lies and misinformation suits his goal of scaring people into voting for him, or making people wary to vote for anyone else. (Of course, all the rest of the GOP are running with a variation of this line too - many of whom are lawyers or are politicians who supposedly keep copies of the constitution in their pocket).

That said, the Supreme Court gets to interpret the words and meanings of the various phrases and statements in the Constitution and the Amendments. They could decide to give more or less weight to say “a well regulated militia”. Or that “firearm” applies only to smoothbore muskets versus an AR-15.

Cruz worries that the next president might get to pick justices who don’t see the world like he does - through a theocratic prism of crazy. He worries that the next president might pick pragmatic justices to the court who would continue to affirm Roe, or might enable the overturn of Citizens United. Or continue to affirm the CRA and VRA.

Still, the justices can’t do this by themselves - a case has to be brought on the issue. And the Court gets to control what cases it hears and then it further decides the scope of the case being heard - typically because there’s a split among the circuits.

The Court can’t simply decide that the 2A doesn’t exist anymore. That’s not how it works.

Upholding gun control legislation is not striking down the Second Amendment. That shouldn’t be difficult for someone who took three weeks worth of constitutional law in law school to understand.

I really want someone to ask and then press these idiots on a line of questions like this:

Do you believe the Second Amendment allows an ordinary person to own RPGs? If not, are you then admitting that there are reasonable restrictions that can be placed on owning weapons? Do you believe that bans on fully automatic weapons are constitutional? If so, why? If you do believe that an ordinary person can own RPGs, what else can they own? Tanks? F-16s?

Everything is a slippery slope to these clowns. ANY limits on ANYONE obtaining ANY firearm they want is TYRANNY!, because that means one day EVERY gun will be taken from EVERY American EVERYWHERE!

And the crazy thing is, if anything their gun rights have EXPANDED over the last 7 years. But crazy, by definition, is unalterable by reason.

Oh, and let’s play the originalist/contextualist game too.

If a founding father only had access to smoothbore muskets, some single shot rifles, and single or dual action handguns, then all current firearms that don’t meet those qualifications are not what the Founders envisioned.

After all, the Founders didn’t think individuals should own cannons or warships or anything heavier than they could normally carry. And they thought of a well regulated militia, not everyone and their crazy uncle running with a cache of AR-15s, shotguns, and thousands upon thousands of rounds of ammo.

Politically, he’s probably correct. Lies piss off liberals, so Republicans now approve of lies. The bigger the better.

Mmmmm…not so sure.

Individuals did have access to cannons (artillery caissons and carriages were hidden in private barns during the abortive English attacks on Concord and Lexington) and various semi-private militias had means to acquire artillery. Individuals can still own black powder firing smoothbore artillery (our unit has a couple pieces) and I have seen Civil War units with more advanced Parrott rifled cannons.

The Founders absolutely had some idea that firearms would continue to become more advanced, more accurate and fire at greater speed. The famous Ferguson Rifle used by British troops at Kings Mountain in SC could fire an astonishing 6 to 8 aimed rounds a minute (and this was a flintlock weapon!!!!!!) as it used an innovative breech loading design. Captured Revolutionary War Fergusons were still in use by Confederate soldiers at the beginning of the Civil War.

What the Founders did not and could not anticipate was the profound dissolution in community social ties that came with industrialization which eventually led to the beginning of the mass shooter phenomenon.

HappyWarrior  Feb 12, 2016 • 11:39:15am

Time and time again we see this tactic. Guns not only do not get banned in Democratic administrations but their ownership increases. It’s yet another example of the sleazy shit the Republican Party will resort to convince gun owners to vote for them.

Pardon me while I pick a nit. “Homeschooled” does not automatically mean “Religious Homeschooled”.

While homeschooling the Older Boy, for whom no proper school really existed, Mrs. FBW found that Homeschoolers break down largely into two groups - Bible Bangers and Bean Sprouts (like us).

The latter were often credentialed teachers themselves ( like Mrs. FBW) who were dissatisfied with what the public schools provide, and/or have children for whom public school would have meant being consigned to a “Special” class comprised of children who wouldn’t fare well in regular classes - often just a place to put them that got them out of the way*.

I know you mean ‘Homeschooled’ as shorthand for the Bible Banger type, but it does bother me a bit to find my family classed with people who are polar opposites of us.

*The Older Boy was briefly put in one of those, when he reached High School age. He is exceptionally bright, but they put him in a class where everyone else was normal IQ or lower, where most of the class were Emotionally Disturbed, and the whole thing was about CONTROL. When he was unable to fit into that class, the next one they suggested was for kids who were behavioral problems - the Hoodlum Class, as I called it. We pulled him back out, and homeschooled him. He passed his GEDs with scores all in excess of the 92nd percentile, despite little formal instruction.

Cruz should also not be boasting about winning a 10 commandments case by a 5-4 vote at SCOTUS.

He had 4 votes on his side just for this case being a RWNJ hobby horse, and all he needed to do was find a way to convince Justice Kennedy. That couldn’t have been difficult, since Justice Kennedy is pretty much a RWNJ with two strange exceptions —- he’s good on gay rights issues, and he won’t give a 5th vote to overturn Roe.

Cruz is reviled because he uses self-serving tactics to paint his colleagues as RINOs and himself as the only trooo conservative in the Senate, not because of his extreme politics. Rubio is virtually as conservative as Cruz, but he isn’t as big an asshole about it. Though one reason the establishment hasn’t rushed to anoint him as the GOP savior is that he is a self-entitled prick.

To amplify this point a bit, there is no crazy nonsense from Cruz or Trump that is a show-stopper for the GOP establishment on policy grounds.

Their main objection to Trump and Cruz is that they think Trump or Cruz will lose a winnable general electron for the GOP.

edited to add: Secondary issues are lack of control over Trump, and Cruz’ remarkable level of assholishness, even for a Republican.

While homeschooling the Older Boy, for whom no proper school really existed, Mrs. FBW found that Homeschoolers break down largely into two groups - Bible Bangers and Bean Sprouts (like us).

I confess, I was home schooled for a year (5th grade) and it was great! Our family was planning to move to Mexico and my parents wanted to ensure continuity of our schooling for the year of transition. My parents were well educated and the public schools in our district in Florida sucked, so it was a big improvement. We used a correspondence school for educational materials and testing so they did not just wing it. The curriculum included art history which I loved and would certainly not have been exposed to in our school system. I was able to finish all of my work in just a couple of hours a day———yay, more time to play piano and do other creative stuff!

To amplify this point a bit, there is no crazy nonsense from Cruz or Trump that is a show-stopper for the GOP establishment on policy grounds.

Their only objection to Trump and Cruz is that they think Trump or Cruz will lose a winnable general electron for the GOP.

They also don’t like that Trump promised to protect social security and medicare from cuts. The donor class really really wants to gut those programs.

re: #71 Big Beautiful Door

Cruz is reviled because he uses self-serving tactics to paint his colleagues as RINOs and himself as the only trooo conservative in the Senate, not because of his extreme politics. Rubio is virtually as conservative as Cruz, but he isn’t as big an asshole about it. Though one reason the establishment hasn’t rushed to anoint him as the GOP savior is that he is a self-entitled prick.

I think that self entitlement is why Rubio has flopped. I’ve felt the establishment while many were lining up their bets on him wasn’t totally sold. I think Rubio’s probably played himself out of a chance to be on the ticket this year if ever. I remember it was assumed that Romney would pick him and he chose Ryan. Perhaps his guys found something on Rubio that they thought would really screw them. I mean Ryan did have the obnoxious Ayn Rand love for sure but nothing that stank the Romney campaign. Ryan didn’t sink Camp Romney like Palin did Camp McCain. I don’t think he helped mind you but I don’t think Ryan was a huge liability for Romney.

re: #54 Blind Frog Belly White

Pardon me while I pick a nit. “Homeschooled” does not automatically mean “Religious Homeschooled”.

While homeschooling the Older Boy, for whom no proper school really existed, Mrs. FBW found that Homeschoolers break down largely into two groups - Bible Bangers and Bean Sprouts (like us).

The latter were often credentialed teachers themselves ( like Mrs. FBW) who were dissatisfied with what the public schools provide, and/or have children for who public school would have meant being consigned to a “Special” class comprised of children who wouldn’t fare well in regular classes - often just a place to put them that got them out of the way*.

Good point, when I was referring to “Homeschoolers” I was thinking specifically of the DON’T TAINTE ARE PRESHUSS CHILDERNS ICE CREAMS FLUIDS WITH TEH EVOLUSHUNS & TEH COMMUNST SOSHUL STUDIES & TEH COMMON COAR ARITHMETIKS!!!1!!!!

GRRR…

Drudge touts new poll claiming that Trump is dominating others in the Latino vote.

It links to the Daily Beast, but now comes the tricky bit. Where’s the poll with all this information?

Well, click through the Beast’s “link” and it takes you to Hoft’s site, which then goes to the NY Post. Still no sign of the actual poll, let alone all the metrics that can help determine just how legitimate the poll is.

Oh, and the Beast’s article identifies the crux of the problem for Trump and the GOP - 80% of Latinos are voting Democrat, so he’s picking up only at best a 1/3 share of the remaining 20%. And with basic math - that amounts to Democrats maintaining about 80% and Trump gaining about 7%.

Yeah, yuge. No doubt he’ll tout this poll just as surely as he touted the others claiming 40% of blacks love him, when the poll had all of 10 black people. Or the other poll that freetoken identified earlier.

Depends on turnout. According to 538’s fun little toy, if turnout remains the same, the Latino vote going to 80% is enough to swing North Carolina back to the Dems, but that’s it. If turnout jumped up to 66% (which is the same as black turnout) and went 80% to the Dems, Texas and Arizona become purple states, but still stay in the GOP column.

Hm. I think that with the engaged Latino electorate this year, you may be right, although Texas voted for Cruz during the Tea Party tidal wave, so that may be an aberration. For a senator or governor, I think they’d be fine with that. But so much race-hatred has been stirred up with the Bubbas over the past 8 years that I don’t think that having anyone darker than a paper bag atop the GOP ticket will get out the vote. My rules generally been the exact opposite - see Terminator and T2 - but I think comedies suck at sequels. It’s because they have to work harder in the second one, which defeats the purpose of comedy.

Comedy sequels being something to avoid is a good rule. I didn’t hate Dumb and Dumber Too but it wasn’t as fun. Ditto Anchorman. I guess my two rules would be, waiting over a decade is foolish and comedy sequels should be avoided.

I was thinking the same. I don’t mind the first Terminator but T2 was great. I liked Arnold better as the Termiantor that has to save John and Sarah Connor rather than the one trying to kill them as in T1. And Robert Patrick as the T-1000 was intimidating as hell.

So apparently the new Zoolander is just awful. Leonard Maltin said it was the first film he’s ever walked out of before it finished and my brother said it makes you want to punch the screen.

Even though it’s not January anymore, it was released in a very “Fuck You It’s January” way. The studio probably knew it was garbage so it gets released early in the year, at the same time a something that will blow it away at the box office (Deadpool) so it can be safely ignored and written off, or they can blame Deadpool for it.

Poking around that link, I found the source of the bullshit claim that the parents faced up to 20 years for late paperwork. The parents, who are nameless to inhibit the curious, may be charged with :

“The criminal charge is ‘contributing to the delinquency of a minor,’ a first-degree misdemeanor with a maximum penalty of up to $1,000 in fines and up to six months in the county jail,” Kamadawiwoole informed. “Each day that a child is ‘truant’ can be considered a separate offense.”

Misdemeanor truancy!!! Potentially a maximum 6 months (virtually never actually imposed) X theoretically 1 charge be day out of school + consecutive sentences very rarely imposed = 20 fucking years!!!!!!

Salvation was, to me at least, the closest we’re ever going to get to a film set post-Judgement Day. Ever other movie is just largely following on the same script as the first two: “We’ve gotta stop Judgement Day in an increasingly convoluted fashion since we’re fast approaching the point where the long war against machines ending in 2029 makes no sense.”

Well, to be fair, the Terminator films were just in the same root as scifi going all the way back to RUR in the 1920s. If we could create sentient machines tomorrow, would we see them as equals…or would we view them as just slightly smarter ways of doing all those tasks we don’t want to do ourselves? Sentient, or rather Sapient, Self-Aware, Imaginative, Emotional, Conscious machines are not needed to do meanial tasks we don’t like to. AI doesn’t have to equate to “machine life”. The second a machine is made that is along the lines of Data, it should be considered a person not a thing.

We don’t have to make Datas or Bishops or Davids or Johnny 5s to do things we might need really smart machines for.

So the Pope met with the disgusting and corrupt scumbag, the Russian Patriarch, and they issued a lengthy statement together. Which of course had to include this (unedited google translation):

The family based on marriage as an act of free and faithful love between a man and a woman. Love strengthens their union, teaches them to accept each other as a gift. Marriage - is the school of love and fidelity. We regret that other forms of cohabitation is now equated with the Union, and hallowed tradition of the biblical notions of fatherhood and motherhood as a special vocation of man and woman in marriage are forced out of the public consciousness.

Yeah, fuck Francis.

Politics is everywhere in a big Presidential election. I’ve mentioned I am an auto race fan. Sometimes I check out racing forums to see what is going on in the sport.

Saw these images in a thread at an Indycar racing forum. There was a thread discussing political ads on race cars. Just as expected, some for, some against and one saying Trump is a ‘man of the people’. I agree. But we need to determine which people he is the man of. 1% of the people…maybe.

Meanwhile, in the “Kansas, What’s the Matter With” File:

The Kansas Supreme Court on Thursday gave the state until June 30 to enact an “equitable” school funding formula or, it said, the state’s public schools won’t open for the 2016-2017 school year.

In its ruling, the court said that if a formula isn’t in place by then, the court will decide that “no constitutionally valid school finance system exists.”

“Without a constitutionally equitable school finance system, the schools in Kansas will be unable to operate beyond June 30,” the Supreme Court said.

And you can bet that Sam Brownback would find his way into a Republican administration.

I like some of his ideas, and think we’ve let shit get so bad in America that we need some of them, but nothing has turned me off of Bernie Sanders faster than his supporters and the people running his campaign. All the Bernie Bots and Bernie Bros I just can’t take their bullshit anymore. They are like if you took all Ron Paul kooks, and spun them to the left and there you go.

At a meeting this morning, one of them was boasting about a volunteer who sold blood to get enough money to go to Iowa to work. Yuck. And, as I mentioned earlier, at a meeting last week, one the Berniacs went up to a young man who was a Hillary intern, got in his face, and said, “You’re working for the wrong candidate.”

They try to MBF it, but I have not seen any Hillary supporters who act like that. (Now, I do know one who was working a phone bank and when the person said he was voting for Bernie, the phone banker wrote “asshole” on the sheet, but she didn’t say it to him. Plus, I’m not certain if she thought he was an asshole for voting for Bernie or just in general.)/

Speaking of Nazis and socialists, here’s a 1930 article by Otto Strasser “The Socialists leave the NSDAP”. It’s basically a manifesto explaining in which ways NSDAP has betrayed socialism and is no longer socialist:

ns-archiv.de

Strasser’s and his comrades’ notion of national socialism included support of the Indian struggle against the British imperialism (as well as rejection of any form of imperialism, German or otherwise), refusal to support war against Russia, but at the same time rejection of Marxism as a false form of socialism.

The inner struggles of the NSDAP are quite interesting. You had the Stresserites who took the socialist in National Socialist literally and then what became the dominant force that didn’t and was fine with having industrialists like the Krupps influence the party. Nazism and fascism did differ from traditional European conservatism. Of course traditional European conservatism of that era was an absolute monarchy and all power to the church.

The low-down on Hitler and other Nazi leaders. This is one of many sets of lyrics for the classic “Colonel Bogey” march.

Hitler Has Only Got One Ball

Hitler has only got one ball,
Goering has two but very small,
Himmler has something sim’lar,
While Goebbels has no balls at all.

At least your better half won’t feel anything-but you will have to put up with some incredibly long and loud flatuence unless the surgeon degasses the missus as he respools the scope.

The farting is my favorite part! I’d ask my wife if it was also her favorite part, but at the moment she’s indisposed. ;-)

Yeah, he’s doing the classic defiant/angry thug stare for the camera. It looks exactly the same, regardless of the ethnicity of the wearer. *smh*

I better start stocking up. Prices are going to jump with all the demand. So much derp, so little time.

re: #251 Charles Johnson

Not at all. It would have meant a return to the original spirit of the 2nd Amendment; that the right to keep and bear arms was limited to “a well regulated militia.” That’s not even close to being “struck down.”

Sorry to be late with this reply but did want to take care-

What use was the 2nd to a person living in DC before Heller? None right? Or if there were a militia DC citizens could join-? So if militia is what it must be… How do you do that with unarmed unpracticed people? But wait who wants more militias anyway?

It’s a long argued point about what well regulated militia means today in the 2nd. Obviously I admit we disagree there. This militia of which we speak does not exist. Bit of a red flag there. To say the militia requirement is where the argument ends is using the amendment to uphold gun bans. I’d say that’s opposite of the obvious intent of the words “the right of the people to keep and bear Arms, shall not be infringed.” One can choose to emphasize either portion, and it seems everyone who cares at all has done exactly that. So again we agree to disagree there IIRC.

In my not uncommon view a fair interpretation of the amendment includes allowing law abiding people to hunt with a gun, or defend themselves at least at home and their own workplace (upheld by SCOTUS circa late 1800’s). Of course the laws limiting who may possess and what kind of gun may be possessed have been upheld many times now.

If anyone can stand another 10 minutes of Bundy/militia derp, here is a little schadenfreude aperitif. The current reaction to the FBI/DoJ work of the last few days is an outburst of paranoia that peaks with the rumor of “68 pending warrants”. The story originates with the Oathkeepers, and includes proposed arrests of doofi from 2014 Bundy, the minor gold miners action, and Fort Dildo. Note this YouTube bard, Dahboo 77, really wants Blaine Cooper to be a Fed.

E gad, let’s hope so. That day has lots of symbolism for the far-right lunatic fringe. It’s the date of the OKC bombing in 1995, which was itself timed to fall on the 2nd anniversary of the deadly Branch Davidian fire in Waco.

I guess Nuge was fine when he was telling people ot suck his gun and calling Black people animals but the second he shatters the illusion that the conservative movement’s hollow support of Jews, it’s time to go. Fuck them and their insincere bullshit. Not that I condone what Nugent says at all of course but I’m tired of NRO acting outraged over right wingers doing stuff that they had no problem with. What’s next NRO? Ted Nugent is actually more of a progressive that makes the pathetic movement that your racist founder helped start look bad?

You know what? Every time I see those militia guys standing in the beds of their pick-ups waving flags, I’m reminded of Da’esh, which in turn reminds me of Mad Max (believe it or not, I’ve never actually seen the movie—gonna have to rectify that).

Creepy similarity. *shudder*

It would be fun, but I’m not sure if worth a trip to Charlotte or Charleston. But I do think that Donna Rose might be the cutest babby evah!!

Loved this line:

I was also jealous — of my own daughter — that she had made her debut on the pundit circuit before me. She is eight months old! I have been doing dick jokes about politics for TWENTY-ONE YEARS. Only one of us can actually say words with her mouth, and it’s not the baby!
