Interviewed by right wing activist Michael Quinn Sullivan last week, Ted Cruz said, “Every justice I put on the court will be a principled conservative jurist.”

Then Cruz blatantly lied once again to conservative voters:

We are one justice away from the Supreme Court striking down the Second Amendment, ruling that no individual American has any right whatsoever to keep and bear arms, we are one justice away from that. We are one justice away from the Supreme Court striking down Ten Commandments monuments all over the United States, just like the one we have in front of the Texas State Capitol that I was proud to stand with Greg Abbott, defend before the Supreme Court and win 5-4 upholding it.

This febrile right wing doomsday scenario is complete nonsense. Constitutional amendments are part of the US constitution and can’t be “struck down” by the Supreme Court. SCOTUS can only strike down legislation that’s deemed unconstitutional, and a constitutional amendment is by definition constitutional. If you believe the conventional wisdom that Cruz is a smart guy (I’m not sure I do), he has to know this.

It’s just one more blatant horrible fear-mongering lie from a Republican candidate who specializes in them. Wait, come to think of it… all the Republican candidates specialize in lying, don’t they?

The Court could return to the traditional understanding of the Second Amendment before its recent rulings. That is, that it does not confer an individual right to keep and bear arms and it does not apply to state gun control laws. Which, when one reads what the Second Amendment actually says, is how its supposed to be applied.

Even more bat-crap insane is that Cruz attended Harvard Law School. He should know better, but has decided that his abject lies and misinformation suits his goal of scaring people into voting for him, or making people wary to vote for anyone else. (Of course, all the rest of the GOP are running with a variation of this line too - many of whom are lawyers or are politicians who supposedly keep copies of the constitution in their pocket).

That said, the Supreme Court gets to interpret the words and meanings of the various phrases and statements in the Constitution and the Amendments. They could decide to give more or less weight to say “a well regulated militia”. Or that “firearm” applies only to smoothbore muskets versus an AR-15.

Cruz worries that the next president might get to pick justices who don’t see the world like he does - through a theocratic prism of crazy. He worries that the next president might pick pragmatic justices to the court who would continue to affirm Roe, or might enable the overturn of Citizens United. Or continue to affirm the CRA and VRA.

Still, the justices can’t do this by themselves - a case has to be brought on the issue. And the Court gets to control what cases it hears and then it further decides the scope of the case being heard - typically because there’s a split among the circuits.

The Court can’t simply decide that the 2A doesn’t exist anymore. That’s not how it works.

Individuals did have access to cannons (artillery caissons and carriages were hidden in private barns during the abortive English attacks on Concord and Lexington) and various semi-private militias had means to acquire artillery. Individuals can still own black powder firing smoothbore artillery (our unit has a couple pieces) and I have seen Civil War units with more advanced Parrott rifled cannons.

The Founders absolutely had some idea that firearms would continue to become more advanced, more accurate and fire at greater speed. The famous Ferguson Rifle used by British troops at Kings Mountain in SC could fire an astonishing 6 to 8 aimed rounds a minute (and this was a flintlock weapon!!!!!!) as it used an innovative breech loading design. Captured Revolutionary War Fergusons were still in use by Confederate soldiers at the beginning of the Civil War.

What the Founders did not and could not anticipate was the profound dissolution in community social ties that came with industrialization which eventually led to the beginning of the mass shooter phenomenon.

Pardon me while I pick a nit. “Homeschooled” does not automatically mean “Religious Homeschooled”.

While homeschooling the Older Boy, for whom no proper school really existed, Mrs. FBW found that Homeschoolers break down largely into two groups - Bible Bangers and Bean Sprouts (like us).

The latter were often credentialed teachers themselves ( like Mrs. FBW) who were dissatisfied with what the public schools provide, and/or have children for whom public school would have meant being consigned to a “Special” class comprised of children who wouldn’t fare well in regular classes - often just a place to put them that got them out of the way*.

I know you mean ‘Homeschooled’ as shorthand for the Bible Banger type, but it does bother me a bit to find my family classed with people who are polar opposites of us.

*The Older Boy was briefly put in one of those, when he reached High School age. He is exceptionally bright, but they put him in a class where everyone else was normal IQ or lower, where most of the class were Emotionally Disturbed, and the whole thing was about CONTROL. When he was unable to fit into that class, the next one they suggested was for kids who were behavioral problems - the Hoodlum Class, as I called it. We pulled him back out, and homeschooled him. He passed his GEDs with scores all in excess of the 92nd percentile, despite little formal instruction.

Cruz should also not be boasting about winning a 10 commandments case by a 5-4 vote at SCOTUS.

He had 4 votes on his side just for this case being a RWNJ hobby horse, and all he needed to do was find a way to convince Justice Kennedy. That couldn’t have been difficult, since Justice Kennedy is pretty much a RWNJ with two strange exceptions —- he’s good on gay rights issues, and he won’t give a 5th vote to overturn Roe.

Rubio is virtually as conservative as Cruz, but he isn’t as big an asshole about it. While homeschooling the Older Boy, for whom no proper school really existed, Mrs. FBW found that Homeschoolers break down largely into two groups - Bible Bangers and Bean Sprouts (like us).

I confess, I was home schooled for a year (5th grade) and it was great! Our family was planning to move to Mexico and my parents wanted to ensure continuity of our schooling for the year of transition. My parents were well educated and the public schools in our district in Florida sucked, so it was a big improvement. We used a correspondence school for educational materials and testing so they did not just wing it. The curriculum included art history which I loved and would certainly not have been exposed to in our school system. I was able to finish all of my work in just a couple of hours a day———yay, more time to play piano and do other creative stuff!

I think that self entitlement is why Rubio has flopped. I’ve felt the establishment while many were lining up their bets on him wasn’t totally sold. I think Rubio’s probably played himself out of a chance to be on the ticket this year if ever. I remember it was assumed that Romney would pick him and he chose Ryan. Perhaps his guys found something on Rubio that they thought would really screw them. I mean Ryan did have the obnoxious Ayn Rand love for sure but nothing that stank the Romney campaign. Ryan didn’t sink Camp Romney like Palin did Camp McCain. I don’t think he helped mind you but I don’t think Ryan was a huge liability for Romney.

The latter were often credentialed teachers themselves ( like Mrs. FBW) who were dissatisfied with what the public schools provide, and/or have children for who public school would have meant being consigned to a “Special” class comprised of children who wouldn’t fare well in regular classes - often just a place to put them that got them out of the way*.

I know you mean ‘Homeschooled’ as shorthand for the Bible Banger type, but it does bother me a bit to find my family classed with people who are polar opposites of us.

*The Older Boy was briefly put in one of those, when he reached High School age. He is exceptionally bright, but they put him in a class where everyone else was normal IQ or lower, where most of the class were Emotionally Disturbed, and the whole thing was about CONTROL. When he was unable to fit into that class, the next one they suggested was for kids who were behavioral problems - the Hoodlum Class, as I called it. We pulled him back out, and homeschooled him. He passed his GEDs with scores all in excess of the 92nd percentile, despite little formal instruction.

Oh, and the Beast’s article identifies the crux of the problem for Trump and the GOP - 80% of Latinos are voting Democrat, so he’s picking up only at best a 1/3 share of the remaining 20%. And with basic math - that amounts to Democrats maintaining about 80% and Trump gaining about 7%.

Yeah, yuge. No doubt he’ll tout this poll just as surely as he touted the others claiming 40% of blacks love him, when the poll had all of 10 black people. Or the other poll that freetoken identified earlier.

Hm. I think that with the engaged Latino electorate this year, you may be right, although Texas voted for Cruz during the Tea Party tidal wave, so that may be an aberration. For a senator or governor, I think they’d be fine with that. But so much race-hatred has been stirred up with the Bubbas over the past 8 years that I don’t think that having anyone darker than a paper bag atop the GOP ticket will get out the vote. Maybe it’d cost them in Ohio, Wisconsin and the mountain states?

That’s a wise rule. Although I don’t hate Godfather Part III which like this film had a sixteen year gap but I would never consider GFIII in the same realm I do the first two movies which I think are brilliant. GFIII I find merely good.

Comedy sequels being something to avoid is a good rule. I didn’t hate Dumb and Dumber Too but it wasn’t as fun. Ditto Anchorman. I guess my two rules would be, waiting over a decade is foolish and comedy sequels should be avoided.

I was thinking the same. I don’t mind the first Terminator but T2 was great. I liked Arnold better as the Termiantor that has to save John and Sarah Connor rather than the one trying to kill them as in T1. And Robert Patrick as the T-1000 was intimidating as hell.

Aliens was a better movie than Alien in my opinion (more dakka!) but I’ve never been a great fan of the claustrophobic slasher movie genre. I recognise the quality of Alien as a cinematic experience but the characters in the sequel were just so much better and the script much improved.

It’s almost as if James Cameron finally had big studio support and a budget and decided to re-make the first movie the way he really wished he could have the first time. That and Arnold Schwarzenegger had become really popular then so there’s no way in hell people would accept him as a bad guy.

Salvation was, to me at least, the closest we’re ever going to get to a film set post-Judgement Day. Ever other movie is just largely following on the same script as the first two: “We’ve gotta stop Judgement Day in an increasingly convoluted fashion since we’re fast approaching the point where the long war against machines ending in 2029 makes no sense.”

I’ve never really understood the epic mountain of hate piled onto Terminator Salvation. I wouldn’t say it was all that great but it looked like Citizen Cane compared to T3, and isn’t in my opinion deserving of the level of hate it gets.

We don’t have to make Datas or Bishops or Davids or Johnny 5s to do things we might need really smart machines for.

Not at all. It would have meant a return to the original spirit of the 2nd Amendment; that the right to keep and bear arms was limited to “a well regulated militia.” That’s not even close to being “struck down.”

Sorry to be late with this reply but did want to take care-

What use was the 2nd to a person living in DC before Heller? None right? Or if there were a militia DC citizens could join-? So if militia is what it must be… How do you do that with unarmed unpracticed people? But wait who wants more militias anyway?

It’s a long argued point about what well regulated militia means today in the 2nd. Obviously I admit we disagree there. This militia of which we speak does not exist. Bit of a red flag there. To say the militia requirement is where the argument ends is using the amendment to uphold gun bans. I’d say that’s opposite of the obvious intent of the words “the right of the people to keep and bear Arms, shall not be infringed.” One can choose to emphasize either portion, and it seems everyone who cares at all has done exactly that. So again we agree to disagree there IIRC.

In my not uncommon view a fair interpretation of the amendment includes allowing law abiding people to hunt with a gun, or defend themselves at least at home and their own workplace (upheld by SCOTUS circa late 1800’s). Of course the laws limiting who may possess and what kind of gun may be possessed have been upheld many times now.
